    Just a correction, Garry's Mod isn't made by Valve, but just has permission by Valve to use their characters.
    Edit: Also, even if someone named "Aaron Peters" was sending false DMCAs, why hasn't Nintendo put out a statement saying "hey these takedowns weren't by us"

      @@Chayusuizai Gmod started as a fanmade barebones sandbox mod for half-life 2, that allowed you to play with the games weapons and npc’s freely. Over the course of a couple years and a buncha updates it grew into something bigger and eventually they got Valve’s attention. They wanted to get the game on steam, and eventually were able to meet an agreement where the developer (facepunch) pays a license to let them use HL2’s assets, plus let anyone who owns the game to use other valve game assets (assuming they own them legally on Steam). Nintendo reached out to Facepunch, not valve.

      @@AlexHyde666it is on valves platform, but they didn’t publish it. They gave facepunch permission to use the source engine assets and code via a paid license. Facepunch still are technically the publishers.

    the thing that isn't mentioned with garry's mod addons (which is what all of these custom content is usually called), is that the workshop is relatively new, there's nothing stopping users from just hosting the models on other sites and other users just downloding and installing them manually, which is what we did before the workshop even existed.
    So nintendo didn't even accomplish anything with this, they just pushed all the nintendo related addons to another site.

This whole take down most likely came about cause a bot detected one person selling a nintendo model, so the 3rd party that usually handles these take downs contacted nintendo to get permission to issue said take down. The actual companies generally don't handle the takedowns and copyright themselves, there are dedicated third parties to do that for them.

    Small correction but feel like I should put it out there. Garry’s Mod (as is implied in the name) is a fan-created mod for Half-Life 2. Half-Life 2 is made by valve but Gmod is independent, published by facepunch. It started as a free mod for HL2 but then was given Valve’s permission to use their source engine assets via a paid license so they could publish Gmod on Steam as a standalone product.
    I understand the confusion, as Valve has made efforts in the past to avoid getting in legal kerfuffles with Nintendo. Such as reaching out to the developer of the Portal64 port for their use and publishing of N64 libraries. But just know that it isn’t Valve that got DMCA’d, it’s Facepunch.

      The problem with Portal64 was using stuff from the N64 SDK that you can't just share the source of like the dev did, Valve has not prevented Xash3D on the PSP or Portal 1 on Android why would they care about Portal64 running on a modded console?

    Pretty much just a classic case of Nintendo being overly paranoid about what the internet does with their IPs. The fact that they took 18 years makes this even more baffling because it should be obvious to them that none of this was damaging their brand.

    It feels like to me Nintendo's lawyers were bored and was like "Who's lives can we ruin today" while spinning a wheel of potential victims they can "Legally" bully to pull content from the fans and came across G Mod and was like "Perfect" while cackling like a bunch of Saturday Morning Cartoon Villains and send the message that ended nearly 20 years of fan driven content.
    As long as these creators archive their Nintendo related works to hang onto privately then at least some of us can have a sigh of relief that hard work isn't lost, I believe there will be a day where Nintendo will be arrogant enough to lose and/or just get tired of doing these Takedown Notices that feel as petty more than anything else. Cause again you can't have the same group of lawyers for eternity something has got to give eventually.

      @@DaGhostToastRoast It's possible, also to make emulation Illegal would also make them and other companies selling official emulated ROMs like on the eShop, Xbox Live, PSN, Steam also Illegal since emulation is about tricking another machine to play a piece of software not originally made for it. So no one wins in that scenario.

      Probably because the producers of robot chicken approached nintendo and requested permission which included details of how they would portray said ips (and likely paid them money)
      Nintendos not against their ips being in other media, they just want it done legally. Story is that disney wanted mario and Luigi to appear in wreck it Ralph but it didn't fit in the budget, but they did get bowser for it and mentioned mario.

      @@eeveeongirl Robot Chicken wouldn't need permission because parody copyright law protects them. Nintendo didn't go after Robot Chicken and subsequently approved them by featuring them in their E3 video.
      Meanwhile, fan art, fan games, and GMOD gets targeted and destroyed by Nintendo. These fans in their basements don't have the resources to go to court with Nintendo or can't risk channel strikes.

      ​@@Luxembourgish parody is a derivative work. If you do purely parody, it means that you don't get the profit. The copyright owner gets the profit you make. To avoid that, you ask for permission and come up with a contract, that way you can make money of it. Let's say robot chicken didn't ask permission, if Nintendo asks them to take it down, they have to or Nintendo can take them to court and demand compensation.

