    I just don’t understand why given all the research that has been done and all the cases that have ended badly, there are still cases like this. It’s absolutely heartbreaking and anger provoking

      That is too simplistic. Murder has and always will be, despite all our learning and technology.
      Ultimately, human behaviour is unpredictable. It really is impossible to predict what a human being may or may not do (even with previous knowledge of a person).
      There are however red flags and previous history should be considered. You can do everything right and still be surprised by the outcome.
      Obviously not in this case which a massive failure.
      One thing that frustrates me, though, is often services are vilified for their lack of action or over-action, but actually, the first responsibility is with the parent who decided to have offspring in the first place. 🤔

      @@k_j_n1242 I think the outrage is not about murder itself, but rather about the MASSIVE failings of the system in this case, and sadly so many others--cases with very clear red flags and authority involvement; but somehow in the end, the child is handed back to their abuser, and tragedy was the result. This case was gravely mishandled. And it's too easy to blame the case workers and judges, because honestly, it's the ENTIRE SYSTEM that's to blame. And society must bear some of this responsibility as well.

      Because CPS receives funding based on how many fanilies they reconcile, so thats all they care about! They dont care about the well being of the child! This commentator obviously does not understand how psychology terminology works! As police officers, we have to use the words "seems", and "appears to" because to use definitive wording without the qualifications to do so, can and usually does result in lawsuits and criminal prosecution and it can also cause justice to be denied to victims! Also, the last place on this planet that has the right to criticize any legal system in the US with regard to protecting children, is the UK! You people think that 10 years is a reasona le sentence for child murder! Feel free to criticize us when you get some real laws!

    This exact same custody situation happened to my husband and even when my step son experienced being molested at his moms home custody was STILL not awarded to my husband, it took my step son trying to commit suicide and his resulting psychologist recommending him live with his father instead for us to finally get custody of him. The family court system and custody situation for children here in the USA is aweful and highly biased toward the mother!
    Edited to say the court system in Washington State was to blame, mother moved to Maine to live with the guy she was cheating on my husband with and took the kids, lying and saying she was just going to visit her sister, the next ten years were a nightmare for both my husband and stepson.

      Both of my ex-boyfriends had FULL CUSTODY of their children & fully raised them & are now grandparents so it happens a lot more than you think. Well here in MI at least.

      Thank you so much for fighting for your Stepson. You are very good parents and whilst he will be so traumatised, he will feel comfort knowing that he is with safe people.
      Cases like this show how things can go if the child does not end up with the right person.

    Hello, first thank you so much for sharing Eli’s story! We need all the light on the failing system. I just wanted to clear up that I am not Julissa’s sister, my husband is her cousin. Next I hope this helps you understand. The reason she was charged with second degree murder is because the police can only hold a person for so long. So when the time was up to either charge her or release her, they charged her with second degree because that’s all the SOLID evidence they had in that short 72 hour window in order to make sure her charges stuck and she would not get out of jail. The police knew that at any time they could increase it to first degree when and if they had enough evidence. It was clear as day that she was the one who took Eli away from us, but I’m so beyond happy with the way the investigators handled everything.

      Thanks so much for that extra clarity. This must have been unimaginably hard on the families close to Eli. The system here in Australia is also flawed and we see such tragic consequences. This case was difficult to hear as we have been personally affected by similar circumstances but thankfully with a much much brighter outcome, however, the lingering trauma is ever present. My heart goes out to all those affected by this case, especially the father and sister and their families who were so close to little Eli and were able to show him unconditional love ❤.

I hope you are able to take some comfort in knowing that you provided an experience of love and peace for Eli.     I'm from Minnesota! Not too far from where this happened, actually. It was such a shock and I can't even begin to explain my disappointment in our social services system. Minnesota likes to pretend it's "better" than it really is.

    I had to watch this twice and parts over again and again because I couldn’t wrap my head around the stupid law and people who failed this poor little guy!

