      An DMCA system will never be immune to misuse. It practically impossible to confirm if someone is the real copyright holder or not without massive amount of manual labor.

      It has nothing to do with CZcams, if they want to retain safe harbour protection they are required to take down any content immediately when they receive a DMCA request. If they do not then CZcams becomes liable for any infringement. The people at fault are the US Legislators that wrote the DMCA. The target can file a counterclaim and have the video returned automatically as well, since the dispute then can go proceed to court. In this case the rights holder is going to crush this guy since he fraudulently filed DMCA forms and seemingly did so with intent and malice.
      Leonard french goes over DMCA cases all the time and does good job explaining the law if you want to listen to someone actually qualified.

      Its happening everywhere else. People get copyright striked for playing a game that happens to have copyrighted music in it, be it Twitch, YT, any other platform.
      Cutscenes get censored because it hurts sales and other idiotic gimmicks they pull on people. To the point not that I wont just buy your game, I wont even bother watching a playthrough, that how irrelevant your product is. So you can censor the entire game better off don't even bother creating nor releasing it, do something else with your time and money ...
      It's like these companies are ran by mentally ill people who behave like edgy 4 year olds. From the CEOs to the development teams, all collectively insane ...
      Come to think of it, I mean it's not that far off from reality, Naughty Dog comes to mind, soon as the company was sold the 2nd time it got a direction of insane people and with that the dev and tech team was even worse. This is just one example of many others out there. Once great companies now ran by insane people, the easiest way to describe the situation really.

    One thing to note about archiving music that was taken out of the game: After this whole debacle, Bungie acknowledged that it isn't right that music could just get yeeted out of existence and put in place a system to allow people to essentially become endorsed to upload music that was taken out of the game onto CZcams for archival purposes. Their stipulations were that you had to get in touch with them via email, you couldn't monetize it, and it could no longer be available in the game or released in any of their commercial OSTs.

      As much as I endorse data preservation you people have to realize also that we live in a broken system, spamming one and the same content is not helping either because we don't live on endless storage databanks. Hence why online content became heavily compressed and true 1080p is a myth lets not even talk about 4K and 6K. In some cases the data you share is useless and doesn't represent it's true form. Even a premium thing, soon as it loses tracking it gets deleted forever and even if it remains it's so compressed and destroyed it's basically just useless data.
      We have to have one ID for one thing that is being shared, streamed in and not simply re-uploaded billions of times. That same space could be used up for more useful things.

      I think I get your overall point, but there's a much larger issue entangled in your complaints, namely what is valuable to people? Aren't teachers more valuable than football players? Aren't scientists more useful than politicians? How do we determine what is good and useful?

      @@HippopotamusPencil good question , the answer is obviously subjective. However I highly disagree with the endless storage banks problem. Storage is cheaper than ever with new factories to be opened up soon around the world by the top data companies. It sufficiently meets our needs. I would say the battery problem is bigger than this but do we really have a battery problem? my headset lasts 18 hours. My phone lasts for days. Do I really need it to last longer? Nah the only needs for that are for solar storage, since the sun doesn't shine all day we need that to cover the night time. Our energy requirements are mostly met by on demand consumption. Our storage does not have an on demand problem and if you even bother to check. storage is starting to go on sale to under 15 a tb and even ssds are going cheaper. they are getting rid of stock because the capability for a huge upgrade on that is already on the way. Then to answer the reason to why compression exists. Bandwidth is a thing and we have been constantly upgrading that, but its much slower to do that. First we started by using phone lines network system and that gave us 56k dial up. We have continuously improved that and now most of the world has cable internet. The next upgrade after that is fiber optic but most of the planet does not have fiber optic. Imagine if we had to suddenly uproot every powerline and replace every cable all across the country? that will take a massive amount of time and budget. Most of that cost is eaten up by the companies competing with each other as they upgrade their systems but unlimited money doesn't mean you have unlimited manpower, or even trained individuals to do this as quickly as we would like. Even getting a permit to a mine in the middle of no where can take up to 10 years, So it is not surprising that a country wide construction project would take so long even though we are still progressing at a phenomenal rate. I for one am not impatient, in fact letting technologies mature before rushing in has been beneficial to us. BTW I have about 300 tb of space , every tb is about 10 hours of 4k video. So think about it. If you wait until the sales you essentially pay for $15 for 10 hours of 4k storage. Thats not bad at all lol. Adjusting for inflation, blank cassette tapes costed more. And this is even on a price downtrend and a storage capability uptrend. The supply and demand and the data in no way reflects this guys opinions. If you pay any attention the only shortage we had so far regarding pc parts has been gpus but that was mostly due to the crypto mining trend that created alot of demand. my 2k pc i got last year is worth about 1.5k now because of how much prices are dropping.... while food and gas goes up, and seemingly everything else. Pc parts are actually going down in price. The supply is the and the demand isnt. My $300 3dprinter is now worth under $100 and that is in 1 year. Without the demand, companies like google can buy up all these drives for cheap. But again the problem is storage bandwidth. How about you try uploading 10 tb of data and tell me how many days it takes?? If our bandwidth infrastructure an truely handle this, it wouldn't take so damn long. So yes alot of data needs to be compressed to make it usable. But it also doesn't stop you from downloading things in lossless formats if you are patient enough to go that route.

