Some HOA are very kid friendly - just remember check the rules and meet the board or become part of the board - HOA are wonderful if regulated correctly - CA is a great state that curbs HOAs but Texas - is another story

@@Hambone571 here in California - rule changes must be checked with Attorney or Escrow Board - it’s difficult and when they go bananas the HOA management company usually looses - We worked with an excellent real estate agent who always told us - In California - Escrow process details this - they will usually give you the HOA number to get see if your a good fit - I don’t know about other states but here in CA it’s part of your disclosures - first meeting with Escrow process 3 weeks before mortgage process

To leave your parents, raise your own family, and escape landlords and roommates. Then HOAs manage to insert themselves into your life and you're back to square one. They cant make you pay for their lawyer fee's... They can try and sue you with a counter suit but they wont get it for that reason alone... They will need a good reason for a counter suit or they wont have a case because judges will toss out any small petty case like that because your lawyer can always fight the counter and drag the court even longer. If they ever do that and get it, then the judge was paid off and or your attorney sucks really bad. If you speak the truth then they must of had a good reason and proof of you wasting their time and cost for no good reason.
Forget about reading the rule of no kids playing in the common area in the CC&R. Most likely, it is not in the CC&R. The HOA may just put a notice on the notice board for a couple of days saying, for example, Parents allowing children to play in the common area with excessive noise are subjected to a fine of $100. Then the HOA thinks that's the law of the land. What pisses me off is that quite a few times we were disturbed by extreme loud car alarm that went on for as long as half an hour both in day time and at around 9 pm but the HOA never talked about it nor did it make any rule to impose a fine on the car owners responsible for the annoying car alarm. I have just expressed my discontent about this absurd situation to the HOA.
I’m guessing there’s more to this story. I assume the family dominated the common area and were most likely loud. Kids will be kids and it should be encouraged. However, I think it’s important for people to live in appropriate neighborhoods. Meaning, people who don’t like to be around other noisy people shouldn’t be in packed condo or townhouse settings. On the other hand, people with gaggles of kids probably should be where there is a yard or more room to be kids. People just need to be more self aware.
My grandmother had Narcissistic Personality Disorder. She would call police on her neighbors for anything - outdoor party, kids playing, someone driving too fast. She got enjoyment out of messing with people. These are the people typically on HOA boards. I have many more stories i’m leaving out.
my mom was like that too. i knew a guy a while back who had horror stories about his dad from his childhood. he was retired and his entire ambition became to lead the HOA board. these people are BATSHIT.
An HOA began where my mom lived and they wanted her to become a member, pay dues (for nothing but their rules) and OBEY their edicts. One day a fat man who was the 'king' threatened her. She threw them off her property, got retraining orders, issued trespass warnings and advised the others being bullied to do the same. She beat them in court, in public opinion and within weeks the GOA gang was begging for mercy. Later it came out they were using fees to pay for parties and improvements to their own properties.
My father, and a bunch of his friends started an HOA the difference being yes you had certain policies you had to follow. However, they also included lawn care and gardening service pest control, pool treatment, as well as exterior house cleaning included in the HOA due the community was very close, and if someone wasn’t following, the rules, neighbors would go up to them and say directly. Hey, you really shouldn’t do that Try to fix it. once my father and his friends left and other people took over the HOA it all fell apart
HOA's are usually found in large planned communities. These are usually safer for families, and have more consistency in the quality of the homes. Dealing with annoying regulations is just the price for that.
Also for those who plan on investing in your bought home where the property value is concerned. Value won't be as great if your neighbor isn't caring about his home as much as another who cares.

You people act as if every neighborhood outside of an hoas control has sevral of "those" thpes of neighbors (unkempt lawns, derelict cars, moonshine still in the front yard etc.). Homes in hoa neighborhoods gain valur (aka: appreciate) at a far slower rate than those in an independent neighborhood.

My daughter’s HOA threatened to fine her $500 every my grandson played outside. Once HOA realized my daughter’s knowledge of the Fair Housing Act, they backed off.
I lived in a HOA with my parents and it was a NIGHTMARE. They are very evil and money hungry. I'm not even joking. We were so quiet and never caused trouble and yet they would constantly send us penalty letters for made up stuff we didn't do. And you have to pay it or get kicked out of your own home. They think they own every house and the 'owners' are under their authority. I will never ever buy a house with an HOA.

