Italian fishermen in Libyan custody | DW Documentary

  • Eighteen Sicilian fishermen have been in Libyan custody since September 2020. Their offence: Fishing for coveted red prawns off the coast of Libya. Their desperate families fear that more is at stake than sovereign rights at sea.
    The Italian authorities remain silent, despite the fact that experts see Libya's actions as a clear violation of international law: The country also claims the seas outside the internationally defined twelve-mile zone, where the fishermen were sailing, as its territorial waters. But the Italian navy is increasingly withdrawing from the international waters off Libya's coast at the same time. Relatives of the captive fishermen say it’s because so many refugees get into trouble on the open sea and the navy no longer wants to have to rescue them. The fishermen's families are holding vigils in front of the parliament in Rome to try to pressure Italy's politicians into getting the 18 men released at last. A report by Philipp Zahn.

    This documentary seems a bit biased, and you have to question everything published by DW. So my question is this, are Libyan fisherman allowed to trawl up the sea bed on Italy s coasts? and if you are'nt, how close to the Italian border are other countries allowed to fish?

      Your response shows you do not understand the situation. International law sets a country's waters out to 12 miles off the coast (although the United States and some other nations claim it is 24 miles). Libya on the other hand claims the entire Gulf of Sitre as its territorial waters. So they are arresting Italians for fishing in waters that the United Nations says are international waters.

      @@antiusromanus1500 Sorry... to break the news.... you are wrong. You are the one who obviously don't understand, or are even oblivious to, what fishing rights are about. In this video has territorial waters/borders nothing with the case to do. It is all about EEZ... which has been international law under UN since 1982. EEZ is the coastal state's exclusive rights to the marine resources up to 200 n.miles out from the coast. In the Mediterranean where the space is limited a coastal state's EEZ sector wil be limited to the midline when it meets another state's EEZ sector. You are either in one country's EEZ or you are in another countriy's EEZ. Hence "...international waters..." does not exist in the Med when it comes to marine resources and fishing rights. So out from the Libyan coast to the midline will their EEZ sector cover all of the Golf of Sirte/Sidra and much more. The Italian fishermen said themselves that they where 74 n.miles out from the Libyan coast. They also showed on the map that they where outside Benghazi. That means that they were far inside Libyan EEZ. Hence the Italians were violating international law. That Libya is in a mess does not give the Italians any right to fish there. They have simply nothing to do there. Google EEZ and see for yourselves.

When one country has territory in form of an Island close to the coast of another country.... well they must both respect the right to waters around the respective territories according to international law under UN. Through negotiation the two countries must agree to a separation line between there waters ... and normally it is the middle line.

    It's not International water
    They fish at Libya EEZ, a 200 notical mile from cost where a country have exclusive right to sea resources (fish, oil and gas, etc..)
    At 6:30 a fisherman admit they fish at 75 notical miles and complain that its not Libya terrtorial water (which is a different thing and he is being missleading)

    So basically they, the Italians, do what the Chinese do; that is they remain in international waters during the day; then under the cover of darkness, sneak into whatever country's water. All while crying they were in international water, when caught and arrested. Sad that we only got the perspective of one side.

      @lili thing Yes, because the fishermen would actually say we were fishing in Libyan waters. This was a poorly done piece by DW, whom I generally like. There was nothing from the Libyan said.
      One of the reasons we had the Somalia pirate crisis a few years ago, was because of Chinese and European fishermen fishing in their waters and then claiming they were in international waters. China does the same thing. European countries does the same thing to poor countries, especially off the course of Africa.
      Stop being defensive and open your eyes.

    A weird argumentation from the Italians. Not once in this video did I hear the mentioning of something called EEZ. That is the international law under UN that a coastal state has the exclusive right to explore the marine resources up to 200 n. mile out from the coast. Territorial border and EEZ are to different things. The Italians claims of "fishing in international waters" is just nonsens. They has simply nothing there to do. They said themselves that they were 74 n.miles out ..... hence they are fishing illegally within Libyan EEZ waters. But in Italy and specially on Sicily rules are not excatly something they find very important to follow. That Libya is in a caotic civil war situation and are not very focused on international law is a different story.....

      @@freddyvorace9990 Well ..... it seems like your attention to the ever important details is not there at all and you completely miss the direction in order to come to a correct conclusion.
      This will be like feeding someone with a tea spoon. Please try to read what I wrote. I wrote about EEZ: "....up to 200 n.miles". Hence like in the Mediterranean where the space is limited between the coastal states then the midline is the guiding principle. The accurate line is given through agreements between the respective countries.
      The closest territory Italy has to Libya is the tiny island of Lampeduse just over 150 n. miles away. For Malta is the distance more ... like over 180 n.miles. Hence will 74 n.mile (as the fishermen claimed to be out from the coast ) be within Libyan EEZ in any case. I can not recall that they at any time in the video talked about that area at all. So that area has nothing with this video to do. But on the other hand did they both talk and even showed on the map the sea area where they fished - outside Benghazi in eastern part of Libya. This is actually important details. In that direction are the distance between Malta and Libya like around 270 n.miles. To Italy is it even more .... like around 370 n.miles. Your claim that the fishermen were "...probably in Maltese EEZ" is just taken out of the blue and stumbles in every fact that there exist. You even ignore what the fishermen say themselves both in distance from the coast and position. Given that video is there no doubt they were fishing within Libyan EEZ waters.
      I hope this can be a wake-up call for you..... because your performance here was zero..... Good luck.