    He didn't even need to make himself look legit. You can literally copyright strike anyone on behalf of anyone without having any connections to the actual copyright holder. CZcams is 100% garbage on this. CZcams does not require any proof at all what so ever that the person issuing the copyright strike owns the copyright. Which allows trolls to copyright strike the actual owner of the copyright. It happens to smaller musicians on youtube all the time.

      @@kraigisboss It is my understanding that this is how you get the info of whoever is miss using the system, if you proceed to sue YT gives you the info however most content creators really just do not have the money to take this into court, this guy just happened to target a company who has both money and lawyers so it can actually go through the process.

      Modern day gaming itself is dead and the online community is not helping it either.
      One example :
      REverse is not even released and it already have 60%, 80% discounts, even the idiots don't want it any more, not to talk about their original community who abandoned them almost 20 years ago now. People left and right online praise the upcoming RE4 Remake, reality is 5% tops will only buy it, the other numbers will be promo free copies to reviewers and fake fan community who will not even bother playing the game, they will slice up one generic premade video, talk over it, monetize the s--t out of it and move on to the next thing. After that they will sell 1$ - 5$ sales to compulsive hoarders and that is it.
      Same thing happened with RE5 back in a day, it was sold for 1 euro, bundled with bunch of things, with other better games even given away for free, later some idiot brags it sold 10+ mil copies, AND?! it didn't brought back the investments of development, company upkeep costs and millions of wasted money spent on promos.
      I can write thousands of bibles on this what is all wrong with the things we get and how it's operated.
      We need a hard reset in everything and start over. Make great content again and we will have a healthier community too.

    I feel like all CZcams needs is a "Verified Copyright Holder" option that copyright holders need to file for. They need to prove they hold copyright to that content, and they need to be the ones who file for said copyright issues. CZcams will then ignore any and all copyright related issues to those who do not have that filing completed. I might be naïve to the way it works, but I can't believe this has gone on for so damn long without some form of attempt to fix it.

