      My husband is a vet and in order for him to receive certain benefits (loans, healthcare etc) we are required to stay in the city. And here in Chicago the taxes and cost on anything is outrageous and the HOA is in every building thats either not an actual house or a privately owned building. So ppl like us who are only making 46000 with 4 kids don't have many options bec of how expensive things are here. So another example of of not having enough to not have to pay for something unnecessary. I know that sounds dumb but its true.

      HOA's are managed BY THE HOMEOWNERS! SOMETIMES these are farmed out to HOA MANAGEMENT companies....... BUT, regardless of WHO is the representative manager. The HOA members must abide by COVENANTS AND RESTRICTIONS. Most in the community are probably HOMEOWNERS while some are RENTERS. IF A HOMEOWNER "RENTS" their home, they general are responsible (per the HOA legal documents) that renters are informed of the rules. Look to these documents (including legal HOA RESOLUTIONS for "changes") to resolve conflicts.

      Nope, that’s called a co-op, where one only owns a percentage of the entire property and doesn’t actually own the unit they reside in. I live in a condo community, I own my unit, have the deed and can sell it. Luckily our HOA is pretty good and responsible. They are a little too quick to fine people without adhering to the established, documented reporting process. Board president’s sister lives in a unit he owns and she tattles directly to him on the residents and he fines them based on her word and not the proof that’s needs to be submitted. Utterly corrupt and disgusting. One neighbor was fined for snapping of some braches overhanging the steps that were a trip hazard. No real damage to the shrubs. Sister calls to report it. Neighbor is fines hundreds of dollars to cover removal and replacement of that shrub and the second one (to match) over some branches. Both are retired. The one isn’t strong enough to completely destroy a shrub and the other spies on everyone all day long 🙄

HOAs that get power hungry like this are absurd and need to be fought against. Ultimately it’s your own neighbors making these rules so if the majority speaks up against them they should be able to overturn the rule.

      When my grandfather was a kid he was paying 5 cents for a bag of candy now I'm pulling out 5 Bill's to pay for that same bag. And before that, my 80 year old grandfather was buying cars for 1000 dollars but his grandfather was buying cars for 100 dollars. Money became more scarce and inflated with each generation. There are tons of economical studies made by people who are paid the big bucks to find this out for you. It's one Google search away.
      But this isn't the point. HOA's are more than just a few 'rules' Dave. It's a ball and chain on freedom. I can't close my garage door? What's next? Can't close my windows when I change? How about lock my doors when I go to work? Open your eyes.

    • @dttra566
      @dttra566 Před 3 lety

      @Jared Early covenants and deed restrictions were established to control the people who could buy in a development. In the early postwar period after World War II, many were defined to exclude African Americans and, in some cases, Jews, with Asians also excluded on the West Coast. For example, a racial covenant in a Seattle, Washington, neighborhood stated, "No part of said property hereby conveyed shall ever be used or occupied by any Hebrew or by any person of the Ethiopian, Malay or any Asiatic race." In 1948, the United States Supreme Court ruled such covenants unenforceable in Shelley v. Kraemer. But, private contracts effectively kept them alive until the Fair Housing Act of 1968 prohibited such discrimination. By requiring approval of tenants and new owners, HOAs still have the potential to permit less formalised discrimination.
      And state oversight of homeowner associations is minimal, and it varies from state to state. Some states, such as Florida and California, have a large body of HOA law. Other states, such as Massachusetts, have virtually no HOA law.
      HOA has a very racist origin and really has no place in modern society today especially when they are not been overseen by any government or regulatory body. I am NOT going to place my rights of what I can or cannot do with my private property and essentially the enjoyment of my property that I have made the biggest investment of my life for in the hands of a bunch of people that are basically above the law and have to rely on them being "chill" in order to be happy.

      @@JohnVJay No, it depends on who appoints or elects the boards and the HOA bylaws. Many HOAs are set up to provide the developer a permanent income stream. Residents may not even have the right to dissolve it or even change the board or at least not a majority of it. This doesnt necessarily have anything at all to do with the age of the HOA though some HOAs are written to be reratified after say 30 years and if not automatically dissolved etc. Others are automatically renewed at specific time lengths if not dissolved.
      Yes the developer can turn HOA over totally to the property owners if they want usually when almost all of the HOA is fully developed.
