How do you know what the VA is looking for when it decides these unemployability claims? How do you get started with your IU claim? Not able to work because of your VA disability? I am 100% disabled with social security , for chronic depressive disorder. Diagnosis made by VA psych. Secondary to diagnosis to which VA gave me 30%.. they denied disability for depression. I'm going to reapply, thank to you guys.

I have TDIU since 2015, 70%PTSD 70%TBI combat related are the main reasons. Also I'm scheduled SMC level 5. In my case, I cant work based on my housebound status. My only other hope for extra income is Social Security in addition to my VA rating.

I wish I had found this channel sooner. I was discharged in 2005 and JUST started getting benefits for PTSD in 2022. I go to sign papers to receive TDIU this afternoon and I can't sleep because I'm so excited to finally be able to get a car and take my girls to cheering practice and tumbling. Being able to do things like that is gonna make SUCH a difference in my life.

before i quit my job in 2018 due to worsening of ptsd, and i was 700 a month and i was denied IU and even though i'm at 90%, they told me that i could still work even though i wasn't working. Seems to me I was duped.
What I had stop working in other words I was not able to work started in 2009 started filling with va in 2006 and SSN disability in 2009 was having muscle spasms and body lock up from waist down and still having them and was told that I was total and permanent disability in 2015 and was never told about it until 2021 and didn't know anything about unemployment disability

I have a question?I have been diagnosed with PTSD a couple years ago Vietnam combat veteran.They evaluated 70% and ended up giving me 100% TDIU. I'm 72 and I thought that the nightmares and irritability were just part of life nothing to do with Vietnam(wrong).My question is my disability check is very important to me to survive, so I can't afford financially or physically to lose it.At my VA, the primary doctor(I've gained 40# in 3 years) and Psychiatrist after discussion with me, both think it would be a great idea for me to seek a 12 hour or so 2 day weekly job at a golf course(I like golf) outside work for my physical and mental well being.My question is would this $100.00 a week job jeopardize my benefits in any way?Even though both doctors agree some work activity would be great for my well being.Has there be any precedence on this certain issue that doctors at the VA recommend some work activity without losing my benefits.My Interview is on Monday,I don't want to look like a fool!

Hello. Thank you for this video. I hope you will be able to answer my questions. First, how long does it take for a TDIU application to get denied/approved? Also, I had my C&P exam and received a notification to apply for TDIU, but I am still working. If I apply and get approved, do I have to quit immediately or is there a grace period the VA gives you before I have to quit. TDIU will help me tremendously due to my disability, but I am in the process of obtaining a VA Home Loan and any changes to my income will make things so complicated so I am not sure what to do.

Question, if a veteran has 100% TDIU P&T (Permanent and Total) can the veteran do side hustles like (door dash or grubhub). I understand 100% TDIU is a decent amount of money but sometimes the veteran wants to get out of the house and do a few things here and there. Is this advised against? Or is something small like this okay? As long as you don’t make over $12,000 a year?

I was disabled completely in 2007 via the VA and secular means. I began drawing SSA disability. I applied for VA disability TDIU in 2010 as not being able to work via migraines, COPD, back issues. I have been turned down for TDIU and now my case is in Wash DC. It has taken 11 years so far. I didn't realize that VA would take so long. The migraines from a mortar attack in Vietnam. COPD from Agent Orange, and PTSD from Vietnam. Back issues related to a leg injury at Fort Knox. Now I have GERD and Sleep Apnea. All related to service. I should have received TDIU 11 years ago. My attorney keeps saying it is a wait. Now I'm 80% but still having problems

So if my “family member” owned the fortune 500 company it would be OK Because family members are more likely to be understanding? If a company offers the same accommodations as a family member would, then what difference does it make if you’re working for Oracle or if you’re working for Mr. Schmidt’s family owned painting company?

Hello. I am a retired federal employee. Not Militarily retired but Civil Service. I want to work but migraines hit me too frequently. I'm considering applying for IU. With a retirement income above the Poverty Limit, would that stop me from IU? I'm not "working" but I am bringing in an income. Thanks

How can you tell if you are granted educational benefits? My decision letter does not state this but I have TDIU status.