Weird Al Yankovich, for example, has been making parodies for decades. And he's making a living off of it. He only requests permission out of courtesy and respect from the artists that he parodies, and he signs no contracts when creating and selling his work.

      @@one2many370 hmmm, you are very misinformed. weird al used to ask permission from labels because they usually hold the masters and copyright. but after an incident with coolio. he got permission from the label but coolio was unhappy with the song, he made sure to always also ask permission from artists as courtesy and respect to those artists.
      regardless of that, he also does the paperwork, contracts and all. you do know if you ask someone for permission and the person says yes, that is a verbal contract right? nut weird al gets written permission as well.

      The difference here is that the community action in the Helldiver case was action that hurt the bottom line of the company that's doing the shitty thing. With Garry's mod, continuing to spam/repost this stuff does nothing at all to Nintendo and makes facepunch's lives harder.

      Ehh, can't think anything like that working on Nintendo. Like, compare how Nintendo and Sony reacted to all the backlash they received after annoucing the closure of one of their older console's online stores. Sony actually listened to the backlash and continued to keep that store online whereas Nintendo still went ahead with it, no matter how many fans complained.

      The most recent SMG4 episode had a crap ton of Mario 64 used for it instead of GMOD, from characters to even backgrounds which hasn't been done substantially in years. I was wondering if it by any chance was related to this situation happening or if it's just because the video was a direct parody of Mario 64 itself and he just decided he wanted to be faithful and use the actual game again. If it's the former then...I hate to say it because the situation really sucks, but that would make me a little grateful for it lol, because I preferred the classic SM64 machinima style SMG4 used to do and would not complain having it be prominent again.

      While I'm sure Nintendo is well aware of SMG4's existence I strongly doubt this is due to them. If they were after SMG4 they'd issue a DCMA against them directly. I'm aware of the lawsuit arc, but I think that was just an excuse to create new models.

    My assumption is that after events like Plaworld and the Delta Emulator, they are on high paranoia levels. They can’t go after those big things directly, at least not without PR disasters, so instead they are going after smaller components of fandom that won’t cause as much an uproar. They recently DMCA’d a Pokemon Fan Game site, for instance.

      One thing to note: Nintendo doesn’t actually care about emulators unless they make a profit. The only reason Dolphin got in trouble with them was they attempted to have it listed on Steam. And that Switch emulator from earlier this year/last year had a Patreon, plus it was being used for piracy. As for Palworld, I’m pretty sure they’ve moved past that completely after concluding that no assets were ripped and put into the game, just used as a point of reference to make characters. The only times where Nintendo actually cares about this sort of thing is if it eats into their revenue or if they have something in the works which is similar (such as Metroid: Samus Returns). And most studios are exactly like this

    Gmod isn't the only game that has been getting DMCA'ed, Fraymakers and Tower Unite (At least from what I've heard) have had mods taken down too, but no mods from Rivals of Aether or A Hat in Time have been taken down, so it seems like they are going after games that have modding as a huge selling point

    This whole thing is actually pretty depressing. I grew up on gmod and source memes and shitpost content, especially with Nintendo stuff (smg4 anyone? :D) so seeing all of these mods just disappear is just really saddening. Like your hometown getting rid of the playset you always used when you were a kid at the park to make room for a parking lot. RIP ridiculously huge Mario and Luigi gmod player models with arms that clip through the body

    If it's any comfort I've heard that some GMod players have already backed up and archived every Nintendo asset ever put into the game, thank goodness.
    This may not be as bad as it may seem, you can still have Nintendo in your GMod stuff but you'll just have to know a guy to get it from I guess.
    Try as Nintendo might they CANNOT and WILL not remove gaming history! GModers are simply too strong! ✊

      Yeah, we're in a Discord server that's backing a ton of addons up. I also have a bunch of backups stored locally on my own computer too, I had to free up a ton of space and re-install GMOD since I hadn't played it in 2 years but it's worth it.

    Pokemon DMCA'd a Minecraft mod, Pixelmon. It had been around for years, but no longer fine.
    ... Like a year and a half later, Pokemon Quest came out -- with Pokemon in a very blocky, Minecraft-ish style.
    I have to assume they cared only when they started serious development on something they figured might be mistaken for their official product.

      I mean, that's basically the situation with AM2R. Based on the timing, it really does seem that the only reason they issued a takedown request of someone's free high-quality fan remake was because they had their own $40 high-quality remake of the same game in production. (And it sure was nice of them to wait until after the release, when they had plenty of opportunity to do so beforehand.)

