      Exactly. And I hate this witch. I hope the plaintiff files the necessary lien paperwork to ruin her credit. What an absolute disgrace this loser is. And she’s not even embarrassed about this! She scammed the property owners by not paying her rent x12 months. Not even an attempt to pay. It sure sounds like she enjoys her cigarettes though by listening to her voice. If she can afford the 300-400/month on that shit, she should be paying her rent!!

      I would be so ashamed to live in someones home and not pay. Once I my autopay was late to my mortgage company and I even called to apologize for that. This lady feels totally fine just squatting and smiling in court.

    Ugh, the defendant was so SMUG. She sat there grinning because she knows she's never going to pay a penny. I usually like Judge Simpson but he was not helpful in this case.

      ​@onbored9627 Except that he scolded the lady like she was the one in the wrong because she expects to be compensated for her services.She gave the lady a place to live and now because the lady doesn't make enough money to pay her.She just has to deal with being ripped off.And on top of that, the judge is going to treat her like a child who doesn't understand what's going on, even though she doesn't understand what's going on.Even though she does she's just angry and feels like it's unfair... What if her getting ripped off in this scenario?Set her back in another scenario like she couldn't pay certain bills because of this lady? Nobody cares about how this affects the landlord.They only care about the lady Is who lives rent free... He bullied her into accepting this.

      @@danshotguns4226 I've seen the entirety of the recorded hearings from this case, and I assure you, he didn't bully anyone. If you've also seen them all, and still feel that way, I don't know what to tell you. He's been more than nice, and getting her to settle was her best bet at getting any money because the woman was only ever going to pay the money voluntarily as she's on protected income. So, by settling the woman thinks she won and will potentially pay. The landlord is so unorganized, unprofessional, talked over Judge Simpson over and over. They both were insufferable, the land lady just was better than the obviously crazy woman.

      Agreed. People always take advantage of landlords. Even courts, who allow people to squat for months or a year. Landlords have to pay mortgage on those properties unless some unusual circumstances exist.

    Nasty Gerler needs to be charged with felony theft. She stole $12K+ from the landlord. She knows she's judgment proof and willingly "took" from the landlord. Put her in jail and have her SSI pay to the landlord until the debt is paid!.
    Never understood why rent theft is any different than theft of any other service or product.

      Unfortunately, if you are in jail longer than a certain amount of time (I think it's 10 days) you lose your SSI benefits, so the landlord wouldn't receive the money anyway. Sadly, the landlord will most likely never see the money.

      get real... it is not 'theft'.. she stole nothing...
      she IS a deadbeat tenant and should have been evicted long before she ran up $12,000 in past due rent... it is not theft because you voluntarily gave them possession... it is breach of contract, and unlawful detainer
      also, SSI is completely exempt from collection, CAN'T TOUCH IT...
      yes, it is frustrating, I lost money to a deadbeat tenant, and my father actually had to pay his tenant's first months rent at a new place to get them out...
      you have to screen these people very thoroughly... you rent to a judgment proof tenant, that is what you get when they default...
      don't get mad, get smart

    I’m very confused.
    This woman is on zoom, clearly operating an electronic device with an internet connection. She hasn’t melted, her brain hasn’t short circuited, she’s remained conscious. Has she been cured from the afflictions that prevented her prior appearances? Is she wearing tinfoil undergarments to protect her just for this hearing? The people need to know.

      Everytime I think about this woman and her electricity/wifi allergy I just laugh that the access to the mechanical stuff for the building was in her unit and that apparently wasn't an issue even though depending on the material and complexity that can legitimately cause issues with people (mostly headaches, but old wiring can also cause paranoia and rashes). So like, she can't go to court because the electricity will kill her but living next to the electric/mechanical panel in the building was fine!

      Don’t forget she had every strain of COVID and continues to develop strains that have not been discovered. I am saddened by how Judge Simpson treated the plaintiff. I just love him but I think Ed he missed the mark on this one!

      For practical reasons the defendant is judgment-proof. She owns nothing and there is a law against garnishing SSI payments.

