      It’s a last resort but it’s an enforcement measure when everything else has failed. Have you heard the saying you can’t get blood from a stone ? Well you can at least get equity from someone’s house.
      People don’t get to ignore their financial obligations to the HOA or their responsibility to keep up their property, if they do they get tossed out.
      They can go do poor people 💩 somewhere else.

      There are reasons to allow foreclosures, but they are very rare and more to incentivize doing the right thing. The examples here are insane. The issues are that some boards are not resident focused combined with the fact that most property management companies are awful.

      I think as long as all parties are in agreement then there shouldn't be an issue. Obviously some HOAs are ridiculous, but if done right it just helps protect peoples property values from shitty neighbors

      The problem is you may agree with this group of individuals running the HOA but in 10 years that neighbor years back you didn’t see and accidentally cut off and has been silently holding a grudge and just stewing for years. Suddenly is now running your HOA. Then you now all of a sudden start getting letters about yard not up to regulation, your roof hasn’t been replaced every 20 years minimum because someone thought that was a good rule. Your trash can were left out longer then they were supposed to because a loved one had to go to the emergency room at hospital and you took care of them the next day and now you are looking a letter because you owe over $8,000 in penalties and every time you call, or ask a question about these. You do not realize every single contact is costing you over $500 because the HOA lawyer is the person you have been having to talk to.
      Now you are just mad and tired and send a check for the now $15,000 you owe then. Thinking you’re finally done. You just want to get away and take the family to your parents house for 2 weeks it’s been only a month since you sent that payment to the HOA but before the revived it. They had file a complaint in civil court and there’s paperwork saying you have a day in court in two days and you just got home.
      Just wanting to be done you call and ask what is going on because you paid the money owed. Then they tell you. Well we filed this complaint with the court before receiving your payment and because of this, per the HOA agreement you are now owning an additional $12,000 just in lawyer fees.
      Anyway this is how these things happen. Someone usually doesn’t like another and wants them gone. Very rarely are they ever used to protect anyone’s property value but that’s the lie people tell themselves

Reminds me of other inside jobs like the private school my children go to did a raffle to win a car…but the car went to a grandmother of a student who had been “volunteering for over 30 years”…..So you know they just made the fake raffle to have everyone raise money to buy her this car. I found out after the fact. Since the grandson of the winner is in my son’s class.

      It's not always that simple. Where I live, homes with HOAs are vastly cheaper, about $200k cheaper. Nobody wants to buy into an HOA but sometimes it's a way to home ownership you wouldn't otherwise get renting

      ​@SweetEssie That's the price you pay to not deal with HOA and I don't mind that. No HOA for me. I was devastated when I found this amazing perfect 4/3 house (as I was downsizing from a 7/5) and it was under HOA. Almost pulled the trigger. But eventually found another 4/3.

      @@Spearca There's no need for any governing of the minute details of a person's personal abode. A home is where a person should feel peaceful and not be a slave to rules regarding the physical residence set by others as far as possible.
      Governing body or lack thereof, the fact that non HOA houses fetch a higher average selling price is reason enough to do away with HOAs.
      Even if we assume a HOA is "well run", a person's home will still be subject to the rules and whims of that "governing body". Thanks, but no thanks.

      @@oldporkchops Have you ever had a complaint about something a neighbor was doing? That's where HOAs mostly come from, the desire of homeowners to protect the comfort and value of their homes.
      To be clear, I think most of them do a bad job of it, and they do tend to attract or encourage petty tyrants. But they were established by the homeowners, for what seemed like good reasons at the time.
      In a few cases they are used more creatively and positively. Some "intentional communities" are structured as HOAs.

      As with most things that so many have been trying to warn them about.
      I am trying not to smirk or say "I told you so", when horrendous actions by people towards me is suddenly done to them, and I have tried to be the voice of the canary in the coal mine but like the canary, no listens until the canary is dead.
      I am working on an exposition that shows how the Affordable Housing Contractor Scheme and the Wall Street / Investors residential buying scheme are working symbiotically with the current state of the Occupy Wall street turned homeless crisis that is leading to Criminalization of "homelessness" which is actually under the category of "Transient" with the status of being "At Large" to LE.
      If a person lives in a monthly motel or with a loved one, they are considered transient and unless they have called the sheriff and reported there current location, they are at large.
      Only a deed, mortgage, or lease (or official letter of residency) allows people to get the RealID , have a bank account, etc.
      Once laws punish people for not having an instrument of residential proof, Landlords (wall street) can charge any amount they want and people will pay.

