  • If your Illinois driver’s license is revoked for a DUI, you’ll need a to have a Reinstatement Hearing with the Secretary of State to get your license back.
    Also, if you had a DUI in Illinois and you cannot get a license in another state, you’ll need a Secretary of State Reinstatement Hearing. In this video, attorney Derek Martin from Driver Defense Team in Chicago discusses the three types of hearings - Informal, Formal, and Out of State. The process can be very confusing. And it is incredibly difficult to be successful at your hearing if you are not well-informed.

    What kind of court setting is this? If u get confused about ur history and accidentally lie, can you be held in contempt of court?

    Hi Derek
    I'm writing from illinois about having my license suspended due to a seizure episode I had in Jan. 2023.
    I got a letter from the Secretary of State in end of April 2023 letting me know my dr. had to fill out the medical clearance form for me to drive again.
    I saw her in June of this year and she approved me to drive again.
    I waited all of June, calling every week or so to check how my license reinstatement was going. They checked my form and told me it was still waiting to be processed.
    This past weekend, the end of June, I got a letter from the Secretary of State letting me know that I mailed documents to them the beginning of June, but that they (the forms), were not able to be located by them, with their apologies. They sent me another form to be filled out again by my dr. and their fax number to send to the medical review board...
    What is happening with my license??
    I need it really bad for work and such.
    I remember when I called in June they told me the medical board usually asks for more medical information too, besides my dr. approval?
    6 months for me is the end of July (the time I read most doctors say a patient should wait after a seizure to drive again). I feel 6 months is going to pass before they even get to my form!
    Could you give me yours thoughts and suggestions on this?

    hi, I was wondering if you could provide some helpful information. I watched your whole video and I liked your explanations, however I have a question about the reinstatement process. I have successfully completed a pro se out of state hearing and was granted reinstatement and have submitted the required SR22 waiver since im out of state resident now and I was wondering when I could expect to have the holds released from the reinstatement fees? I paid the SSS one last week and waiting on the state to document my insurance waiver to pay the revocation reinstatement fee. I was wondering how long it would take for the hold to actually be released so I can obtain a new license in my current state

      That's a very tough question to answer. I cannot tell you how quick the SOS will process the documents...especially since their operations are disrupted by COVID. Just keep calling the SOS and make sure they get it done!

    I had a dui in 2010 but I wasn’t convicted of it because I paid all my fines and had 6 months suspension with a baid device . In 2023 I caught another one but they list it as a first offender will I get my license revoked on the current one and would it count as a second dui in Illinois

    I was granted pretrial bond supervision by the judge during my first arraignment last month. My next court date is at the end of this month. Now I received my MDDP permit from the SOS, but the pretrial bond condition indicates that I can not drive without a valid license. I'm not sure whether the MDDP permit and the interlock device installed on my car are enough for me to legally drive…

      Yes they are. If you had an MDDP and were driving legally, there is no way that would be a violation of that bond condition. As your lawyer though.

    I live in So. Illinois...I haven't had a licence since 98..they are revoked. I'm totally lost as taking the first steps to try and getting them reinstated.I did try once in 02, but I wasn't prepared enough at the time of the hearing...22 years later. I feel it's time to try again. Could you give me just a little advise on that first step?

      Sounds like you need to have a hearing. Since you live in Southern Illinois, it's best to find a lawyer down there who does these. I think you can do it at Mt. Vernon or Springfield. We don't handle any down there but I can send you the names of some lawyers down there that do hearings if you send our office an email.

    i got my 2nd dui in 08 and have gone thru all classes and paid fines now i want to get my DL again, should i request a formal hearing now?

    Hi Derek, question for ya … I got my first OWI in Wisconsin last year 2020 while on vacation but I’m actually from Illinois. My license has been revoked since last year and still currently is. If I wish to reinstate my license in Illinois, do I have to do an informal hearing in Wisconsin or in Illinois? Thank you, any help is greatly appreciated.

      Good question. You need an informal hearing in Illinois since you have an Illinois license. We'd be happy to help. Plus there are a ton of good lawyers in Chicago that do the same.

    I got a question my license got suspended I got in a small Accident got caught with no insurance I got a insurance when I went to court I pay off the tickets. Got a letter saying that I needed sr22 before the deadline and my license wouldn’t be suspended,I called my insurance that I needed to get sr22 and they needed to notify the Secretary of State but they didn’t. Know I got sr22 after deadline. Can i restate my license,and would I need to pay a fee at the mva?