      You obviously need to learn to read and pay attention to facts. What I said stands 100% correct. Look at my comment and see what I wrote about EEZ: "...up to 200 n.miles". That means according to UN law that the EEZ can stretch up to 200 n.miles - MAXIMUM - out from the coast. That means that the EEZ can also be smaller. Like in the Mediterranean where space is limited ..... there will one coastal state's EEZ be limited by the neighbouring state's EEZ. When this happens the midline will be the guidance for the separation of the two sectors. The accurate line will be agreed on between the to respective countries.
      Thank you ... I know very well about Lampedusa. I have specifically commented on Lampedusa other places in the comment field. It does not seem like you are able to divide you own number of 157 n.miles into two .... where you will find the midline/separation line between the Italian EEZ- and the Libyan EEZ sector. With the Italian fishermens own claim of being 74 n.miles out from the coast .... guess what.... they ends up in Libyan EEZ. Is that to much for you to grasp...???
      You obviously didn't pay much attention to the video and it's content..... At no point was there talk about this specific area anywhere near Lampedusa. It is simply irrelevant to this video. The fishing area they talked about in the video and even showed on the map was outside Benghazi in the eastern part of Libya. The distance in that direction between Malta and Libya would be around 270 n.miles. For Italy the distance to Libya would be around 360 n.miles. So with the Italian fishermens own claim of being 74 n.miles out from the coast .... they will end up far inside Libyan EEZ. Their talk of "international waters", but should know that when it comes to fishing (and EEZ) so is that just nonsens. The Mediterranean is limited in size so either are you in one country's EEZ sector or you are in another country's EEZ sector.
      Libya is in a mess, but that does not give the Italian fishers any right to fish there. That is simply a blunt violation of international law under UN.

They have never been truly enforced and Tunisian and Lybian fishermen are allowed in Italian waters on a daily basis. Italy and Greece have formalized an agreement over their EEZs just few months ago, and other Countries are moving in the same direction just now.

      You seem to mix up to different things. In the video the Italinas claim to be "fishing in international waters" .... which is just nonsens and twisting reality. The fact is that they are fishing in Libyan EEZ waters .... not mentioned once in the video. EEZ = exclusive economic zone with the right to explore the marine resources .... and that is international law under UN. The coastal state has the exclusive right to 200 n.mile out from the coast. To talk about "international waters" refer to the territoral border.... and that is a totally different thing. Hence don't mix up territorial - / international waters with EEZ waters.

      Due to lack of resources, war and corruption there barely is a coast guard and navy in Libya to protect its waters just a few boats with 50 cals and neighbouring countries such as Tunisia, Egypt and italy have taken advantage of this lawless Libyan sea

    Thats simple piracy and kidnapping. Seems like a UN or EU naval force needs to intercede and protect international waters, and arrest coast guard forces from these countries when they overstep. Some embargoes on these countries would also be helpful.
    US Sixth Fleet should intercede and put the smackingpractice. Libyan Coast Guard units. Good target lractice.

Apart from that and as an example italy had plenty of foreign fishing boats working in italian seas (often from north africa) but they didnt kidnap them and arrest them in this undemocratic and backwards fashion..

It's not mentioned in the video but the Italians are fishing illegally in Libyan EEZ waters. EEZ = exclusive economic zone. International law under UN state that the coastal state has the exclusive right to explore the marine resources up to 200 n.miles out from the coast. The Italian said that they were 74 n.mile out .... which is far inside Libyan EEZ. Talking about international waters refer to a territorial border.... and that is a totally different thing. Hence EEZ and international-/territorial waters are not the same.

      A coastal state has the exclusive economic rights to the marine and seabed resesources up to 200 n.miles out from the coast. In Mediterranean where the space is limited the midline will be the separation between the different countries EEZ sectors. So in the Mediterranean does there not exist any "international waters" - when it comes to fisheries and EEZ. That is just nonsens talk from those Italians. They were far inside Libyan EEZ ....and they had nothing there to do.

      Territorial water is 12 notical miles, and it's where a country enforce their laws
      EEZ is 200 notical miles, and it's where a country have exclusive rights of sea resources (fish, oil, etc..)
      In 6:30 you can hear an italian fishermen admitting that they fish at 75 notical mile from the coast, and complain that libyan have no right to arrest them !!
