      He was asked how much he is making there as if there is a problem with it. Thing is, everyone but the defendant in that court room is making some money for being there. That one made me chuckle.

      When a prosecutor asks a witness, "how much are you being paid..." they are humiliating themselves, and they are losing.. That is the weak sauce right there. She is reaching and flagrantly pimping to the jury.

      @@jimmyjambon9206 she was definitely reaching, she got her ego hurt. I believe in all her efforts to discredit this witness,she wasn’t paying attention to how many times he’s been on the stand. She thought she was gonna trip him up and ended up just embarrassing herself. Larry’s the real deal.

    Excellent witness. Absolutely correct about mishandling. Collecting blood for accurate results for any use is critical. You have definitely educated yourself so that you can advocate as you should!

      I'm sure one week of training exceeds this doctors expert opinion on the human body when it comes to the affects of alcohol/narcotics on the human body! 🤔 Minimum of 8 years studying the human body compared to 36 hours worth of reading and 3 hours hands on training! One of the two is far superior and its not the officer! I wouldn't want this officer to perform brain surgery on me with his amount of training.

      Let's see... I wonder why it's doctors, surgeons, and the medical profession, rather than the entire law enforcement profession, who have caused the highest number of 'unintentional' deaths, on record, for decades. 🤔
      Astronomically more unintentional deaths than the entire law enforcement profession.
      So much so, that carrying malpractice insurance is virtually mandatory & their profession's norm. The claims and payouts on that have been monumental in both dollar amount and total numbers of claims paid/won.
      This 'expert' is also getting paid $2000 for his simple court appearance, whereas the trooper doesn't get paid $2000 for his testimony.
      In legal circles, it's also common knowledge that you can *always* find equal 'experts' that would contradict this 'expert's' testimony.
      Number of years in college study is not a true indicator of actual knowledge. You live in a bubble if you're not aware of ppl who have numerous years in college, yet are still idiots overall.
      The trooper's job will never consist of "performing brain surgery" (and I highly doubt that 'expert' can perform it, either) but I sure wouldn't want this 'expert' trying to save me & my family from any threat to our lives or any criminal act, or trying to perform the countless other tasks that a law enforcement officer regularly performs.

      As a person who has lived in both, I think the big city good old boys are every bit as bad and probably far worse. NYC routinley butt-fuvks working class people. As does Philly Shitcago, LA etc, etc.

If you saw him after lunch, you were usually in good shape but a pre-lunch appearance often resulted in unbelievable consequences! He had been busted, charged, & tried...represented himself in the trial and wore an ankle bracelet while on the bench! How "off" is that? How can someone like that sit in judgement of ANYONE else?

      Ohhh 6 weeks and your a human testing machine lots of college students and teachers in one state were all given DUIs bcuz the same cop who took that either 4 to 6 week class became a human drug tester no lie it was on the news!!!! Look it up cop who is being labeled a human drug test and can determine the type of drug or Alcohol just by the course he took and is better than any lab testing he accused several college students and one professor of being under the influence of marijuana he had arrested 90 or more college students and a professor with charges of DUI because of the course he took which labeled him a human drug tester it was on the news they even had a scientist come on and say that that is actually impossible and the news had their own investigator look into it and 99% of the Tess that were actually blood drawn came back negative and which they still tried to charge these young teens and one professor of DUI and what’s even more crazy is the professor had a headache two days prior and he had took a Tylenol p.m. two days prior that came back in his blood work so they tried to say that he was under the influence of Tylenol p.m. almost costing him his job you can probably find the whole situation that went down by googling the professor who was Falsely accused with children in car and arrested for DUI by the human drug testing cop it’s absolutely getting crazier!!!

      @@SeasidePrincess look it up on CZcams that’s where I saw the entire story about this new course for Leo’s to take and it was a news channel that reported on it and had Scientist discredit the theory that someone can take a 4 to 6 week class and become a human drug detector!! Try different searches professor accused of dui by state trooper who was labeled a human drug detector expert!! I will try and find it and let you know where to find this doc that was on

    Wished I had found you about 6 yrs ago. My daughter got railroaded in court. I felt responsible because I got the lawyer. He was worse than the most worse anyone else! I’d bet my life o. It. He did nothing and she was screwed. She had a wrecked her car and taken to the hospital. We find out months later there was a warrant. It was a horrific experience

      @@EddyA1337 From my own experience, one gets what one pays for. Do your research on the firms before you hire. Yes, research and get bids from multiple firms. My associate would be in jail if he went in with a no-name $500 lawyer who was just making quick cash on low-risk stuff and clearly a legal whore. My associate paid $4000 and got a lawyer from a respected firm. That lawyer put the judge and claimant in their place and prevented all sorts of illegality by the claimant and the judge. Not bad for one day's work and they noted about 10+ points of appeal by the judge's own conduct. He won on a technicality in state law and that his lawyer would not let the claimant or judge violate the rules of evidence or due process. We speculate the judge told the claimant not to appeal as the judge's own behavior was career-ending.