The kids behind my house scream at the top of their lungs when they play outside. I would prefer that i didn’t have to hear it but then I remember how much fun I had playing outside with friends as a kid and then I get over it. It’s part of life, let kids be kids. So what if there is noise outside.
My kids can be noisy too even in the house. I tell them to tone it down and that last all of 30 seconds lol. But seriously when I get annoyed I think of them having to be at school all day, where they are required to sit down and be quiet. Kids need an outlet to run and play and yes be loud sometimes.

We were fined and had to fight our case because we repainted the deck and they said it was the wrong color. Turned out, it was just a brighter white because we had painted more recently than any other owner. HOA are all about the 💰

I paid the mortgage, taxes, HOA dues but were not allowed to grow some roses. Hence the HOA owns the house not the people paying the bills. So we moved and no HOA and we can grow flowers if we want to or not. I finally feel like a home owner.

The lawsuit won't go anywhere and here's why. HOA attorneys love conflict and lawsuits because lawsuits equals more money. The HOA has much deeper pockets and can afford a lengthy and expensive lawsuit. The former residents will likely have to cut their losses at some point because of the increasing expense of fighting an HOA that they no longer live in anyway. Believe me I know from from first hand experience. At the HOA where we used to live things got so out of control that we could have easily filed a civil suit against the Board members for defamation and harassment. Ultimately it wasn't worth the time, hassle and expense. Instead we led a recall effort that saw the entire Board removed after which we decided we had had enough of HOA life and moved to a non-HOA neighborhood. HOA's are an abomination that should be banned.
This is a very wrong assessment in this instance. Because this is a federal Fair Housing Act case. It’s not a simple state HOA issue. They’re subject to federal investigation and serious repercussions to include licensure, HOA disbanding and a host of others. I know. I’ve helped prosecute several right next door in NV😁

When you receive a lease you can take that lease to your lawyer and edit out sections you disagree with. If your lease states that you can be evicted for not paying HOA fines or fees. You are perfectly with in your rights to have that entire section removed from the lease. I have removed HOA clauses from leases, lowered the monthly payment and had the community leasing agent sign the edited lease without reading it. So if I can get away with it so can you. Don't take any shit from an HOA.

Fined for garage door left open for about 15 min, fined for my grandchild leaving a toy truck left in the grass while he came in for lunch, fined for my motorcycle being to noisy in my garage. My neighbor plays very loud music when she arrives to her house at odd hours then sits in her car for 30mins replaying “her jam” I once walked outside and asked her to turn it down please, her reply “ Are you gunna make me! I can do whatever I want!” the whole neighborhood can hear her music. She’s a renter hopefully she’ll move soon.
Parents knew what they were signing up for. In order to live where the parents want to live, they need to discipline their kids or move out. Really no reason for a bunch of girls to run out of their home screaming every time a team makes a point.

As someone who has lived next to kids that were terrors and parents that couldn’t have cared less I’d be interested in hearing the other side of the story.
I feel bad for the family but I’m wondering how loud those kids were. Yes kids get loud but for how long? I use to live next door to a family of 5. They were always loud and it was worst when they had other kids over. Just constant noise. Even at night. Even the dad looked miserable. He would sit outside in the back after work while his kids ran through the house. You could hear them from outside. Constant yelling and screaming.
I understand why they this happened. I lived in an HOA community and the kids were a constant problem mostly because none of them were being monitored and allowed to do what they wanted which included running in front of people who were driving intentionally. They climbed trees and fences in the common area and even stole packages and vandalized property. And this was a nice community.

Kids can be extremely noisy, I'm in the 10th floor and when I have window open in summer some scream so loud I can't focus on work, imagine what it's like on the first or second floor...

No, it doesn't. It is meant to address people who don't consider the impact noise makes on others. Nobody forced them to live in an HOA. I have lived in them for years, with kids and had no trouble. My son had 11 friends in our little HOA. They had a park set aside for them to play. I made sure of where they could play etc., before buying.. They played football, baseball, basketball. We had their parties there. They just hung out there. When they wanted to get rowdy, it was in the park. If it ever got too loud for more than 5 minutes, one of the mom's or dad's would call out and ask them to quiet down. They did. Yes, the PARENTS did it!!! What a concept!!! Those kids are still friends today - from age 5 to age 30. ALL of them have the fondest memories of our neighborhood. They loved growing up there. It's up to YOU to decide if your kids have enough space to play before you buy in an HOA. If your kids are extremely LOUD, they probably should not live in an HOA. Everyone would be happier if they didn't.

The problem with seeking to address matters with an HOA is that doing so often ends up consuming a good bit of time, emotional energy and money. HOAs are generally not worth it, in my opinion.

