    Important Tips Filing an Application for TDIU with the VA - VA Disability Attorney John V. Tucker explains.
    Watch as Disability Attorney John V. Tucker goes over what you need to know if you're going to file an application for Total Disability based on Individual Unemployability with the VA.
    One thing to keep in mind is that Individual unemployability is another way to get paid the same amount of money as a veteran rated 100%, if you can't work because of your service connected conditions. In other words, Individual Unemployability, is for veterans that are not rated 100% combined.
    You also must understand is that Individual Unemployability is governed by Title 38 of the code of federal regulations. Section 4.16. If you take the time to read it will help you understand what VA is looking for in terms of TDIU; Total Disability based on Individual Unemployability.
    It is also possible to work and get IU, you can actually earn up to the poverty line, they call it marginal employment in the regulation. Also if you're employed by a family member or somebody else who's giving you what's called sheltered employment, you can get TDIU.

    I was assigned a combined service connected rating of 60% for hypertension and heart disease. I recently had my 2nd heart attack and had my 3rd stent placed in heart. I'm on 17 scheduled medications. I think I might be qualified for TDIU.

      If you think you cannot work because of your ssrvice-connected conditions, you should file a VA Form 21-8940 Application for Total Disability Based on Individual Unemployability. Do not delay, because VA only pays benefits from the date you apply forward. If that is denied, please call us to see if we can help with an appeal.     I been a total 160 disability n rated at 90%.....I have one rating of 40%...... I already intent to file for TDIU 7 month ago can u help me get over the hump to 100%......Also i was approved 3 years ago for disability retirement due my condition not able to work.......thank you

    So. I’m at 95%(rounded down) for multiple disabilities primarily osteoarthritis in my knee. What are the chances of my approval/ acceptance for TDIU?

      Well that totally depends on whether your service connected disabilities prevent you from working. If they do, it is certainly something you want to pursue. I am confused by your comment about being 95% though. If you are at 95%, it should round up to 100%, not down. Give us a call on Monday and we can assist - (866) 282-5260.

    Im 10% tinnitus, 70% mental health, and 10% sinnitus. How common is it to get tdiu for the mental health part?

      Very common. Sometimes all it takes is better documentation about how your mental health condition impacts your ability to hold down a job... Other times you need your doctors to document your symptoms and limitations better. We have helped hundreds of vets with 70% ratings for mental health get TDIU.     do you get the same benefits as 100% P&T?

      Yes, TDIU pays the same benefit as 100% scheduler VA compensation. NOTE: Not all 100% awards are permanent & total (P&T). Getting P&T just impacts what VA has to do to take the benefit away from you, not the rating or how much you get. AND you can get P&T for TDIU also.