Thanks so much for all the info you have shared. I have a big question: I just got 100% unemployable T & P on April 14, 2023 and effective date back to 9-20-2022. I have been working 3-4 days a week but paid for 40 hrs. Am I in danger in loosing this benefit now or can I make threshold after the 4-14-2023? Thanks for your reply.
If your rating was 100% from combined ratings, it would be under different rules than being brought up to 100% via TDIU. They explain it at the end here.
If you’re receiving 40 hours of pay while receiving tdiu then they will, unless it’s your disability compensation.
I already put in a intent to file for a new claim for PTSD and TDIU but I don't know what I'm doing and I need help! I have 10% for tinnutus 10% for lumbar MYOSITIS, 10% for left knee Iliotibal Band Syndrome, and 70% for major depressive disorder. Totalling 80%.
I was recently diagnosed with PTSD in July. And I was medically retired from the army December 2019.
Find out where a VSO, veteran service officer, is or the VFW or Foreign Legion post. They can get you the help you need.

I have a question for you I've been on workman's comp because I sustain an injury while working now the VA is examining me because I am unable to work because of a service connected condition what happens if the VA approves my unemployability since I am already getting disability from an accident I sustain while working working I have not been approved yet by the VA but I like to no where I stand and what do I have to do in the event that is approved
Worker's comp is tax-free and not reportable. I am 100% P&T and also receive a state L&I monthly pension from an injury I suffered while on the job.

I understand that the VA can take away or reduce tdiu benefits if you are above the poverty threshold, but can the VA take away benefits over any amount of earned income regardless of how much and have you ever represented anyone who has had this happen?
Thank you for your question. Our website states "Veterans with paying jobs are not necessarily disqualified for an IU rating. The key, however, is that all income earned from employment must be at or below the poverty level as stated above, or from a job that is considered to be “protected”. This marginal and sheltered employment is the exception to the rules for IU qualification. However, it’s important to note that this total disability rating isn’t always permanent. Quick question: if I understand correctly, while a veteran is receiving TDIU he/she can still work full-time and make unlimited income as long as they work in a “protected environment” - where the employer accommodates the veteran for their service-connected disabilities? Can driving for ride shares like Uber and Lyft be considered sheltered employment for someone on tdiu? Being that you can create your own hours and location, as well as minimal interaction with people?

How do veteran's receiving TDIU, get their percentage pushed up to 100%? I'm at 70% but receiving TDIU. live in in Florida, and even at 100% comp pay is barely enough to get by. It's so expensive these days.
Getting bumped up to 100% if you're already on tdiu would not make a difference in your pay

@@camcamandgirls6373 well I'm here to learn, if you can sustain income over the poverty threshold and you loose tdiu you still receive your base 70% or so and you can work so that means you can earn much more money than receiving tdiu. Why try to pull tdiu plus income over poverty threshold. That's just asking for trouble with overpayment and debit.
What about someone who can't work in a normal job for or with someone else but can sit down and type and writes a novel and uses a company that does almost all the publishing and marketing, if they someday manage to bring in more than the poverty threshold - specially after 55?
I'd bet the answer is like every case is specific, you may loose it when you publish the book but say the next year you don't make any money you may be able to reapply. Which sounds like a horrible waste of time.
If you are receiving IU benefits and your schedule ratings reaches 100 percent, can you then work if able without any penalties from the VBA?

What about rental property income while on TDIU? I’ve never been able to get clarity on this question.
Cap gains income doesn’t count. Only W2 income is restricted. I have been on IU for almost 10 years and last year I had $30k cap gains from bitcoin. Getting a paycheck that takes out SS and Medicare is the red flag you want to avoid.

