Chris and Cru Kahui were twins, aged just three months old when they died in hospital, both suffering from traumatic brain injury. Their death was the result o a severe impact, either from direct blows or being hit, thrown or slammed against a hard surface.
Violent shaking was another possible cause, and couldn’t be ruled out. What was clear was that the twins' injuries weren’t accidental…

The Defendant refused to take the babies to the doctor after they had stopped breathing for at least several minutes. Then, after finally being persuaded to take them to the doctor and being informed that they were seriously ill and needed to go to hospital, he refused to take them. I'm no expert on New Zealand law, but those two acts/omissions in my view make him guilty of manslaughter.
Rest in peace baby Chris and Cru. I'm sorry for your brief lives full of abuse and pain and that you've received no justice for your deaths.
This case is the most heinous crime against a child. It makes me angry that someone could do this. This Show was well told. Thanks(I look forward to your next case.)

@@Hapitap Not sure how that excuses anything, even if it was true. Leaving the house to go somewhere isn't abandonment - especially if you have left your children in the care of their father.
Who is a grown man and has no excuses for his actions.
He should at the very least be guilty of negligent homicide - who says 'whatever' when their partner calls them from hospital to tell them their sons are dying?
What kind of parent thinks playing Playstation is more important than his babies devastating injuries?

That said, if I was Maxina, the only thing I would have told that sad excuse for a father on the phone was that he had better have packed his stuff and be gone before I got back, because his behaviour that day was unforgivable, even if he didn't kill them, and even if they'd been okay, I wouldn't have been able to stand the sight of him after the way he treated the situation. Shit partner, even shittier father.

1st Chris tried to throw his 13 month old son, Shayne, under the bus; claiming he had hurt his brothers. When that didn't pan out, he blamed their Mom, Macsyna. That was apparently pounced upon by the sensational seeking media. I just hope Chris is never left alone with his new daughter, Carla.

Thanks for this upload - I remember the way the families at the centre of this tragedy formed a 'wall of silence' in the weeks after the deaths. To my memory it took about a fortnight before the police were even able to make any meaningful interviews. A prominent Maori politician of the day (Pita Sharples) made some concerted attempts to persuade the family members to break their silence and cooperate with the investigators, all to no avail. Such a senseless and gruesome episode. Yet one more tragic statistic in New Zealand's child abuse story.

Of course everyone was all too eager to place all the blame on the mother. Nowhere do you see that reflexive eagerness more than in the true crime “community” on youtube. This channel’s comment section is better than others, just as this channel is better than others. It’s both remarkable and unsurprising that people take a _really_ _special_ thrill in finding a woman, any woman, to blame for a man’s crime. I’ve seen them twist themselves in such amazing pretzels in order to do so, time and time again.

The Coroner's report said it all. Those jurors were lame.
I could not have said it better- I'm utterly disgusted by the defense attorney. She helped a murderer go free-that's her job, but please STFU about it now. Her cynical commentary, fully knowing that her client was guilty, was simply too much. It was rubbing salt in a horrible wound.
As a defense lawyer. You really dont know what you're talking about. I was also working in NZ when this happened it took the jury 10 minutes to find him not guilty you really have to know how prosecutions work in NZ its wrong they have the most unsafe convictions in the western world. Its the hospital who should never have released those babies never had a chance everyone gets a lawyer its your right this show also dosnt tell the full case the socisl issues involved here are also endemic throughout the society

The judge should have declared a mistrial, because most of the jury had made up their minds very early in the trial, A 6-7 week trial needed a lot more time to thoroughly review all of the evidence, and circumstances.
Defense: "He didn't want the police to think he was a bad father."
If he were a good father and she were an absolutely horrible mother, why didn't he leave her and take the kids with him?
Yet it was he who couldn't be bothered to leave his PlayStation game to rush to the hospital for his twins.