      How in the hell can the “justice” system & child “protection” services allow for this to happen?? I genuinely hope Tory sues the judge and the CPS for everything they’re worth given all of the damning evidence against her and the fact that Juliss’s family even repeatedly warned them about her, and they still refused to listen just for this to happen!! The judge and every single CPS case worker involved on this case really need to reconsider their jobs!! You don’t make this critical of a mistake and get to go on to continue to make this kind of mistakes, jobs are replaceable but Eli can’t be replaced by any means!! I’m not sorry that this case has me beyond lividly irritated with the justice system!!
      I’m going to have to finish this video at a later time when I’m calm enough to finish it.. I can’t get over everything up to the point where she refuses to get her mugshot “until her hair is styled”. It’s just all overwhelming & too much!!

    EMMA…OMGOSH, This one is ESPECIALLY DISGUSTING AND DISTURBING, but your videos are so important on a multitude of levels. I always learn so much because of your expertise in child development. Regression is sooooo IMPORTANT to be knowledgeable about in case we see it happening to a friend or relative’s child. Not to say that it automatically means the parent is the abusive participant, but it’s a red flag and makes the situation worth taking a second look at. The child videos are so hard to watch, but are the most important and I thank you so much for all the hard work you put into the research analysis. ❤

    A judge read the cps report about the mothers visits and how terrified this kid was of her and the disgusting things she said to blame him for being taken and then still gave custody back to her! That is the most disgusting and negligent bull💩 I've heard in a while! I think judges need to start being held responsible for the neglectful decisions they make in these cases that end with the child losing their lives! If there was harsh punishment and termination of their position I think they would start taking their time and actually make responsible decisions on who should have custody. They ultimately have the final say in who the child is returned to, so they must ultimately be held accountable for the decisions they make! This kid would still be alive if the judge did his job the right way and actually cared about the children he is supposed to protect!

    I live in Minnesota and saw this play out on the news. I'm glad you did a case study on it so I could learn more. It was so sad to watch and sad that this happened. I really hope that it can help change the laws a bit and give more chances to the parents that really care and don't hurt the kids.

Women, especially mothers can be twice as brutal as men when it comes to dealing with baby killers. I won’t shed a tear for her. May Ely’s soul be free and peaceful 💔💖💔