      ​@@samuelfreeman2181A compromise was made assuming she would pay the reduced figure, as soon as she balked on that and said she basically has no income, the landlord should have said fine, I want the full amount. If she isn't going to pay anyway, why not get the full judgement. That was a stupid decision for the judge to push for a reduction since he already eluded to the fact that the tenant was uncollectable, he just didn't want to be bothered with a trial for some reason, which isn't like him normally.

    It is very rare that I disagree with a decision any judge makes. After everything that Ms. Gerler has put the plaintiff through, I feel it was very unfair to badger her in the manner he did. I feel it was a form of intimidation on his part. Watching Ms. Gerler smirk when the judge was talking to the plaintiff was disheartening, to me it gave her a win that she didn't deserve. The plaintiff in this case deserved every penny that she was asking for.

      He did not badger her. It is not his job to reprimand the tenant for non paying, he was willing to put the whole amount of judgement to the plaintiff’s favor, but since the tenant is on SSA he cannot force that judgement into it as he indicated. In the end the plaintiff decided to drop 3k herself, and then Simpson made a judgement in the plaintiff’s favor I believe. The problem is, how is she going to make that money from a now disabled person that has no income.

Does not matter if he indicates this info with intimidation on tenant or not the end is the same. And after going through criminals on a daily basis I understand why judges want to be as civil as possible where it can be.

      Exactly! People will stop renting soon and I'm with them. I had 2 renters for 3 years. Luckily they were never late but once they moved I sold and will never rent again because of the crap I see in videos lile this.

      Problem is this is civil case not a criminal one, so jail can't be allocated for this. Also not paying your debts is not classified as a crime in 99% of all cases (there are special circumstances but this is a run of the mill landlord/renting case, not a multi million dollar failure to deliver goods/services fraud kind of casel). Let's say the judge did enforce the full amount, then comes the real hard part, getting the money. Based on the defendants declared income, the payments (which would take months before they could be figured out/enforced, with court costs/fees) would be so small, they would NEVER recoup that money in their lifetime. Unfortunately, the landlord is better off writing the money off than taking these actions.
      It's morally wrong doing what the defendant did, of that there is no doubt. But there is no feasable way to punish them for it and I would bet everything I own that whatever assets the defendant owns/money in the bank wouldn't even scratch the surface of the debt. You do not go to jail for not paying your debts in 99% of all cases and this is true in many countries. This is why private letting property is a HUGE risk and should never be entered into unless you can go without that money. It's one of the reasons its a terribly bad idea to mortage a property and pay that with the rent made letting the property out, if you get bad tenants, you're screwed.

    It is not this judges concern on how the landlord is going to collect on the judgment. He needs to rule in the landlords favor for the entire 12k and let her worry about collecting.

      That would require a.trial. The plaintiff decided to agree to an immediate judgement of about $9k instead. If plaintiff wanted to go to trial for the additional $3k judgement it was her perogative.

    I hate that the defendant gets away with not paying but once in collections. If she does not pay up she will be screwed. For get another rental place or getting financing.
    This is why I would never rent a place to someone. To many horror stories. The lady is a grifter.

      I was incensed with his attitude and his demeanor. However, his hands were tied. He knew that this POS would never be compelled to pay the Owners back. She's on SSI which could NEVER be garnished or touched, and even if she were doing a side hustle, there's no way to prove that, substantiate the amount of that income. At this point, he knew there was NO recourse for the Owners. All he could do issue a judgement then again, it becomes the Owners' responsibility and good luck in getting this POS to comply with an order. He essentially said, it's a lost cause. He could have lectured the POS but he didn't. I would have. So this POS gets to run her game in another place.

      you are the one that does not understand.... the judge brokered an agreement... a stipulation, a COMPROMISE...
      plaintiff could have been stupid, and insisted on a trial, and probably would have won the entire amount, maybe not...
      it is people like you that clog our courts with millions of cases that most likely will never get paid

    I normally am a fan of Simpson, but he was kinda rubbing me the way this time. He's too tenant biased sometime. She flat out stole 12000 from the property owner. Theft of that amount is a felony.

