      I would like to know how to secure legal representation for these smaller actions. Lawyers seem unwilling to represent controversial auditors (or anyone else) unless there are huge sums that can be realized.

      You could argue he was walking around to cause trouble/arguments/instigate discussion since he was so very well prepared with his answers. As if he had prepared this whole encounter just to test the police their awareness or effectiveness or something to that extent.
      Considering that, the suspicion of the officer was right, but that does not excuse his hostile behavior.

      @@rumplestiltskin7304 I disagree - it is difficult for outsiders to understand the "ego deflation" that ensues when a superior (in every way) officer simply walks out, and essentially tells these two subordinates to "Get back to work - and go find an actual criminal - I've got work to do." and then simply walks away, *in front of* THE PERSON THEY WERE UNLAWFULLY DETAINING AND ANNOYING...
      Cops like the one demanding unlawful obedience like the original cop are all about being obeyed - being "special," and being in absolute control - they become, over time (because so many people do not know their rights enough to exercise them, and are afraid of police), driven by an arrogance, ego, and self-aggrandizement. They will both remember this for a long time - and the incident will HAVE to (because of the Auditor) go into their personnel file.
      Do not doubt that valuable, very humbling lessons were learned here - and the Sergeant seemed as though he had been through this with this cop before, and it was time to slap the ego down.

      My guess it´s because it wasn´t always legal, there´s just a COMMON BELIEVE (or general assumption) that it isn´t... But yes, you´re right: That´s no excuse, and every officer on the field should know (and be instructed in) these kinds of things. Like... Im a communications tech, and we have to update ourselves ALL THE TIME... Like nurses and doctors, electricians, mechanics and computer guys... Official safety regulations and measurements change ALL THE TIME, and if you don´t keep up and do it the right way, you just get fired. I don´t get why this doesn´t apply to the police.

    I feel compelled to write. I am a retired LE officer from a very large department. I had the pleasure of teaching new LE officers for my last few years of work. While I was often looking at youtube for something educational and worth sharing with officers in training your sight might be the best I have seen. Often the 1st amendment audit videos are just silly and ignorant on both sides. The information offered by you is outstanding. I took great pride in knowing the law and respecting the rights of those I served. People should know their rights. It's even more important that LE knows the rights of those we serve. Just because I wanted to talk to someone or search a vehicle doesn't mean I got to without following the law. I always informed students you can ask whatever you want but that doesn't mean anyone is compelled to answer. I will share your site with other who still actively teach new LE.

      Exercising your rights and creating problems are not mutually exclusive. I would argue that some auditors *are* looking to create problems by purposefully behaving in ways that they know is going to get the police called on them. Intentionally upsetting people to the point the police are called, I would say, is creating a problem, even if it's legal.

      I get what you're saying and it's great the civilian was immediately free to continue doing what he was doing but we have no idea if this was actually addressed and if the stupid cop received any education or understood that his position was wrong. Therefore, the likelihood is that there was no accountability and the stupid cop is doing the same thing to other people tomorrow. I'm waiting for the day the ranking officer corrects the officer on the spot, admits the civilian is correct, apologizes for the misunderstanding and hands out business cards in case the civilian wants to file a formal complaint. I'll probably be waiting awhile for that.

      To me, I'm always surprised that the cops don't explain that they don't want their patrol cycles studied by unknowns. What if the man were plotting an attack? Get the schedule: step one in plotting an attack, right?

    I find watching these interactions fascinating of late.
    I worked in a pub for a very long time, and you rarely need to raise your voice or come across as aggressive to diffuse/prevent a altercation if you have full context for the situation.
    It shocks me how the police officer didn't stop and simply ask "what is the purpose of your filming? Is it a hobby?" Open up a dialogue, show interest and relax a tense situation by letting them talk.
    With context the officer surely could have been on his way as quickly as the sergeant.

      That's precisely what an officer did when I was photographing buildings in the middle of the night on the sidewalk. The officer was perfectly polite, and almost apologetic about stopping to see what I was doing. "I enjoy photography. I studied the rules about photography in public. I won't be trespassing". "okay, have fun. good night". that was it.

      Cops want that ID so they can run you through their system in order to find someting to arrest you for. If they find you have had other arress they fill safer to abuse you. Also, having the ID in hand they think they can hold on to you utill they return it.

    I’m so glad that there is videos out here like this cause i live in Minnesota and been asked to identify myself many times without me committing any crimes most likely cause I’m brown skinned but I always gave them my ID because I’m not well versed in the law and didn’t want to cause myself any more problems that I already have in my life. He let me go on a few stupid things I have done. Saved my life as well , mad respect to him for handling this like a legend, He has been one of the best officers i ever met!

    Let's not forget the other side. The sergeant also managed to defuse the situation without directly making Heinz lose his face. He didn't reprimand Heinz in front of the citizen, Heinz only did that to himself by stating that the sergeant would tell the man the same thing.

      Agreed, very professional of the sergeant, not to leave it in the street, but to end the situation calmly and quickly, and (presumably) leave the aftermath with his subordinates behind closed doors.

      A 10 second dismissal is a faaairly big slap in the face. Or, call it a reality check. But, if you're expecting backup and the guy throws you under the bus in 10 seconds flat. I'm not sure that's saving face. Sarge was professional and let the guy get on with his business quickly - super pro.

      ​@@splonky1216 lots of PD's don't even run their own SWATs they are so small, they have regional SWAT teams, even in the VAST majority of Departments SWAT is not a full-time 40 hour a week assignment where all you do is SWAT. No, it's more of an additional designator with additional training and responsibilities.
      Further, being promoted doesn't mean going from Patrol to Detective or SWAT, it often means going from Patrol Officer to Corporal to Sergeant to Lieutenant to Captain etc.....

    I love it. As soon a ANYONE "refuses to ID", the officer reaches for the microphone. There are 26 states that do NOT have stop & identify laws. This means, unless you were "Lawfully " arrested means Legally arrested for an actual law. Just because an officer SAYS you have to ID, unless they say you are committing a crime, about to commit a crime or HAS committed a crime, you DO NOT have to ID. PERIOD. I'm a retired police officer, I travel with my pistol concealed in every state I go into. Even under the Law Enforcement Officer Safety Act of 2004, they CANNOT do anything to me for carrying, even if it is illegal in their state or town. Slippery slope if these officers are not familiar with the law; the federal LEOSA law OVERRIDES all state laws. Just hoping that as a photographer, and a retired federal law enforcement officer, my carrying a concealed loaded pistol in a state where these guys are like this, (AND don't like it) that I don't go to jail. It concerns me.

    see that moment before the officer calls his supervisor?... when he shows his frustration... before those body cams and recording police was a thing he wouldn't have called a supervisor at that point... the guy being questioned would've been arrested for "resisting" or simply just beaten into submission
