    My experience at a C&P exam felt more like an interrogation. They TRY to trip you up. I’m convinced the VA gives them setbacks for writing bad nexus letters

    I just had my C&P exam two days ago for PTSD I was brutally honest about my life over the past 20 years post Iraq Deployment. The Doctor was apologizing to me and felt sorry for me. I also felt like she WANTED me to get Max Compensation. She was almost prompting me to answer YES to almost every symptom. She even went as far as saying “Im going to record this summary in my notes to the VA - let me know if this is accurate” “Veteran served in Combat with the Army in Iraq and had incidents which had multiple people killed and maimed, and has been having very distressing and disturbing thoughts about this for almost 20 years” This is the first time I ever filed for a Disability Rating since my time in Iraq in 2004-05. Im wondering if that long time actually HELPS my case? My point is that I went into the exam very nervous, and I was pleasantly surprised on how it went. Easy in a sense but not easy to conjure up deep memories and honest commentary on my life. I made sure to tell her that this wasn’t easy for me as I have literally NEVER told anyone about all this.

    Great content! I can relate to a lot of what you said. I spray painted a lot of military vehicles back in 1982 while stationed in Germany. Back then, we did not use any PPE. Aerosolized paint made it into my nostrils, ears, and onto my skin, eyelashes, and hair. I remember having to frequently clean paint out of my nose by blowing the mucus mixed with paint onto paper napkins. I painted inside the motor pool bays without any mechanical ventilation. Because spray painting was loud and messy, I was made to paint during graveyard hours. The CQ runner never came to the motor pool, so I couldn’t sign up for sick call. I was getting headaches, nausea, dizziness, and back pain from climbing up and down vehicles with paint guns, air hoses, and other equipment. Because I never went to sick call, nothing is documented in my STR. I got out in 1983, just a few months after the painting operation ended. Shortly thereafter, I started getting frequent nose bleeds, which lasted for several years. My daughter remembered this, so she wrote me a statement about it. Up until 3 years ago, I did not know much about VA disability, as I always assumed it was for combat-injured vets. Anyway, over the years I’ve had various medical issues, but I did not start seeing a private physician on a regular basis until a couple of years ago. Since then, I’ve been diagnosed with Reactive Airways Dysfunction Syndrome PFT with methacholine challenge test done), bibasilar actelectasis (collapsed lower lungs), lung nodules, severe sleep apnea, GERD, nasal polyps, deviated septum, migraines, allergic conjunctivitis, cateracts, hearing loss, tinnitus, arthritis in both wrists (I’ve had the steroid injections), mid and lower back pain, and major depression disorder. I have found three former military buddies who can corroborate the painting operation, but only one of them has provided me with a buddy statement. The two other guys don’t seem to want to get involved. I sent a FOIA request to the Army asking for records from my military unit to verify the painting operation I was involved in, but it’s been almost 2 years and no response. I also sent a FOIA request to the Army Research Laboratory (ARL) asking for the description of the version of the CARC paint I painted with. They sent me the military specifications document (MIL-C-46168). After reading through the document and doing my own research of the contents of some of the pigmentations, that version of CARC contained lead and HEXAVALENT CHROMIUM. Not good. So I’m thinking that if my lung nodules ever turn out to be malignant, . . . I’ve had three CT chest scans within the last 2 years, but the nodules haven’t grown since the first CT scan I had in Nov. 2022. (The ARL has a video on CZcams about CARC and how the older versions, one of which I painted with, contained hexavalent chromium. They even put up a slide that says hexavalent chromium can cause lung cancer and listed other injuries as well. If interested, just search CZcams for “Coatings DEVCOM.”) The VA sent me an acknowledgement letter of my Intent to File in Oct. 2023. I am currently in the process and putting my initial claim together so that I can file all my injuries together as a fully developed claim. Because I have weak supporting evidence of the event, no related complaints in my STR, no private medical care records until 40 years after my discharge, I anticipate a denied claim. I am not looking forward to the anticipated years ahead of denials, supplemental claims, appeals, etc., but this in-service event I have described happened to me in 1982 and I believe my current health condition is arguably attributed to spray painting those military vehicles with CARC paint. So I’m willing to spend the rest of my life fighting for what I believe I deserve. Thank you.

    So if you're mentally ill you can't be intelligent? My career was in Mental Health so am I supposed to dumb it down when I talk to doctors? And even intelligent Google your symptoms diagnosis symptoms add medications especially since most doctors and psychiatrist are not going to educate you educate you about the about the diagnosis and meds they give you. Are diagnosed myself with liver disease 10 years ago by looking at my CAT scans and was told there was nothing wrong until recently I was told that I have liver disease. "Oh wow doc. It's a miracle. I developed liver disease the moment i had this new ct scan ?" Iwemt to er bcus I knew my pancreatitis was flared and severe pain. Afyer 5 hours i finally got a bed. They said lab work show no pamncreatis so ct scan to find why i think I'm having pancreatitis. (Bcus its my body and I know when I have pancreatits???) I was.right, I had it. But when I was discharged I read my own reports and ct showed a healed fractured rib, diverticulitis and pancreatitis. Um hello, did you read any of the report? Maybe my fractured rib is kinda interesting? It is to me bcus I didnt even know.