The closer you get to a city the more youre likely to live in a subdivision. Dont do it! Sometimes its worth the commute to live in a more rural area for your peace of mind and free from HOA torment. A house where you have a few acres and can hardly see your neighbor from the porch is a beautiful thing.
These types of parents are oblivious to the noise/disturbances kids make when playing. They should not be screaming and running amok. This is why you take your kids to a park to play. I totally get this. Nobody wants to hear brats running around. It's common sense and the HOA is totally right on this front. Kid's don't belong in Condos/Apartments. Having your brats running outside screaming is SO rude.

In college I rented a room in a townhouse. I was told to tell neighbors I was a cousin because a neighbor wanted to know who I was to the owners. The homeowners were harrassed by hoa for the baby crying or the mom putting a ninja turtle window cling in the baby's window or kids toys on balcony. Totally ridiculous.

I am not defending the HOA(I hate them with a passion), but funny enough I lived in San Diego which is near the area in the video with very similar laid out neighborhood. The way the building and the “common” area is set up, the echoes are very profound. I can only imagine if bunch of kids are screaming their lungs out and always playing with toys, it would drive the other neighbors crazy! One time, when I was walking my dog, I noticed that one of my neighbors were getting it on. I guess they had their window slightly open and the moaning was echoing throughout the street lol. Very difficult to be ignored. High five to that couple!
I want the other side of the story. My gut feeling is that these kids are out of control. There is a reasonable person standard for how loud kids can be when playing and it varies depending on if it's at the HOA playground vs the common area near the garages or the actual townhouse. Would you want screaming kids outside of your bedroom window down in the garage area while on a Zoom work meeting? These parents are what we would call Karens in modern lingo and they should GTFO.
Back in 2003 I worked as a 'groundskeeper' for two years at an HOA community in Laguna Niquel CA. I was hired by a friend of mine who had purchased a townhouse in the community. She got onto the landscaping committee and she wanted to turn the community into a 'pesticide and herbicide safe zone.' Anyway, little did she know that a realtor was purchasing townhouses using straw-buyers and flipping them. The realtor didn't want the community to be a 'pesticide and herbicide safe zone.' She wanted full-on spraying. Anyway, a sort of mini-war broke out between my friend and the realtor with both ladies lining up homeowners on their side of the arguement. The realtor had her clique march around the community with signs like "He's not spraying' and 'He's destroying our property values" -- he being me. My friend had her followers marching with signs like "They want to kill the bees" and "spraying is toxic to your pets." Finally, things got so bad that there was recall election against my friend -- and she lost. I was immediately fired and my friend was hounded out of the community by the opposition folks. But what really made her move was the day after I was fired a company came in and sprayed the heck out of the community. Guys were walking around in haz-mat outfits with long hoses and using spray marked with blue dye to spray everywhere. The place looked some kind of blue-dyed warzone after they got through. My friend put her townhouse up for sale and got out there as fast as she could.
Your friend was most certainly the intelligent one in that community. Would be interesting to see the stats on medical issues incurred in that sector. It is always astounding how many folk's will fight for their impending doom. Prayers and Blessings for you and your friend.
I always say when I see HOA communities-- well , you can’t eat from that yard. Growing perfect grass will not feed them ! I grow organic food - my yard blesses me.
We bought a brand new house gated community. The first 2 months we moved in we got a letter from HOA that we couldn't park our car on the street right in front of our house. Then we another letter came in the mail, we couldn't park in own our driveway. They said we have to park our cars in the garage only.
I remember one time a weed was sticking out on to the sidewalk and they didn’t warn me but instead sent me a letter saying I’ve been fined for $50 for that one weed lose to the sidewalk. HOA are a fucking nightmare

The complex is obviously NOT an over-55 area which expressly excludes children so children are allowed. The people living there need to put up with them - at least during the daytime. These families will win the lawsuit.

Yes and no. Planned communities usually have designated play areas away from the living units. There is no reason for your child to be screaming right under someone else's window. They said that there were parks and such nearby...that's a perfectly appropriate place for noise.

I live in a HOA who feels like most people do. Kids should play, however, if they go screaming out side your house, that's total bullshit. I had to deal with this shit for over a year. HOA did nothing about it. The guards did nothing about it. I was happy as hell when they moved out. I'm now buying that home. And loud ass kids are not welcomed.
The neighbor, who screamed at the children should also receive the same warnings and the same threats for making noises by screaming at the children. Fair is fair.
There was a column in the paper where i lived written by a housing attorney. You could write in and ask him questions. 90% of the questions were complaints about hoas and asking what could be done. His answer was always the same: get a copy of the bylaws and covenants and if what youre complaining about is in those bylaws and covenants and you signed them (which you have to do before you buy your house ) then you have no recourse because you agreed to them.
Exactly! Everybody likes and agrees with the bylawas until it doesnt suit them anymore. People should live in comunities that fit their families because these bylaws must be enforced so everyone can keep that aesthetic they liked when they purchased. If you dont agree, dont sign saying that you do.
Our HOA had one set of rules when we moved in but they've had board meetings and a change of directors and they change the rules so just because you signed the first rules doesn't mean that they won't change the rules.