    I kinda wonder if asking for verfification might have doomed them. The way copyright law works, explicitly confirming you're okay with something can risk ownership over your IP in a way that simply ignoring it doesn't. Companies can theoretically lose their trademarks if a court can prove they knew about trademark violations and chose not to protect them, if a company simply ignores it they can claim ignorance.

    Well, Nintendo succeeded in two things: Making themselves look awful again, and reminding everyone that GMod still exists. It hasn't been relevant for at least a decade, nobody remembers it. I feel like there is a legal case to be had here against Nintendo, because for 20 years they failed to file a claim and I feel like there has to be some limit of time where they lost their chance to do something. 20 years is just excessive, they can't have just now learned about this when it was at it's peak relevance ages ago.
    Also, this just highlights yet again how stupid copyright laws are. Nobody is profiting from this, nobody profits from most fan projects. If someone wants to put together a little Mario game to share online for free, why is that illegal? Fan art isn't illegal, fan films are not illegal, why are fan games illegal?

      No, a ton of people remember Gmod. It's not some forgotten game. Many people who played it years ago still play it to this day, it being "forgotten" isn't the sort of issue that Gmod has with its popularity. The issue is that it isn't getting any fresh blood.

    That aside, thankfully most of the mods that were taken down can be found on other sites, just sucks they aren't in a central hub anymore.
    So many animators got a start with this kind of stuff, shame it happened regardless. At least GMod itself wasn't taken down.

      Literally apples and oranges here.
      In the case of Helldivers, Sony *LIED* to the public in saying linking/creating a Sony account with the game being sold on platforms other than PlayStation was optional at launch, then suddenly started requiring it a few months later after people bought it. Textbook case of Bait and Switch. That is illegal.
      In this case, Nintendo has an air-tight claim against people illicitly taking assets of theirs (the video literally shows the Mario model from Super Mario 64 doing the very things he does in that game) and putting it into another game *which you have to purchase to access* . Nintendo clearly doesn't have an issue with Garry's Mod itself (as it is someone else's property), only with the ripping of their assets and putting it into another piece of software you pay someone else to get.

    Additional bit of context for the Aaron thing: this specific person posing as a Nintendo Lawyer has been a recurring issues for years. He randomly strikes digital artists who draw Nintendo related content taking advantage of the fact that most sites have automated systems that nobody checks which leads to whole accounts getting suspended for no reason. I personally got my twitter account suspended because of this dude back in 2019 and i'm not the only one who's suffered through that so now every time there's a news about Nintendo sending C&D over something very minor (like in this case) a lot of people are trained to expect that there's a 50/50 chance that it's just Aaron again.

    The obvious thing is if they waited this long that means something happened that forced their hand. People just ignore that there are a lot of highly publicized projects that are largely ignored by Nintendo until they go viral and get a ton of media attention because companies can and have tried to get access to Nintendo's IP before by claiming they don't adequately defend their copyrights and trademarks and if that can be proved then Nintendo can lose the right to stop other companies from using them

    What I find the most egregious is that Nintendo wants EVERYTHING related to them taken down, even if the addon in question is an original creation and not taken from one of their games. It's on the level of taking down fan-art and CZcams videos again. Not to mention, the random striking of content regardless of age or platform is probably a tactic to keep people afraid. Like you said, it obviously is not a substitute for actual games and doesn't affect them monetarily. It's just about having control over how people interact with their products. Companies should not have that level of power over their consumers.

    I think a very important nuance to this situation is that only Steam Workshop Nintendo items are being taken down.
    When Garry's Mod came out in 2006, there was no "Steam Workshop" for hosting modded content. Instead, community servers would facilitate hosting modded content themselves.
    In 2011, Steam Workshop became a thing and Valve started offering means of hosting modded content *themselves*. On their own servers.
    When one billion dollar corporation starts hosting another's copyrighted content, I can see Nintendo feeling like Valve is benefiting by having Nintendo mods so out in the open like that.
    Decentralized servers hosting modded Nintendo content will still probably live on, like in the old days. That's the benefit in how these old games gave far more freedom to the end user to make the game their own.

