Whales are never actually good at games they spend to compensate for it you see it all the time with asian gacha games.

I cannot fucking believe a game based on earning loot through playing has devolved into discussions about the legitimacy of unfair third party transactions and blizzard's attempted monopoly on it instead of just playing the fucking game. It's monetized and we all support it, and because we keep playing their games and buying their services we will never see a change.
Just another way the rich are screwing everyone else. The rich chads get all the women and the rich players get all the gems.
Games are designed with our current society in mind. We have a problem with our society. The rich have lobbied for laws that prevent people from competing. This disallows most people from starting a business and this lowers wealth generation.

Never stepped foot on this garbage as a long time Diablo fan. It's also muddied the waters for Diablo 4 as well, likely to side step is completely. If all they want is whales...then fine, I will avoid Blizzard entirely.
The only reason I'm gonna play D4 is because it's on PC gamepass day one. It's really sad to see a beloved franchise and game company go down this road. I hope with the acquisition of ActiBlizz by Microsoft that they truely take out the trash. D4 is the last chance for me. If the monetization conflicts in anyway with the grind for loot and gems, I'm done with this shit company. I'm cautiously hopeful, like an idiot.
Diablo IV is dead for me after announcement of paid horse armor, other microtransactions and paid battlepass in a full priced game. Now blizzard is making paying experiences instead of video games.

I don't think they had all the money at once, and it wasn't cash. I believe these people use credit cards and it's over a long period of time....I don't think if any of these players had 100k cash they would choose to spend it in a game in one day, you know lol it's just very different

Using 3rd partys to buy stuff in game is always against the rules because the company that made the game doesnt get money from it. Its why most mobile gacha games nowadays dont have an ingame trade system anymore. Since its just way cheaper to buy an item from another player with money as opposed to going in to the gambling aspect of games.
Has any gacha game ever had ingame trade system? Even back in the PAD day I don't even remember it ever had one.
The way Blizzard resolve thing is the first time I saw it though. Last Origin did put people into debt but it's because it was a mistake in their system. Purposely putting players into debt is like telling them either quitting or going F2P forever, which sound pretty dumb to me.
in this case, it doesnt apply at all, the guys who sold the orbs already bought them to Blizzard (through illegal mean, like stolen credit card), so Blizzard didnt loose a dim here

If by being the 'best' player is based on the amount of purchased gear, then yes... he certainly is the best player. If anyone who purchased 35k of RL money towards pixels and power upgrades, anyone can be the best.

I have lived long enough to see a game put you in debt due to not using their 'exclusive' marketplace and will say no dice to all of your stuff. Clearly a purposefully fully broken system, and will slap anyone who tries to trade when Blizzard let's it happen in the first place.
You do realize those people purchased from third party seller who sell with huge discounts because the seller commit credit card theft and selling everything cheap for cash in before they got caught, right?

I can tell you never have played a gacha game before. These third party scams are nothing new and rampant in those games. They steal peoples credit cards and charge the premium currency with it.

Nah, not broken. This is their game, it's fucking stupid to think that anyone can pay another person, company, entity, etc while bypassing the game's devs and then expect the devs to not punish you for it. And then there's the fact that what they were buying was going for a significant discount. If that's not coming from the devs then there's no way that's legit. You should always think it's the worst scenario, in this case essentially buying stolen goods because it's very possible to be from a stolen credit card, stuff like this is the epitome of "a deal too good to be true." Even if it's actually someone spending money from a different currency, if you find a deal like that you shouldn't expect it to be legit and you shouldn't expect to be able to keep what you bought through some random non-authorized third party.

This is actually common practice in Chinese developed games. The coders put backdoors in the code so they can sell premium packs as a side Hussle. When the developer finds out, they patch the code, and hit the whales with huge bills. Then in like 2 weeks they will start offering settlement agreements to restore whale accounts. Most of these whales will jump at 20 cents on a dollar to get their account back.

It's the player's account, not Blizzard's. The ToS is not a legal contract.
Blizzard will lose hard considering they accepted the payment and have not refunded it.