      Do you realize how many things can be copyrighted? As an example, I own the copyright to photos that I take, whether I publish them or not. So, if I go on vacation to Yosemite and use a modern Digital Camera to take photos, then all of the photos that I take are technically copyrighted to me. I don't have to file anything. I don't have to register my copyright (although I could, it is not required). Inherently, when I take the photo, I am afforded some copyright protections. With a modern digital camera, I could reasonably take 5000 photos a day (Modern Mirrorless cameras can shoot 20FPS in burst mode). If my trip is 5 days, that is 25,000 photos, each of which is a separate copyright to me. All of those raw photos are protected by copyright and if any one of them were to end up posted by someone else without my permission, I could theoretically submit a DMCA Takedown Request to try to get them removed. So, how exactly does a database function to keep track of all 25000 copyrights that I own from my 5 day trip to Yosemite as a hobby photographer? And if I decided to start editing my photos, it gets even more insane. Because, technically, every single edit that I make is a separate copyright protected item. So, if I have a few Lightroom preset filters to make a B&W version, a Sepia version, a High Saturation version, and a Low Saturation version, then every single different version is theoretically a separate copyright. And I could theoretically apply each of those filters for ALL 25000 of my photos and it would probably take me less than 10 minutes do so with Adobe Lightroom.. So, my 25000 photos is suddenly 125000 different copyright protected images (the 25000 raw photos and then the 100000 edited photos). How do I go about ensuring that all of my photos are protected? Do I have to file for 125000 copyrights? Is my copyright invalidated because I didn't go through that process?
      TLDR; you are naïve.

      @@morkins3243You are correct and I do like the example you provide. Pretty much anything you create for your use is automatically copyrighted upon its creation. This does include, but not limited to, papers, letters, manuscripts, pictures, and videos. As long it is not in the capacity of creating something for your job/place of employment (i.e. taking a picturefor Vogue magazine or an article for NYT), copyright belongs to you, at least in the U.S.
      That doesn't even get into Fair Use. People do forget that Fair Use is a legal defense that is defined in the courts and not an automatic thing in law. The courts have been defining and narrowing down what Fair Use means.
      This gets even more complicated when you add international copyright laws. Other countries outside the U.S. may not have Fair Use exceptions. That's why Japanese companies, like Nintendo, can go after CZcams creators since they do not have Fair Use exceptions. You not only have to deal with domestic laws, but also international laws on top of it.
      Copyright is an extremely complicated issue. I am not saying CZcams copyright claim is system is not an issue. It certainly is and as we see is easily exploited. But, you cannot just have the solution of "provide proof of copyright" since, again, anything you create has automatic copyright status without filing for it.
      The fact that in the U.S., the DCMA laws have not been seriously updated since its inception since 1999 doesn't help matters.

      @@matthewmayton1845 While I think DMCA should perhaps be re-examined and updated, I also do not know if I can actually even conceptualize any changes that would improve it without breaking it in different ways. I think the most reasonable change that has been suggested is a codified "Small Claims Court" to handle arbitration of copyright disputes without such a massive legal expenditure. But even that has it's issues. Beyond that, any ideas for changes to the law that I can think of have consequence that create new problems that are just as severe as the problems under the current law...

I'm just pointing out a law passed 20+ years ago and not significantly updated for the digital realm that wasn't even feasible then is an issue (have to somewhat deal with this at work). Like we both pointed out, copyright and verification is not as simple of an issue nor does it have as simple of a solution as the original poster seems to suggest.

    No no no, the party at fault here is CZcams for allowing this mess to happen.
    All the youtube creators who were wrongfully harmed should get together and sue CZcams for damages to their earnings.
    The youtube creators and bungie have to party up and begin a class action lawsuit againts youtube for not doing their proper due diligence. Sue youtube for over 1 trillion dollars and have the earnings divided amongs all the youtubers who had copywrite strikes/ and or bans.
    Make youtube pay for once.

We all know that Act was being sarcastic and he wouldn't seriously dox youtube employees and all what was said, but if you think about it as if Act was worker inside of a company: Person A did something evil and wrong and person B was against it, but since the company did nothing against person A, then person B started shit talking the company and joking about being a danger for the company, which is something the company can't prove he wouldn't do, so the company decided to cut person B because B is now a threat for them. I feel sorry for Act but he fucked up big. Even as a joke you don't threat the place that pays your bills. Yt is a private company and they're in their right to decide who they ban and who they don't. Act's only hope is through YT having mercy on him, not through a court room.

    Actually, the copyright holders getting struck is a fairly common problem. It happens in the music scene to creators all the time. Leonard French talked about it, with examples, including his own choir videos that he had the rights to getting taken down.
    It's bad. This system is so far beyond broken...

