    I find it absolutely disgusting how these police departments do not have body cameras in 2024! This is a deliberate decision to avoid accountability. I am sure they have all sorts of ex military equipment, plenty of ammo, armoured cars ect, but no body cameras.

      By the date stamp on this video it was August 2015. I agree that every police force should have cameras now and not be able to mute them or turn them off unless they're using the restroom or something.

    September to February his training was =\- 5 months total with a majority of the focus on physical fitness/ PE. There not a profession in this world that would consider someone a trained Expert or professional after only 5 months training. These officers are sworn to uphold the constitution without appropriate comprehension or education pertaining to such a complex issue. Constitutional law, federal, state, local law and ordinances, police procedures and policies, deescalation techniques, human psychology, mental health issues, understanding and identifying the effects of alcohol and drugs, other physical and biological conditions, investigative techniques, tactical training, weapons training, understanding of social, economic, geographical, and cultural factors, learning radio skills, driving techniques, estimating speed and distance, recognizing authentic threats, understanding RAS and probable cause, maintaining a crime scene, collecting evidence and chain of custody, conducting appropriate traffic stops, fist aid and medical training, and on and on…..All can be trained in less then 6 months!! Ya right. Hell, it should take more then 5 months to appropriately evaluate and if a candidate is cognitively, psychologically, morally and physically competent enough to be considered for the profession!

      This may be an unpopular opinion, but I think all police should have the bare minimum of an Associates Degree in criminal justice! You have to go to college to be a teacher, for instance, and it’s a similar paying job, and just as an important of a job. When I retired from teaching, I had the equivalent of a masters degree, but hadn’t taken the comprehensive test at the end, however, that did bump me up on the pay scale because once you get over 15 hours above a bachelors that’s another step between bachelor and masters. anyway, I was making 33,000 a year which is similar to what municipal police make in my area. I don’t live close to any big cities so they are small to medium agencies.

    I am a simple working guy and if it is one thing i learned in my 74 years of life. Always hire an attorney than can spit out of his office window and hit the court house. The reason is that, only the most expensive attorneys can afford to rent offices in those buildings. I am a simple man only attended community college, but after working in machine shops 45 years came to realize, top pay hires the most effective employees. something to do with physics. and the lady outside his office are nice.

      That’s entirety not true and a common misconception that’s spread via propaganda over decades and embraced by a boomer generation. People’s level of talent, skill, competency, and expertise isn’t necessarily reflected by their financial compensation or artificial monetary requirements. It’s an arbitrary number. This ideology originated to substantiate those over compensated individuals and was perpetuated after famous consulting firms found that regular employees where receiving wage increases at a rate higher then management. They then began campaigning this false notion that certain white collar and higher educated people were worthy of insanely generous wages and lifestyles. This ideology had a negative impact on the social economic structure of the nation as well as degraded nearly every known sector from health care to legal to finance and even manufacturing. Certainly, people (everyone) should be compensated fairly and equivalently to their worth but thats far different then reality today. We hyper inflated certain peoples value. Unfortunately people bought into this false notion and think people are worth more then they are or otherwise associate cost with success. All legal experts over charge. Bad ones also have nice offices and live extravagant lifestyles. Doctors just the same. The worst culprits are CEO’s and executives. Those fools are no more valuable then the average employee. They once had a salary 20x the average employee yet know enjoy 300x to 3,000x the salary. Salary not equivalent to their intrinsic value. More expensive doesn’t mean better.

    So as anyone in HS band can attest, breath carries a lot of moisture, so saturating the walls of that machine with breath 3 times without an air blank in between is problematic. I don't know the design of that machine, but I assume it's counting parts per million when it comes to alcohol content. If I were a juror in that case, I would be bringing up the probability that the walls in that device likely had trace amounts of alcohol coated on them from the 3 blows and no blanks. When he blew the 4th time, some likely evaporated, mixed with his breath and bumped it up from say .05 to a .08

      You're pretty much correct. The air blank is so you clear any residual alcohol out of the machine's air flow path so you can testify the machine is literally starting its measurement from a calibrated 0.000 starting point. Anything other than that may return an artificially high reading. It's not really moisture stuck to the walls as much as it is alcohol molecules remaining in the air flow path.

    I might be overly optimistic but this case seems ripe for dismissal. The defendant must be considered as reasonable doubt of guilt due to only 2 clues by the officer .

    Not even a year are spent to become a police - working with people, knowing the different laws - serve & protect - this is a joke for cops in Europe.       Speed radars use specific tuning forks(like 25mph) to literally read the speed of vibrations of the fork.

      A tuning fork provides a reference frequency and in calibration, must be stationary with respects to the radar gun. The 'Doppler Effect' is detected by the gun and the relative speed of the target can then be calculated from the apparent shift in frequency.
      So, imagine your gun is transmitting a signal at 1000 Hz. You point it at a vehicle and this 1000 Hz signal bounces of the vehicle and is detected by the gun. If you measure a frequency of 1000 Hz then you know the the vehicle is stationary relative to the gun. If the vehicle is moving away from you, the measured frequency would be lower and if the vehicle is moving toward you then the measured frequency will be higher. This 'difference' in the measurement is the result of the Doppler effect and is directly proportional to the relative speed of the vehicle with respect to the gun.