    Emma, when I began my paralegal career, I fell in love with criminal law. My mentor was a former prosecutor until he crossed over to the dark side and became a criminal defense attorney. I learned so much from him. The other attorney in our office practiced family law. It was crazy! This was in the late 80s/early 90s and the cocaine run came up from Miami along the East Coast until it hit NYC. I live in South Carolina. So, we were on the direct path and I got to know drug dealers because I saw them so frequently. I was married at the time to a cop in a different county. They'd ask if he was staying safe and genuinely meant it. Honestly, I felt much safer if one of my clients was waiting while the family law client was also waiting. Some of the drug dealers worried about my safety and would tell the attorney that I worked for that I wasn't safe. He'd summon me to his office and usually, the family law client was in with his/her attorney. But, I was given strict instructions that if it got too crazy, I was to call his office and he'd be out to get me. We had different types of clients, I just got to know the drug dealers better. My then husband wanted to move home, the last place I wanted to go, but I did. I quickly got hired by an attorney in single practice but he practiced family law. I hated it. I didn't deal with it regularly but enough to realize that the Family Court system in the south was never going to grant a male parent full custody, even if He walked on water and fed the multitudes, He wasn't getting the child. I was so angry. Having a vagina and womb doesn't automatically make the female the better parent. I later quit that job due to a problem with the attorney playing loosey goosey with clients settlements. I was hired as a Clerk of Court for a small municipality and later became a judge. You don't need to be an attorney in SC for the lower level courts. I became a municipal court judge and my court only handled criminal cases. Most attorneys thought that I was an attorney, I was taught well and for some reason, I understood legalize and SC Supreme Court decisions, I even wrote one that they heard oral arguments on and they published it. Obviously, an attorney had to present those cases. Our state's Chief Justice's reasoning for not requiring the lower courts to have judges who were lawyers was simple, she thought that it would back the cases up because defense lawyers would file ridiculous motions and blah blah blah. She wanted common sense to prevail. I'm well-educated and have multiple degrees. I had been accepted to the National Judicial College before becoming ill. I had attended 2 of their week long classes and I was with judges from every state, many had sat on death penalty cases, and there was a JAG lawyer in my little group. I was the only female non-lawyer. It was an evidentiary class and they were all wrong. I was nervous for some of those death row prisoners. They couldn't believe that I wasn't a lawyer, I think it was a compliment, I took it as one. And, just general trivia, SCOTUS didn't require lawyers either, at least, not until 1946 (I think). By that time, the majority were lawyers, it just wasn't a requirement until then.
    South Carolina has made improvements but still has a long way to go, in my opinion.
    Now, this waste of DNA, I just want a set of brass knuckles, a case of Red Bull, and a locked room with her. I don't care about her mental health, I'm presuming she was required to take her medication during the trial, if that was her good behavior, she and I definitely needed some time alone.
    I had to retire after only 10 years on the bench after I was diagnosed with lupus, a very aggressive version, I'm never in complete remission, the least bit of stress causes it to flare up a lot.
    Emma, as a Southern girl, I'm very familiar with guns, and I have fired a double-barrel shotgun many times (it helps with stress), if she shot him that many times, I can envision what was left. I hate people who hunt for sport, I understand people who hunt to feed their families.
    And, due to the GOP we can't get basic safety gun laws passed. Those elementary school kids in Uvalde, TX could only be identified by the clothes they were wearing. An AR-15 uses high caliber bullets that shred anything it's fired at, which is why it was designed to be a weapon of war only, but the NRA has deep pockets and the GOP is a bottomless pit.
    I really enjoy the way you really do go on a deep dive of your subjects. I thought I knew everything about Ted Bundy. I knew he revisited his kills but not to the extent that you revealed. I think I threw up a little bit when you revealed that tidbit. I love your sarcasm, we would be a force to be reckoned with as a team. If you ever come to the States, the Southern states, we should meet for dinner and drinks, I'll make sure you have a safe way back to your hotel and I'll have a safe driver to take me home.
    I also wanted to thank you, I know you leave a bit of yourself with every victim and it takes a lot from you. I'm very happy you have your hubby, your boys, and the rest of your family to help you recover a little bit. I hope you'll keep us posted on Tory's suit against the social services. Personally, I think there's a place for criminal charges for some of them.

Children DESERVE so much better then many get!I wish I could take care of all those babies that are stuck with those evil so called parents. I HATE that this happens.     CPS was called out to my home in California on numerous occasions for abuse by my father. Nothing much happened because he was able to spin his stories and talk his way out of every incident. So many reports were closed. I have found out that some case reports were kept open for years but because he could sweet talk his way out of everything, nothing was done and i had to find my own way out when i was old enough. Out of all the reports that were made, i was only spoken to twice. My father spun it that i was the one with mental health issues. Granted i did have an eating disorder, depression and anxiety. But to me it was a reaction to his abuse against me.

      This is so wrong. Im so sorry that your childhood wasn't what it should be.I hope you have now support,love and healing proses going on❤.
      CPS around the world mainly works with women whose own parenting is in trouble or there is some kind of twist, so they easily "understand" the "challenges" of parenting, which is disgusting in these cases.
      It's clear that you can't get smart people to work there, they're more like employed morons for whom the main thing at work is that the salary runs. They are lazy and can't put in the work and go where the fence is the lowest. If a few good employees sometimes work there, those other slackers/supporters of child abusers will also dilute their work.
      It's unbelievable how easily people working in child protection can be fooled?! But the truth is that, for example, pedophiles and other abusers of children apply for fields where they can satisfy their own sadism.. maybe this is how CPS workers fulfill their own "inside" when they support child abusers because they identify with them "so much".

    My little sister was friends with her growing up. When she saw what she was doing to Torry and Eli . She reported it to children protective services more than once.
    My sister was so destroyed by the auction of the mother. Would say I should have done more to help Torry and Eli. I told my sister they need to find away to change the laws in MN.

