Hey, you might think that this info makes me your lawyer, but it doesn't and I'm not. Sorry, but I AM NOT YOUR LAWYER unless we have an engagement agreement. I am just providing public information here, like a library does, and am not providing you with legal advice about your situation. So, it would be totally unreasonable for you to conclude we have an attorney-client relationship just because you're viewing this information.

I love how this channel has evolved
I don't
I love how this channel even exists
You talked about civil forfeiture, but you didn't answer the question in the title: "Can the police take your house?"
I remember there being a scenario where an armed criminal was holed up in a family home and law enforcement ended up damaging the property to the extent it was deemed illegal to live in. If you haven't discussed this case already, would you?
It definitely did. It was included in civil forfeiture as a real estate.
No they can't take your house that would be stealing
The Supreme Court has ruled a difference between taking and searching. The police with a viable warrant can completely trash your house without having to pay for it. Tho you can potentially argue certain things. For instance if they're looking for something specific that is the size of your head and they destroy something that clearly wouldn't conceal the item of that size it can be argued there were no reason to destroy it. This is supposed to be on docket for review but probably won't change. As for actually seizing the property itself, if the house was used in illegal business they can (dependent on state) seize the house and auction it off to recover costs of the investigation. We have seen this with certain fbi raids if you check Google. They aren't hard to find
@@Iambamtman1 So they can do vandalism to your property without having to pay for it.
What other crimes can they do?
What a great video! You always combine real humor with good hard core answers. The "right to travel" misinformation has increased tremendously in recent years, and it's a real service to address it on your channel. Excellent work, counselor.
If I'm pulled over and a cop suspects me of DUI, should I get out of the car when asked/ordered?
Should I refuse field sobriety test?
Should I take the breathalyzer?
Isn't losing your license for refusing a breathalyzer a violation of the 4th?
What's the rationale of your silence not being evidence against you in criminal court, but can be used as evidence against you in civil court? It seems like the way it should be is you should have the right to remain silent in either scenario because the burden of proof is on the accusing party.
It depends
@@opinionatedfoxl8369 Great answer. Really answered his question!
@@cactusclik but am I wrong?
1 Yes if he has suspicion of OUI he can order you out of the car legally
2 If you're drunk yes, if not then no
3 Here's the tricky one, most penalties for refusing the breathalyzer are actually worse than an OUI conviction. But if you're drunk you just handed them the best evidence they could ask for... although I did get my breathalyzer thrown out of court, you might not be as lucky.
4 No as Mike said traveling is constitutionally protected but the mode of transportation is not. You have a right to walk to another state but even then that can be infringed upon by the courts, such as probation and pre-trial release. As you don't have a right to drive, you don't have a right to refuse the limitations and requirements the law demands for you to operate a vehicle on the public roads.
5 Finally you have protections against criminally compromising yourself. For example (sticking to DWI) if the prosecutor asked how much you spend on booze in a week during the trial you would have to answer as it doesn't prove that you were drunk while you drove. But if he were to ask you how much you spent at the bar before driving home you could refuse to answer that. Now if you get in an accident an hurt someone and they sue you, you again have no such protections as it isn't directly criminal in nature.
2. I've seen people still get arrested from a field sobriety test when sober because of little reasons like you stuck your leg out or wobbled to much. Idk for sure if you can deny it but I would just ask for a breathalyzer. Less likely that you get screwed. But I have seen a video of some kid getting arrested even after blowing 0.
I've been following puppet Mike's advice for years now and I'm doing just great. No strings attached.
👍😁
"So you did a no knock raid" 😂😂
Thank you for another fun and informative episode! 🌟
What online courses would you personally recommend for criminal law and criminal justice? (I want to go back to school and would love to get an MD in those areas [at the very least])
"He is only in it for the handcuffs"
This is one of the few areas where NY is better than many other states. A conviction is required for assets to be seized (the exception being preponderance of evidence for specifically drug trafficking).
Wow, I figured cops would be able to take your stuff just by looking at them wrong. Lol
Thanks, Mike! More please.