    Nintendo rarely if ever comments on these things and it's disastrously bad for their public relations. The thing is that they may well have had a good reason to issue the DMCA; Nintendo rarely cares about emulation or character copyright infringement (Like has been said, Garry's Mod has unofficially had Nintendo characters in it for decades) but what they do care about is their software security.
    So for example with Yuzu a few months ago, the report is that Nintendo took down that emulator and sued them for 2.4 million dollars. What's missing is the why, in that Yuzu admitted to forcibly breaking Nintendo's encryption and securities in order to make their emulator work. I suspect something similar happened here, in that people likely started uploading assets and proprietary code for Nintendo characters that had originally been encrypted and secured.
    Ultimately, if that was the case and Nintendo's proprietary code was used in Garry's Mod assets (and this is only speculation that it was, to be clear) then a DMCA was probably one of the *better ways* this could have gone for Garry's Mod.

    Having been a long time Nintendo fan, my view on this company has grown more sour over the past couple of years, and I feel this has been a major turning point for me on how I view them from now on.
    In the past yeah they'd take down fangames and that really sucked (still does), but it ended up being expected after a while; it was a boundary that people learned not to cross. But stuff like the shutdowns of online tournaments during COVID, taking down a Mario 64 guide that is OUT OF PRINT, and going right for the throat of emulation and game preservation really makes it hard for me to owe them any of my care.
    Why as fans should we give them our time and energy if they're so willing to burn it? I wouldn't even call this GMod situation "petty"...it's evil.

Man, i love nintendo and i don't wanna see them fail or anything but at the same time, whenever they are doing financially well, they always start treating their fans like this over the smallest of tiny little things, and i kinda hope their next console isn't exactly a Wii U style blunder, but i kinda hope it does fail JUST enough where Nintendo is forced to treat their fans better like they supposedly did during the Wii U era, as i have heard, because as much as i love them, they need to stop doing this, because this is just ABSURD!

    Again, have to reiterate, the Japanese have a different conception of property rights and especially intellectual property rights since their culture is very much steeped in a Mercantilist artisan/trade secret business attitudes and a Shinto/Buddhist conception of culture wherein even immaterial things that belong to a people are the property of that people.
    The Japanese don't have a "liberal" socio-political ideology as part of their culture, certainly not a Continental "Enlightenment" French one.

    One thing I like about the internet, is when it refuses to allow someone to have a petty victory. AM2R is probably the best example when it comes to Nintendo. For years they completely ignored the so well loved Metroid 2. After 10 years of one lone fan working on his own remake of it Nintendo ordered a cease and desist on him after he had already completed the game and released it. He's no longer able to do any updates and Nintendo unsurprisingly has ordered takedowns of the game every where. Only for a fan of the game to re-upload it so more can download it. Nintendo isn't going to win this fight no matter how hard they try.

    Honestly I'm kind of in the camp that this wasn't Nintendo's doing. Whenever Nintendo takes down something (whether you like it or not), there's usually a reason in the background they do it. These takedowns also lined up with the reports of trolls false flagging things. And before you say "Garry himself said it was Nintendo" he made a follow-up statement questioning the situation. Other Nintendo franchises that aren't Mario, Zelda, Splatoon, etc such as Star Fox, F-Zero, or Punch Out still have a lot of mods on the workshop too, some of them dating all the way back to 2012. And some non Nintendo addons are getting taken down too like Sonic, Pac Man, original fan models, and even Mickey Mouse characters. I'm not denying it was Nintendo. Some of this stuff makes me think it wasn't them.

    I think the book was way more petty. The gmod content can seriously damage the brand if something goes viral in the wrong way. Like lets say that someone recreates the 911 attack in gmod with Nintendo characters flying the planes. Some old boomer see's that then starts spreading false information that Nintendo was making light of the tragedy. That is a completely understandable and justifiable reason to take the content down. Is it stupid? Yes but we are talking about Nintendo. The book on the other hand was literally a copy of an out of print book from 20 years ago.

    To understand this whole Nintendo-like stuff of restricted IP protection i recomend watching the moony channel. The guy is a lawyer and i saw many of his videos about this and explained why is Nintendo so overprotective with their ip's. Is because they might loose it if they don't watch their steps.
    For example Sega could loose all of sonic's owning because of a non-contracted manga drawing of a guy that tried to keep the characters copyrighted. Also Moony talked how at the cost of terrible sonic games and threat of the mascot, the fans are allowed to do whatever they want with it and seem to have no restrictions. But that's because some Japanese "pachinko" folks bought part of the ip's to hide a gambling bussines, and they don't seem to really care about sega or Sonic. (SegaSammy)
    Seriously i recommend getting as much info on these things because we complain a lot but we don't really know the implications of having what we have.

