    1) Kavanaugh continued to refer to a piece of evidence that Ford debunked. He claimed that Ms. Kaiser said she didn't know him or recall the incident. Ford stated clearly that her friend has been ill and had apologize about the letter to Ford, saying that Kaiser's lawyer wrote the letter without consulting her.
    2) After the female prosecutor Republicans hid behind (because they don't know how to ask women questions like big boys) hit on a particular date in Kavanaugh's calendar-- July 1st--which indicated he was going to a party with some of the other males Ford said were at the party she recalled, Republicans switched tactics and stopped using the prosecutor to speak for them.
    3) Kavanaugh routinely answered with non-answers and distractions. He seemed to be claiming that people from Yale and A-students could not also be capable of sexual assault.
    4) Kavanaugh refused to say whether he would support an FBI investigation, at one point when asked about an investigation starting to whine about how he asked for a hearing the day after the allegation. Except that no one said anything about a hearing. Holding a hearing doesn't solve the problem. An investigation would potentially benefit him if he's innocent, but strangely neither he nor Republicans want any more information on the matter. He then pretended that being questioned by Senators in the hearing (a format he has lied in before) was the same as an FBI investigation.
    5) The hearing demonstrated the usual Republican tactic of projection. They have run an unethical confirmation process where they have withheld millions of pages of documents about Kavanaugh's past, refused to let the public hear about information in many documents, refused to have any other witnesses (including Mark Judge, who was part of the alleged assault), refused to hear from any of the other women who came forward, who refused to call for further FBI investigation, and who staged their own partisan investigation using Grassley's own staff people, and the GOP senators and Kavanaugh complained about how Democrats were causing problems by calling for a fair, normal process instead of the unprecedentedly biased one the right staged.
    6) After portraying himself as a non-partisan, fair judicial nominee, Kavanaugh flew into a partisan conspiracy-theory laden rant that demonstrated he does not have the temperament for the Supreme Court.

      FlatusOhlfahrt not feminazi or bullshit. just facts. watch the full hearing to see the contrast between an honest and genuine woman, and an angry man dodging questions and disrespecting democratic senators. sexual assault accusation aside, the hearing was actually his job interview, and i don’t even think he should be on the supreme court because of how he acted. he continually cut off democratic senators mid-question and asked one of them if she’d ever drank so much that she’d blacked out after she got done explaining that her father suffered with alcoholism. he was temperamental and insubordinate and completely out of control of his emotions. someone like that shouldn’t carry the title of supreme court judge.

      @bellesogne Před 5 lety +9

      Whether Kavanaugh is guilty of the allegations or not really should not be what worries you about his paranoid accusations today. What should worry you is that his response WAS paranoid and that he latched onto a conspiracy theory as the basis for his argument. This action reveals much about the actual man and his values, as it pierces the veil of his otherwise "safe" pre-packaged testimony from previous weeks. Was his combative, spiteful performance today indicative of the type of person we Americans want to sit on the highest court of our land, where a measure, SOBER demeanor is required to evaluate the most profound legal questions that our nation must confront? No person is an angel. However, Kavanaugh appears to have very troubling character issues. And we Americans deserve to have a better individual - conservative or liberal - ascend to the bench.

      She certainly sparked a few memories in me too. The hand over the mouth, the crushing weight. Most telling for me was the fear that he might kill her accidentally. That's a tiny detail, one that doesn't always get talked about when recalling these types of assaults. But I remember it, and the 4 other women I've talked about this testimony with agreed: The fear that, whatever else he was trying to do, whether it was a genuine attempt at rape or 'just messing about for a laugh' (at a terrified female's expense) - with a hand being held over your face and the weight pressing you down, you panic because you feel you could easily be suffocated here!
      There are plenty of men in prisons who absolutely never meant to *kill*. They meant to beat, humiliate, grope, rape ... but they never meant to kill.
      Enough is enough, there needs to be a fire and Kavanaugh is one of the men who should be on it.

The anger, the resentment, the smugness; those were the most honest moments coming out. But Graham still took the cake. The script he wrote was disgraceful, misleading, and disgusting. The only consolation is that Grassley and Graham WILL BE remembered by this single moment in history. After 27 years, it seems all they've learned is how to better reinforce the man and more subtly denigrate the woman.

