  • He guys welcome to my first video where I was threatened to have the cops called out me for fishing in what I guess is the Indian Rivers version of Area 51. Check it out and see what else he said to me and let me know if you think I handled it cool enough or let me know in the comment section what you would have said to him...lol.

    i am a land surveyor and even if your lot DOES extend into a lake, stream or river, YOU ABSOLUTELY CANNOT RESTRICT ANY ACTIVITIES OF OTHERS in the water...end of story.

      He wasn't claiming he owned the ''water'' but the land under the water they could own. The guy wasn't in a boat, he was wader fishing. Floating on the water is completely a different story. Same rules apply in NY State.. not sure what the laws are where he was in the video but many states are same as NY.

But I have heard the property ends at the water line or shore unless the area was private property to begin with like a lake or a pond and the property surrounds it. But I have also heard when it comes rivers and large bodies of water the feds own it. Whatever the case fishing is turning into a bitch of a hobby.

In Canada, at least in my province, you just aren't allowed to own anything within 10 meters of the water, kinda like if you buy a property in a town, the town owns 5 meters into your lawn which they use to put power poles and whatnot in. So up here, I would be allowed to walk along that guy's beach and fish from the shore legally, though most people are pretty respectful where I live. It's usually only people from other countries that buy summer homes here that end up getting upset about people fishing on what they consider their property.
      This video is apparently a good example of why it's important to actually read the laws for your area before you head out for some fishing or hunting, because there's weird differences like that. Probably best to check with the Dept of Natural Resources since they'll be the ones coming out to explain the rules to you when you mess up anyway. They're much nicer if you ask before so they don't have to come find you.

      Just my guess, but land owners often have water rights going out a specified distance. This means they have a legal right to the water and land, but not ownership of the water or land. The public still has access to these waterways.

    Florida Statute 372.705, “Harassment of hunters, trappers and fishers,” states:
    (1) A person may not intentionally, within a public or privately owned wildlife management or fish management area or on any state-owned water body:
    (a) Interfere with or attempt to prevent the lawful taking of fish, game, or nongame animals by another.
    (b) Attempt to disturb fish, game or nongame animals or attempt to affect their behavior with the intent to prevent their lawful taking by another.
    (1) is guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.
    (2) Any person who violates subsection
    The latter two statutes set the penalty for a second degree misdemeanor as up to 60 days in jail and a fine of up to $500.

      I don’t know about Florida, but I own both sides of a river in Michigan, and everyone can use it, legally. You have to stay in the water, and aren’t allowed to pass the high water mark.

    In my home state when this issue has confronted me I immediately ask the homeowner to call the sheriff or the DNR. If I am in my home county I call the cops as I have the sheriff's department and the DNR officers' numbers programmed into my phone. Every time this has happened to me the homeowner will usually run back inside the house when the cops show up and the officer has to go to the door and call them back outside.

      @mike sixx the best answer would be "it depends". You have have access to navigate the waters, though the bed may be private or state owned. The land owner also has Rights and is also restricted as to what he can and can not do. Such as he can not shut off navigation, but he can prevent trespass.
      The water is deep enough for a canoe, so it is public access, as long as you enter and exit the water at a legal place, and not through the man's property.
      Location makes a big difference as to legality, since the land owner may own to the center of the river, or the entire river bed, depending upon if he owns the property on one side or both.
      Some states allow the public to fish while wading, and others do not. Some only allow "navagation".
      So it really comes down to the local laws involved.
      I know that here, I can hunt and fish even on private land, , that a navigable river flows through, as long as I do not touch the river bed at all. If I drop anchor, he can have me arrested for trespass. (Of course, if he owns one side. I can stay to the other side. )
      There is a HUGE section of Law devoted to water, access to water, and Water Rights. Some states even claim rainfall as a state resource, and illegal to collect or interfere with. (Colorado for example, just recently allowed for civilian collection of rainfall.)

      That's what it is in Washington State. I wouldn't bet it was the same everywhere. I'd call the Fish & Game Dept. and ask them to come and talk to the guy. Lots of rich folks buy waterfront property and seldom come close to the water. They want a house with a dock so they can moor an impressive yacht and let it sit because they don't know how to drive the thing. Sad!

    Here in north carolina properties that adjoin the ocean or the sound or rivers run to the high water mark not out into the water 450 foot. I've been a land surveyor for over 30 years and it's easily checked. We have a GIS (geographical information system) online that is accessible to the public. Type in any address and it will give owner info as well as deed information. Reading the deed will either give you a recorded map for that piece of property which would show where the property ends in regards to the body of water adjacent to it or the deed description should address that fact itself. all of this info is available to the public.