I love kids but some often are a nightmare because parents don't educate kids, instead shove technology down their throats as substitute. Last year I had to complain because it was 3am and the kid was running all over the place and parents were watching tv like nothing is happening. I went upstairs and told them dudeee its 3 am have your kid stop running in the apt at this time, I have an in home test tomorrow at 9 am. Guess what at 9 am they had their kid make more noise same as them just to annoy me. Teach your kids to behave for Gods sake, there a place and time

I’m so glad I live outside a hoa they wanted to join because my house is so close to a gated community and threatened me if I didn’t good think my high school best friends was the country judge and helped me but here’s some advice there is a lot better places to raise your children beside these housing developments and if you do live in a development with a hoa sell your home as fast as you can and give a copy of the bylaws to realators so they now most of the time hoa’s don’t give them a copy also tell your neighbors what’s going on the more people leave the faster they change the rules
First impression is that this seems like a good place to live. It respects the rights of all residents to quiet enjoyment of their homes. Second, these people are lying. If they just wanted to resolved their case, they'd just go to court. The only reason to call TV is to try to wage PR war, hoping to gain some advantage. The HOA can't discuss the details because of privacy regulations, but these people are free to lie all they want on TV and face no penalties. Third, 1:40, the woman says that the demand to "cure the problem" meant getting rid of the children. She's clearly misrepresenting the reality, which is to have the kids play inside, not play in the common areas (liability issues) and teach them to monitor and maintain their noise level when playing in the yard. That she is deliberately misrepresenting a reasonable request strongly suggests she's lying. Finally, their lawyer is full of shit, you know, because he's looking for a fat payday.
I wish our HOA took a similar view about noisy neighbours. We are surrounded by barking/howling dogs and the HOA say there is nothing they will do about it. They refused to even drop a polite note to the relevant dog owners. When I went round to see our neighbour about his dog (it was almost midnight & it was still at it), I was verbally abused and he (the neighbour not the dog) deliberately broke our mailbox, costing us over $300 to replace it. The police came out but wouldn't do anything unless we pressed charges. We declined as it would have cost us even more in the long run. Our HOA is more concerned about the colour of residents' lawns than anything else. They are against artificial turf (there is a water shortage where we live) and solar energy (their opposition to which goes against federal law).
Thats awful! Thats why i always tell our property manager from the property management company we pay our dues to, that she must be the mediator and send noticed herself. She must confront neighbors, even though she tried to wiggle out of doing that by asking us to. What sre we paying her to do, then? Do she now does that because going to talk to your neighbors always ends badly. She also sends someone to check oit our properties and she enforcess our bylaws. Barking dogs and loud kids are a nuisancem we email her everytime with a complaint. So staying on top of her making sure she does her job is most important first or the HOA thing doesnt work.
Only a joy to people with houses in neighborhoods with houses. There are reasons why people live in condos. Mowing and maintenance isn’t the only thing people want to avoid and the reason this family is no longer there.
Sounds of fun and laughter, yes...that's when it's pleasant, they should be outside playing. But not when they scream...literally scream and bicker the whole time or cuss each other out. If you're also at home working all day its stressful. Walmart is a great place to go if you want a dose of kids screaming to the top of their lungs on the other end of the store...home is supposed to be a sanctuary. Kids can be taught respect and consideration while having their fun. We did as kids.
There should be other side of the story. People living in close proximity should be respectful to the peace and quietness of the neighborhood. Kids can play in the park, there should be no blasting music and loud parties. People prefer quietness and it is never too much.

Though I hate HOAs and made sure I don't have an HOA when I got my home, but this time I would side on the HOA if they had such rule.
Yup, people knew the rules and bylaws existed, they only dont like it when it doesnt suit them anymore. We live in an HOA community, but I only buy into the ones where rhe bylaws i agree with and it works out. Our subdivision looks new still because of it. Its a choice, if you dont agree, dont sign papers saying you agree then move in and try to change what everybody else agreed on.