Blizzard did this man a favor. He may not know it yet, but if he never plays this game again or anything like it then he may actually focus on living life. Personally, I think this guy knew exactly what he was doing and that Blizzard could bust him. This happens all the time. Blizzard has, to my knowledge, never been ok with people buying in game currency. Just because people have gotten away with it didn’t mean it wasn’t against the terms of service.
This is not new, in Genshin happened the same. People went and bought crystal from a random guy because they were selling them cheaper. The catch was that after they bought the crystals the seller asked for a refund on their side and the account was left in the negative, they let you know you had x days to pay or get banned. In the end the fault is on the buyer, you have to buy from the official seller and not some random dude on a dark alley selling you something a bit cheaper.

He spent more than that…. He had to spend money on blizzard for the extra gems to sell to get 200% back on his gem sales. There’s a limit for how much a gem can call for. 200% is the max.
Just want to point out that this is compliant with how stolen goods are handled in the UK. In the UK, if you buy stuff that was stolen and you don't know they're stolen, the police takes it from you and returns it to the owner without compensating you. You need to sue the thief if you want any compensation. In this case, if Blizzard refunded the money to the original owner, then at least they followed this pattern.
If you know or think they might be stolen then you've actually committed a crime as well.

yeah these 2nd party transaction often does the Refund chargeback abuse, i done this before in Genshin impact and i was at Negative balance for Primogems, and then told me on in-game mailbox to bring it back up to 0 or else they will ban my account.
He got the gear and blizzard didn’t get their cut, they don’t care about him knowing it was right or wrong.
Blizzard got their cut, someone still had to buy the digital points, if with a discount since some regions have cheaper prices.

Its pretty simple, i know nothing about DI, but you see, if you allow a currency that as i understand it can only be bought with real money to be traded between players, you encourage and allow those credit card scammers to do their work in hopes of some percentage of those fraudulent transactions to not be flagged and keeping the gains from it. As i see it, the only instance thats to be blamed for this is activision blizzard themself.
I disagree, mostly because the only way scammers can hope to offload their premium currency before they get banned is to give huge discounts, which should make any prospective buyer suspiscous. It's like buying fake designer clothes, there is no way that people don't know they bought fakes even though almost all of those people claim they didn't know. I am not saying Blizzard doesn't also share the blame, but the guys buying would have to be basically incapable of living by themselves without a lot of assistance to not have known why the currency was so cheap.

It isn’t that every secondary seller will bring a ban, but there is risk that typically correlates to the level of discount. It gets even riskier when the purchased digital good must be initially sourced from within the same ecosystem that it is traded in. If the account doing the selling is caught because blizz gets hit with chargebacks from a theft victim’s CC company, they might not know or have the power to shut-down/punish the external marketplace (a la G2A), but they CAN punish all parties that obviously interacted on that site.
This makes me feel so happy lol. Also sidenote we can see how gifted Asmon is as an interviewer compared to that other guy.

Thats Common practice in those games, in most games you’ll get negative currency when refunding because the rather give you negative currency in hope you’ll top up until you’re even again instead of banning and loosing you

3:25 tbh, i used to do the same thing with ESO crowns, there are no rules against selling crown gifts for ingame gold- there re against abusing regional prices though, i used to be able to get £75 worth of crowns (5000) for just less than £30, and sell them for 1.5k per crown and get millions of gold more or less instantly, that gold can be then used to buy the materials to max out your armors quality, they did fix it in the last update though. But not the subcription price which is half the cost of normal, £8 down to £3 which can get you 3 million gold in current crown cost, i dont see any problem with it though really, atleast you cant buy your way to perfect traits on that game with gold, or decent dungeon/farmed sets (since they cant be traded outside the group u farmed it with, or even sell them on the traders)