Remember, always say I invoke the 5th and I want a lawyer.
Hi Mike! I was thinking maybe you should include "What the law?" in the title of the the videos, as it is not often clear which videos are just about a certain issue, or a video about questions. Besdies that, great video, I'm glad you're putting content out, thank you!
My question is,
What is the legality of you calling yourself the #1 Lawyer on Social Media? It doesn't imply #1 in anything, but even if it did, is it relevant?
Thanks
Without due process, civil asset forfeiture runs afoul of the fourth ammendment takings clause.
Can you give us a full explanation on fair use in your next episode with muppet Mike
Something I've always wondered is complacency with the cops while they're conducting a search. I understand I don't need to answer questions, but can I return to what I was doing like sleeping or playing video games, though it may not be recommended?
Can you go over the 14th amendment and how it can be used to prevent a debt ceiling default in the USA?
This channel see is very good! Only my first day on this channel and I am seeing it 24/7
I feel like after all the videos he posted, I feel like I need to get this off my chest, I think I kind of broke a law. Basically, when I was much younger, I was at school, and there was a C-3PO toy which didn't work. I told the staff I'd try to find batteries to make it work, so I took it home to do just that. I never returned it
thank you for this confession of this insane felony
Yeah, I don’t understand the word of art phrase; “operate or drive registered motor vehicle equipment upon the state roads”?
I like to administer my property over the non-exclusive easements to access my land by right. This keeps I me from getting traffic tickets.
I think that drivers license question was about "sovereign citizens" ... what about them?
Didn't your dad have his cop friends throw you in a jail cell so you could see what jail was like?
Most "sovereign citizens" don't even know what that term means. It's just a buzz word used to try to get out of being in legal trouble or as a "fuck you" to law enforcement.
0:54 I love the show cops.
The people have a 9th amendment right to travel. State Driver’s licensing is too intrusive as it doesn’t prove competency in the interest of public safety, but “certificates of competency” would do a better job, what do you think?
FOR ALL THOSE RIGHT TO TRAVEL SOVEREIGN CITIZENS OUT THERE GO FLY AN ULTRALIGHT NOT A KITE IF YOU WANT TO TRAVEL WITHOUT A LICENSE LOL 😂.
Puppet mike is supporting the hole channel by himself and deserves more respect.
But for real the puppet is a great idea.
I 100% agree with moppet mike I’d rather see cops busting moves than busting heads any day
How would a sue for a small claims for a laptop Thanks
What town are you in
Mike, i don't think I can raise my eyebrows 😂😂😂😅😅
Reminds me when my mother got high jacked and the police took a none working reverse camera
Nice video
Does the federal government recognise and respect state laws? Like of I was arrested for doing something illegal in a state, that's legal in the federal government. Could I take the state to a federal court? Also can break state laws if it's on federal government territory?
Would it stand in court if a cop pulled you over for going 1-3 mph over the speed limit
cop takes lawfully withdrawn money from Bank, pays lawyer to get money back, loses money to lawyer fees. so that's a lose lose
NWA never wrote a song called F** the Fire Department. FTP
Back to the discipling children. Would a cop who went to the house once before because of a child who would listen have the right to charge the child? Because a officer said he would to me a couple years ago and it always made me very confused
Hey Mike is it legal to put a fellow cop under arrest
I love watching these vids by Mike but I think they also exemplify why so many people hate lawyers. For example the advice dating a cop is, "Maybe don't do it if your a criminal". Which just sounds shitty. Instead of what a normal person would advise, which is, "Maybe don't be a criminal".
Moppet Mike sounds like Joker from The Dark Knight.
Why is the moppet mike background in HK? I see HKCEC on the left
I've got a question
Can you sue a police officer under the correct circumstances?
Is "suspicious behavior," in itself R.A.S. enough to ID someone, or do the cops need a specific crime to reference in order to demand an ID?
Can I not follow cops orders if I haven't done anything wrong or they don't have a legal reason to order me that specific action
such as( stepping out of the car, searching me... etc.)
“Constitution doesn’t say you need a license to travel.”