      There may be a law in Detroit like in NYC. These laws are always in favor of the tenants. Even if the judge feels the landlord deserves the rent, some times their hands are tied. My family owns a two family home so I know these crazy laws…

    As a landlord I received a judgement for $25,000 . The person left the state and I never saw a dime. It’s a joke to go through this process. The property was destroyed and we had to put it back together. Good luck seeing any payments.

      the part where there is no way to collect the money after the judgement is rendered. Defendant admitted to owing 9k, plaintiff wants 12k, no matter what the judge awards, 9k or 12k, there is no way to enforce collection of any amount because defendant has no money eligible for garnishment. the outcome is the same, plaintiff actually collects 0 in both outcomes, and judgement against the Defendant is on record. by forcing the judge to adjudicate the 3k discrepancy, all it did was waste another hour of their lives.

    If Nancy receives SSI the most she receives is approximately $950 per month. How much was her rent? Sounds like the rent was unaffordable from the beginning and she should have to show how much she made as a psychic. If I was the landlord I would make a report to Social
    Security about possible unreported self employment income She should owe the whole $12000

    The bad tenant looks much older than retirement age, at which point SSDI turns into regular SS, hence she’s not considered disabled anymore. Also, the judge should ask what the tenant did with the money that should have been paid in rent. Perhaps she saved it, or gave it to someone. If true then the landlord should be able to go after her. No wonder rent is so expensive these days. Landlords have to figure the cost of eviction and non payment of rent into every rental. Not to mention the cost of cleanup and fixing broken crap. All the while keeping their own head above water to pay the mortgage.

      While I don’t always agree with Simpson and I think in this case the defendant was in the wrong, I’m so glad there’s finally a judge standing up to bully landlords!! Who think they can charge 3x what a place is worth, not fix any problems, unlawfully keep security deposits. They’ve been getting away with it for too long.

      @sixbrigands not necessarily true. My mom has maintained ownership of the home I grew up in and rents it out...and for a much lower price than she should. The home is being kept for a few reasons, and I promise, as an investment isn't one of those reasons. There are still monthly costs that need cared for, and it's a big strain when a tenant doesn't pay rent. She's had to evict a few tenants. The last one destroyed the property, and she lost money on repairs and rent for the time it took to repair. Not all landlords are companies or investors and it hurts a lot when a tenant doesn't pay and even more so when they damage the property (which isn't really relevant here).

      He's being REALISTIC. It's virtually impossible to get retirement checks garnished from even moderate income people. It's not even easy to get garnishments from people with moderate incomes who are working. If the landlord can get the tenant to agree and make voluntary payments they are much better off.

      The problem with tenants who default on rent is that you can’t get blood from a stone 🤷‍♀️ Judge Simpson can rule that she owes every cent, but it’s nearly impossible to GET the money from these thieves unless they actually have valuable assets that can be seized. He’s not being anti the landlord, he’s just being honest (& he’s understandably a bit annoyed that they keep talking over him!). I spent a while working as a property manager & I took a heap of defaulting tenants to court & got rulings against every one of them. But, only if the landlords had landlord protection insurance did they actually get all or even most of the money. You can only request the court to garnish wages, and if people have assets you can apply to the court to get them seized. But most of these people who default on rent for long periods don’t have assets & don’t have wages high enough to garnish enough to fully get the money owed. He might seem like he’s not being fair to the landlord, but he’s just being practical & realistic. He’s trying to get the landlord SOME money back. The law & reality of the lives these grifters lead just doesn’t help 🤷‍♀️

    I made the mistake of renting out my house when I moved out of town for 6 months. My tenant paid nothing beyond the first month. I tried to get legal help and quickly found out the law does not protect the landlord at all. I went to court and got a judgement in my favor. They still had another 3 months to vacate. I still never got any money and it cost me $10,000 to repair the damage done to my house.