Also, the senate should be decided by vote and only be for a certain period of time. It should not be a lifetime appointment. I have no desire to be fair to Kavanaugh, but to give him his due, he's undergoing one of the worst and most public humiliations imaginable. No one's likely to react well to this kind of public ruination.
    That out of the way...
    Isn't it a recognised psychological fact that guilty people tend to react to accusations with anger, while if you're innocent, you're more likely to react with bemusement and sadness?
    And plus, so much of his defence is this ridiculous resort to all the pious, flag-kissing, apple pie stuff he supposedly spent his teenage years on: going to church, studying hard, being an athlete and 'service' whatever that means. It's almost like he's desperately crying: goddamnit, why doesn't this veneer work for me anymore?
    Well for a start, _judge_ as a legal defence it's nothing at all and anyway, most of it, if you've ever been on the wrong side of it or known of anyone who has - abusive priests, bullying jocks - is just horrific anyway, especially for the way it couches itself in unimpeachable wholesomeness.

      Right? I don't know if Kavanaugh is guilty, none of us really can - we weren't there, but if Ford is some sort of Democrat plot, like everyone keeps trying to say, she's being awfully cooperative in things that would earn her jail time. Her kids had to be pulled from school, she had to quit, her husband's off work, and they've all been pulled from their home by the FBI, all because they've received so many credible death threats, and she's still willing to testify, after passing a polygraph, and all she's asking for is an investigation.
      Meanwhile, Republicans won't call witnesses, won't force Mark to testify under oath, when he was allegedly in the damn room, won't let any other women who've accused him speak, won't allow an FBI investigation, and Kavanaugh himself is a proven liar. Kavanaugh belonged to a frat, that was disbanded only years after he graduated, for sexually assaulting, and drugging and raping women. The exact same accusations multiple people have made towards him. His comments in past year books have been wholly offensive towards women, and people say that in some speeches he gave at the time, and in yearbook comments, he referenced several inside jokes about drugging and raping women. He said he was a virgin who'd never drunk at the time in a previous interview, then he changed his story completely after many people who knew him at the time came out and said he'd get black-out drunk every weekend!
      I can't say Kavanaugh is guilty, but at the VERY least, this demands an investigation.

      Psychologists don't have magical powers to manipulate machines and other people's minds. Clinical psych professors are experts in psychopathology, they're not Svengali hypnotoads. Also, polygraphs aren't admissible in courts because they're not reliable enough to present to juries who have to reach a verdict _beyond a reasonable doubt._ They _are_ reliable enough to be used as a guide in investigations. I do not condemn Kavanaugh while there is still reasonable doubt (but I certainly wouldn't be alone in a room with the man), but the burden of proof that should bar one from the Supreme Court should be much lower than the burden for a criminal conviction. Ford's credibility and the fact of additional accusers is enough, and even were it not, Kavanaugh's lack of decorum and judgment should prove his unsuitability.

      @TheNinetySecond Před 5 lety +5

      Considering the dismal numbers in rape cases, I'd definitely agree with you.
      Less than 30% of all rape gets reported, and even in the western world, less than 10% of those reported cases end in conviction. This doesn't mean that more than 90% are false allegations, mind you. This means that guilt beyond reasonable doubt couldn't be established, even in cases with corroborating witnesses who spoke to the accuser right after, or heard it through the walls, or sometimes even observed it. With enough denial and a lack of physical evidence, even the most obvious rapist can walk free, simply because it's a ridiculously difficult crime to judge.
      Taking all those numbers into account, the growing sentiment of "unless he gets convicted in court, he should walk scott free!" seems insane to me. There's basically no chance in hell he's gonna get convicted, but that *does not* mean he didn't do it. Really, we might feasibly see facts pointing to his guilt, but still be unable to have him convicted in court. Should we just let him have a seat at SCOTUS then? Should we let him work as a judge in any capacity? These are difficult questions, but the "innocent until convicted" crowd refuse to take them up, because their slogan sounds better, and seems more reasonable. Hard truths are great when they work, but in this case, the devil is in the nuance.

    • @bismuthcrystal9658
      @bismuthcrystal9658 Před 5 lety +1

      Couldn't have said it better myself, Clemens. The aforementioned crowd fails to realize that this is not a courtroom, it is a process designed to determine Kavanaugh's character, and that the members of the Senate are meant to make their own judgments on that matter, as are we. No one is required to ignore evidence because it isn't proof. And even in a court of law, this testimony would be acceptable - just not enough to convict. But it would be weighed.