      Yes once you get SR22 and that is properly communicated to the Secretary of State, the SOS will remove the suspension.

    I got arrested for a dui in 2016 but was not convicted due to paying off my court fines and my license was only suspended for 6 months. I got another dui in June of 2019 and my license was only supposed to be suspended for a year but since I couldn't prove that I had sr22 it for revoked. I now have sr22 and I am wondering if I'm eligible for an mddp. What steps do you think I should take in my situation?

      If you receive a second DUI within 5 years, you're ineligible for a MDDP. So that might be the reason you can't get it. My best advice is to make sure you trust your attorney and they do everything they can to avoid a conviction on the DUI. Because that will revoke your license. Good luck!

    Where are the people on CZcams that have representated themselves? I talked to a lawyer earlier, and told him that I wanted to file for full reinstatement, and then file again after failure. He looked at me, like doctors look at me when i ask them to name 3 ingredients in vaccines. Integrity in the "justice" system would be lovely

    I was military and was stationed in IL and got an IL license in order to drive. I moved to VA and got a DUI. I completed all the VA requirements in order to get my license. Since I was never a "resident" of IL, can IL have a hold, in the NDR, on my ability to obtain a license in order to work?

      Illinois can report the ticket back to your home state where you have your drivers license. Then that home state can suspend you. So yes you still need to take care of out of state tickets.

    Hi Derek, I have a question. So 2 speeding tickets in Indianapolis (where I go to school) now my license is suspended in Illinois. Now I’m trying to get restricted driving permit. Will I be able to drive in Indianapolis with that permit?

      Yes you would be able to drive in Indiana with that Restricted Driving Permit.
      But I’ll tell you right now, by the time you actually get the permit, your suspension will probably be over. Instead, contact an Indianapolis lawyer and see if they can re-open one of the tickets and get it removed.

    Hello. in 2014 I got a DUI in Indiana while I still had my Illinois license. I just turned 30 a few days ago, and went to renew my Indiana license but Illinois has revoked my license from the earlier charge (Even though I've been driving without incident for 6 years). If I get the DUI expunged in Indiana, does that bypass all the hearing requirements or are they unavoidable? Thank you so much it's been very difficult finding this information.

      You cannot expunge the Illinois DUI in Indiana. You'll likely need to have a hearing with the IL SOS. But go ahead and call our office or any Illinois lawyer that does SOS hearings.

      Now your license is revoked and you’ll need to show a track record of sobriety and have a formal hearing at the Illinois Secretary of State if you ever want to have an IL DL again.

    I lived and got my first dui in 1998. Then moved to Indiana and had an Indiana license, then in 2008 in got my second dui in Cook County. I was convicted in 2010 and have been revoked since.. it's been 11 years and I've been sober for 8. Do I still need a hearing 11 years later?

      Yes you absolutely need a hearing. It doesn't matter how much time has passed. The only way you'll get a license in Illinois is by having a formal Secretary of State hearing.

      You’ve got that backwards. People who have an IL DL then move to another state need out of state hearings.
      If you have an ongoing DUI case in Illinois, you need a lawyer to defend you. Figure out what county your case is in. Then hire an experienced DUI lawyer in that county.

    If I’m eligible for a license in ga where I’m currently stationed will I be able to get a license in gorgia if it is revoked in Illinois or do I have to do the hearing to get the revocation first

      You’ll have to ask Georgia to know for sure. But I strongly suspect that Georgia will see that IL has a hold on you and you’ll never get a GA license until you clear the IL hold.

    Hey there, I have questions and help. I got traffic ticket in Chicago and I went to court and they put it half for me but I didn’t set up monthly payment. Now they called me and lemme know the price is double. Now my question is, can I go to court again to reduce the price or there’s another way to reduce the price? Thanks

      If the case is in the Chicago area, the courts typically do not give you back your physical driver's license until you've paid all your fines & fees in full.

      Nobody monitors it in real time. But if you get pulled over and ticketed outside of your permitted time, you're likely going to lose your RDP.

      If you have an IL address, you'd need an in-state hearing. But if you're a TN resident, you may be eligible for an out of state SOS hearing.

      Sounds like you may need an out of state hearing. If you’ve been without a license that lot, the prep work may be a lot. But the hearing itself will be easy. You wouldn’t even have to come to IL probably.
