I don't understand digging for the papers! I have my insurance/registration in the little state farm plastic sleeve, right on my visor, ID in my wallet beside me on the seat! It must be a weird feeling being a law enforcement officer being under investigation for DUI. So far, every reaction you guys have done where a law enforcement offi er was being invested that I saw, the officer did the field sobriety test. It seems they would know better.

EMS isnt giving him water in the event he needs surgery for an injury. He needs to be medically cleared by an ER doctor before he can be given water or anything. He is being an absolute idiot. If he is only requesting water that doesn't sound like a medical problem. Btw I'm a Paramedic, RN, and a 3L. So I understand this and a bunch of other situations from multiple angles minus this dude doing the crap he did tonight. Just refuse the field sobriety, stop being evasive, etc.

As someone who works for a large healthcare provider in the southwest, I can say that he can refuse medical treatment once he gets to the hospital. That is one of his rights, and it MIGHT get him out of a blood draw, at least by medical staff for diagnostic purposes. This would stop all medical care, because no hospital staff is going to administer any treatment without knowing what's in his system. And that also means he's probably not getting water, either. Now, when he gets to the hospital, can the police request a blood draw and tox screen? I don't know. I'm not a care provider, so my annual classes didn't cover that scenario. I'd say outside of state law addressing that scenario, HIPAA would probably trump the officer's request and the officer would need a warrant for the blood draw. (Yes, kids, just because HIPAA says you get to decide who sees your medical records doesn't mean that under no circumstances can law enforcement seek your medical records. A judge can issue a subpoena to open your medical records to law enforcement.)

Uhg, The following needs to be on a card that is handed out when people get their driver's license: "Know your numbers: 4 - You have the right to be secure in your persons, possessions, and papers. If they ask for your permission to search your car, you can tell them NO. 5 - You have the right not to self incriminate you. That means keeping your fool mouth shut and not answering any question or statement that is outside of establishing your identity. It also means you do not have to do the Roadside Sobriety Test and/or the Portable Breathalyzer. 6 - You have the right to an attorney AND if you can't afford one, the state shall provide you with one. Any question and/or statement outside of "Sir/Madam, what is your name?" should be directed to a lawyer. (Mind you, they won't get you one at the side of the road.) These are part of your constitutional rights. Exercising them does not indicate guilt or innocence. It means you know your rights and know how to use them."
