Does a Non Competition Clause Meet Your Goals
zhlédnutí 11Před 14 dny
Previously, I discussed the pending FTC Ban on non-competition agreements, or non-compete clauses, in employment agreements. In New York, we already had restrictions on these, so maybe the federal restrictions aren't as frightening for businesses as you think. Regardless, now is a great time to consider: 1. What are the goals you expect to achieve through such agreements? 2. What do you hope to...

Lack of Documentation Can Hurt Businesses

When I started practicing law in 2002, many people believed it was best not to document much in their businesses. If it's not documented, it didn't happen. Right? Wrong! The lack of documentation can hurt businesses in many ways: - The lack of timesheets could subject them to overtime wages asserted by employees (or misclassified independent contractors). - Failure to memorialize the terms of a...

What the FTC Got Wrong in It's Ban on Non-Competition Agreements
zhlédnutí 9Před 2 měsíci
Last week, the Federal Trade Commission announced its ban on non-competition agreements, or "non-competes." Although the ban makes sense with employees, who we want to be able to demand physically and emotionally sage workplaces and find gainful employment after separating from an incompatible employer, it includes independent contractors, which I think is a mistake. Yup, but not a man! What a time to be alive. An entire generation of men blocked by systemic prejudice! Yay!
We know a lot of men working in DEI. If this is your passion, keep looking. It takes time and persistence to find a compatible job. The persistence can be hard. Do it anyway. Good luck!

@@thirdearCR If you give me permission I can give you some tips to grow your channel
DEI thrived on the belief that it was objectively moral. If you support DEI, you are doing good. If you oppose it you are doing bad. And since everyone wants to do (and be seen doing) good, and not be seen doing bad, DEI efforts thrived and were unopposed, no matter what they actually did. This presumption of moral goodness has been eroded. That is basically what we see in the video, where she differentiates between good and bad DEI efforts. What's disappearing is the idea that just because it is labeled DEI it is good, and therefore nobody can speak against it, lest they be viewed as bad. This exempted people from exercising their moral judgement when it came to DEI activities, and effectively silenced many. We are surely better off without it.
Thank you for your comments. It does seem that, like many movements, a few people got swept up in the process and went in directions not intended by those who: - acknowledge the diversity of our world - recognize the need for equitable distribution of resources - want to give all humans an opportunity to participate meaningfully in life That's the problem with anything humans create. There will always be flaws. But that does not mean we need to throw all programs away. Some are highly effective at reducing segregation, inequity, and exclusion. Others have pieces we can use to build more peaceful and productive families, workplaces, communities, and more. It doesn't have to be a zero-sum game,
Indeed you are right.
Where’s the program where can I find it
We haven't done the live program in awhile, but if there is enough interest, we certainly can again (in-person or online)! In the meantime, you can also learn the process in the DIY Conflict Resolution book: www.amazon.com/DIY-Conflict-Resolution-Choices-Actions/dp/1636180817

When I was working for a regular job, I always wanted to wear a dress, but back then I used to present as a woman whenever I crossdressed. I now present as a man when I wear dresses and I work from home, so I'm glad to never have to go through a situation like that where I would get fired for dressing like a woman to work. I'm glad progress is being made in the laws to allow men to wear what they want to wear in public or at work.
We are also glad progress is being made. Clothing isn’t gendered by nature. Society genders it. Aside from safety and hygiene concerns or branding and identity, clothing has little to do with whether someone can perform the essential functions of most jobs. We have bigger problems to focus our time, money, and energy on.
@@thirdearCR I agree and thanks for the response. Like you said clothing isn't gendered by natured as society has gendered it and hopefully that fully comes to an end one day far into the future. Like you said, clothing should be one of the last things that anybody should be focused on when it comes to getting a task done. We have much bigger problems to figure out in society and execute them.
Dei is first to get laid off becuase its not productive or genuinely good management. Its a Bunch Of marxist bullshit. GRAMSCI MARXISM. MAO DID THE SAME DURING HIS CULTURE REVOLUTION IT WAS EVIL
It’s all about control I’m over it all
If I claimed to identify as an elephant that wouldn't make me an actual elephant in reality, but still a human being. I am still a confused person if I actually see myself as an elephant becuase I wish that were the case or I know that I am not an elephant and so I am a liar by saying to others that I am or else I am calling myself an elephant but don't know what an elephant is - so genuinely believe it to be true through being misguided about where the truth lay and need correcting. All of these variants could make me feel as though I am an elephant, except the lie variant. Why should the rest of us believe that I am an elephant and call me an elephant? Would it make it all the more true - reinforcement in numbers? No. It make everyone who claimed I was an elephant, a liar. This whole ideology is an assault on truth, objectivity and logic. It has nothing at all to do with accepting and including genuine categories of people otherwise disregarded and ignored.
It's too late. This is gonna run it's course. Sorry.
while this is a useful video, the title is COMPLETELY misleading.
Did you watch the entire video? I do answer the question. Was my answer not clear enough? How would you improve it? What’s not clear? I’m still learning to get everything tight in three minutes and appreciate your suggestions.
Some jobs do I'm a man I love to wear women clothing
True. There are safety concerns in many jobs if, for example, anyone is wearing a long, flowing dress. But as I discussed in a later video, clothing is not gendered. Humans made that up, and we realize now it's arbitrary and probably unnecessary.
@@thirdearCR but if they do then they can't stop me from wearing women underwear and bras only if I don't say anything and there's restaurant that would let men wear dresses and skirt's with high heel's