    I can see where Nintendo is coming with this one because of Mario Odyssey, specifically New Donk City. The city scale looks somewhat realistic, the full-sized humans look somewhat realistic, so if a video went viral of Mario suddenly "discovering" a perverted dungeon of some kind in the depths of New Donk City, that would put a heavy dent in Nintendo's reputation for years to come by parents who are only tangentially paying attention to their kids' gaming habits & what could realistically be found in Mario game. Not to mention the ocean of phone calls, tweets, emails, etc.

    Welcome to 2024 in the gaming industry. 2023 was a huge year now all we get is studios being closed. Nintendo and Sony seem to not have any aaa ip coming out. Just remasters. Ff7 rebirth was the biggest game of the year. I thought the $70 games would save gaming?? Sony is stupid if they are going to release a faster ps5 this fall and have 0 new games to show it off on.

      @@jeremyzapsmash Ok. But a bunch of Mario characters aren’t main characters anymore. Plus with Meggy, Bob, Fishy Boopkins and SMG4’s redesigns and all the new original characters, they’re definitely still moving away from Mario and Nintendo.
      Mario and Nintendo are still a focus but less than before for me. Plus their content is just worse. Less funny. I stopped watching regularly a long time ago.

      Yes, please! As I was watching this video, I kept responding that Arlo would have so many answers if he understood Nintendo's approach to protecting their intellectual property and subsequently protecting themself due in part to the Universal case and later on, Sega's IP scare with those comic book Sonic characters from the Penders case. That's discussed in the excellent Moon Channel video. I think Arlo once referenced that channel, but it was a different video.
      Anyway, Nintendo, like Disney, will do whatever it takes to make sure no one else can claim ownership of their IP per IP law. Losing their IP does far more damage than the risk of not being able to sell an old strategy guide, among other things. Their logic appears to be "if someone does anything with Nintendo IP without permission, they can claim ownership of said IP and we're at risk of losing Mario or Link" e.g. Other companies appear to work with IP law a bit more loosely. It's not user friendly, but seeing that perspective at least allows us to understand Nintendo's approach whether we like it or not. If anything, it should make us want a change in IP law, protecting companies and benefiting artists and end users, that allows Nintendo and others to retain ownership of their IP while allowing anyone else to use IP under certain specific circumstances such as fan art.

While Nintendo has gone overboard in protecting their IPs on multiple occasions, I wouldn’t consider this to be one of those times. Besides, technically speaking any content made in GMOD using assets not made by Valve is a violation of copyright unless those publishers have Facepunch permission.

    When I worked at the San Diego Zoo Safari Park there was a rule where we couldn't point to give directions, We had to point with our whole hand instead because at some point someone from another country got offended at "Pointing"
    If Nintendo is taking down all of these things because they think it makes them "look bad" then it reminds me of rules like this that are so absurd it just makes the company look stupid.

    To play devils advocate, there are pretty big creators using this content to make stuff not exactly brand safe (though i don't mean NSFW). I can see why they would do this, but why not just go after the people making the content? Thats obviously still not a good thing, but those creators still have this content

    At this point I wouldn't be surprised if the Nintendo execs are just leaning into being evil after their ridiculous early shut-downs and the "backlash" they received.
    It's no secret that no matter how terrible they behave and treat their community, they will have their money, and with the law on their side: their pride as well. There is exactly nothing we can do about it and Nintendo knows, and loves to remind the "woke" ones as often as they can. They're just playing with us at this point. They've declared war on a ton of people for "playing" (as Arlo puts it so well) and they have all the weapons. They're that kid who's got the cool stuff at their house, and invites you to play. You guys go and play trucks, which you LOVE. An hour into the playdate he GIFTS you one of his trucks: your favorite one. It's going great, but 2 hours into playing trucks, you start playing ambulance when Nintendo wanted us to play firetrucks. So he starts screaming at you to give him his truck to get his way. He doesn't like to see hits old truck get used how he doesn't like. So Nintendo screams and screams until his mom comes into the room in a hurry. Nintendo knows how to get his way. "Hargle won't give me my truck!" Playdate is over, his mom is mad, I'm mad, my own mom is mad. Nintendo keeps their truck and is feeling awful proud of themselves. Only the worst part is Nintendo has so many other friends who will play trucks exactly how they tell them to, and will never go without as a result.

    Well this'll be interesting... Large CZcams channels like SMG4 rely on using Garry's Mod to create their content using Nintendo characters. They've made their own characters too, but their main series on the channel has centered around using Nintendo characters like Mario in their adventures.