      @Bare_Essence There are neighborhoods with no HOA's. HOA's are not necessary. They only harass people on ridiculous violations that don't make a difference in the community. Like not being allowed to have bins on the side of the house, or having a potted plant in front of the garage etc. There are already local laws in place that can keep communities in check. The city already will ticket overgrown yards etc.

      Exactly but this is how government works whether at the local or federal level. HOA dues and fines to property taxes and permit fees. Even if you own the property outright, someone with a power complex is going to take it from you a piece at a time.

Fines for weeds in the lawn or grass too high does not qualify in the same category. It is arbitrary, capricious burden on property owner, specially with the threat of foreclosure.

      @@livedreamsg When you dine at a restaurant, aren't you paying more, compared to eating at home? That price isn't just for the food. It's also for the convenience of having someone else cook and serve your meal. A dish that takes 20 minutes to make in a restaurant could take hours to prepare at home, so you're also saving time. As for my HOA dues, they were $31 a month and included lawn care and trash collection. It was a great deal for having a HOA.

      When people purchase a home they almost NEVER bother to read that HOA contract, it's just another piece a paper at the closing. Problem is, they don't care at the time and if people would actually READ the HOA contract first, they would never make an offer.

      Well your presence wouldn’t increase anyone’s home value so no one will pay you to live near them.
      Within the past 3 years my HOA pays my water bill, bi-weekly landscaping, painted my front windows, painted my shutters, painted my front door, replaced my roof, fixed my front sidewalk, replaced my front steps railing, repaired water line breaks, resurfaced the entire cement deck around the pool, regular pool maintenance, new pool furniture, and got me a group discount on replacing my windows. What’s even crazier is that my HOA is in this video and my home is in the thumbnail.
      Guess the news didn’t do any research before posting this video.

In my area, the only places with HOA's are condo's, townhouses, trailer parks, and 55+ communities. Monthly HOA fees range from affordable to insane. Oddly enough, the vast majority of neighborhoods don't have HOA's and are just fine, as long as you don't mind individuality over the cookie-cutter monotony of overly-controlled communities. Sure, there's the one-in-a-hundred house with junk cars in the yard or weedy flowerbeds, but it's well worth the chance of one bad neighbor over a committee of small town gestapos telling me my lawn isn't mowed to the correct height or my trash cans are two feet too far to the left.

      @@joannesmith2484 this is a townhouse community. It’s not 55+. Our HOA is $350 and that also includes our water utility which is paid by the HOA. I only comment on it because MY HOA is the HOA this news video is talking about. For single family homes with their own yards and no shared amenities there is no need for an HOA. The particular person in this video however owes years worth of HOA dues that are responsible for paying shared amenities and her water utility. All paid for by her neighbors. Unless she bathes is a tub of tears.

    I'm confused, is the HOA acting as a bank and offering home loans? Because if not, the banks should REALLY take issue with someone interfering with their mortgages like that. Also, shouldn't the idea that a whole house went for $3.25 be a MASSIVE red flag to any state/federal body that investigates fraud?

      Outright ban is too far; basic, nonintrusive HOAs are useful for maintaining the parks, lakes, entrances of neighborhoods. Definitely needs to more regulated, not able to foreclose homes, and there needs to be inexpensive recourse for homeowner-HOA disputes. My HOA is very nonintrusive and has vastly improved our neighborhood and property values, so they're definitely not all evil but I know way too many are.

If they didn't exist the karens would be unleashed into the regular neighborhoods looking out the window ready to call the city when you're a day late taking in your trash barrels or for any other reason. HOAs keep them all in one neighborhood it's best for everyone.

    I lived in an HOA in central Georgia once...for about six months. Then I realized I liked to mow my lawn on my own time schedule, I didn't care if the window curtains facing the street were white or pink. I occasionally I liked to keep the kiddy pool in the driveway overnight or park my boat in front of my house the night before a big fishing trip, and I like to paint the outside of my house whatever color I like. Not what someone else tells me what color it can be. Never ever buy a house with an HOA.

    I was forced to recently sell my mom's condo due to her health. In the process I found out the condo assoc. has not been audited since 1981. she was paying $380.00 a mo. on a 90k property. HOA's are an excuse for embezzlement, because its regulations are not enforced

    My sister is a realtor and she's told me that over the last five years the 'no HOA' rule has become quite common among buyers. An HOA is often the deciding factor between two comparable homes. Recently a small subdivision in our county dissolved their HOA because it's very existence was driving down their home prices. The entire point of an HOA is to preserve home prices, so the owners decided there was no point in the organization.
    People are wising up. This is the only way to end this nonsense.