    In most states, the public has a 10-15 foot right-of-way from the edge of the inland lake, river, stream, creek on which they my walk or fish. They may not do any damage, place any pole holders, tents or stakes into or on the property, just walk or fish.

Many states have laws regarding rivers where you can actually walk the beach, fish from the beach etc. as long as you are within the high water mark which is usually way the hell up the bank. Wyoming and Colorado on the other hand the owner does in fact own the bottom. However, as long as you are in a craft and not touching the bottom.....to bad.

    The river is not his property. The river is public property. He is wrong. Period. If I were you, I would have called the police to set his @ss straight before he mistakenly harasses anyone else. When I spoke to a wildlife officer here in NC about the whole private property thing, he told me all public waters have an easement & it is technically public property even on the beach, I "think" it was 7 foot he quoted me. Nobody's private property extends into public waters. Now, the wildlife officer also told me it would be better to just stay away from easements adjacent to private property just to avoid confrontation, but technically, there is an easement and this dude is 100% wrong trying to tell you his private property extends out into the river. 100% wrong. The wildlife officer advised me to just stay in my kayak on the water and then I would be safe from breaking any trespassing laws. You would do well to contact your wildlife management officers in your area to confirm because in my mind, if you're wading out in the water, and not walking onto the beach at all, then that's the same as being out on a kayak on the water. You're not stepping foot onto the beach where someone could possible dispute whether you're on or off the easement. This dude you were talking to here in this video however, was 100% wrong about everything. He thinks his private property extends 400-500 feet out into the river? Bwahahahahaha! He's just trying to scare you off imo. I wouldn't back down if this is your regular fishing area. Get a wildlife management officer to go talk to the dude if necessary so he'll stop harassing you. You are in the right, not this hatin @ss bozo.

    While it is true that in my State the land owner DOES own the land to the center of the river bottom, he or she does not own the water that flows over it. Here in Wisconsin we have a law that considers any navigable water way open to the public as long as your "feet are wet" or if you must portage your vessel to get around obstacles. You have every right it be in that water.

    Laws and ordinances can vary from state to state, but my overwhelming experience is that navigable waterways are open to the public. Strange as it sounds, the land underneath may be considered trespassing. Anchors or standing within their property limits is illegal. Fishing from a flotation device would be ok.

    I know each state is different, but I have run across places where people actually do own part of the water. In one case, a family had owned land and then a lake was impounded down the "creek" and flooded part of their property. The courts granted the portion of the lake to them that had been their land. They subsequently put up buoys and signs.

    Not sure exactly where this was but from looking at the map generator app that shows property lines and the owners names for that city, half of the properties do not even go down to the waters edge. In a lot of the places the South FLA Water Mgmt Dist owns a buffer along the shoreline. (most likely up to high water mark) Looks like the property owners mow the grass and stuff down to the water but they seemingly are just mowing the grass for the city/state. LOL

    I was born and raised in Melbourne/ Satellite Beach area. The Indian River Lagoon was a big part of my life. No one owns the river. You are free to wade and fish where you like as long as you don't go on private property. the land owner's property ends at the water! I would have made him call the cops so they could school him on the law!

    Hi John, here in Oregon all navigable waters up to the high water mark are legal to use as long as you stay below the high water mark.I had the same thing happen to me so I went to the state water board and took a letter to the land owner. He had to let us fish. I know all the states may have different laws.Take care......Bill

    Why dont you go and get a copy of his deed to the property. Here where I live in NB Canada anyone can go in to the Land Registrars office where the deeds are registered, search out the deed and get a copy printed off.
    Now some old old deeds have what's called Riparian Rights written in them, which means, the property line is in the middle of the stream or on the opposite bank. Where a stream cuts through a property it may be that Raparian Rghts are included also. These Rights were usually given to the original land owner, because they were a member of the influential upper class in a province or country, plus, they stay with the property. The land owner has to voluntarily give up those rights.
    Also, generally, properties that border on a stream, lake or river, the high water mark is the property boundary, not the waters edge on any particular day.
    Anyway, I'd go and get a copy of his deed to find out for sure and if there is nothing written in his deed saying he owns out to where he says he does, then fish there whenever you want.
    This is basically from memory. I worked at NB dept natural resources for 35 years dealing with private and Crown land.

      I've fished most of the Chi but in a kayak. Had to explain to some folks that their right is the river bed not the water on top. As long as I don't get out of my kayak or anchor they can't stop you from fishing. DNR backed me on it with one crazy fella on the US owned side of the 66 pool.

    Most lakes and rivers the bank of the river or lake is owned by either a river authority or core of engineers. Usually excludes property owners up to a certain distance from the shoreline. If they build a dock they lease that dock spot from the entity but not the water.

