That wouldn’t be the reason if they got sued though, the reason would be the blatant copying of their designs and even other designs from many other games, I guess they don’t really have an imagination to create unique designs lol, and also they can easily sue palworld as they are both not based in the US, I think they just don’t care, there has been many shows and games like Pokemon and they didn’t care either, pokemon fans are just annoyed because they didn’t grow up with this game like the other pokemon like games, Palworld is still a great game to play despite the huge amount of game breaking bugs they actually make it even fun to laugh at the amount of random stuff that happens, especially with friends, though I do hope they will change their designs to be actually unique and not blatant copies and even some being basically reskins of other stuff

Pocket pair is a Japanese company if Nintendo wanted to sue they would have at launch.
And Japan has no fair use laws. So it would be an open and shut case. The fact they haven't done anything is proof they just cant cause it doesn't violate their copyright

Nintendo Laywers have already told people to stop emailing them about the game. They aren't sueing. And I think if the worlds most litigious lawyers can't find anything to sue. There's nothing to sue
On point 2: no, they don't have to deal with the US legal system at all. Both the companies involved are based in Japan, so any legal proceedings would be done in Japanese courts.
If Pokémon had any intention of legally suing them they would have done it 2 years ago

I think that this game could also easily fall under parody, which I believe is protected by law.

No, parody is considered to be a form of expression. This means if you make a funny youtube video parody of your favorite characters that’s fine. But if you can’t actively seek to make money off of it. The real problem for Nintendo is what mike said, it’s gonna be really hard for them to actually make any money off of suing them and it’s financialy better for them to leave it alone.

This video was just lazy. Japan has very complicated and strict copyright laws, and the fact that both of these companies are in Japan means palworld is violating none of those laws. Palworld never claimed to be Pokémon, and the two games are so different that they can never be thought of as competing for the same audience. That’s basically it, Japan allows parodies as long as the gameplay is different enough

Shit Palworld took more than just designs lol, they also took the inability to make a proper game that doesn't bug out in 3 years. Lookin like Scarlet and Violet with its bugs and glitches that put you through the map, considering you can sometimes spawn under the map. 3 years of development and we still have bugs and glitches that can prevent gameplay.

Regarding the resemblances, what if Pal World makes the case that Pokémon copies designs from them in a future entry? I could feasibly trademark a thousand characters in the Pokémon style, turn then into NFTs, and sue The Pokémon Company on the same grounds if they happen to make a character similar enuf to my IP. Do they want that precedent? I don’t know.
The reason Nintendo said they would investigate was to shut up the pokemon fanatics, if there was any chance to sue, there would be no Palworld.
Actually when Nintendo said they would investigate they were talking about a card game that was using Pokémon’s assets look alike they decided to make that statement but it wasn’t toward palworld at all!
They could easily sue Palworld, they blatantly copied the designs on many Pokemon and not even just Pokemon, they also copied stuff from many other games, the creators got no imagination ig and couldn’t think of something unique but still a good game despite that , the huge amount of game breaking bugs makes it really fun to play especially with friends laughing at the random stuff that happens, I don’t think Nintendo even cares in the slightest lol

@@toonier8655 Well the creators of Palworld don’t really have an imagination, they’ve copied designs from Pokémon and Digimon for the Pals, and gameplay wise it is like Ark Survival and even some UI design choices are very similar to Ark Survival, and I haven’t really verified this but many people are claiming they have copied animations with small modifications to them, they have even copied base systems from their other game into Palworld which kinda makes the game feel like a quick cash grab.
The supposed Pokémon copies are the following;
- Tocotoco & Xatu
- Relaxaurus & Goodra
- Sparkit & Raichu
- Pengullet & Piplup
- Azurobe & Milotic
- Celaray & Mantine
- Direhowl & Lycanroc (Day Form)
- Jormuntide & Gyarados
- Grizzbolt & Electabuzz
- Boltmane & Luxray
Now I wouldn’t call them direct copies but it does further prove my point that they didn’t put much effort into making original content and instead they just took designs from Pokémon, and this is only listing a few of the similarities to Pokémon out of the many, they have also done the same with Digimon.
Personally not hating on Palworld, I don’t really care despite all of the evidence, it’s still fun and I wouldn’t even call it a Pokémon like game, they both have entirely different play styles. Despite all the game breaking bugs it has I will always enjoy the game lol, it’s new and fun, people are just hating on it because they didn’t grow up with it like Digimon and Pokémon, we all know they would be hating on Digimon if it released recently aswell.
Palworld is definitely screwed if they did actually want to sue though, Japan has bad free use protection laws and of course they are both based in Japan, though I personally believe even if they were both based in the US they would still find a way to sue Palworld, I wouldn’t want to sue them either if it’d ruin the reputation of the company. I bet Palworld probably did this on purpose to get Pokémon fans mad so it can become very popular and get more purchases, which if it was it has worked perfectly lol

