    Karl Jobst's video: • Cheater Billy Mitchell...
    BACKGROUND:
    Billy Mitchell is a renowned video game player, specifically for his high scores in the arcade game versions of PacMan and Donkey Kong. But a few years ago, Twin Galaxies, the chief company that oversees world records in gaming, unverified his scores after a report was filed with them arguing that his scores were achieved with modified hardware--which is against the rules. Billy Mitchell sued Twin Galaxies for defamation after they concluded that they believed that he had, in fact, achieved those scores with modified hardware.

      I think more publicity is not good ... for him ... in his case. Because he is the poster child of a snake oil salesman:)
      While this is no evidence, the public perception gives a s. about evidence anyway.
      Okay those "feelings" do not matter because the documented and non original joystick tells everything. And while others think different, this is sports. Sport is based on rules (otherwise we would be in the Colosseum in ancient Rome) and following them. Anyone who cheats there, cheats their fellow campaigners and also the public and definitely deserves a lifelong ban. It's not the death penalty, it's a wave of the fence post! Oh and well earned in his case, boasting and making a living of his lies.

    The tall red joystick seen in the picture is of a type commonly seen in fighting games. Which had faster and more responsive 8 way sticks. They were also sprung differently and would have a much better feel for a competitive game player. It was a generation or two beyond the very crude sticks used in original donkey Kong and Pac-Man games. It also backs up the Twin Galaxies conclusion that the score was achieved on an emulator cabinet.

      @@SianaGearz "while the gate of the 4-way stick forces you to take the long way around very nearly through the neutral position, like a gear shift in a car."
      This is not entirely accurate. There are two types of 4-way gates - cross and diamond. A cross gate acts as you say, but a diamond game allows you to go directly around each direction, but prevents two switches from being activated at the same time. (many diamond gate designs can also be adjusted into square 8-way gates)
      I don't know which type of 4-way gate original DK hardware uses, but I think it's worth keeping this information straight given that there is, you know, a few lawsuits hinging on these matters, and they're being pursued by someone who looks bound and determined to become a vexatious litigant.

      @kable6693 Před 8 měsíci

      You're almost correct. It's not because he submitted it, it's because he continues to claim it to be legit. You can submit a fake run without much consequence except public ridicule. When you are proven to have cheated and then begin suing the people calling you a cheat, that's the problem. At the time this record was done it may have been legit hardware, but it was definitely not a legit joystick. Billy has continued to maintain that it is legit and is fighting to prove it's real because he didn't know all this evidence existed proving it wasn't real. Watch his deposition video, when he first learns that a picture of the arcade cabinet exists you can see him start physically sweating. He dug himself into a hole and his son assisted him. With all of these frivolous lawsuits he'd be lucky to escape jail time let alone a large settlement payment. His son could easily be brought into this and charged with fraud since he created the plaque that Billy submitted into evidence. That's knowingly submitting false evidence and that is a felony. This isn't even about money anymore, he's putting his and his son's freedom on the line because he can't bear the thought of admitting he cheated. He's just that sad of a human being.

      As long as you're entirely transparent about what hardware you used, it's all good.

    • @_Locrian
      @_Locrian Před měsícem +1

      To further elaborate, it's also not that he submitted to the leaderboard that he shouldn't have, but it's also that the standards of proof are different. Billy Mitchell, for each of his scores, has videos and alleged witnesses (which we now have reason to doubt). These are suffice for original arcade scores, but not for MAME.
      In MAME, a person could theoretically use savestates, keep reloading from those savestates until they get a perfect score, replay from MAME the inputs and video of the one coherent run to make it look like everything was done perfectly in one go, and submit that. This is likely what Billy did, and people have been aware of this strategy for as long as MAME has existed. The workaround is that MAME has an uneditable log file that goes along with every session of play, which shows every input made by the player (including savestates).
      Runs done on MAME require that this log file be submitted, which Billy did not do, meaning that even if he had been honest from the beginning and said that he played on MAME his runs would still not be valid unless he was to also provide that MAME log file. Hope this makes sense and adds to your point!