    This is so heartbreaking. I was raised by a single father. My mother didn’t have a maternal bone in her body. From the beginning, she was showing signs of what we now know to be munchausen by proxy and that’s just the tip of the iceberg. Thankfully, she didn’t fight for custody or visitation. A fathers role is a deeply important thing to me and I’m saddened by this woman wanting to take that away and not valuing a good father for her son. She was so lucky and couldn’t see what was in front of her.

      Some cases the child is better off with the father.
      And this is coming from a man who was raised by an amazing single mother for 12 years and had a terrible father who was never there. But even my mother would agree. Some cases, the father is the best suited parent
      I have a 11 year old brother who is very lucky to have a great mother and a father (my stepfather) in his life growing up and everyone agrees that my little brother is not only well cared for and a well behaved boy who knows from right and wrong but his mentally, socially and physically healthy as can be. He proves to me that having a great father and mother in a kids life is what's ideally the best. So I agree completely, I do think having a positive father figure in a young boys and girls life is just as important as having a positive mother. My little bro is proof of this to me.

    I can't even begin to express my anger at this case. I'm just literally dumbfounded at the system that let this happen. I hope Tori sues the ever living piss out of every single person who failed this baby. I hope they all lose their job and any licensing to do their job.

    I have bpd and I hate it when very bad criminals come up and they have this. It is a big spectrum and you can get quiet bpds who like you said are more likely to hurt themselves and are recluse. Thanks for explaining this ❤

      I'm also BPD and this is a big pet hate of mine also especially at I've always been very open about my mental health I do get a few people that decide they don't want to pursue a friendship with me just because they have watched a few videos where the murderer happens to have bpd

      I give you guys credit for admitting you even have BPD. The people in my life with that won't even acknowledge having it. It's hard to live with honestly. It's very distressing but I feel life being able to acknowledge it might really help.

    I’m so sick of these parents murdering their children…when are these ‘lessons going to be learnt’? How many children are suffering right now, being tortured by a parent…it’s scary to think we just don’t know about them yet 💔
    Edit: I have to commend you Emma for delivering this horrific story so eloquently…I can imagine how much you’ve had to censor yourself when describing this vile monster of a mother…

    I've lost my nephew to this. My brother has battled courts even with all the allergations towards him and against his son, and he won his case in England and then she kidnapped him to Romania her home country, and he won his case there too. We are still without him. She's not stable.. nobody believed him at first.. they don't take it seriously. Years on 😢 so unfair

    P.S. watched this one again. Third time ive listened to Eli's story. Because i feel his life had importance!! Way more than the garbage womb doner he had. I hope shes getting her just dessert in prison 😈 i also pray Minnesota takes a long hard look at their custody laws!!

    I’ve watched a lot of true crime stories that are absolutely upsetting. But this is honestly one of the most heartbreaking cases I have ever sat through. That poor baby deserved the entire world. My heart goes out to him and his family.

    This case had me crying, not all of them do but this one hurt more than usual for a number of reasons. This smart and happy little boy was failed by a system, and let into the hands of an absolute depraved, self-centered narcissistic monster that shouldn’t have the right to bare the title of ‘mother’.

It’s so frustrating when you can fully agree, that these kind of accusations should be taken very seriously and be investigated, surely at least a similar amount of time must be taken to find this evidence before totally believing the lies and ruining someone’s life.

    This is a MOST heart wrenching case. The system absolutely failed this child & his father.
    There are no words for what’s happened here.
    I’ve seen a few videos about this case, though can’t help to wonder: Did any of the social services worker/judges interview or SPEAK directly to little Eli?
    Why didn’t any of them think to ask Eli what HE was experiencing/feeling/wanted?