If the children are watching a sports show on tv indoors why on earth would they all run outside to cheer? Makes no sense, it sounds like they were all just being deliberately provocative when they were already aware they were supposed to keep noise levels down. There are 6 units in my 8-unit building that are owned by members of the same extended family. All 6 have kids, and they use the indoor common areas (entranceway, stairs) as their private playground. Sometimes they keep the doors to their units wide open, the easier for the kids to run from one to the other. I *wish* they would play outside and make all the noise they want! It would be an improvement!

Other laws state that after 9am and before 10pm noise is part and parcel of living life. Anything outside of those time periods then yes get warning notices
I definitely got screwed by my HOA. Mariners island condo association in San Mateo, CA. When I first bought my monthly was $170. By the time I left, HOAs went up to $500 and the market value had not increased proportionately. Ridiculous for a small 700+ sf condo. When I went to association meetings to complain, the HOA committee (all old retired geezers with nothing better to do) chastised me and bullied me. The HOA fees were meant to benefit the homeowners in the current period. However those old geezers were stockpiling our money for their future benefit. I finally had to move after 9 years of being literally stolen from. Don’t buy in that community. We never even saw any benefits to the fees we were paying. A pool that was open a few months a year and not excessively pristine, hall vacuuming. That’s about it. Oh wait. They re-did the landscaping one year. The new landscaping looked exactly like the old landscaping 😖. Also for people who don’t live in the sf Bay Area, often for a first home buyer a small condo is all you can afford. Most condos have HOAs. The solution is to have perhaps a regulatory body overseeing HOAs and homeowner complaints and ruling on them. The body would be solely funded by HOA fees. Perhaps this sounds counter intuitive. But maybe in the long run it would actually reduce these types of criminal activities.

They cant make you pay for their lawyer fee's... They can try and sue you with a counter suit but they wont get it for that reason alone... They will need a good reason for a counter suit or they wont have a case because judges will toss out any small petty case like that because your lawyer can always fight the counter and drag the court even longer. If they ever do that and get it, then the judge was paid off and or your attorney sucks really bad. If you speak the truth then they must of had a good reason and proof of you wasting their time and cost for no good reason.

Forget about reading the rule of no kids playing in the common area in the CC&R. Most likely, it is not in the CC&R. The HOA may just put a notice on the notice board for a couple of days saying, for example, Parents allowing children to play in the common area with excessive noise are subjected to a fine of $100. Then the HOA thinks that's the law of the land.
What pisses me off is that quite a few times we were disturbed by extreme loud car alarm that went on for as long as half an hour both in day time and at around 9 pm but the HOA never talked about it nor did it make any rule to impose a fine on the car owners responsible for the annoying car alarm.
I have just expressed my discontent about this absurd situation to the HOA.

I’m guessing there’s more to this story. I assume the family dominated the common area and were most likely loud. Kids will be kids and it should be encouraged. However, I think it’s important for people to live in appropriate neighborhoods. Meaning, people who don’t like to be around other noisy people shouldn’t be in packed condo or townhouse settings. On the other hand, people with gaggles of kids probably should be where there is a yard or more room to be kids. People just need to be more self aware.
My grandmother had Narcissistic Personality Disorder. She would call police on her neighbors for anything - outdoor party, kids playing, someone driving too fast. She got enjoyment out of messing with people. These are the people typically on HOA boards. I have many more stories i’m leaving out.

my mom was like that too. i knew a guy a while back who had horror stories about his dad from his childhood. he was retired and his entire ambition became to lead the HOA board. these people are BATSHIT.
An HOA began where my mom lived and they wanted her to become a member, pay dues (for nothing but their rules) and OBEY their edicts. One day a fat man who was the 'king' threatened her. She threw them off her property, got retraining orders, issued trespass warnings and advised the others being bullied to do the same. She beat them in court, in public opinion and within weeks the GOA gang was begging for mercy. Later it came out they were using fees to pay for parties and improvements to their own properties.
These were condos.

My father, and a bunch of his friends started an HOA the difference being yes you had certain policies you had to follow. However, they also included lawn care and gardening service pest control, pool treatment, as well as exterior house cleaning included in the HOA due the community was very close, and if someone wasn’t following, the rules, neighbors would go up to them and say directly. Hey, you really shouldn’t do that Try to fix it. once my father and his friends left and other people took over the HOA it all fell apart
Why would anyone buy property with an HOA ?
HOA's are usually found in large planned communities. These are usually safer for families, and have more consistency in the quality of the homes. Dealing with annoying regulations is just the price for that.
Also for those who plan on investing in your bought home where the property value is concerned. Value won't be as great if your neighbor isn't caring about his home as much as another who cares.