Nintendo also doesn't really care, they gain nothing from getting into a dispute with pocketpair. Even if they win what would they win ? they do not have a comparable product so they wouldn't gain customers from this.
They probably also don't want a comparable product since they already found the perfect milking loop , they release a new game once in a while and fans will buy it no matter what. On top of that they have the whole mobile market with an endless stream of micro transaction income. They are content with what they have and won't change the reception, if they need more money they just look at some household objects and slap some faces on to them before releasing a new pack of Pokemon.
Palworld was produced in Japan, their copyright law is pretty cut throat.

In Japan there are no free use law, yet they still got copy right laws over there.
In the end Nintendo saying they are looking into it is just them sayimg they know about the game and stop spaming them.
I remember reading somewhere recently (I don't remember where exactly) that said that, when it come to the Pokémon games, Nintendo's stance on infringement is 'whether or not a game's code is copied or taken from an official game'.
(I believe the same goes for assets as well)
Basically, I think Nintendo could only really do something to Palworld if they had either code or assets that were directly ripped from one of their games.

This argument doesn’t hold up. Half of the pals being mentioned don’t have animal inspirations that they have copied, they just straight up took proportions from Pokémon. Verdash has the exact same proportions as cinderace with a few deviations like the tail and head ornament. Anubis literally just took lucarios face same with dinossom and meganium. With the examples I just mentioned this argument just doesn’t hold up.

Palworld developers clearly wouldve legal checked all of this. They wouldve wanted this to happen because it creates free publicity to their game and generates a higher demand for it. They played it very smart
They are both in Japan and Palworld did things under the public eye through a kickstarter or something similar for a while. Like years. At worst, Nintendo will demand some changes to certain creatures which most are already "different enough" to not be mistaken for being [insert creature name here].
Honestly, it's more annoying that players who "know" Pokemon call the Pals by a Pokemon name. But if you've played Digimon and reference a Digimon they have no idea what was referenced. I only watch a couple of unfortunate streamers that insist on playing Palworld for content. Thankfully one focuses on combat and evolution while the other is more architecture and engineering so there is little overlap. Everyone else is just cookie cutter content.

In 1983 Universal Studios sued Nintendo over copywriting infringement for donkey, Kong saying a it was a rip off of King Kong. However, Universal Studios lost that lawsuit because it was determined that you cannot trademark an idea or genre. The same law that protected donkey Kong and Nintendo which if we are being honest is a rip off of King Kong protects palworld

While they dont own ideas of a “leaf monkey” as you say, they do own the designs, and designs that are deemed too similar could fall under copyright infringement.
To me, some of the pals bear a striking resemblance to the similar pokemon, while it’s possible there was the possibility of design inspiration, in looking at Lycanrock, and the other one shown with it, the two wolf looking ones, they look too similar to me to be simply inspiration.
This is just my perspective as someone who does make models and assets for VR games

Drawing a picture of the Eifel Tower would classify under this notion but it's not applicable. Plagiarism is a very tricky situation when it comes to artwork.
Plagiarism almost strictly applies to academia and literature. This situation falls under intellectual property, copyright, and trademarks.

Nintendo doesn't have a monopoly on cartoon figures in video games. Even if they tried, they won't win. The only thing they can do, is strike down modders who make mods that replace models of Pals into Pokémon.
Actually they couldn't even do that, so long as those mods aren't for profit. At least in US law.