Ya it also doesn’t say anything about selling drugs………
Feral hog problems require well-regulated solutions. Arm up and solve often. Be the consequences you want to see in this world! 🌈⭐️
“Hey sir, I’m gonna just take your house because we believe that you’re a criminal”
From a police public relations perspective, the cops dancing thing is good idea, makes them look more human. Who cares if they're dancing around? It, could technically b called exercise and they need to stay in shape
ima become a cop, go to elon and say i’m legally allowed to take his house and everything in it
Cool
How much police waste tax payers' money by dancing on tiktok?
Short answer: $0
Long answer: Way lesser than the amount you waste your boss money watching tiktok at work.
will i be in legal trouble if i use fake money without my knowledge
Nah if the cops tried to take my stuff im getting it back by force
#Question for LawByMike what if the cops don't read your Miranda rights?
Doesn't matter. Google the Wikipedia page for "List of Common Misconceptions". It has tons of them listed and that's actually one of them!
Is it illegal to sell weed in a pizzeria bathroom in upset NY? Another question Can you have a cabins plant in your in garage in upstate NY?
IDK if you answered this question but do you have to let a cop in if they have a warrant?
First and what’s the age difference of drinking beer in other countries
First and also thanks for the advice
i have 2 questions 1: is it legal for your parents to destroy your stuff. this did not happen to me 2: what do cops do with your stuff when you are in prison. this did not happen to me.
Civil forfeiture is when they SEIZE, not CEASE, then keep your property. We're both attorneys here, and in the law, words matter. Also, I am not sure how police could cease a tangible item, but let me know because it would probably involve committing a crime
My attorney claimed medical malpractice is not even close to the 3rd leading cuase of death in usa now i qestion if he knows anything at all which i doubt or if your dishonest his name is trevor d terry at douglas d terry and associates pllc i think he needs to practice more personally i think he lacks basic information but he has alaw degree not me
Sounds like youre making that out to be a bigger deal than it actually is
@@AlkalineGamingHD how so?
Lol I can tell you don’t have a law degree. Although what’s more apparent is that you don’t know how to type.
I for one am seriously tired of hearing about the travel law... If ur going to exercise ur constitutional rights then for the love of God make sure u actually understand what ur exercising 😂😂😂 so many people are just brain dead.
What if it is their pwn child? (I'm not stupid, I am making a joke.)
Why can’t citizens impeach government officials and president?
Hi
3:03 Micheal p?!??!!? Like the fucking mock nostalgia guy whos stuck in 2009
But if you open your front door and have drug paraphernalia on the table next to the front door in clear sight, in movies and TV shows that's enough, they don't need a warrant if it's in plain sight.
So if you invite them over and hang out with them and you've got you've got illegal substances or a class 3 firearm, on your kitchen table, and you invite them in your kitchen for a sandwich. You're screwed right?
Can a child invoke the fifth
What are some exceptions for cops to not follow the constitution? (If any)
Then explain why people are getting away with traveling and not driving. Driving is a privilege not a right traveling is a right not a privilege. State laws do matter but for most states you can travel freely. If you don't believe none of this then go ahead and watch this video and look up and do research numerous other videos and then go down to your magistrate's office the next for the paperwork and then you will see. But if you have a driver's license you definitely have to cancel that through contacting the DMV and your mare. I don't have my driver's license but yet I travel freely wherever I go. No taxes no nothing. Just me my personal vehicle and my tags showing that it's my vehicle because it's a tag that I made up
I asked for your help.i don't know why you won't help me...I'm getting sued in civil court..take care.
Is it legal to date your step-sister? (Guys im just curious, ok? I don't even have a step-sister)
can I outrun the cops?
First one
First
יע
Can I arrest mr beast
You could not be more wrong, the cops don't "have" to show anything. The can take whatever they want, whenever they want. There are no laws stopping this. I have lost all respect for you as a lawyer, and human being. your attitude could be due to the fact that as lawyer you are part the lawlessness of the system.
Can I sue Roblox for assuming I am a teenager based on the sound of my voice?
Is it illegal to be fat