I am 100% IU. When you state marginal employment and not over federal poverty guidelines are you saying it is just for yourself or do they factor in your children or dependents? poverty level for adult in 2023 is $13,590 and per dependent is $4,720. So, in my case having 2 kids plus myself could I make up to $23,030 or would it be only $13,590?

correct me if I'm wrong, I'm not sure I quite understood. If you are already 100% permanent and total, you can not receive TDIU or IU benefits? Being 100% P&T are there any benefits to help you increase your monthly income, especially if you have issues holding gainful employment? Don't you have to be accepted for IU to receive Social Security? I'm 32, 100% P&T but struggle keeping jobs due to my disabilities. I have been fired for poor performance, but can't perform at their standards for obvious reasons and have been fired for behavior due to my PTSD. I have had 6 jobs in the past 5 or 6 years. I can't afford any homes or apartments in my area with 100% scheduler payments alone. Any advice would be greatly appreciated 🙏
You absolutely can qualify for SS without IU. Start the application process immediately because it can take years. You can hire an attorney that won’t get paid unless you get SS awarded. They usually take like 25% of the backpay. Also, you should look for shelterd employment like they described. A job specially for people with disabilities that will overlook underperformance because of disabilities.

If you own the company, yes it can be considered sheltered employment.

If I decide in 2023, to close say five mortgage transactions and net $20-30K in 1099 income, will that raise red flags with the VA, Even though the amount of work for an entire year is extremely minimal and work from home? Can you utilize your MGIB while being PTIU? If You are going to school, then you’re working towards a degree. If you have a degree, it’s for a job/income. But you wouldn’t need that because you are PTIU...🤷🏽♂️

Yes you can. Only earned income is considered.

I get TDIU which is permanent & total and my wife has a business and taxes are filed together. I get no earned income. I help when I can but get no payment.

Also I don’t get SSD bc I was told I couldn’t - I had plans returning to work. 4 cervical spinal fusions (1 didn’t take), 2 lumbar spinal fusions, knee surgery, & shoulder surgery in a 6-7 year period and it bc apparent I can’t do much work. Went to Social Security and they said I should have drawn before 2012 bc time expired. So beings I paid none in since 2012 I can’t draw.
Also, I told CPA to pay some SSD in for me for 2019, 2020 that way in a decade or so I can draw SSD bc I just turned 43.
Will this get me in trouble? No earned income. Kinda in a strange dilemma.
My last option is to send off remaining claims I been having which should raise to 100% scheduler after reviewing their data.

You don’t want to be Scheduler because then you are likely to be rescheduled for a future C&P rating review board. You could potentially show signs of improvement and lose that 100%. You can work on TDIU but you must keep the income in the poverty level AND you cannot do work that conflicts with your disabilities. Bad back? No job doing physical labor. You get the point.
I took ss at 62 because i couldn't find a job ,,,,so i retired,,,i guess to collect,,,,, now they say because of that,,,, I can't get unemployability,,,,,I drove otr because I can't be around people that much ,,,,like factory work

Thank you for watching and that is a good question that many Veteran's have. A 100% VA rating and Individual Unemployability are essentially the same rating. The only difference being that with Unemployability, you must continually show the VA that you are not working. To answer your question, no you cannot get both unemployability if you’re on 100% scheduler rating.. As mentioned, they are essentially one of the same.
I’m rated at 90% with IU P&T and SMC S. I’d like to attempt to work a few hours a week. Will I jeopardize my benefits if I attempt to work under the poverty line being that I’m rated housebound due to combined percentages? We’re a family of 4 living in California and we need some extra income.

I think you just go to work and the VA will drop you after you break the threshold. Not a very logical operation. Incentivises not returning to work.

After being awarded I.U. with an 80% total combined rating. Two months later the va updated my total combined to 100%. It’s been almost a year now, and it hasn’t changed. Is it possible to have I.U. and be rated at 100% p@t? ? Because basically that’s what I’m reading. Or will my over all rating drop back to 80% if the I.U. ever goes away?? Just looking for some clarification. Thanks