We were fined and had to fight our case because we repainted the deck and they said it was the wrong color. Turned out, it was just a brighter white because we had painted more recently than any other owner. HOA are all about the 💰

The lawsuit won't go anywhere and here's why. HOA attorneys love conflict and lawsuits because lawsuits equals more money. The HOA has much deeper pockets and can afford a lengthy and expensive lawsuit. The former residents will likely have to cut their losses at some point because of the increasing expense of fighting an HOA that they no longer live in anyway.
Believe me I know from from first hand experience. At the HOA where we used to live things got so out of control that we could have easily filed a civil suit against the Board members for defamation and harassment. Ultimately it wasn't worth the time, hassle and expense. Instead we led a recall effort that saw the entire Board removed after which we decided we had had enough of HOA life and moved to a non-HOA neighborhood.

This is a very wrong assessment in this instance. Because this is a federal Fair Housing Act case. It’s not a simple state HOA issue. They’re subject to federal investigation and serious repercussions to include licensure, HOA disbanding and a host of others. I know. I’ve helped prosecute several right next door in NV😁

My family and I live in a beautiful SAFE and clean subdivision with no HOA. This is an absolute BLESSING from GOD.
When you receive a lease you can take that lease to your lawyer and edit out sections you disagree with.
If your lease states that you can be evicted for not paying HOA fines or fees.
You are perfectly with in your rights to have that entire section removed from the lease.
I have removed HOA clauses from leases, lowered the monthly payment
and had the community leasing agent sign the edited lease
without reading it. So if I can get away with it so can you.

As someone who has lived next to kids that were terrors and parents that couldn’t have cared less I’d be interested in hearing the other side of the story.
I feel bad for the family but I’m wondering how loud those kids were. Yes kids get loud but for how long? I use to live next door to a family of 5. They were always loud and it was worst when they had other kids over. Just constant noise. Even at night. Even the dad looked miserable. He would sit outside in the back after work while his kids ran through the house. You could hear them from outside. Constant yelling and screaming.
I understand why they this happened. I lived in an HOA community and the kids were a constant problem mostly because none of them were being monitored and allowed to do what they wanted which included running in front of people who were driving intentionally. They climbed trees and fences in the common area and even stole packages and vandalized property. And this was a nice community.

No, it doesn't. It is meant to address people who don't consider the impact noise makes on others. Nobody forced them to live in an HOA. I have lived in them for years, with kids and had no trouble. My son had 11 friends in our little HOA. They had a park set aside for them to play. I made sure of where they could play etc., before buying.. They played football, baseball, basketball. We had their parties there. They just hung out there. When they wanted to get rowdy, it was in the park. If it ever got too loud for more than 5 minutes, one of the mom's or dad's would call out and ask them to quiet down. They did. Yes, the PARENTS did it!!! What a concept!!! Those kids are still friends today - from age 5 to age 30. ALL of them have the fondest memories of our neighborhood. They loved growing up there. It's up to YOU to decide if your kids have enough space to play before you buy in an HOA. If your kids are extremely LOUD, they probably should not live in an HOA. Everyone would be happier if they didn't.

The closer you get to a city the more youre likely to live in a subdivision. Dont do it! Sometimes its worth the commute to live in a more rural area for your peace of mind and free from HOA torment. A house where you have a few acres and can hardly see your neighbor from the porch is a beautiful thing.

These types of parents are oblivious to the noise/disturbances kids make when playing. They should not be screaming and running amok. This is why you take your kids to a park to play. I totally get this. Nobody wants to hear brats running around. It's common sense and the HOA is totally right on this front. Kid's don't belong in Condos/Apartments. Having your brats running outside screaming is SO rude.

In college I rented a room in a townhouse. I was told to tell neighbors I was a cousin because a neighbor wanted to know who I was to the owners. The homeowners were harrassed by hoa for the baby crying or the mom putting a ninja turtle window cling in the baby's window or kids toys on balcony. Totally ridiculous.
They lived there knowing the rules.

I am not defending the HOA(I hate them with a passion), but funny enough I lived in San Diego which is near the area in the video with very similar laid out neighborhood. The way the building and the “common” area is set up, the echoes are very profound. I can only imagine if bunch of kids are screaming their lungs out and always playing with toys, it would drive the other neighbors crazy!
One time, when I was walking my dog, I noticed that one of my neighbors were getting it on. I guess they had their window slightly open and the moaning was echoing throughout the street lol. Very difficult to be ignored. High five to that couple!