    It's a fact that it took a multi-million dollar company to sue a multi-billion dollar company to even put this on anybody's radar. There's no way to convince me that an individual would be able to make this impact without going through this sad process of abusing the system. Creators of their own music get DMCAs claiming to be on behalf of themselves as shown. Ridiculous. The system needs to change.

    I call it Internet Rage...similar to Road Rage, but you are sitting at home instead of in your car, and you're feeling so safe and empowered. This is the same as the guy who rams his car into someone who cuts him off. Losing his channel sent him over the edge and he went all scorched earth. Oh, and another point, I am a vendor on Amazon, and they have something called Brand Registry. The way it works, is say you want to be the Admin for you brand, let's use Lego as an example. You would go into Brand Registry, and apply to be the moderator of Lego on Amazon.your country. Amazon would verify you via the trademark registration for your county, which has an attached email, usually going to the trademark lawyer who did the filing. That lawyer has to reply back to Amazon and approve you as the Admin/moderator for Lego. So Amazon has verification you are authorized. Clearly, CZcams didn't copy best practice here. I have said it before, you don't have to be smart, all you have to do is copy the best practices of others, and add them to your "spell book". If you do that with everything, you will be the smartest person on earth.

    On abandonware: The simple answer is no, distributing and downloading abandonware is not legal.
    Even if the creator "abandons" a copyrighted work, it does not become public property automatically. The creator may not be currently choosing to enforce their copyright, but this does not mean they can not choose to defend their copyright in the future.

    I hope Bungie seeks out legal action against youtube for allowing this to happen. Theoretically i think it should be possible as youtube's shoddy system never even tried to confirm whether or not this guy actually worked for Bungie and just took him at his word. This seems like it could be a huge potential security concern.
    Also, this guy might end up forcing youtube's hand to improve their copyright policy, he might legitimately be one of the best things to happen for the platform.

    I still remember when this shit happened. It was a massacre I’m not a big Destiny channel or anything but I knew a few people that got hit by this and it pretty much had the whole community on edge because we had no idea what was going on. Some videos were removed just for showing GAMEPLAY. I’m glad Bungie is doing something about this.

    I don't really like how chat is calling this guy a gigachad or a hero. Was this impressive? I think so as well. But you've got to remember that he did this for "Revenge." He was willing to manipulate people around him just for his personal tantrum.
    He's a gigachad until you're that person who made videos on a game constantly for years, waking up one day to a bunch of strikes, getting sympathy from a fellow content creator, and it turned out that they were the people they were complaining about.

    Honestly though Bungie and all people affected on YT should sue YT for their inability to create an actual functioning system for this.
    All this proves is that randos can be DMCAing anything they want. Until they get sued by some big companies they're just refusing to put any effort or money into fixing their abusive system.
    Edit: also have to report that Bungie had to hit YT with a freakin Subpoena to get the information they needed to find this guy because they have such a lazy shit system. So maybe they should just hit em with a lawsuit at this point.

    There is a key issues that explains a lot of this stuff, Bungie works with a 3rd party to copyright stuff, this guy thought the 3rd party(the same company that he impersonated) was doing the copyright on their own. This whole insane crusade was against the third party, he tried to get Bungie to stop the third party from doing DMCAs not understanding they were doing it legally.

    Something like this happened to pewdiepie, he made a song which he made dmca free so anyone can use it, and someone claimed they worked for pewdiepie and flagged some creators because of the song. Pewdiepie didn’t know but threatened to sue the “company” and thus they stopped.

    The thing is I'm a long time destiny player, I don't agree with what he did but I agree that bungie deserve to be put in their place, they don't listen to us guardians. They are just disrespectful with our money and time, they sunset weapons and then a year later reskin them and reissue as a paid season (£16) the seasons are 3 months long and are time gated too much. Anything the community dislikes they double down and then apologise and expand the caps or remove the caps, almost never revert nerfs

The game costs $100 a year to play and access all of the content with no way to pay more money to access that content faster.