      1:30:45 However, the suspect was not under continuous observation so he could have burped or hiccupped which would result in a higher reading. That’s why you keep the suspect under observation to see if they burp or hiccup and have to restart the observation period so you can get a true and accurate reading. Oops on the rookie.
      1:32:22 The cop also failed to ask the suspect if he burped or hiccupped. Now that reading is questionable because the officer cannot state the suspect did not burp or hiccup because the officer does not know. Oops on the rookie.
      1:33:35 It’s the same as if he failed to run the air blank after running the calibration solution on the breathalyzer. The final air blank proves there’s no residual alcohol in the machine from the calibration solution.
      1:34:11 If there are multiple blows you’ve got to run air blanks between them to clear any residual alcohol from the machine to get a new, clean reading.
      1:35:00 There’s a 2 minute interval where the suspect did multiple blows with no air blanks in between which invalids the reading. The readings reported by the machine are of tainted air samples. Oops on the rookie.

My comment was to point out that OP seemed to have watched a different video than the rest of us. This was one of several comments of OPs that didn't make sense because, in this case, he stated a number. I was commenting more on that than the accuracy of the cops actions and testimony. Whether or not that number is correct is something that's obviously in dispute because cops lie.

    I couldn’t pass a lot of those balance tests and I’ve not had a sip of alcohol in years! It depends on the age of the participant. I wonder if that is taken into consideration? I broke my leg 10 months ago. I’m still rehabbing. It sucks to break bones when you’re old. Lol.

    In Finland police uses alcohol breath analyzer and if that shows alcohol in breath above 0.5 permille (iirc) they take you to blood test. Why you have all these very weird tests in US?
    I'd be terrified to drive in US since due to my illnesses I couldn't pass most of them on a bad day. Those illnesses does not affect driving but standing and walking is sometimes difficult.

      Aaa.. So with these crazy tests they are able to arrest more people. Breathalyzer (or whatever, English isn't my first language) would be too objective for that purpose.

      Because in the United States, your freedom is a business. Police have an “incentive”, if you will, to make a certain number of arrests. Then you get to fight the charge. Isn’t it great?!?

      The Field Sobriety Tests, you aren't legally required to take them in the US. Most people don't know this. The officer doesn't have to tell you you don't have to take them either, they just start giving you instructions and the majority of people just comply. The tests are kinda designed to be failed and the results are based on the officer’s opinion and are used to justify your arrest and are used as evidence against you in court. If you don't take them you're going to be arrested anyway but it's less evidence they have to use against you in court.
      For someone like you they could have you do the seated field sobriety tests. Those are typically used for drunk boating but those are even worse. I don't think there's any way to pass them.

      How do supervisors evaluate an individual officer’s performance for their yearly performance reports? A low crime rate means the PD is doing well, overall, but doesn’t tell you how an individual officer is doing. So how do we figure that out? As normal, we like to measure stuff. How many tickets are you writing? How many arrests are you making? Those things we can measure and obviously the more tickets and more arrests the better the job your doing. And I say obviously because look up Officer Cody Wood of Commerce Ga. He had twice the number of DUI/DWI arrests than all of the other officers in the department combined! He had to be doing a great job, right? Aaron Cash might disagree. He was arrested and charged by Officer Wood for DUI-alcohol after blowing 0.000 ten times on 3 different machines. The officer who did the evidentiary breath test literally asked, “Is this an [expletive] joke?” He said he thought he was being pranked. Officer Wood was a star performer until they found out he was padding his number and arresting and charging perfectly sober people.

    My problem,,, where do I start. 1st off, 1979. I got married, 16. My man was about to turn 18. Got apartment and I had my friends over at my apartment. They were my age. Well cops showed up, made my friends leave an arrest my husband and I. All we ever had was a couple beers. Got to the small town and my husband was arrested. I was as well but I'm a minor. We had 1 joint between 6-8 people. They searched our apartment while we are at the station. Said they found a bag of weed. We got attorney and at court ask to show evidence. They said it was being annalize. Never could produce, but for a young couple starting out in life cost a fortune to you. No proof

    Non American here… these tests are so ridiculous!! And there are a hole lot of people who wouldn’t be able to pass them. Not because they had alcohol in their system but because the had any type of disability, being neurodivergent , age and so on…. I have several chronic illnesses and I would fake these tests miserable. Where I live police does the eye test, but none of the others. If they suspect you are impaired of alcohol then they do a blow test, if they suspect your impaired of narcotics they take you to a doctor and collect a blood test. If they are found guilty it’s normally a fine. No court. Unless the defendant asks for a court proceeding or if the defendant has been found guilty of DUI before or if the crime is found to be more than a DUI.

    What did I miss in this video? I saw nothing to indicate that this officer was “destroyed” on the stand. What we don’t have is the verdict to show that the jury did not find him credible and rendered a not guilty verdict. The attorney didn’t produce any videos of the Sally port, he didn’t produce any videos that would show this officer is being dishonest. I do not have any ties to LE (other than firefighters), but I don’t see how this was destroying him on the stand.

      I had a lawyer once slow play on my last court date, at lunch. It was a packed room when I got there, he showed up way late, when it was just me him, the da n his thugs n the judge, my lawyer was fuckin around with paperwork, it was 1225 past lunchtime, the da was tired n ready to go, he calls my lawyer over n offers to drop one of the charges, any jail time if ill just plead guilty n pay fines.... If I had a better lawyer I'd gotten off completely cause it was some bullshit charges, but considering the situation n his competence, that was a big win. At least I stayed outta jail. Still got fucked over, but nowhere near as much as they were wanting

I doubt it thom that da was annoyed n it was a bullshit charge anyways, he just wanted to get lunch. The offer was 9 months in that horrible disgusting Oklahoma county jail, we was gonna try for a blind plea, til he offered to drop the jail time n probation. Which was total bullshit, I was charged with felon in possession of a firearm, despite not being w convicted felon. They're a bunch of lying scumbags up there. They've earned my hate for sure

    I do not get it...I was waiting for the evidence that demonstrated that the policeman did something inappropriate, but it never came. The lawyer did not tear apart anyone.