      I moved out of the city years ago because they started to pop up here in Australia, it was just as well my parents needed help as it gave me the best reason to leave the city for good. I lived in one place with HOA and it was a ruddy pain in the butt, I’m disabled there are things I simply cannot do, but they demanded that we swept our driveways everyday every time autumn came around, I love the autumn season I love seeing the leaves as they blanket the world ready for winter. We were not allowed to use leaf blowers to clear the leaves, they stated that they must be swept up and binned and not placed in a composting pile.
      I was NOT going to waste what Mother Nature gave to me, and what I do in my own yard was non of their dam business. My parents ended up selling the house because like me they hated dealing with them, they ended up selling at a loss just to get rid of the problem HOA had one job make sure the security gates worked at all times, that was a joke. They bought the house to rent out, the realestate kept putting in tenets that damaged the place, so after the last tenet was evicted and they had to fix up over $10,000 AUS in damages I moved in but we dumped the estate agent and I paid directly into the house account every fortnight it was working great until a new board of dictators came into control of the HOA up until then nobody had any issues with them, they kept the gates in working order and that was it. The new dictators took over and everything got very messy very quickly. My Parents were the 5th house to be sold within 6 months of the new HOA dictators, that’s how bad it got.
      So nope you could not pay me enough to live in any HOA area. I loved living there it use to be so nice and quiet.

    We need this in Missouri.
    I bought a lake lot in 2006, at the time I was 18 and clueless of anything HOA related, I wasn't even aware I bought property in a HOA.
    I paid my taxes and all and we never had any one bother us, I hate to say there were a lot of trashy places and people in the area, no one would have guessed there was a HOA. Well one year I got a surprise that I owed many years of assessments or my property was going to be sold.
    I did manage to pay them off, but it didn't stop them from sending me to collections and having my property listed at an auction for sale! I had people stopping by my place and checking it out all the time and I was running people off, I had to contact the lawyer for the community and provide my receipts proving I have paid and prevented my property from being stolen from me.
    Fast forward to 2017 I purchased the lot directly next to the original and rented to my best friend and suddenly these people act like we are an HOA, theres rules and everything we must abide by and they have a "security guard" standing at the entrance.
    They eventually did build a gate with arms and remotes etc woth cameras and all, but that was maybe 2020ish? Anyways, i was not allowed to rent my property i purchased so i was getting fines. Now they comenafter me if my grass is a little tall or if i work on my car in my garage I built for that purpose etc, millions of rules that never existed before... This year i paid my assessments, in cash, in person and got a handwritten redeipt and all, paid in February - April 31 was the deadline to pay. March 6th access to the gate was cut to anyone that didnt pay, June 1 unpaid goes to collections.
    Guess whose access was cut on March 6 despite having paid and having a receipt? Yea, well I did definitely get that settled real quick... But I'm in the process of moving now, sonce January me and my girlfriend have been living on 22 private wooded acres of our own, I still own the lake lots but they'll be getting sold sooner than later. Done with the absolute nonsense.

      Yeah, that’s not always terrible. I don’t know anything specific about Georgia, but in my state and I know in many others, the legislature is only in session for a few months each year, and by May many legislatures have completed or nearly completed the session until the next year. The study committee can do its work while the legislature is not in session, and hopefully by the time next year’s session opens, the committee’s findings can inform new legislation that will be introduced.
      If it’a true that Georgia’s legislative session is nearly over, then you can bet that lots of people will be watching what happens when the next session opens, and how the committee’s report will be handled. People will be expecting new legislation.

    Had (past tense) an uncle who moved into an HOA area in Florida. After about a year, he got a notice from the HOA telling him his car could not be parked in his driveway or on the street (outside of his garage) because it was too old ! The car was a low-mileage vehicle, in excellent condition, but because some snoop from the board discovered it was more than 10 years old, it was "unsuitable for public display in his neighborhood". That week he bought the rustiest & cheapest wreck he could find at the junkyard and parked it, without license plates, in front of the HOA President's house. ~ took a few pictures and made enough copies to plaster all over the area. Sold that place within a month and made sure the local news got the whole story for their Sunday real estate section.

    My cousin bought his home in 2008 for $400,000. It’s a McMansion like most homes in metro Atlanta. The HOA president decided to let some random builder come in and build small rental properties in the remaining lots. Property values in the neighborhood plummeted. Now the values of the homes are about $450,000 and steadily dropping after 16 years of investing into your property. Meanwhile the homes in comparable neighborhoods that were built around the same time are at $600-$700,000 and above.

    HoA is insane. Penalize for everything. One time the garden hose wasn't wrap correctly and fined us for $200. And another was because a vehicle was parked right outside our home for more than 72 hours for a fine of $500 and guess what's the best part? Wasn't even our car!

