      Perhaps a good video format would be to go over certain rights/laws more in depth (or even just a simple overview) and use clips from police encounters as examples. In any case, keep up the great videos!

      Would the officer asking him not to get out of the vehicle be lawful as "controlling the movement of the person as an investigation is conducted" as would be during a traffic stop?

      Audit the Audit So it doesn't matter that the reason they think he's going the wrong way is because the arrows that are on his property? Since it's private property, he could make a U turn arrow so nobody can enter. Could the police then issue citations for anybody that actually ends up on the property? I would think that since the markings are on private property, the cops can't enforce those markings unless the property owner says they can.

      @@rayage777 well it depends on the state as far as enforcing traffic laws on private property. Some states allow only certain traffic laws to be enforce by law enforcement on private property. In Georgia cops can only write citations for Wreckless driving, DUI, and Failure to obey a traffic control device to name a few on private property. So someone driving 45 MPH on private property and the private property owner has a posted speed limit of 15 MPH could be cited for Wreckless driving not speeding.

      This is the most stupid part. Does the officer need to know who owns every property? He knows he doesn't own it. He's being asked to leave by someone with access codes to go in and out of the property. Any moron can look at this evidence and see that they are being trespassed. This officer is too egotistical to accept that, and too stupid to see that there's no "gaining the upper hand" in this situation.

      That's is such a lame attempt to excuse the blatant abuse of power and force that has become the norm in police departments.
      that would be the equivalent of an african american saying He refuses to cooperate with police because u get shot regardless and then goes on to name one of the hundreds of examples.
      Certainly police officers getting shot while in their patrols it's a tragedy, but that doesn't justify the lack of professionalism and all around morals displayed by this police officer who blatantly lied when backup arrived, he was willing to lie over such a petty argument, imagine if his ass was actually on the line.
      He is the very example of everything that is wrong within police departments, and here you are desperately trying to excuse his behavior.

      I disagree. I think he should be able to keep his job as long as he’s required to wear a dunce hat and a muzzle for as long as he works for that police dept.       @@Clee-dv9jz Well it plays to the camera, because if they say stop resisting when they show that to a Jury it makes the Jury think you are resisting even if you are not. I have watched enough cop videos it seems they say it even if the guy isn't doing anything but letting them cuff them. What you got to say back knowing it's being recording is "I'm not resisting" and "you are hurting me" just keep repeating it when they say "stop resisting" makes it a lot harder in court for a Jury to blindly go with the officers words. In fact the Jury might side with you because why would you be saying that you are not resisting and that you are being hurt if you were not hurt.

      @@Meekerextreme you are 1000% correct. I mentor young men and we have classes every quarter to help them identify what we call them "tnt" words. We use this term because these words are specifically said into body cams in order to "blow up" any chance of future reprimand. We teach them to never act aggressively and to immediately refute these words. We tell them to actively listen. "Stop resisting or dont tense up" immediately say officer Im not resisting why are you trying to hurt me. "Do you have a gun" immediately say Officer we have talking for however long and now you are asking me for a gun but always keep your hands up because this is usually the escalation technique officers use to draw their weapons and have it documented that they felt threatened. "I smell weed" immediately respond I dont smoke weed Officer and I dont know why you would make that up. This officer says he felt like he was going to "get assaulted by this car" an obvious lie....his response should have been but you walked directly in front of the car so that doesnt really make sense Officer.

    In my state cops are not allowed to sit on private property in order to make any type of stop, if a stop is initiated while the officer was originally on private property the ticket or any offence after will get thrown out.
    My coworker had an officer try to pull them over twice while sitting on private property the judge ended up looking at the Statue and calling the cop an idiot and throwing it out and warned him never to have this come up again cuz he did it twice in one week, the judge was very unhappy that he had to tell the cop twice.
    Police can be charged with trespassing, but keep in mind trespassing signs do not apply to police officers or postal federal agents delivering mail until they are told to leave then it applies. Trespassing signs also don't apply if they are called to a scene.
    The careless driving would also get thrown out immediately if a cop tried doing this in my state. The inbound and outbound Lane when entering private property is optional it is up to the owner of the private property to enforce the inbound outbound Lane it is completely up to them how those Lanes are used. This is the reason why cops can't enforce stop signs or speed limits in a Walmart parking lot it is up to Walmart to enforce it.

