Great Vid!, I think one of the most important aspects to convey to the watchers is that a "Trust" really does not exist. The Trustee exist, and a trust cannot be hauled into Court. It is an "unincorporated" non public entity. The Trustee could be hauled into Court by the beneficiaries of the Trust assets, however the language of the "Trust Agreement" could be written to be quite prohibitive against such action.
The Trustee is in a very interesting position of "Non Liability" and in most cases operates with almost total immunity, so you must very certain of the character and integrity of the individual that you choose to be Trustee of your assets that you are going to convey into the trust, because the Trustee is vested with the authority to sell, mortgage, invest, gift, or whatever the Trustee wants to do, because for the Trust to actually protect your assets you must give up ownership interest in those assets.
The Beneficiary, can only have beneficial ownership certificates, and not actual legal ownership certificates.
You can read any pooling and servicing agreement of a MBS trust and its agreements, and you will get a great idea of how the Securitization of mortgage loans caused the crash of the economy. No Owners of the actual asset, only "investors" in the Trust, but the investors do not get ownership certificates, they are dependent upon the Trustee to be honest and disburse the "income" from the assets to the beneficial investors. All the insurance, and re-insurance policies only named the Indentured Trustee as Beneficiary, and NOT the actual investors, who never received a dime. Hence the downfall of everyone's investment and retirement accounts due to the managers of these accounts investing in these trust, and due to the actual language of the trust agreements they had no recourse to sue.
So Yes, Trusts are Great, well......depending on which end of the stick you are on