@@cucuawe465 Most people take down their mods from the threat of legal action. Legally, Nintendo can't actually do anything, but most people cave under the threat of an actual legal battle. And who wants that sort of stress and potential financial strain caused by a mod that isn't even making money?
They could potentially take legal action if someone was making mods for their games. But Palworld isn't their IP, so they can't take action on behalf of the Palworld devs. It would be up to devs to do so. The best they could do is send the mod maker a cease and desist that doesn't actually have any real legal backing.
(Even if they did, the case could be thrown out since games like Garry's mod has those sorts of mods and Nintendo does nothing in spite of Garry's mod being absurdly popular.)

When I heard about the controversy, I was one of the people that hurried up and bought a copy. Nintendo is helping by keeping the story in the media. And I heard that both companies are from Japan and it took several years to make the game why did Nintendo not see it as a threat, and tell other people started saying it was like Pokemon with guns. These days people just love the drama.😂

Remember, Nintendo took down a mod for palworld that changed pals into pokemon the same day it was released. This isn't a situation of it not being pr friendly, you cannot exactly copyright pocket monsters as other IP's also use similar concept.

There's a lot your behind on Mike. Palworld's studio is down the block from Pokemon's HQ in Japan. Palworld was announced and publicly talked about 3 years before release so if Nintendo wanted to sue they would have already and they've sued for less.

Stealing assets would defeat the purpose of having said lawyers. They were INSPIRED by their assets. Inspired and stealing are two different things. The whole stealing assets post on twitter was faked because the person who posted the tweet purposely scaled the models to fit Nintendo's models. The same person has stated they did what they did because the game promotes "animal cruelty". Stop using twitter posts as evidence of anything.

Art style and game mechanics cant be copywrited in the United states. That alone means palworld is not going anywhere. But that also means Nintendo can look at palworld and use mechanics from it. Even borrow some art style.
Both of the companies are based in Japan so they are definitely not protected that well and even if they were based in the US they could still sue because of them taking heavy inspiration from actual Pokémon (and Digimon), if you take the time to compare them all you can actually see that many are like merges of Pokémon and Digimon or multiple Pokémon as one, GameFreak (Owned by Nintendo) just doesn’t care and they know it isn’t worth the money to be hated by the community even more which wouldn’t benefit them, they just want to shut up their annoyed fan base.

Note about #2: both Nintendo and Palworld are from Japan. I don’t see any reason why they would sue in American courts.
I think it has to do with the fact that Steam is the distributor, thus Valve would have to be involved, which means having a court case in I think Washington. I think that was the issue with the Nexon/IronMace IP case last year over the Dark and Darker game, since I know that part of that case was in the US courts until it was withdrawn from the Store and a judge dismissed the US part to be handled in S. Korean courts.
That's the other thing, if Valve want to hold on to PalWorld, Nintendo would be forced to filed at least part of the case in the US.
I don't think Nintendo will actually sue simply because it may drag Bandai Namco, WiZ, and Square into the mess because of the fact that they are a bunch of Pokemon that share resemblances to Digimon (although that does go both ways) and Dragon Quest monsters.

Palworld might turn out to be a way more important game than people realize. If people watch the Sonic movies or play the Sonic games, this is definitely a game to keep an eye on, because it might turn out to be extremely decisive if they manage to get around all the copyright issues.

There´s also that Nintendo didn´t sue the game despite it being in development openly for years, so they are fully aware of this game and would have if they had considered it as possible AND the game being a threat to their IP.
The reason why they can sue, both are Japanese companies, Japan has fair use but it is nothing like Americas.
Even if they were to sue the fact that the game is basically an exact rip of LoA (map style and interaction layout) minus in game mechanics that alone could win the case even in an American court. Regardless of that, the lawsuit will happen in Japan, and the Japanese government can and most likely will crack the hammer to the point of server deletion. The game could theoretically have servers opened in other countries but at the same time due to Japanese law the devs could be sent to prison and pay a hefty penalty for the infringement.