      Because the prosecutor and the judge are two sides of the same coin. They have to do the most to assert jurisdiction over man and woman in order to extort money and cause harm under the guise of the justice system when there is no harm caused to the state. Just the state making unconstitutional "laws" to extort funds from hardworking individuals.

      Trying to impeach him as an “expert witness” by alleging he lacked the proper credentials and experience in the subject matter he was called to testify about. Obviously Mr. Forman wouldn’t let that happen, hence the super thorough line of questioning to establish his education/experience/training/peer reviews/publications etc etc. 🤓😉👏🏽 He was sooooo well qualified he taught law enforcement/lab clinicians, but that didn’t stop the Prosecution from objecting THREE times. 🙈😂😂😂😂😂😂😂😂😂😂😂 Disgusting bias from the state, especially the JUDGE 🙄

      Now, I'm FAR from being on the State's side - and I particularly found her attitude and conduct to be absolutely DETESTABLE, especially while addressing/questioning the witness - but as for the utterance you mentioned, which occurred at 8:17, it was BLATANTLY obvious that she inadvertently combined "Bachelor's" and "Master's" when discussing his educational background. Not sure why you made such a big deal about it. Mountains out of molehills...🙄🙄🤦‍♀️

    A biased judge? There are many ways to expertise other than an undergraduate course in biology or chemistry. As the conversation goes on the judge becomes a little more open to listening to the witness and his qualifications. Good for her. Her decision - right on.

      @@toododd Seems like (it's been so long I won't swear to this) that she said she was an LPN but not sure. I'd have to watch again. I don't hold in very high regard any medical staff who work at a jail (for personal reasons that include turning a blind eye to some truly deplorable actions, among other things). But again, I wouldn't swear to it but I think, at the very least, they have to have a LPN on staff.

    How is it even possible that blood samples that have been collected during the time of the test tube recall can be used in court? All DUI blood tests that were done with these faulty test tubes should have their cases dismissed before it even gets to this stage!

    The first 40 minutes of this is incredibly frustrating! It does seem as though the judge has preference for the prosecutor and the defense is automatically having to fight harder than necessary for equal treatment. You rocked this Larry!!! I’d never seen these videos of you working, just the commentary on the Depp vs Heard case, which was awesome too! I’d totally hire you if I needed a good defense attorney, you don’t hold back and you put your foot down when it comes to legality issues.

      Exactly. Bachelors degrees do not confer expertise. They give broad general background to get in the door for expertise to develop whether via additional academic work or job experience. The prosecution knows this is the exact expert to show what LE did wrong that could introduce doubt. A judge really should not be struggling with this, THEY should have enough experience with DUIs to know what the various types of experts can testify to in a case.

    How long has she been on the bench? I got a ticket in Hardin County in like 2004 and I think she was the judge. The prosecutor was an arrogant douche, sitting on the table while talking to the judge. It was a joke.

    I do have to say that while I think she was being overly cautious, this wasn't a bad ruling in the end, at least from a layman's perspective. I noted, however, that Dr. Henson stated that he taught medical personnel, and then during one of the sidebars, the judge argued that he hadn't. That was odd to me, and I was waiting for the DUI Guy to ask Dr. Henson whether he specifically taught medical personnel, but he didn't. I found that a bit confusing, but perhaps there was a nuance that I didn't catch that made him not seek to clarify that specific issue? Or perhaps it had to be asked in a different way so as to lay a foundation? Again, layman here.
    A point of criticism, though: I would like to think that I would never use a word like "feud" with regard to a judge's initial rulings, at least not at that point. Perhaps if it went off the rails, but I don't think it had. Generally, I find it's best to assail ideas, not to attack people, and the DUI Guy seemed to be taking it personally -- and maybe that's a vocational hazard, especially given how many rotten judges he's found himself in front of. But I don't think it'd reached the point where it was anywhere near appropriate to state that the court was "unreasonable" and having a "feud." Of course, I'm backseat driving or armchair quarterbacking here, but I would like to think that, if I had been in his position, I'd have used words like, "I think there's been a misunderstanding" or that I found the court's position "puzzling" and so on.
    Anyway, very fascinating, and as always, I love your content, Mr. Forman!