I want the other side of the story. My gut feeling is that these kids are out of control. There is a reasonable person standard for how loud kids can be when playing and it varies depending on if it's at the HOA playground vs the common area near the garages or the actual townhouse. Would you want screaming kids outside of your bedroom window down in the garage area while on a Zoom work meeting? These parents are what we would call Karens in modern lingo and they should GTFO.

Back in 2003 I worked as a 'groundskeeper' for two years at an HOA community in Laguna Niquel CA. I was hired by a friend of mine who had purchased a townhouse in the community. She got onto the landscaping committee and she wanted to turn the community into a 'pesticide and herbicide safe zone.' Anyway, little did she know that a realtor was purchasing townhouses using straw-buyers and flipping them. The realtor didn't want the community to be a 'pesticide and herbicide safe zone.' She wanted full-on spraying.
Anyway, a sort of mini-war broke out between my friend and the realtor with both ladies lining up homeowners on their side of the arguement. The realtor had her clique march around the community with signs like "He's not spraying' and 'He's destroying our property values" -- he being me. My friend had her followers marching with signs like "They want to kill the bees" and "spraying is toxic to your pets."
Finally, things got so bad that there was recall election against my friend -- and she lost. I was immediately fired and my friend was hounded out of the community by the opposition folks. But what really made her move was the day after I was fired a company came in and sprayed the heck out of the community. Guys were walking around in haz-mat outfits with long hoses and using spray marked with blue dye to spray everywhere. The place looked some kind of blue-dyed warzone after they got through. My friend put her townhouse up for sale and got out there as fast as she could.
Your friend was most certainly the intelligent one in that community. Would be interesting to see the stats on medical issues incurred in that sector.

The complex is obviously NOT an over-55 area which expressly excludes children so children are allowed. The people living there need to put up with them - at least during the daytime. These families will win the lawsuit.

Yes and no. Planned communities usually have designated play areas away from the living units. There is no reason for your child to be screaming right under someone else's window. They said that there were parks and such nearby...that's a perfectly appropriate place for noise.

I live in a HOA who feels like most people do. Kids should play, however, if they go screaming out side your house, that's total bullshit. I had to deal with this shit for over a year. HOA did nothing about it. The guards did nothing about it.

There was a column in the paper where i lived written by a housing attorney. You could write in and ask him questions. 90% of the questions were complaints about hoas and asking what could be done. His answer was always the same: get a copy of the bylaws and covenants and if what youre complaining about is in those bylaws and covenants and you signed them (which you have to do before you buy your house ) then you have no recourse because you agreed to them.
Exactly! Everybody likes and agrees with the bylawas until it doesnt suit them anymore. People should live in comunities that fit their families because these bylaws must be enforced so everyone can keep that aesthetic they liked when they purchased. If you dont agree, dont sign saying that you do.
Our HOA had one set of rules when we moved in but they've had board meetings and a change of directors and they change the rules so just because you signed the first rules doesn't mean that they won't change the rules.

I love kids but some often are a nightmare because parents don't educate kids, instead shove technology down their throats as substitute. Last year I had to complain because it was 3am and the kid was running all over the place and parents were watching tv like nothing is happening. I went upstairs and told them dudeee its 3 am have your kid stop running in the apt at this time, I have an in home test tomorrow at 9 am. Guess what at 9 am they had their kid make more noise same as them just to annoy me.

I’m so glad I live outside a hoa they wanted to join because my house is so close to a gated community and threatened me if I didn’t good think my high school best friends was the country judge and helped me but here’s some advice there is a lot better places to raise your children beside these housing developments and if you do live in a development with a hoa sell your home as fast as you can and give a copy of the bylaws to realators so they now most of the time hoa’s don’t give them a copy also tell your neighbors what’s going on the more people leave the faster they change the rules
First impression is that this seems like a good place to live. It respects the rights of all residents to quiet enjoyment of their homes.
Second, these people are lying. If they just wanted to resolved their case, they'd just go to court. The only reason to call TV is to try to wage PR war, hoping to gain some advantage. The HOA can't discuss the details because of privacy regulations, but these people are free to lie all they want on TV and face no penalties.
Third, 1:40, the woman says that the demand to "cure the problem" meant getting rid of the children. She's clearly misrepresenting the reality, which is to have the kids play inside, not play in the common areas (liability issues) and teach them to monitor and maintain their noise level when playing in the yard. That she is deliberately misrepresenting a reasonable request strongly suggests she's lying.
Finally, their lawyer is full of shit, you know, because he's looking for a fat payday.

