PA doesn’t enforce anything. I have a PFA against my ex…the judge that granted it recused himself because he was the defendants attorney for several years….the defendant violated the order within a week for an attempt to break in…he also had several violations that the pd refused to write (stalking - he actually called the pd on me and admitted he was watching take my stuff to storage, then he calls me the day before court trying to get me not to come to court -witness intimidation) I also have evidence of all this and some ish the pd did….they kept trying to discourage me at the courts when it came to the Icc hearing and emergency custody I filed because they kept sending it before a judge that revised himself…when I threatened to file a judicial complaint things got moving…now the judge granted me emergency custody and he only has sup visits, but the defendant has a warrant currently for another PFA violation that occurred at the sup visits…it gets better… he appeared at court for a non related incident and nobody brought up his warrant so he was let to leave…this almost happened the first time until I pressed the issue…yes, he had a warrant for a violation of a temp PFA while we were at court, because I was seeking a final PFA….at this point I need a lawyer but I can’t afford one, the judge is making a big mistake allowing these visits
What about false accusations of DV...Suppose during Discovery...a Party discloses evidence that proves DV did not occur, will the court take that into consideration...when deciding custody
Hi, Jason. In my experience, the court takes false allegations of domestic violence VERY seriously. The court may consider it a credibility issue with the party who admitted to making false claims. When deciding custody, the court should weigh that credibility issue in light of the other 16 factors, as well.
Thsts what's happening to me right now. I have a case against me from January. Now she's all of a sudden trying to blame me for other things after I kicked her car because she took my son and said I can't see him anymore.
What it's supposed to happen when a grandparent gets custody but then moves out of state and then the parties go back and forth to the courts in both States yet neither gives any visitation for the duration of the child's life? I'm still trying to figure out why I never got custody or visitation. But I was being told in court was that it was a jurisdiction issue. But according to uccjea New York was supposed to hear the case however, when I filed the New York they told me I had to go to Florida because that's where the child was and then when I went to Florida they would say the same thing.