He and others in tandem with him built a lucrative business off his and his accomplice's "legends" and used those as a tool to gain numerous paid appearances all over the world. It's quite extraordinary when you know just how big that iceberg is, how long it's been floating and how much money they made by via the deceptive practice of manufacturing legends. For instance, Mitchell and his pals dedicated a bronze public plaque to themselves in Iowa, proclaiming that they created "organized eSport" in The 80s. This plaque of lies hangs in public in Ottumwa, Iowa. It was hung as a way to not only align their names with a multi-billion dollar industry they hoped to grift attention off, but to pull off a "birthplace of gaming" tourist destination just like the fictional "birthplace of Baseball" in Cooperstown, NY. Cooperstown has the National Baseball Hall of Fame. Iowa has the National Video Game Hall of Fame and Mitchell and his pals are the progeniters of that project. All in all few would care about this case at all under most circumstances, even being fairly well known. A court case over a cheated video game record, usually wouldn't be consider that important. The reason so many are interested in this case is due to the sheer amount of defamation cases files by Mitchel, he basically sues every person who whispers negative things about him, and people really don't respect that type of behavior.
    It's also worth noting that a large part of this also stems from the fact that Mitchel worked with Walter Day (the person who founded Twin Galaxies) and some others within Twin Galaxies to create this persona. The referees that approved of several of his proposed cheated records were Walter Day himself and Todd Rodgers (Who is believed to have cheated records himself and also likes to sue people over it), both of whom were part of Twin Galaxies. When Jace Hall took over Twin Galaxies he shortly later filed a case against Mitchel claiming he colluded with Walter Day and Todd Rodgers to intentionally pass off faked records so that Twin Galaxies would be able to create the persona of the greatest video game player of all time, something that due to numerous circumstances helped Twin Galaxies reputation and recognition grow and help establish their credibility and validity. Jace argues that by doing so they artificially jacked the value of Twin Galaxies before selling it. Jace thought he was buying a database of legitimate records and felt the actions of the pervious owner and staff of Twin Galaxies raised the perceived value of the company, which they then sold off when the cheating controversies were starting to come to light, to effectively dodge a bullet. From what I understand this case is still ongoing as well.

    As someone who has build multiple MAME arcade machines, I can say... WOW! Not only would Billy Mitchell know it wasn't an original joystick... 8 way joysticks are HARDER to play in Donkey Kong and others 4 way games... until you have practiced a ton with them! Your not running on flat land in DK often (slightly diagonal on a few screens).. Well, with a 8 way joystick that makes it so if you press a bit diagonally you end up accidentally starting to walk up a ladder when you meant to walk past it... at times killing your game. I purchases and have owned multiple original DK/Pacman 4 way joysticks in the past, just to get past this! If he got a high score on that machine, that meant that he practiced for ages using a non-original hardware or he wouldn't have done his best. Anyway... The other examples I saw in the past of the videos he showed could only be created on an emulator because of imperfect video emulation. That also should have been enough to get him kicked.

    In addition to the newly released photos, Twin Galaxies already had some extensive and highly irrefutable evidence that Mitchell's gameplay video demonstrated the use of an emulator referred to as MAME. This would mean that he was very much playing a modified version of the game regardless of the joystick, and was, therefore, cheating.
    You see, the way the game screen loads for Donkey Kong on MAME is very different to how it would appear on an actual unmodified arcade machine, and quite visibly obvious if examined frame-by-frame. All this photo does is really seal the deal for someone not fully educated in/convinced by the emulation loading evidence.

    Nobody is disputing whether he got the score using the Donkey Kong arcade *software*; the issue is whether he achieved the score running the Donkey Kong software on arcade *hardware*, or whether he ran it on MAME.
    Maybe I'm making too much of this; but if (for example) he was just "miming" to a pre-recorded MAME playback played on the screen of a Donkey Kong cabinet, that would give him an out. It would mean he hadn't sworn an untrue statement before the court, for example.

