That's incorrect. He showed that the library witness persuaded the court that he couldn't have done it.
The timeline was always extremely controversial and compressed with no evidence or witnesses for him going with her to that parking lot.
what has long been debunked is the entire jay testimony. he was paid off and actually coached as in dictated what to say by cops. it's incredible detective work to uncover that. worth listening to.

@blakebrothers3984 to prove one’s innocence is going way beyond the legal standard for a conviction; it is the prosecution’s responsibility to prove the defendant’s guilt beyond a reasonable doubt. Imagine an innocent person who was completely alone for several days in a row but was set up by others for a crime during that window. It would seem impossible for this person to “prove” their innocence to anyone

    • @imanchamma1891
      @imanchamma1891 Před 5 měsíci +5

DNA excludes him amongst other facts and evidence. His downfall was that he wasn’t given a fair trial because of prosecutorial misconduct. They committed a Brady violation. That’s huge in deciding the outcome of a case. What he’s doing here is showing a pattern of misconduct by said prosecutors. What people need to understand is that, in trial, it’s not whether the defendant is actually guilty or innocent. It’s whether the prosecution can prove beyond a reasonable doubt that he is guilty. The defendants job is to poke holes in the prosecution theory and case. It NEEDS a to be a level playing field. If you are familiar with actual facts of adnans trial, anyone can see he wasn’t given a fair trial.

  • @astrowuff

Adnan has the worst luck ever, it's too bad his ex-girlfriend was strangled but not robbed or sexually assaulted and the body hidden just days or hours after making their breakup final. And then also very unlucky that Adnan's good friend that he loaned his car and phone to on the day of Hae's murder decided to conspire with police to implicate Adnan and what was really impressive about Jay's lies is that he knew things only the murderer or someone working with the murderer could know. It's so unfair that Adnan was charged with Hae's murder despite all the evidence that implicates him, why didn't the cops hunt for someone else despite all the evidence pointing to Adnan? I'll tell you why, it's because they were jealous of Adnan, I mean look at his strong arms, why he could snap me in two pretty easily, but he could never hurt a girl who just broke his heart, that never happens in real life ever when girls leave their possessive controlling boyfriends.

    - cell phone data WAS accurate and it placed him right there. Not based on incoming calls but outgoing. He went right to the crime scene the day after!
    - he not once tried to help find Hae! Never once tried to even call her-despite calling incessantly the night before.
    - Jay was obviously involved as he knew where the car was. Adnan was there too, there was zero motive for Jay to do this on his own.
    - Adnan’s lending his phone and car to Jay (who wasn’t even a close friend, according to Adnan, is just a setup. Adnan knew exactly what he was about to do.
    - He was/is a jealous F__K and didn’t want Hae dating another person. He was too proud as a devout Muslim to let her be with someone else

First of all the case isn't as clear as you're claiming it to be.
The cell phone data was wrong, presented in the first trial, later on got changed and Jay's story changed with it, which is suspicious and not normal. Jay wasn't a trustable witness, his story changed so many times, and didn't match other witness's testimony either.
If being her Ex boyfriend makes Adnan Syed a suspect, then it makes Don the current Boyfriend the suspect too. If not contacting her on the day she went missing makes Adnan Syed a suspect then the same thing makes the Boyfriend Don the suspect too, because he was supposed to meet her on the day she went missing. Don did not tried to contact her either. When we are suppose to meet someone and they don't show up we try to contact them to find out the reason, but he didn't do that either...
Adnan Syed had an alibi. Some would claim she wasn't trustworthy, then Don's alibi isn't trustworthy either, because his mother was the manager of the place he was working in, a fake alibi can be used...
Jay was apparently fed information... there are tapes proving it.
Adnan Syed lending his car to Jay to get Stephenie his friend a Birthday gift makes sense and the phone was in the car, which wasn't lended to Jay, he forgot the Phone in the car...
He wasn't a devoted Muslim at the time, because Islam does not allow Muslims to date, do drugs etc. He was completely astray from Islamic rules and teachings.
Someone who acually believes in justice would not only care about the person Killed but also would want the actual Killer to be in the prison and not just anyone.
A person who acually believes in justice would want answers for all the misconduct, and to be investigated and a new fair trail should be held to clear all the doubts and find the actual killer... and justice to be served.

Character flaws, bias, and dishonesty don’t stop because you punch a time clock for work. There have been too many vindications due to police and prosecutorial misconduct against marginalized people to ignore. I think bail really depends on the case and if they think there’s a chance the defendant will flee. In Durst’s case he ran. Whether he would’ve been able to pay the bail or not, it sounds like they used the fact that he was of middle eastern descent as the main reason for denying him bail, not because of his character or past crimes, which I also believe is a factor.

