  • A Cary resident is getting fined $50 a day because of a Homeowners Association rule change that came 18 months after he installed new windows on the front of his home.

    Homeowners associations in North Carolina have enough power to take a home if a homeowner starts racking up fines.
    It’s the fear of a Cary resident Andy Cheng, who is getting fined $50 a day because of his windows.
    "It was not in the ARC. It was not in the guidelines," Cheng said of newly implemented rules regarding windows. "It was added last year."
    The HOA rule change came 18 months after he installed new windows on the front of his home.
    Even more frustrating to Cheng, he reached out to Carpenter Village’s management company to see if he needed approval from the HOA board before installing the windows. In an email exchange Cheng provided to WRAL Investigates, the management company said as long as the frame and trim of the windows remained the same, no approval was needed.

    HOA's. The privilege to purchase a home at full retail price and still retain the nuisances of a landlord.

    If he already had those windows put in and they were approved 18 months before that rule change, then they don't have any legal footing to stand on at all! If I were in his shoes I would tell the court that they are clearly being racist and singling him out since they're at least two or more other houses in that same neighborhood that changed their Windows like he did!

    Cannot believe they have so much power! What tbe hell are the HOA paying my mortgage. This is crap, why is the government allowing this crap to continue and be allowed to take our homes! New laws need to be given to those HOA. This really sucks °°

    Instant $20,000 value drop for every Carpenter Village home!
    Why? A few petty Carpenter Village Architectural Board control freaks! You made the news...and Google has your negative story indexed...for all Internet Eternity!
    So, take your property value hits, homeowners! You earned them! Thank your Carpenter Village HOA board!
    I'd rather have a home with radon emitting granite counter tops than buy in Carpenter Village now! I could change counters out for less than the $20k it will cost your neighbor you shat on over window grids. THOSE ARE USUALLY INTERIOR INSERTS or PANE OVERLAYS anyway...either between panes or on top of the glass ON THE INSIDE of the home, not the outside.
    INSIDE the window--not the EXTERIOR! HOA: You have NO JURISDICTION over the inside of that man's home, unless your HOA can regulate curtains, drapes, miniblinds, or pleated shades in the window. Can you do that? If so, take another $30,000 value hit for excessive regulations!
    Great job tanking your property values, Carpenter Village!

    I just sold a home in an HOA. Never again. If I need to buy land and live in a tent, that is what I will do.

    Someone needs to shut HOAs down....HOAs Could be useful, but in this kind of situation is ridiculous.

      @@skipbogard No. China has always been socialist since 1949. NPR is leftist establishment. However, both fascism and socialism believes in maximum government. You will find fascists and socialists jumping to each other’s camp easily if you study history independently