Quick Fruits Agreed. Also important is the apparent degree of carelessness on the part of the jury. Just a few minutes tops to reach a verdict on such a massive case? Unbelievable, and quite pathetic really. In the end, I can’t help but think that this whole saga should actually make us feel some level of guilt-that is, those of us who are quick to jump on the bandwagon when it comes to similar cases that run viral through our respective communities & nations. It’s all too easy to hear & read about a such a serious case and just blindly follow the public opinion with no independent research. You simply start to associate the crime with a face that’s been repeatedly shown on the news & papers, and around social media.
It should serve as a lesson to us all that evidence is key. Independent research is key. Critical thinking is key. Social influence & conformity is a powerful thing, but we should put our own intellect, reasoning, and rationality above that and cease from making judgement until we’ve examined the evidence ourselves and found sufficient proof one way or the other. It’s just not worth it to follow hearsay.
But ultimately, though the justice system failed in this case, I rest assured that the one who carried out this repulsive crime (where I strongly suspect it to be the father) will eventually get what they deserve at the hands of God in the end. On the day that each & every one of us meets our Creator, those who were ungrateful and neglected their conscience, using their free will to instead to perpetrate all sorts of terrible things, will undoubtedly face the truth & reality, and be fully repaid for all that they used to do. On that day, everyone will get exactly what they deserved, and none will be wronged. For to God is our final return & ultimate destination. And God is fully aware of all that we do.

There is a key piece of evidence that seems to have been overlooked by the police, and everyone on the outside looking in. One of those babies had a broken leg that was weeks old and was healing!
That means that with four adults living in the home it would be impossible for any one of the four to have not known there was a serious problem!
The blinders that allowed the police and prosecution to single mindedly ignore the obvious fact that there was ongoing brutal abuse taking place were not shared by the jury!
Reasonable Doubt: The abuse has been ongoing and the prosecution is ignoring the fact that there is likely a conspiracy to cover it up among all the adults in the household and possibly the extended families.
All parties in this case are guilty of something. Why not conduct an open minded investigation and focus on the truth?

Why was there not more pressure put on Stuart and his partner that where also at home when cru stopped breathing? They where at the home at the same time these injuires occured? They also would of been at home when the other injuries happened or at least know something
I remember when this case happened. Nz has a horrible track record of abusing and murdering children and it's absolutely heartbreaking that these boys never got any justice. Still makes me feel sick to think about. Chris is a murderer and maxine is negligent, those poor babies deserved better.
If this wasn't true you would never believe it...1) The father should have got life for killing his sons 2) The mother should have been given 5 years for being an absolute disgusting mother 3) The jury members should have been named and shamed and ridiculed as the biggest pack of idiots in criminal history....Fucking unbelievable!

A mistrial should have been definitely called. The Coroner was not swayed by media.He looked at the facts. It was clear to him that the father made false staements to police. His actions were highly suspect . He was angry , frustrated and clearly too immature and this led to the tragic scenario that saw the death of those twins left in his charge.

I can see how this story ended up on Casefile. Maxina, although not the murderer of the twins, still deserves no mother of the year award, either. The police did their job properly with this one, but the justice system failed anyway because those babies' murders went unavenged and someone the police suspected got away with murder. It's clear the father resented being stuck at home all the time taking care of those two infants then took his frustration out on them, and his behavior strongly suggests this. He sure got lucky.

I think there are a number of people involved. This video seems to imply that at least 4 people collectively did something small that was in addition to what was done before. My initial thoughts are that most of the injury, sat with the dad, and mum also had an input. I think alcohol played an important role in all presents ability to assertain their specific role in the event.

Mine was when the doctor said it was urgent that the boys went to the hospital and instead of heading there, he went home.

very interesting and complicated case. the only definate is these babies were let down by so many people each person they came into contact with failed them. To many changes in the stories people told. Don't think we will ever know the truth. Personally I don't think the dad ment to kill them I think he was angry with the mum so did something to make them ill so the mum would have to come home to look after them so he didn't have to
