      @@LostSoxIt was due to a plea deal between lawyers. Nothing to do with the judge or prisons. The lawyers wanted a speedy trial and maybe thought the state attorney would lose/didn’t have evidence the guy actually did it or whatever reason; they agreed to drop the heavier charge and the judge can only do so much after that (I think you are allowed to void a plea deal but are given only so many “veto” rights as a judge.)

      The problem is that he was allowed to plead to 2nd degree manslaughter. That implies the murder was an accident. It doesn't sound like there were any other charges, but there really should have been for battery and desecrating a corpse (with that picture he took!) Idk what the prosecution was thinking in this case, but I'm not too familiar with the details.

      The judge can reject the plea deal. . .he didnt have to allow it. Forces a trial and then when found guilty he can then sentence the defendant according to the guidelines of the charge he's found guilty of. The problem is the cost. . .its about dollars and putting the family/witnesses thru a trial. 99% of the time the family of the victimhas some say in the plea deal. Facts people, stick to facts not speculation.

This is false and I can't stand people misunderstanding the law like this and blaming the judge. No doubt in my mind with the words from the judge he wanted to give much worse problem is sentencing guidelines dictate what a judge can actually give. The crime he was convicted of it has a minimum of 4 and a max of 12. If the judge would have given him life in prison the case would easily be appealed and he would probably end up walking way sooner. No one doubts he should get life the judge doesn't doubt he should get life the problem is sentencing guidelines want the guidelines changed then contact the legislatures and get it changed. New York goes hard on petty crimes yet soft on major crimes New York is truly a cesspit that should be avoided at all costs.

      Its hardly a punishment he could be out in 4 years after murdering that ladies daughter, i too was surprised at the sentencing, i really thought all murders got a minimum of 25 years to life for murder in America, but as i have read different states different laws, perhaps it is time that the laws in each state were the same. In a different state he may have ended up on death row (which he would have deserved) i feel for the family and she looked such a pretty young girl.

      @sum body You are right, however so much of what goes on in the justice system is political . The judge has to weigh the cost of a trail against the possible outcome and with such an increase in crime or more people get caught due to technology. The courts are over burdened, the jails are over full and the judge is under a lot of pressure. So while the outcome does not fit the crime. What can society do? Maybe it is more important to spend tax dollars supporting the victims rather than punishing the weak minded criminals. IDK