    I was diagnosed with moderate to severe complex PTSD, which means I'm contending with multiple events. The documentation of this spans two decades with the earliest notes describing my struggles going back to 2005. The C&P after meeting with me for 30 minutes claimed otherwise.

      When the C&P examiner ignores obvious evidence, it can be the basis for a solid appeal. Keep in mind they may have diagnosed another condition which VA may have rated (and that may be the same % rating you would have received had they called it PTSD).     Im 10% tinnitus, 70% mental health, and 10% sinnitus. How common is it to get tdiu for the mental health part?

    *Damn, not even my lawyer told me that, when I was FORCE to go back to work OR STOP GETTING PAID!!!!* *I 100% would have ended up in the ER IF I did go back to work, so I DEPLETED MY BANK ACCOUNT AND STAYED HOME DOING MY OWN ''PHYSICAL THERAPY'' for 4-months, then when I returned back to work, after 1-month I RE-INJURED THE SHOULDER I HAD THE SURGERY ON!!!* *MY INSURANCE ADJUSTER HAS BEEN PLAYING HIDE & SEEK AND OTHER HEAD GAMES AND MY LAWYER IS DOING NOTHING TO HUNT DOWN THAT ..............!!!!!!!!!!* *I WAS ALWAYS TAUGHT TO ''TRUST'' THESES PRICKS, NOT NO MORE!!!*

    The VA's own doctor diagnosed me with PTSD. I filed a claim with a VA Service Rep. I had a C&P exam and the ruling was was I didn't have PTSD despite the VA's own doctor saying I had PTSD. I appealed and again they said I didn't have PTSD I only had anxiety. The VA VA psychologist who was treating me copied his treating notes and circled the diagnosis on the notes stating that they were being billed for PTSD and that I had PTSD. After a few months I received the final review and they acknowledged, finally, I had PTSD and won my claim. I was awarded 30% disability. The VA is in fact the enemy. I'm battling them again for GERD for secondary to PTSD. They denied the claim. They're trying to say I have gerd because of a hiatal hernia. This despite that the VA hospital and the VA doctor specifically said I have GERD and do not have a hiatal hernia and nowhere in my record does it say I have a hiatal hernia. Here we go again!!! By the way the VA medical staff has been outstanding with me and all my issues.

    It doesn't matter at all because the va is allowed to do anything they want for as long as they want to. They were allowed to deny me for over 10 years by claiming I had PTSD before I even enlisted and they never provided any evidence to support that. I had a Purple Heart from being wounded in combat as well as the incident report as well as other documentation but none of it mattered because they were allowed to deny me for over ten years without ANY proof at all on their end.

      Right, I say what’s in the dbq symptoms list and look the examiner dead in the eyes and wait for them to type it down in their notes. I’m not playing games and we are not friends. I’m not going to sugarcoat shit for the VA. Let them accuse me of whatever the hell they want but what they won’t be able to do mix up my words because I said it verbatim. “Yessir I display grossly inappropriate behavior, …. Uh nope that’s uh right sir exactly as described grossly inappropriate behavior. He can draw up all the notes and opinions but two things happen. It gets documented and the box under symptoms list gets checked. Stop playing games with the VA and be as direct with them as they are in denial letters. F that !

    good video, def going to refilt a claim...im curious if there's a statue of limitations so to speak on this...years ago i filed a claim, i explained how i had diabetes and now peripheral neuropathy....i have 20% on a knee, and i stated to va that since i could hardly walk after they operated on me, ( docs at va actually told me that i was on the verge of being diabetic) i gained weight, became diabetic, and then had peripheral neuropathy...claim was deneid and was told that diebetes was not service connected.

    Luckily my PTSD was well documented while i was still in. As a medic i saw tons of shit and still have nightmares or just dont sleep. I was hospitalized while i was active duty in a civilian hospital which took care of me, better than any military facility ever did.

    Courts have held that disability plan administrators have to consider Social Security's decision, but they can getvaway with just saying in their denial letter that they looked at it. There is no requirement that they follow what Social Security decided, and very often your company's disability plan has different rules than the Social Security system. Bottom line is that the Social Security decision is not binding on the disability plan administrator unless the plan document says it is, and that is prettyvrare these days. That does not mean that you would not be. Entitled to receive long-term disability benefits. Though comma and you should certainly pursue that if Social Security has decided, there is no occupation you can handle with your disability.

