The elected branches have broad powers to rein in a rogue judiciary, or to limit the scope of at least some of the Court’s decisions. The greatest of these powers is court-packing - adding additional seats to the Supreme Court to dilute the votes of Trump justices who lack democratic legitimacy.

What would he call it if the indictments were coming from the same party, a ‘bitter’ party member? The fact this notion of having a two tiered justice is coming from a justice of your country’s highest court is quite alarming and confirming in one. If that’s not a wake up call to EVERYONE of a failed justice system I don’t know what is…… Imagining the fact ANYONE as long as they’re American can run for presidency even if in jail and having this ‘absolute immunity’ to commit crimes while in presidency what that would do to your country???? Conservatives today rely on political institutions that brazenly undercut majority rule. The Senate, the courts, the Electoral College - all provide conservatives with structural advantages at the expense of the many. But the Right isn’t content to sit back and cash in on the tilted playing field. It actively labors to restrict voting rights, skew the census, gerrymander districts, and generally increase the sway of the country’s most anti-majoritarian institutions. When confronted with criticism, they resort to the nonsensical argument that “we’re a republic, not a democracy.”
Free speech rights, civil rights, and other protections are essential to a flourishing democracy. But conservatives’ contempt for majority rule does not spring from a concern for a beleaguered minority (unless you think big business qualifies as an oppressed group). The truth is, the Right doesn’t expect a majority of Americans to support their policies, nor do they particularly care..
To defeat conservatism today, the main thing we have to do is to explain what it is, and what is wrong with it.
    Q: What is conservatism?
A: Conservatism is the domination of society by an aristocracy.
Q: What is wrong with conservatism?
A: Conservatism is incompatible with democracy, prosperity, and civilization in general. It is a destructive system of inequality and prejudice that is founded on deception, and has no place in the modern world..

The amicus brief needs to be amended to include this:
Pose a more extreme version of the SEAL Team 6 hypothetical to SCOTUS we heard in the Court of Appeals, where a judge asked if Trump's theory would absolve him if he used the military to take out political opponents. Take it a step further and tell the Court that if Trump has the immunity he claims he does, a president would be free to order the assassination of Supreme Court Justices who disagree with him, and could not be prosecuted for doing that.
Make the impact of Trump's argument unmistakable. Let the examples of conduct that would be permissible under Trump's view of immunity drive home how essential it is for the Court to reject his appeal and send this case back on its way to trial.
