Top 3 Reasons VA Denies Disability Compensation Claims - Disability Attorney John V. Tucker answers.
Watch as Disability Attorney John V. Tucker reveals the top three reasons VA focuses on when they deny Disability Compensation Claims.
If you filed a claim for benefits, you know you're waiting for a rating decision from the VA. You're waiting for a decision saying, "This is service connected," and if it is, they give you a rating percentage. Before the VA gives a rating percentage, there are three things they have to decide are present to give you service connection, and those are really the three areas that we see that are the biggest problems in terms of VA denials.
    • Proving an in-service occurrence or event
    • Showing they have a current condition with medical records
    • Proving a connection or nexus with an in-service occurrence or event
If you've had a claim denied by VA on the basis that it wasn't service connected, or a rating percentage was assigned, but you don't feel it's high enough, call the Tucker Law Firm at 855-757-0707 or visit www.TuckerDisability.com

I just filed for Tinnitus I was a Navy Seabee and suffered from Tinnitus for years. My problem is I have medical evidence from a private doctor but I don't have any evidence to support from when it happened, which was in 1990. I went to my Senior Chief back then and he told me not to report it because they would hold it against me blah blah blah. So I dealt with it for years until I learned from Tucker that I can try to claim it. So I haven't even gone for VA Medical exam yet. The VA contacted me and said everything looks good and they will contact me regarding my exam when it's scheduled. Any thoughts ??

Can't tell you too much based on that limited amount of information, but I would recommend that you get a statement into the record explaining that you have never had exposure to other loud noises beyond what you were exposed to in the service (assuming tgat us true) and try to get your ear/nose/throat doctor or audiologist to give you a report explaining that your tinnitus at least as likely as not (50-50 chance) related to your service. Good luck!

I was exposed in 1990 during range training then my mos which is the Navy Seabees (construction Battalions) made it impossible to recover . Initially when I told my superiors they scoffed at me saying it would cause me to be removed from my A school so I kept quiet about it. I'm pretty sure I'm shit out of luck.

What is a compensation service case review ? This is post service connection determination and already receiving benefits.

It is a phrase that has no official meaning in the VA according to several VA personnel I have asked. If you were seeing this on your eBenefits site, it may be that the computer system is automatically drawing information from other parts of the system to give a status which technically does not exist. I have had several clients with claims at different levels in the system have this appear in their eBenefits/va.gov accounts. Most commonly it has come up when VA is doing a review of a claim to determine if the compensation rating that is being paid should continue to be paid at the same level...in other words to see if improvement has occurred. But that has not been the case for every one of my clients that has brought that to my attention.

@@TuckerDisability It doesn't show up anywhere (I don't even know where in ebenefits I would see that kind of info) but the VA told me over the phone thats what is occurring. I have a good honorable 4 year discharge and a separate second admin oth (that is not upgradable) with current compensation attached to the good one. It seems to confuse them. However, if I call every few days I get a slightly different explanation as to my status everytime. I wish I could see what they are looking at when I call.