Excellent points Nance. I do struggle with communicating succinctly when I feel wronged, not only because my emotions temporarily block my rational thinking, but also because I must express myself in a second language. I like your relevant reference to pop culture in this clip, and while I know I won't resort to physical violence, I am grateful for the reminder of implementing your 7 steps. Your book has changed my life.
I am so happy to have made a difference for someone. <3
It’s easier to just refer to them by their name, this way it is respectful and you never risk misgendering someone.
True. I also think most people respect that you try and clean up when you err. We're slowly learning to work together more compassionately.
Nance, you make a good point that we need to set those initial steps in motion to get things rolling. Sometime starting is tough. But once I do something (even if its small) I am already one step closer to my goal. I'm going to hold on to that thought - Thanks!
In the Atomic Habits book, James Clear reminds readers that our habits grow from our identity (which I touch on in the "Is Racism a Bad Habit?" video). You are already one step closer to your goal because you identify as a savvy business owner. I see you as one, too! Let's make 2022 your best year yet!
Recruitment agencies are not well disposed towards CVs plastered with pronouns.
Can you explain what you mean? Are CVs and resumes being submitted with multiple references to preferred pronouns? It has been a while since I have hired for my firm, and I thought the movement was toward as few gender, race, ethnic, etc. identifiers as possible--in an effort to make the hiring process as objective as possible. It's always interesting to learn that our perceptions aren't accurate. Tell me more.
I am a big fan of Mary. When I was living in San. Fransisco I accidentally ran into her book at Barns and Noble. The book was Live more, Want Less. It literally changed my life and how I approach everything. Most importantly, it helped me unload physically and emotionally. Mary’s books are written in clear, and very precise language. The book impressed me so much that I found Mary on Facebook and wrote her, and how happy I was when she responded and even gave me some helpful advice. Thank you for your review. Next time you speak to her please say that her loyal reader Daniel from Russia is sending her my best wishes.
Interesting book recommendation 👍 I will look it up
Excellent video!
Thank you very much!
Let's not. Loser.
Let's talk about made up shit.
You're absolutely right, Jonathan. Pronouns are just made up. They were presumably intended to help people communicate and connect, but they don't always work as intended.
Did any of you watch the whole video? Some of you may not like the whole gender pronoun business. But in NYS it's a legal reality. I am pretty sure that in NYS, transgender people are a protected class just like women and minorities. Don't shoot the messenger. She is simply telling you how to protect yourself from lawsuits. If you have a problem with the legal enforcement of gender pronouns, tell your public officials.
If I get offended because someone properly identifies me by my biological sex then that’s on me. And the solution isn’t to try to control how other people talk to me
She is wasting her time, no decent employer is going to be told what or how they address an interviewee. The employer will be polite and respectful. He /she does not need to do any research to find out whether they are miss, mrs, master or mister if the interviewee does not like that we will nit employ them.
No matter what one wants the DNA will come back one of two ways.
No no, just no. Gender pronouns are the stupidest things I've ever heard in my life I'm still going to use the words I want to use.
"It's really not that different"? Yes, yes it is. These narcisists get off attempting to control your language.
Anyone who tries to force you to use "their" pronouns simply respond by telling them your pronoun is master and they must respect it. Their ideology will fall apart in front of your very eyes.
Asking to be called by your middle name, or changing your last name for any reason is NOT similar to forcing people to be call you something you are not. Trying to force people to bend their sense of reality just to make you feel better is wrong, it makes communication into an impossible to navigate mine field. Heres a better solution, keep politics out of the work place. And yes this aggressive push to by the radical left to take over language and its meaning is political.
Thank you for the education
You're very welcome. I hope this helps you have more effective communication and a better life generally. :)
Thank you for this kind review. I'm honored that 48 Days to the Work You Love has played a small part in helping you do exactly that.
Thanks, Dan! It has played a large part in my life and the lives of many people around me. There's so much more possible than we might realize--especially if we follow old models.
This is in my library, too! Even Scripture says it's not money itself that's the root of all evil -- it's the "love" of it. It's when all we do is in pursuit of money, and not to provide value or service. That's when people start to cut corners, or make bad decisions. Harv's book is a terrific tool for healing money hurts. Well done!
I love seeing how many people this book has helped and being reminded how lucky I am to have such great people on this journey with me. :)
Great video Nance!

Great Nance!! I have to keep remembering to put on a real shirt instead of my cartoon T-shirts.
Cartoon T-shirts and things that make us laugh can actually be useful. It's those who forget they are on camera who cause the most unintentional chaos. Of course, this reminds me to talk about dress codes and "professionalism" in a future video. Thank you!
Awesome ladies!!!

Owning up to your mistakes and inviting discussion from anyone you may have offended....big time props to you Nance :)
Thanks, Brian! It's not fun to realize we've made a mistake that we need to clean up, but it's so often worse in our heads than in reality. People were very forgiving and some were even surprised that I was concerned about it. Still, I'd rather err on the side of being too considerate. :)