    Its always extremely frustrating when you see Judges like Simpson trying to discourage landlords from pursuing their rights. It doesn't matter if the woman can't be completely collected from, attempting to discourage someone from pursuing their meritorious case just makes it clear that you believe their rights matter less than the defendants.

      No, he said he would do a trial, but what he was getting at was that there was a valid claim by the tenant that she would have received a subsidy for rent if the landlord had not moved to evict her. So It was possible that the could have ruled against the landlord and deducted that $3,000 anyway. Judges are as much in the business of resolving disputes as they are in supervising trials.

      But he's trying to save the Landlord even more time and money. He knows this defendant is judgement proof. He understands wanting her money, but he knows that it doesn't matter what judgement he makes, this defendant has no means to pay, no means to be garnished, nothing. By the system of law, he could have had a full trial, more hours and time and cost, and the plaintiff could have gotten a larger judgement. But the plaintiff would be sitting with the same amount of money, 0. Because this defendant either knows the system well enough that she knows SSI can't be garnished and she'll just take cash for her "readings" or she's just lucky she's only got SSI.

This landlord is also on social security retirement which she worked and earned via work and wages. Her tenant is under SSI, totally different circumstance. What is going with the most fair Judge Simpson?

      A landlord still has to make mortgage payments on a property if the tenant does not make payment. Plus, the taxes and insurances. SSI means you don’t have enough work credits to receive a legitimate retirement income. Should a landlord just hand over their property for free? I don’t get Judge Simpson on this case.

Basically, it was slave labour and the jail could also skim Govt money off the prisoners too by paying them even less than the incredibly low "wages" already set by Law. They also charged the prisoners for food, bedding, etc so it would take forever to pay off their debts. It was basically the Workhouse system with the voluntary part removed.

    Actually disappointed with Judge Simpson on this one. He definitely is perpetuating the appearance that 'squatters' have more rights and protections than landlords. Maybe if landlords had more protections than they currently do rents would be lower?? Not in this example, but say someone owns an 8 unit complex. Over-charges 5 tenants who pay on time to subsidize 3 tenants that don't pay because the legal system encourages non-payment of rent. Just a thought.

Had good paying positions. He passed from cancer at 65 of pancreatic cancer (Apr to Sept) just before retirement. I get a portion of his and my own pension…we are all paying for Nanci Rose’s scam.     I love Judge Simpson but he has been to scared to do his job with this woman because he's afraid of what she will file against him. She needs to be in jail.

    This lady is a real grifter. If she wasn’t so smug she’d get a little sympathy but she knows how to work the system and the landlord if left holding the bag. A common problem faced by many property owners. Even a promise to pay $100 a month would be a better pledge than to say I can’t pay anything now and not anytime in the near future.🤬

    Either way, the defendant now has a judgment against her. Which will screw her up trying to rent something else.

    I’m don’t see why Judge Simpson was so against filing this judgement, it’s the right thing to do. If the defendant has a win fall the plaintiff will get her money and I hope she does!

      And what gets me is it's not even like he feels bad for her for being on social security and her ailments. He's just angry that a landlord has the audacity to want rent - which isn't even the full rent owed, just SOME of it.

      @@FrenkTheJoy yes indeed. Glad Fl is a red state. My dad was blue, but always said, pay Ceasar what Ceasar is due. No negotiating on taxes local or federal. He also said, a legal day of work equals a legal day pay. Plus that lady knew she couldn’t afford to live there and poo pooped her way the long way around to move out. In my book, that’s stealing.

    What a jerk of a judge! Seriously, HE allowed the liar tenant to stay longer without paying rent owed! That awful renter ruined the house, lied and never paid WHAT she owed! I bet he would be singing a totally different tune if he was the landlord!

    Why can’t the court just reposes or sell her possessions such as jewelry, antiques, etc until she pays the full amount???? The bank does it to debtors

    Judge Simpson is horribly bias against landlords. I would have said yes I want the trial and no I don’t care if you don’t think it’s necessary. His job isn’t to determine how a plaintiff collects their judgment.