    I'm sick of ppl using BPD as an excuse. I have BPD it effects my life severely and I can confidently say the only thing I do truly love about myself and reason for living most days is being a mother to my daughters. We self destruct sometimes, we don't hurt others. Especially considering most of us got this diagnosis from childhood abuse

    So sad, it's utterly heartbreaking, it really highlights the need for greater funding and oversight to all social services, too many times the sentence of "lessons will be learnt from this" but things just don't change. What a horrible story about a beautiful little baby who was blessed with a dad trying to be his dad wholeheartedly. Completely heartbreaking case 😢💔 the system completely FAILED Eli and should be totally rehauled in order to stop this from ever happening again 😣

    Gosh I've never heard of this one it's truly awful! The whole thing of people telling them that the child would end up seriously harmed or dead reminds me of Elisa Izquierdo, especially with the fact she also had a really loving golden father. I hope you cover her case one day, that case is an example of true mind-blowing evil and absolute failure of child protective servers.
    (I'd love for you to cover the case of James Prout, no one ever talks about that case, I've only ever found one documentary and it was just all about the killers... James Prout deserved better and I think you could do that, I'll warn you though it's heartbreaking and it stayed with me for a very long time. 💕)

    My niece has bpd, and if she imagines something has happened, there is NO convincing her that it didn't happen. It is a very scary world to live in, and here in the States, there really is no help for her.

      Is there help for people like that anywhere? My daughter has BPD also…and it is a frightening condition. Nothing seems to help. (Therapy, meds, hospitalization) I hope your niece is able to get the help she needs.

      @gwenjackson8583 we've been dealing with it for almost 20 years. She's pregnant with her 2nd baby and getting married in August if he stays around. I don't believe anything until it actually happens. She's not very med compliant, and her "therapist " is a JOKE...., we live and breathe on a whole lot of prayers.

    Emma, that absolutely broke me when you said something to the effect of, "instead of watching Eli grow, Tory was given his son's ashes." What an absolutely horrific, heart shattering, and painful story about a loving and beautiful little boy. Eli will never be forgotten, I wish he could have had that nice life we all dream of for kids. I know his daddy Tory would have done entirely everything he could to make life perfect for his son ❤❤❤ I'm not even mentioning JT, it (that's a monster not a human) doesn't deserve any breath wasted on it's name or energy wasted thinking about it.     You have described the family court system in the US perfectly. It makes me laugh when they talk about "the best interests of the child" but literally do nothing in a child's best interest. Happens all the time. Most of the time doesn't end in murder, but I can tell you, my adult 30-year-old son has mental health issues due to the custody battle I had with his father in the 90's and I had to hire a lawyer for my second son to get custody of his daughter due to a situation similar to this, where he had no rights because he wasn't married to the mother and she decided to put my granddaughter up for adoption. She even gave her to these people and they had her for 3 months. I spent so much money for the lawyer and it worked out in his favor, but it shouldn't be this way. Its exploitative and means poor people cannot fight for their children. Especially poor men. So don't get me started on the coercive, unethical, adoption industry.

    Unfortunately some mothers do use children as weapons. I live in the UK and one of my own sons haven’t seen his children for over a year as the ex decided to complain about abusive behaviour while they were together after being not in a relationship for over two years -with no proof, and while the claims are being investigated his contact was stopped - therefore none of our family have seen these two children in over a year either. The courts are far more in mothers favour than the fathers.

      Thankfully, my son's ex was never abusive to their daughter, but she was a piece of work! They weren't married and from day one she started carrying out her plan- she didn't put my son on the baby's birth certificate (said is was a hospital error but never fixed it) then kicked him out of the apt 4 months later. She allowed face time video visits for 8 months and got my son to pay for a ridiculously huge 1st birthday party, and then moved in with her new boyfriend and cut all contact with everyone in our family. None of us have had contact for 3 years. When she cut ties, her income allowed her a free lawyer through legal aid. Because my son had a decent job, he had to find money to pay for his own lawyer. It was extremely expensive. He couldn't continue to fight it. I pray every day my grand daughter is safe and happy.😢💔

    Thank you so much for covering Eli's case. When Eli was first discovered I saw one article about it online and never saw or heard anything about it again until I looked and found she'd just been sentenced. Not to say the story didn't get ANY coverage, there are a few articles but I am still shocked that this wasn't a well known case, even locally. I grew up in Farmington, everyone around here should know who Eli is and what happened to him. No one around here that I have asked even heard about what she did, and that pisses me off.