    In Helen GA there is the same problem and I never got to the bottom of it . I was wading and ran into signs that said I could go no further . I would leave and go further down the road and then I could re enter the river or stream . There was also and out fit that was a trout guide service and they owned a stretch of the river for guide service fishing only .
    If we are not careful the rich will own every thing . Sounds like England in the old days !!!!!!

      I used to own a cabin 5 miles south of Helen. I worked at the Shaft back in the early 90s. I fished the Chatt from the headwaters above town down to below Sautee Natoochee all the time. That is pure BS as it is a river. They own to the water line not into the river. No one can own the river even if they own property on both sides. No one can stop you from using the river or banks, and even in town, under the bridge and down river, not even some tubing outfit!
      Even the spot where they filmed Smokey and the Bandit! Some old woman that owns a house close to that spot tried to tell me I could not fish there. I told her to call the game warden or the county or city as I knew them all being a bouncer and resident and having been married to a retired Wardens daughter. She did, but they told her on the phone she was wrong and she actually came out and apologized to me.
      Check with the state about some company or residents owning a section of the Chattoochee or any river and get the truth not BS from fools!

      Yes some big city duwad came in and bought a park that kids had used for decades to go wade the river he started charging people and restricted all travel then got all crappy about it. I think it was for sale or sold last I knew. He was an asshole and didn't understand the navigable river laws and apparently the local sheriff and neighbors didn't either

    As a cop, I can suggest that you should call the local law enforcement. They may not know as much about the rights of home owners but they would have made him nervous about confronting you. He looks like body builder or something and I believe he wanted you to start a fight. Let him know that you are filming him and if necessary, you call the police.

    Best thing to do is to check the subdivision plat at the county clerk's office. That will confirm if he in fact owns 400' of river.
    I have seen houses like that, but there are signs posted on both land and waterway stating such.

    In Kansas, generally the only river open to the public navigation or wading is the Kansas River or the Missouri river that borders KS. Stretches of other rivers located within public wildlife areas are open as well, but all other rivers and creeks in KS are owned to the center divide of the water by the land owners bordering the water body. You cannot trespass on the land OR water without the owners permission. You cannot fish off roadway bridges either. Maybe this guy came from such a state and "thinks" he owns part of the river?

He is just harassing a angler and it’s against the law,& any navigable waterway is public waters and I would told him to go check his plat on his property and he would most likely find out that he only owns land to the mean high tide line. Technically if you were in a boat you can pull up there on the shore and get out and walk up and down that beach fishing from the shore and as long as you’re not disturbing the peace,trashing or anything like that there’s not a damn thing he can do about you being there. And you should contact wildlife authority to let them know he’s harassing anglers so they go notify him of the law! Good job!

    Anytime you happen upon a situation like that, I believe that the police or fish n game should have been called. Home owners that have the false sense of entitlement are a nuisance and dangerous. This home owner wasn’t too bad, he just tried to run you off. But without being corrected, but someone with authority he will believe, what if next time he comes down with a gun? How far will a misinformed self entitled home owner go to defend property he has no legal claim to? You came across a ticking bomb and just left it for the next person to deal with. You spoke well, cordial and non-threatening, and were the perfect person to attempt to deescalate and educate this guy. You should have called police, continue fishing, wait for police, then discuss the concern with them and the home owner. Next time the home owner confronts someone what if it’s a couple of teens, who are likely a bit cocky and less level headed than you. That situation could get nasty. As a fellow fisherman, I would have made it my responsibility to get him educated, or receive the education myself if I was wrong. No different than cleaning up other people’s trash they leave, yes it’s a nuisance but if I don’t clean it up who will?

    Some states allow ownership into the water, others do not. Many countries do not allow ownership of a strip of land next to all water courses, making all water fishable from shore, such as Canada and New Zealand!

    Homeowners on waterfront property need to obtain special permits to build a dock or pier out into the water. Meaning they obtained permission to extend their pier out that far. The dudes pier probably extends 500 ft out...he just mistaken over what he actually owns.

    Please carry and conceal a firearm. Never trust a person who truly thinks you have entered/trespassed into their "home". They will feel perfectly justified in harming you to any extreme.
    You calmed that guy down, significantly, with your demeanor and manners. However, he was making verbal and nonverbal cues that he was ready to escalate this quickly. I think you handled this perfectly.

    In the state I live in if it is a navigable body of water and is not surrounded by landowners property with no public access the landowner owns up to 5ft. From high water mark.

    In Montana, the property owner owns the land below the water. So if you beach your boat or wade , you can be held accountable for trespassing! Your water craft has to be able to drift thru.

    I've never understood people like that, I'm guessing he doesn't fish...your in the right as others have said....you handled that well...I'm curious what if anything he would say if you were in a kayak or boat ...