Asia McClain was a witness for the defense. She contacted the prosecutor because she said that she felt pressured by Adnan's attorneys to give Adnan an alibi. The prosecutor did not reach out to her. Why would he? Asia makes it sound like she would have testified at the hearing but for the pressure exerted on her by the prosecutor. This is not true. If you were an alibi witness for a convicted defendant, and you knew that your testimony could potentially free that defendant, would ANYTHING a prosecutor told you deter you from testifying? The Asia alibi story is as frivolous as all the other nonsense that comes from the pro-Adnan crowd.

Just believe us..Adnan did it through process of elimination and Jay's lies which you can Ignore cuz that's what he does. The overall story is there you just have to sift through it...oh the timeline he lied about? Well just move the come and get me call to after 3pm..oh the trunk pop? Forget about where it happened and what time..all that matters it that it happened? Same with the burial..look Adnan is an evil narcissist psycho who killed his ex girlfriend and made Asia McClain write his alibi letter for him and then wrote one back and her type it up and made sure she misspells his name cuz she's also a dummy..oh and the calls after Jay got arrested..that's definitely Adnan panicking that jay got arrested and calling Jay's friends..who Adnan didn't know..but forget about it he did it anyway cuz his big brown cow eyes are just evil

I just think a lot of people‘s eyes were glazed over and it would just be even easier if he stayed in the summary of each topic at the very first so that way people already have their mind primed for what they’re about to hear next.

I want to believe him and a part of me does. I mean if he was going to to commit this crime would he really invole a shady drug dealer friend? Would he have done it straight after school? Would he have driven around getting high while her body rested in the trunk of her car? So many things do not make sense. The one issue that bothers is me is who else would have done it, especially at that time of day. If it was late at night walking home of leaving a club it would be easier to digest but a random murder at 230pm seems very unlikely.

Of course, it is evidence. You can draw an innocent inference from it if you are gullible. But most reasonable people would draw the inference that Adnan was at least contemplating killing Hae.
Many accused of murder do testify at their trial, especially if they are innocent. Nothing speaks louder to a jury than the refusal to testify by someone charged with murder.

    • @milart12

But none of these things make the trial "unfair".
There WAS reference to Syed's Pakistani roots at the bail hearing, but none during the trial. I think that there was a reference to his "pride" being hurt in the closing argument but was hardly a big part of the case.
Your middle 3 points relate to the competence of Syed's attorney, and I agree that she was terrible. Her manner and style alone were very grating. But the Debbie Warren issue is surely minor. The Asia McClain issue is not minor. But what do you conclude from failing to call Asia McClain? Adnan's attorney must have concluded that she was not credible and would have done more harm than good. Her subsequent vacillating cast serious doubt on her veracity. In any event, the appeals court has decided that even if Adnan's attorney was derelict in her duty, it would not have changed the outcome of the case.
As to the final point, there is no indication that the prosecution deliberately hid this disclosure form the defense. More importantly, it has been determined that the statement isn't even true. There is no distinction between incoming and outgoing calls. Even if there WAS a distinction, many of the calls support the prosecution's theory of the case.
If you are inclined, there is a great article entitled "The Wrongful Exoneration of Adnan Syed", in Quillette, written by Andrew Hammel, which exhaustively details all of these issues.

@@milart12 I know that article. But the McClain point alone made the trial unfair. She says she saw Syed exactly when the state concluded the murder happened. The Court of Special Appeals noted that an alibi witness for exactly that time would have changed the entire evidentiary picture. The state would need a new timeline and adduce evidence that Syed could have gotten into Lee's car later that day when she had already departed the school. There is no evidence for that. A new timeline would also contradict the testimony of their star witness.
With a competent counsel, Syed would likely not have been convicted. That's why his trial was unfair.

    • @milart12
      @milart12 Před 7 měsíci +1

But without knowing Guiterez strategy in not calling McClain you cannot say that she was incompetent. There is much more than meets the eye with McClain's testimony. And you have failed to mention what the MAJORITY wrote:
As for Asia’s alibi, the Court held that Gutierrez should have contacted Asia, but that her failure to do so did not harm Adnan’s case. Asia’s testimony would have conflicted with Adnan’s own claim never to have left the Woodlawn campus. In any event, Asia only provided an alibi for a “narrow window of time,” and her testimony would have drawn more attention to Adnan’s own “internally inconsistent” statements: “At best, her testimony would have highlighted Mr. Syed’s failure to account precisely for his whereabouts after school on January 13, 1999.”
Judge Shirley S. Watts agreed with the majority’s decision that Asia’s testimony would not have helped Adnan, but she also endorsed Gutierrez’s decision not to even investigate Asia. Watts details the questions swirling around Asia’s letters and motivation, which raised the possibility that her testimony would have backfired-the jury might have got the damning impression that Adnan was trying to fake an alibi. It was thus “unequivocally” appropriate for Gutierrez not to have investigated Asia further.
      (Quoting from the Quillette article)
Of course, if there were no issues with McClain's testimony and it was believed, it might have thrown a monkey wrench into the whole thing. But Gutierrez, as bad as she seemed to me, would not have ignored an alibi witness without good reason.