secondary markets are usually 1/10 the price of retail so that 35k is alot less.. but still alot of money. blizzard banned them.. because someone else got a cut of thier money.
This how it works .. those who sell orb cheaper price have there own credit card... They gonna login the account of the buyer then purchased the orb.. then the seller going to refund it in a few days or report it as stolen credit card.... So blizzard really never received any peny from that kind of transaction.
Shia is on my server and our clan had to face him in the rite of exile pvp battles a couple times. His kill/death ratio was 29-2 and 28-0 respectively in both games and so we hit the 55 death cap very quick. It was just laughable. In the third game rematch a couple weeks later, he was not on their team and was more of a balanced/fair resonance fight, and sure enough we crushed them 31-15 in kills and won the game. It just shows the magnitude of the whale impact, and I'm sure it caused many players to lose faith or confidence and just quit all together, which Blizzard does not want so these actions were necessary. I have zero sympathy for this loser and would slap him silly if we had the same gear/reso. I have NO idea why they are still allowed to pvp so he has like a 5.5k rating right now, but I'm sure he will leave soon.

There is also the simple matter of same thing costing different amounts in different countries.
Official EA/Steam/Epic/Blizzard store, game X costs 60 dollars in the official US store. Same game X in the official Indian store costs only 10 dollars.
The problem is knowing whether stuff is being bought with stolen credit cards, or just bought from a cheap country and then sold at a profit in a more expensive country, but still cheaper.
Its the same thing big companies do with having their HQ at low tax country or production in a cheap low salary country.
Global market, but when a customer wants to take advantage of it, its suddenly a bad thing.
generally speaking games like these have a baseline price in USD and autoconvert to whatever country you are at with a payment system, normally u can get a bit more bang for buck with more volatile currencies, but 30-40% off is pretty obvious a scam
why would they buy it from a secondary market... there is no other way to buy orbs than from blizzard and if you have any sense you know the only way to sell it cheaper than them involved charge backs etc. which can be tracked

To be honest they shouldnt have made it possible for this to happen in the first place. If anything it's bad game design and holds up a mirror to what they are doing to their game and community. I don't understand why they don't just make gifting a in-game event only. They clearly use some sort of key you need to type in.. you know this is going to happen then.

The ruling against the Apple story should be held against stores like what Blizzard is running in Immortal.
And depending on the country where this transaction took place form of cost difference based on country could be illegal.
A ToS is not a legally binding contract and Blizzard is setting itself up to lose HARD if they do not return the money that was spent.
Although there is some suggestion the credit card used to buy the gems was stolen so who knows what is really going on here. There is just too little concrete information.
I bought once an entry ticket to a meseum from a guy because i was unable to get it from the official website which was down at the moment. it was a valid ticket and it was more expensive than the offical price. The person who was in charge of checking the tickets found out about it and they kicked me out of the museum after throwing the ticket.. i cried all day long like a baby

asmongold is pretty out of touch with reality here. If you buy a stolen car, you dont get to keep the car once police find it and you dont get your money back. thats real life. Besides this guy knew he was doing RWT which is against ToS. He was just trying to get orbs cheaper than what blizzard was selling them for to give himself an unfair advantage against people who follow the rules. He got what he deserves.
A car is a unique tangible item, credit and in game items are not.
I agree that there are no victims here. The one big question I do have; why the hell are these orbs a tradeable item? There is zero doubt that Blizzard knew this would happen, but they allowed it because they also knew that they could siphon more money from people willing to buy orbs to trade to other people for in-game currency or other items. Blizzard is mad that they got clowned, and if they ACTUALLY cared about the game, it would have been a simple ban and not some wierd mob-debt shit. Big L for Blizzard.

Blizzard did the guy a favor in the same way as scammers from India do their victims favors. They're great teachers. Unfortunately the guy was obviously too stupid to get it though, since he misses playing a shitty slot machine.
When I was a kid my father was very worried about me getting into any game because he tought I was going to be addicted and I would do soemthing like this, to me it made no sence because I hate to spend money in video games more than just buying the game, but NOW I can understand why he said those things ....
this thing happen on genshin too before, the scammer top up the buyer account and after that they refunded it so the scammer will get the money back without the buyer knowing