We are surrounded by barking/howling dogs and the HOA say there is nothing they will do about it. They refused to even drop a polite note to the relevant dog owners.
When I went round to see our neighbour about his dog (it was almost midnight & it was still at it), I was verbally abused and he (the neighbour not the dog) deliberately broke our mailbox, costing us over $300 to replace it. The police came out but wouldn't do anything unless we pressed charges. We declined as it would have cost us even more in the long run.
Our HOA is more concerned about the colour of residents' lawns than anything else. They are against artificial turf (there is a water shortage where we live) and solar energy (their opposition to which goes against federal law).
Thats awful! Thats why i always tell our property manager from the property management company we pay our dues to, that she must be the mediator and send noticed herself. She must confront neighbors, even though she tried to wiggle out of doing that by asking us to. What sre we paying her to do, then? Do she now does that because going to talk to your neighbors always ends badly. She also sends someone to check oit our properties and she enforcess our bylaws. Barking dogs and loud kids are a nuisancem we email her everytime with a complaint. So staying on top of her making sure she does her job is most important first or the HOA thing doesnt work.

There are reasons why people live in condos. Mowing and maintenance isn’t the only thing people want to avoid and the reason this family is no longer there.
Sounds of fun and laughter, yes...that's when it's pleasant, they should be outside playing. But not when they scream...literally scream and bicker the whole time or cuss each other out. If you're also at home working all day its stressful. Walmart is a great place to go if you want a dose of kids screaming to the top of their lungs on the other end of the store...home is supposed to be a sanctuary. Kids can be taught respect and consideration while having their fun. We did as kids.
There should be other side of the story. People living in close proximity should be respectful to the peace and quietness of the neighborhood. Kids can play in the park, there should be no blasting music and loud parties. People prefer quietness and it is never too much.
the news is bit twisting the facts, yes children will be noisy in the house in the park etc... but if the common area is meant to be noise free, then it needs to be noise free. Though I hate HOAs and made sure I don't have an HOA when I got my home, but this time I would side on the HOA if they had such rule.
Yup, people knew the rules and bylaws existed, they only dont like it when it doesnt suit them anymore. We live in an HOA community, but I only buy into the ones where rhe bylaws i agree with and it works out. Our subdivision looks new still because of it. Its a choice, if you dont agree, dont sign papers saying you agree then move in and try to change what everybody else agreed on.

Makes no sense, it sounds like they were all just being deliberately provocative when they were already aware they were supposed to keep noise levels down. There are 6 units in my 8-unit building that are owned by members of the same extended family. All 6 have kids, and they use the indoor common areas (entranceway, stairs) as their private playground. Sometimes they keep the doors to their units wide open, the easier for the kids to run from one to the other. I *wish* they would play outside and make all the noise they want! It would be an improvement!

To be fair some HOA's are very tame then when new members are elected it can become a nightmare. I personally would never live in a neighborhood with an HOA no matter how relax the rules are.

Other laws state that after 9am and before 10pm noise is part and parcel of living life.

I definitely got screwed by my HOA. Mariners island condo association in San Mateo, CA. When I first bought my monthly was $170. By the time I left, HOAs went up to $500 and the market value had not increased proportionately. Ridiculous for a small 700+ sf condo. When I went to association meetings to complain, the HOA committee (all old retired geezers with nothing better to do) chastised me and bullied me. The HOA fees were meant to benefit the homeowners in the current period. However those old geezers were stockpiling our money for their future benefit. I finally had to move after 9 years of being literally stolen from. Don’t buy in that community. We never even saw any benefits to the fees we were paying. A pool that was open a few months a year and not excessively pristine, hall vacuuming. That’s about it. Oh wait. They re-did the landscaping one year. The new landscaping looked exactly like the old landscaping 😖. Also for people who don’t live in the sf Bay Area, often for a first home buyer a small condo is all you can afford. Most condos have HOAs. The solution is to have perhaps a regulatory body overseeing HOAs and homeowner complaints and ruling on them. The body would be solely funded by HOA fees. Perhaps this sounds counter intuitive. But maybe in the long run it would actually reduce these types of criminal activities.

yes. the HOA are criminals. they make reasons to charge some individual homeownwers . they even double charged me HOA fee. when I argued with them, they started to harge late payment fees. when I paid them without late payment fees, they used collection company, further charging more than 500$ collection fee, threatening to put a lien on my property. ... I’m pretty sure one of those neighbors that was doing the harassment moved into our neighborhood. They moved from a townhome in Carlsbad and the exact same stuff has been happening here since they moved in.