      I wondered about that too, I think when they sussed it out it explained what happened there. There were 3 portions of the testing that were at issue - collection, analysis and results. He testified that he had trained medical personnel in the collection portion, that's where he was talking about hospital staff taking blood draws that had less stringent Chain of Custody and cross-contamination procedures because for a diagnosis they are less important, but were creating problems in court. He then said that he had not trained medical personnel with respect to analyzing the samples after collection.

    It’s VERY clear that without your continuous fight to rightly declare the specialist on blood and labs, that your client would have gotten an unfair trial. And that’s exactly what this court is used too. But you made it very obvious that the court was being unfair and biased! And that hit a nerve with the judge, she realized she might actually have to rule in the side of the defense…. So proud of you Larry, I’m very impressed!

    First thing...the fact that you move the podium EVERY CASE! In my opinion it gives you the upper hand..at least in the officer testimony. Very impressive arguments and speed and tone changes you make when the witness realizes he has a black eye and is bout to be knocked out. Keep it up bud.

    Why was she so hung up over him not having a biology degree??? Makes absolutely no sense to me why he would need a degree saying he’s an expert in the “studies of life”… if I was her, I would have been more specific of which degree in biology he would need to have, like the highest degree in phlebotomy, or clinical laboratory sciences. That would be a much better argument, say if he didn’t have anything in those areas. But, biology? Wtf does that have to do with him being an expert in this situation?

      I do work as an expert witness. Once you are declared one in a given jurisdiction you are good to go from there on out. First qualifications get more scrutiny.

    Oh my goodness. I barely breathed through the courts challenge of your expert. Whew! I think the judge dozed off during the expert’s discussion of his training because she missed some information twice! The ADA was loudly & forcibly interjecting her opinion of the educational requirements of an expert. Are there not standards noted somewhere? Great job keeping your cool - which you always do so well.

    The whole series of objections and bench conferences could have been avoided had it been stipulated that the witness would testify as an expert solely with respect to the collection of blood and the output of the gas chromatogram.
    The whole point of why Dr. Henson was there was to point out the existence to the jury of the two unknown substances on the gas chromatogram and the non-existent record keeping of the whereabouts of the sample.

    A couple of minutes in, He sounds very qualified as far as collecting samples is concerned. But I did not hear anything about actual testing in the lab, experience with doing lab work. I don't work in the lab, but I've had to do training in the lab as part of my military training where I had to train in every part of the hospital, as I worked in field hospitals where I had to do everything in Aeromedical Staging Squadron & Combat Rescue Squadron, I'm a nurse, EMT, & military combat medic, where I understand the importance of actual experience in the lab.

    If I were on the jury I would definitely be concerned about the tube recalls, the moment they could not prove chain of custody I would have too much reasonable doubt to convict. Did they really send it snail mail USPS? I noticed the prosecutor never questioned that. She was pissed off though. Kudos to the Judge, It was clear she was trying to understand exactly what DR Hensen's qualifications were before making her ruling. I love your videos in this format, getting to see the whole thing instead of snippets.

      Even more to the point; the issue at hand were the effect(s) of deviation from established, standardized procedure. Hell, the complete lack of chain of custody record is damning.
      The common auditor’s refrain that “if isn’t documented it never happened!”rings true not matter the industry/field.

      It’s not that bad. At summation you literally just gain all the concessions you can and tell the jury “this is a professional witness, who has regarded what they will say to you each time verbatim.” Jurors see way through expert testimony.

    Decades ago, I have on more than one occasion seen the hospital on Ft. Knox take medical samples, I even provided the KSP kits... - training is critical. If we adopted how things in Germany are done DUI cases would be considerably tighter as far as prosecution goes. A doctor MD comes in conducts an interview and conducts sobriety tests and finally collects blood - While not absolutely perfect this would be a game changer in many cases for the better if done here. I am not a fan of people who drink and drive at all I have worked too many fatal accidents, with that said if something isn't done correctly, it is critical for that information to be exposed. I believe you do very well with this.

    ...the problem was the two extra vials the prosecution attorney and her expert could not explain. Also the prosecution attorney doesn't know the spectrum of what certain degrees cover. This lack of knowledge also exists in this judge. The judge in her confusion and lack of knowledge shows, especially in her attempts to asks for specific expert information from the witness. And the prosecutor also has lack of knowledge.