    The APD is a dumpster fire, to be honest. 9 years ago my husband's wallet was stolen. Obviously, we called the police and had them come to our house to file a report in hopes that they would just do their job and help catch the people responsible. In the 20 minutes it took them to fill out the report I decided I would try to help them and I managed to find video evidence of the people that broke in and stole his wallet. All they had to do was just go get that video and then continue what should have been a fairly simple investigation in order to arrest the people that did it. It's not like they were criminal master minds. They went around to a bunch of stores where they knew they would be on camera and used a stolen card to make purchases. So, do you think the cops took the 5 minutes to go get the video I found for them? No.. no they did not. They didn't even try to help, because then the would have to actually do something. And we can't have that now, can we? The people that stole the wallet then went on to steal my husband's social security number off of either his Medicare or Medicaid card (I can't remember which one had his SS# on it back then) and steal his identity which created an absolute nightmare of a situation where they took out credit cards and drove his credit straight down into the ground. All of this happened just because the APD couldn't take literally 5 minutes to get the video and then just figure out who it was, which they easily could have done using the parking lot video I also found for them, to get the license plate number and track down the owner of the car. All because they didn't want to have to actually do their jobs. So, while I respect the police in general, APD gets no respect from me whatsoever, and they never will. There is literally nothing they could ever do to make up for the shit they allowed a piece of shit thief to do to my husband. Moral of the story, feel free to rob anyone you want in Aurora CO because the cops couldn't care less.

It was in a bad area of town, and I was 19 at the time closing shift also not wearing my uniform anymore. They said they got a call about a suspicious vehicle and were pounding on the front door which was locked. I went to the front to ask them how I could help them and they immediately asked how I broke in and what I had taken not believing I was an employee until I pulled out the key and locked them inside while standing outside asking them how I possibly managed to get a perfect replica of the key.
      They kept sitting in the lot too at random times during the day and night for no reason afterwards, probably because I made them look like idiots.

Their boss hates me because I filed the report to have his dog examined for no rabies tags, after it bit one of my drivers and he refused to take the initial call. Funny thing he didn't know, the guy who trained me in his vet clinic during highschool, was the rabies officer of the county and had top level jurisdiction in that case. So I just called him in front of the sheriff's face, and put it on speaker for the whole station to hear. The dog was seized within a few hours. That city is known locally for corrupt shit from years past too

      They used to be able to hang out at the doughnut shop, shooting the 🐂 with the waitresses but now in big city PDs they are tracked everywhere they go so have to fake being on watch.
      Ever see the old night watchman systems where the watchman has a mechanical recorder and each station on his rounds has a key that he has to use to record his presence? Well, cops are under modern electronic systems that do the same kind of keep tabs on them. Many don't like it.
      I recall when city police patrol cars were first equipped with the "Iron Sergeant" that recorded every turn, every mile, and the time. The cops hated it. Then when they first got dashcams the cams were huge VHS video camcorders. Every one ended up broken when the car returned to the carpool. Until a video cleared a cop of a false rape accusation. After that the cameras didn't get broken any more! Fancy that.🤔

    By the way, Officer Justin Henderson of the Aurora, Colorado Police Department, the officer in this video who drew his service weapon, pointed it at the Dr.'s head on his own property, and failed to properly document the incident as required by his department's policy, is currently facing a Federal lawsuit over the shooting death of a person in 2019 and was just recently (November 2021) denied Qualified Immunity as a police officer in the case.
    It seems Officer Jordan Henderson is woefully underqualified intellectually and emotionally to be a police officer and carry a gun. Hopefully for the safety of all law-abiding citizens who find themselves in Aurora, Colorado, Jordan Henderson will at a minimum be stripped of all authority permanently and decisively.