    Oh my goodness, this case is so freaking heartbreaking!!! It’s like the courts were determined to do everything opposite of what was right for the child. And Ely’s Dad was pretty dang perfect(IMO) as a Dad.

    Emma, I've been subscribed for some time now and as hard as this particular case is for me to get thru, I just wanna leave another of my thank yous.
    You have been one of my favourite tc channels for your input, your detailed work and your personality, but from where I'm standing, you moved on to be a very vocal and very loud advocate for children and a passionate voice for those we lost to these monsters. I don't think there's enough words that can explain how very deeply thankful I am for that. Yes, I have survived a very abusive excuse for a mother, so it hits differently and yes I am often triggered, but honestly that ain't got nothing to do with the facts you talk about: that people need to do better, as parents, as citizens, as social workers, teachers...as humans.
    If you see something, say something. You might come off as a nosy next door Nancy. Or you might save a life.

    Thank you for emphasizing about mental illness and these awful people, and I agree: many people would rather hurt themselves over hurting their loved ones.
    Also, as an American, I can appreciate the need to make sure those who purchase weapons have a mental wellness check, but do it case by case; stuff like Julissa, who had history like this.

    First of all, I just love you Emma and your way of putting these cases out there so that we can all be kept aware in honor of those lost to absolute demonic monsters! I am a true crime fan. Some think I’m weird for that but it’s just me! I am deeply disturbed that these evils even exist in our world but my fandom is in those like you that keep us aware! I do have to say that maybe I’m slowly being desensitized because it makes me more angry and more angry that people are pampered in their convictions due to possible mental illness! I do realize that exists but there’s such a fine line as far as I’m concerned because I’m starting to believe that most of these monsters are exactly that! Monsters born without a conscious or even a soul! Thank you Emma for yet more amazing coverage over an obviously enormous and growing evil throughout our world.     Firstly thank you for bringing this case to light with such love and care for Eli, I really don't know what it's going to take how many children have to die before the ridiculous idea that the mother is always going to be best for their children. Eli had such a loving supportive father that would have done anything for his son my heart breaks for him. I hope that in time with the love and support from his family.

      Not all cases. Sometimes the mother is definitely the best for the kids. My mother for example was always way better than my father but I think society and court forgets that some mothers are really horrible abusive monsters and some fathers are outstanding decent parents
      As soon as sexism stops in the court. Maybe more kids would be alive. It's not just Eli. I think the deaths of a 4 year old boy Liam Fee and 1 year old girl Star Hudson would also still be alive if they were in their fathers care instead as their evil mothers were clearly unfit for them.

    I don't understand how she had access to a weapon. I have schizophrenia and am not allowed to own one despite the fact that I've never harmed anyone other than myself. The US needs serious mental health and gun reform. Any individual trying to purchase a weapon should have to undergo an psych evaluation beforehand.

A horrific moment In a horrific period in the time of the troubles in Northern Ireland, its the story of a psychopath given licence to freely indulge his bloodlust to the point where his own people (it is alleged) colluded with their sworn enemies to bring his reign of terror to a fatal end... would love to hear your thoughts on how this man convinced his closest peers to go on a horrific and bloody killing Spree where innocent men and women were targeted and brutally murdered and literally left in the gutters of Belfast.

    I'm from Minnesota and you are correct. Our system is broken in so many ways. That poor poor boy. It just breaks my heart.

    Mental Health services here in the States is a severely broken system. That's no excuse for the mother's actions, of course. Additionally, the Child Protective Services system is just as broken. When the 2 grossly inadequate systems come together, failure is no surprise.😢

      We have exactly the same issues in the UK. There has always been less money put into social services than healthcare and even less in mental healthcare than other sectors. It's very sad and worrying as these cases continue to happen. Some are unavoidable but even if they could have saved 1 out of 10 it would be 1 less life gone.