      Most neighborhoods with community amenities like pools, tennis courts, basketball courts, etc, are managed by HOA. The HOA dues typically go toward maintaining those communal areas. They also have a committee that sets rules on how the houses in that community are to be maintained. Used to be the committee members were residents from the neighborhood. I think the idea is that everyone pitches in to help keep the neighborhood clean, safe, and ensure that property values are protected.
      So they can be good things if the committee is reasonable. But they can go on power trips and be so entitled that they get out of control. I used to own a home in an HOA subdivision. Nice place to live. But I once got a violation notice that my trash cans were visible from the street. The bylaws also state that the lawns need to be maintained, and the there was an empty lot next to me. So I told them I’ll move my trash cans into the garage if they deal with the empty lot next to me with overgrown grass and weeds encroaching into mine. I had already spent a lot of time and money rehabbing my lawn, but that empty lot made it a battle I could never stop fighting. To their credit, they did.
      My dad had a less forgiving experience. HOA came in and told him he was in violation of the bylaws because his window shutters were the wrong color. Crazy thing is, he never painted them. They were that color for over 20 years. He argued with them over it, and ultimately won since they were that color before the bylaws were updated. Then later their HOA was dissolved. I think too many folks were having problems with them, and filing complaints.
      So, under the right management, an HOA can benefit the community. But they clearly have too much power if they can foreclose on your home! That shouldn’t be possible! Sounds like these issues are from HOA’s being managed by outside entities where their bottom line is all that matters. I would think most internally managed HOAs would have more empathy for their neighbors.

      @@von4297Well stated! HOAs can be unbearable under management by certain personnel. We have an HOA under “Trish” who was picky about the absolute minute detail and it felt like the home we were living in wasn’t ours, like we’re renting it. When Trish moved on, there was a lot of neighborhood cheering and rejoicing, like the end of a HOA fuhrer.

      That’s normal, by the time the lawyers have to step in things have gone on for too long. There’s no such thing as cheap lawyers and someone has to absorb those costs. HOA’s don’t have a special pool of money where they can just throw it at lawyers. SOMEONE has to bare those expenses. It’s usually going to be the at fault party.

    In Florida, there was ONE law firm filing about 70% of the foreclosures in the state. Upon investigation, they were found to be a foreclosure mill, and put out of business.

    My HOA tried this with me Westfield Terra Katy TX I fought them and won their lawyer fees came out to 3k over $50. They waited so long to try and come for me and thought I didn’t keep my records. When I proved all the payments… I never heard from the shady attorney again.

      @@smartaz4u For one, if you sue and HOA, you are suing yourself. In some states if you lose you have to pay the HOAs attorney fees. It's best to settle these problems immediately. if it's $50, PAY it, THEN fight it.

      It's not just "Karens" that are the issue, though. My friend lives in a COA where the previous board was made up of a gay man, 3 POC, and a reeeally passionate Democrat.

    My home is mortgage free and my HOA fees were paid however the president decided, by herself, that a special assessment for each property owner was necessary. The bill was sent to the wrong email and because I did not associate with residents I didn’t receive any information. I was served with foreclosure notice. The attorneys fee and other fees cost me $19,000. The best part is that our bylaws clearly state that the HOA cannot foreclose because of ANY missed fee but the judge literally refused to read the governing documents.

    Lady's beautiful home of 18 years sold for $3.20. How do you recover from that kind of trauma? May God give her the peace she deserves. Seriously if the person buying the home was a decent person they'd have sold it right back to her for $3.21. How could you live in that home knowing you kicked a woman out like that?

      1:27 - "Quigley admits she did not pay two of her bi-annual homeowners dues payments, $800 total." I think a lot of her story is glossed over in this report, but she admits she didn't pay for more than a year. When she received her first delinquency letter from the HOA, had she gone ahead and submitted the payment, she might have avoided the explosion in legal fees that eventually resulted in the foreclosure.

      @@TheVsingh2 The explosion in legal fees would have been pretty much for the reason you stated, but I don't know about "exploiting" a homeowner who had not paid HOA dues in more than a year.
      I think we can safely assume the law firm representing the HOA did a lot of legal work leading up to the foreclosure. The homeowner probably ignored all the letters from the HOA and then lost a lawsuit before the HOA attempted to garnish any wages the homeowner was receiving. If the HOA was unable to collect, foreclosure would have been the only other option. The law firm representing the HOA might have billed thousands of dollars just to handle the foreclosure.
      Obviously, we can't know what details were left out of this news report, but many details were definitely left out.