    Disability Pension denied, there reason was my doctors medical records wasn’t enough basically, even though my doctors said I was disable, plus SSDI agreed, they didn’t look at Social Security decision at all. I believe they didn’t think I wouldn’t pursue any legal action being that I would receive some kind of pension anyway. Knowing the only way to win was in Supreme Court. Isn’t that a huge mistake on them for not reviewing SS decision at all.

      Yes, TDIU pays the same benefit as 100% scheduler VA compensation. NOTE: Not all 100% awards are permanent & total (P&T). Getting P&T just impacts what VA has to do to take the benefit away from you, not the rating or how much you get. AND you can get P&T for TDIU also.

    I’m a nurse, so I know the terms in the DSM and use them in my normal conversations, so I hope that won’t be detrimental to me because I put thought blocking on my claim form.

      I think that is fine. You have a good explanation for why you would use terms like that. Most veterans do not have your background and using medical terminology is often a giveaway to them having looked at something online or in a book about PTSD.

    I have been on permanent disability for 10 years with 10 excepted injuries. Moved to a different state 2 years ago. Pain management PA treats migraines but nothing else. Psychiatrist just retired. Cannot find either for help

    I have both. Got 100% rating in 2019. I applied for TDIU in 2014, but that stayed in limbo until 2022. Initially got 67,971 in back pay then three months later received another $59k plus the designation housebound.

    What is looked on aid and attendance claim when scheduled during a C&P exam

      Sorry, I don't understand your question. If you are asking whether a C&P examiner evaluates whether you need Aid & Attendance, the answer is yes, they are supposed to. They often do not, so you should be sure to claim Aid & Attendance when you file your claim.

      @@roldyczarmoaes6226 The examiner is going to try to figure out why you need assistance taking care of yourself, whether you have problems leaving your house, and what kind of assistance you need in your home with things like activities of daily living (toilet, bathing, eating, dressing, etc.)

      That really depends on your circumstances, but they are very similarand both are dependent on whether your condition(s) improve. How long you have had your rating can be a big factor. If you have a rating and your medical condition improves within 5 years of the effective date, it is just as easy to take away a percentage rating as it is TDIU. After 5 years, it becomes progressively harder for VA to take away a percentage rating, going on up to after 20 years, it is locked in unless you are engaging in fraud. On the TDIU side, TDIU is not easy to take away though, because if you are unable to work, you never earn money. You have to report earnings, and that can cause problems for your claim. But if you are not able to work, that is not a problem. If you are able to work and earn more than the poverty line, then you are not actually entitled to TDIU, so it should be taken away under the law. Essentially, if your conditions never improve and you keep going to doctors to document how severe they are, you should not have a problem with either 100% schedular or TDIU being taken away.

      Good idea. You could also give the examiner a copy of your notes and ask that they be included in your records. TIP: if it took you a long time to record your notes because of your symptoms, write how long it took, i.e., "Because of my problems focusing, it took me 5 days to write these 2 pages." Actually, we almost always recommend to our clients that they keep a detailed journal with examples, and if it is good, give a copy of that to their own doctors and a C&P examiner.

      Social Security's ability to cut off benefits is tied to whether someone's condition has improved, so it is based on what the medical records say. Life insurance is not a factor in any way.

    DO NOT GO! I went from 50% to 100% never attending a single C&P exam. The law allows you to submit DBQs from your own doctor in place of a C&P exam and I’d encourage all veterans to do so. A C&P exam benefits you in no way. As a law firm I’m surprised you don’t suggest this.

      We do use this tactic with our clients. That was not the point of the video though. We use private doctor DBQs and reports in our cases every day.

      @Dushawn Bulloch. You may ALWAYS use a DBQ. But you do not get to pick whether you attend a C&P exam. VA decides that, and if it schedules one and you do not attend, VA will undoubtedly deny your claim. Also, PTSD is a unique condition - it is the only condition that federal regulations state that a trained C&P examiner must diagnose. While your DBQ from a VA treating psychologist is great, as is one from a private doctor....and it is a good tactic to get one...do not be surprised if VA still schedules a C&P exam and requires you to go.

    What if you have chronic pain from nerve damage in your back after multiple fusions? Loss of control in your leg walking. How does an FCE show that?

      An FCE does not show your pain or loss of leg control. Instead it documents how long you can walk, stand, etc. It proves your functional restrictions in terms of function needed for work. Your doctor's records should verify your nerve condition and loss of clinical leg function.

      I do not know the specific, but try writing a letter to them outlining their error. Tell them if they do not agree, to writeyou back and "show their math!" Be sure to tell them you are appealing.

    What action can an LTD insurance carrier take against you if you are unable to pay them your SSDI back pay? Can they sue you in all states? And if they can sue you does the fact that you have no money to live and medical bills an acceptable defense that a judge would consider?

      First, the insurer can stop your check until it recoups the overpayment. Second, yes, you can be sued...though that rarely happens unless your benefits are cut off. When these suits are filed, the insurer typically will sue you in federal court, because most LTD insurance that hS an offset for SSD is covered by ERISA, a federal law.