It looks like an atari one but with a red shaft, or a modern one but with a red shaft cover and balltop, but it is correct that it is not the original joystick. As for if its 4 way or 8 way you cannot tell without looking inside the panel (with any joystick actually). The nintendo joystick had a 4 way and an 8 way gate available for it too, as its the same joystick used in excitebike cabinets. Most modern joysticks have gates that can be swapped or rotated. Tbh I almost wonder if mandating diagonal cleaners might be a good idea what with diagonals having unfair bugs. His MO is to abuse legal tools to frighten, exhaust, and bankrupt his adversaries. After these cases fails, he's likely to file others just as flimsy. Then perhaps more after that. At each stage, prolonging and nitpicking every possible tiny detail. He will fight entirely empty and pointless disputes in the hopes of exhausting the other side until they are at least willing to settle out of court in a way that he doesn't have to admit his cheating. As a member of the community, there is a big "if" in the new evidence.
    Jobst makes the claim that it "appears to be an 8-way stick", and goes on to explain what that *would* imply, but it is not obvious from the photo that it is in-fact an 8-way stick. You would need additional footage of the joystick internals or demonstrating 8-way motion (or a full copy of the gameplay video to observe the advantage being utilized) in order to confirm that, by which point the photo would be supplementary, if not wholly unnecessary to make that argument.
    The joystick *is* clearly non-original (a fact which would importantly be plainly obvious to anyone who has prior experience in the game -- the original joystick is very small and distinctly uncomfortable/awkward to use, so it would be fair to assume that Mitchell would have known that), but the important question is if that alone would be enough to make a substantial difference sans the "8-way" embellishment.

      @CrippledMerc Před rokem +2

      Ya I wondered about that as well. I don’t know how they could tell by the picture alone that it isn’t a 4-way stick. Maybe they can, but I think that claim is a bit of a leap. I’m curious to see how this all plays out though and whether or not that picture really does break Billy’s case.

    • @squidcaps4308
      @squidcaps4308 Před rokem +8

      It is the opposite: Billy has to now prove that it was 4-way. The joystick is not original, now Billy has to prove that it is identical in function and not what is most common, which is that old 4-way was changed to modern 8-way. It would be extraordinary that someone would take 8-way stick and put it on a 4-way mechanism. Of course, since the joystick was not original but larger.. that in itself means it was modified arcade machine. With the other evidence proving that it was emulation that was used strongly suggests that it was 8-way joystick.

    • @joefox9875
      @joefox9875 Před rokem +11

      As was said many times, the arcade console has to be unmodified. Any change of hardware is in breach of the rules.

    • @RWhite_
      @RWhite_ Před rokem +3

      @@squidcaps4308 Actually no, since Twin Galaxies does not allow any hardware modifications unless they are either "...needed to support the use of external storage devices..." or otherwise exempted via the specific leaderboards rule set (I.E. A category that allows modified hardware). This means, even if Billy were to prove it was a 4-Way joystick, it would still be a violation of Twin Galaxies rules on modified hardware.
      I haven't followed this case in a while so I don't remember all the details, but unless Twin Galaxies made some statement saying he cheated it doesn't actually matter if the hardware modifications are purely benign in function. All that would matter is whether or not their actions were a typical enforcement of their own rules.

    • @Zerst
      @Zerst Před rokem

      @@RWhite_ There is a rule, specific to Donkey Kong (written in 2009, in direct response to the game's spike in popularity following the release of King of Kong, a total anomaly compared to the overall community), effectively in which submissions have to be on a cabinet with a joystick that is or matches the original. So that aspect of it is valid from a TG rulings perspective, although at worst it would invalidate that specific performance from the TG leaderboard and is not, by itself, an indication of cheating.
      To the best of my knowledge, Xelnia's findings have held up to scrutiny. The modified joystick photo is just something obvious that will make it an easier sell for TG specifically to defend their decision to not include his scores in their leaderboard.
      The issue is with Jobst's (who is not a member of the community, just acting as an external reporter) speculation about it possibly being an 8-way. There is zero method to prove it one way or the other at this point, and I don't want to see him blunder his way into having to defend that statement.

      Mitchell relies on people backing down when faced with a lawsuit as it's so expensive. Unfortunately for him, Karl's supporters have happily backed him financially in order for him to fight back. There's a video of Mitchell ranting about how unfair that is. The man is a bully and is finally being taken down.

    So, a word about the pics. From what I've gleaned via other CZcams videos and relevant gaming articles, the photos are hard copies, not digital. Metadata as verification is out the window. However...internet sleuths pieced together the following. Mortgage Brokers' publicity photos showed Mitchell directly in front arcade cabinet while being congratulated by convention organizers and referees; the machine's hardware was entirely out of view. They reasoned more images of the event likely existed, and after a lot of back-and-forth with a former Mortgage Brokers convention employee (or attendee--I'm uncertain of which), these new photos were unearthed. Mitchell took one or two steps to his left, and the red joystick was now visible. The provenance of the hard copy photos seems rock solid by all accounts, and that's where verification appears to exist.