      That was a confused look, not one of malice. He's probably a rookie.
      Checking a cop's ego is only dangerous if you do it aggressively. The doctor handled it correctly, even if he was understandably being a bit of an asshole about it. The only thing he should have done differently was to stay in the car until the tension had been diffused. Disobeying an officer's order can be misconstrued as a threat. If you find yourself at gunpoint then your safest course is to calmly comply to demonstrate you are not a threat.

      Dude was totally startled by the horn, overreacted, and then was stuck trying to justify his reaction to himself. He exaggerated the Doctor's driving, ignoring that he'd parked on private property (blocking an exit), and basically panicked and fumbled this entire interaction. Dude looked like a spooked hare when the Doctor didn't care about a gun in his face (also notice how he neglected to include the detail that he drew his weapon on someone for "reckless driving").
      Props to the Doctor for having perhaps the most civil, yet withering disdain I've seen in some time, all while a gun was pointed in his face.

Henderson's obvious alarm fear and gross overreaction in this situation combined with the fact that in 2019 he had to shøot and kïll somebody who attãcked him with a machete makes me think he probably has PTSD. she should be psychologically evaluated and if it turns out I'm correct he should be made to take a medical retirement and given mental health treatment if he wants it, in addition to facing charges for criminal trespass and assãult with a dêadly weãpon. instead he got suspended for a week without pay and that's it.

    Your closing summary was so well done. Thanks for the knowledge you have passed onto myself. I was taught to basically do what I was told by those in authority with out questions. This may work for children but even they should question something if in their "heart, mind, soul" feels wrong. As an adult I should have done a better job of learning my rights as a human being and a citizen of my country. I think it would have opened my eyes and helped me to see my self worth. And how I am a important part of my community and society as a whole. Blah blah blah, thanks.

      The point wasn't hw was driving dangerously on his own property it's that he was not following the printed signage of the road. If he dis indees enter through an exit he has thus for the shortest moment driven illegally as per the signed rules of the road.
      It's ridiculous had he made the citation, on such a silly circumstance, however it likely would have been thrown out in order to apease the Dr. As the cop lijwly could face tresspasaing charges, agrevated assualt ect.

      When I lived in AZ, I NEVER had a traffic experience, on a State Highway, that didn't involve the Officer coming up to the driver's door with his gun drawn. Most times the Officer stood behind my driver's door with his sidearm angled at my ear. Believe me I complied with every order. I never even received a ticket. I'm pretty sure they pulled me over because they just wanted me to know who was in charge. Strangely enough after the initial gun out part the Officers behaviour was very polite. They would say some bla bla about my passenger looking like he was a " #$%&#$@$% " , " but it is Okay now buddy " and, " Be safe, we're lookin' out for your safety. Drive safe."

    I had read years ago, that as an example, a stop sign on private property cannot be enforced by police. The statute you referenced is referring to public roads and streets. So if I had a business and had signs directing flow of traffic, police could not enforce it legally. Please correct me if what I had read is wrong. Thank you for your videos.

      Black woman did the same thing, finding a cop on her property and question him as to why he was park on her property. She wound up getting assaulted and arrested. The judge sided with the cop because that cop told a series of lies on the woman. So now she has to hired a lawyer to get her charges thrown out.

      He could be power tripping because someone honked at him, but I think the cop wasn't supposed to be there - was napping or just F'ing off, and attempted to cover his tracks with intimidation, because you can't fix stupid.
      All he really should have done was move and let the other car pass - any action beyond that was unjustified.

    it's nice to hear the law read and hearing about both sides of the law (along with the ambiguity of certain situations). situations are not always strictly black or white. for better or worse, there is a lot of grey area. it's the court's jurisdiction to try and clarify those grey areas when possible.

    “I’m not trespassing, I’m a police officer.” This is exactly how most of them feel and operate. It’s why so many of us now no longer trust law enforcement. And that number grows everyday, while thugs in uniforms continue to double down on stupid!
    Also, the statue regarding careless driving only applies to public roads, not private property. I can drive however I want on my property.

We are all guilty until proven innocent and at risk of having our rights violated for the most minimal of infractions.     As an update, Officer Henderson received the grand punishment of one week suspension, and was ordered to attend de-escalation training. The civil lawsuit against Officer Henderson and Aurora is ongoing, and a motion to dismiss has been denied.