It will drop back if they decide that whatever reason the extra 20% is no longer valid. If you have the increase for more than 5 years, it's usually considered permanent so they wouldn't investigate except under special circumstances
Yes you can be rated P&T with TDIU. That’s precisely my situation. I have a 70% rating P&T getting paid at a 100% rate through TDIU.
I’m rated at 100% 90% PTSD / 10% back issues can I work? The reason I’m asking is my son just started his senior yr in high school and I will lose the money I’m receiving for him once he graduates I’m trying to make back what I’m losing . Thanks
If you’re at 100% without TDIU, then you can absolutely work. Contact the DAV to double check if you don’t want to trust a random guy on the internet. They usually reply very quickly. Best of luck!
As a hobby, I wrote a book. Later, I put that book for sale on Amazon and Audible. I still write, but most of the time I don't write anything for weeks or months at a time. Two questions...is my Individual Unemployability still secure, even if my book starts sale well? Second question...can I publish on Amazon any other books I write and gain profit for those without my Unemployability being affected? That's all, thank you.

Does the VA actively look at veterans income? And if so, How do they see that?
You sign a form annually stating that you are not gainfully employed if you are receiving TDIU. Additionally, the VA is a federal agency so checking your SSA or IRS earning records is easy and routine. The biggest issue if you are working, receiving TDIU compensation and not telling the VA you are committing a felony.
If I feel like I can work, can I get off tdiu? I'm not on it yet, but an attorney wants to take my case.

Im recieving TDIU, its social security im having to fight with. 2+ yrs now, doctor exams, shot down twice, Now, Ive had to obtain a legal team. For them to ensure me( with $ signs in thier eyes) they would not take my case if I Wasnt entitled, because They get 25% off the top as payment.

What about working for a LLC with you being 51 percent owner wife 49 percent. The llc makes ok. But has a lot of tax deductions. So you pay yourself appropriately nothing but pay your wife 12k a year? Such as a hobby farm.....if she makes more should we file married joint or separately

I'm not a lawyer but I got myself 100% TDIU from doing extensive research. I already found a correction that needs to be addressed.
You CAN make more money than the poverty threshold WITHOUT sheltered or protected employment while ON Marginal status if you're working less than half the hours of your co workers for the same job. If your co workers make 100k a year working 40+ hours a week but you work 20 hours a week and make 50k a year, you can still keep TDIU because Substantial Gainful Employment is NOT DEFINED by income only. Working low hours because of your service connected disabilities can let you qualify. There are people that work 10-20 hours a week and make a lot of money but can't work full time because it's too much to handle. Also, with protected or sheltered employment, you are not limited by hours or income.
Another correction,
Poverty threshold is NOT based off a single veteran if you have a spouse or dependent living in your household. The number goes up for ea additional household members (immediate family). Veterans NEED to know this stuff. It only took around 50+ man hours of research to learn all this. I even called multiple disability lawyers to confirm it and I was right. The VA not only doesn't want you to know this, but many of them (supervisors included) don't even know about it due to lack of training on the matter. 38 CFR, due diligence people.
Tdiu since 2008 bipolar and chronic prostate gland inflammation but I work 20 hours a week I told the VA before starting to work they say it's ok as long as you don't go over the poverty guide line. What do you think I'm I doing the right thing?

Capital Gains and Passive Income (Rental Income, Stocks, etc.) does not affect your TDIU, as it is not considered Employment Income.

I have TDIU (IU) . I get 100% compensation pay but my rating is 90%. Now what I find to be a fun fast is even though they pay you at 100% rating you do NOT get the 100% benefits like for example property tax exemption. Wish that was different.

That's not accurate if it says you're a hundred percent I use a mental health trap who the hell can live on $3,600 a month in this economy
Depending on the state,not all states have complete property tax exemptions
ask them to increase your TDIU to TDIU P&T then you're good
I use a joke it's mental health dangerous to put a veteran tell him he's unemployed will if I'm rated unemployable in my in my disabilities are so bad why don't they just give the damn hundred percent cuz there's people less screwed up and I am who are making a great income in the VA doesn't look into their business like they do with me I can't work 40 hours a week but I can make some money if I wasn't looked into and it's hard to work for $700 a month for somebody who who who let you work that little this is bulshit while Congress rips off our taxes and spends it overseas
