How America fails its whistleblowers

  • Whistleblowers who work with classified information have a few options. All of them are bad.

    “Whistleblowing” is when someone exposes a secret in their organization. And in the US, it’s often hailed as a heroic act. But within the government, whistleblowing is often perilous-especially when it involves classified information.
    If a whistleblower goes to the media with classified information, that’s illegal. And since the Obama administration, it’s become common for the government to prosecute people who do it by charging them under a law from 1917 that was originally intended to prosecute spies for helping foreign governments. If a whistleblower files a complaint through internal channels instead, the complaint has to go through the head of the intelligence community before it can see the light of day-and after that, there are few protections against disclosing the whistleblower’s identity, and only weak recourses against retaliation.
    In August 2019, a CIA officer filed a complaint about an alleged quid pro quo between President Trump and the President of Ukraine. The complaint made it to Congress, and kicked off impeachment proceedings. But the existing laws don’t guarantee that this whistleblower will be protected, either.

    An interesting fact is that whistleblowers like Drake,Snowden etc. were charged under the Espionage act, like they said in the video. Now the Espionage Act is fairly unique in the legal system as it is called a “strict liability crime”, basically the government considers this crime worse than murder. If you killed someone you could go to the court and explain why you did that, what motivations were behind that action, if it was self-defense. Whistleblowers instead cannot say anything, the jury can’t decide if they acted to protect the human rights or the constitution. Since the jury is only allowed to consider if you committed a crime, there will never be a fair trial for Whistleblowers in the US. I believe this is fundamentally wrong.

      It kind of makes sense. More whistleblowers should be able to bring government wrongdoing to light, but if someone were to actually sell information to foreign governments that could bring harm to US citizens (the blocking of which was the original intent of the EA), they probably shouldn't be given a public trial, as that would give them a chance to expose the information anyway.
      They should receive a trial of some sort, but until we can figure that out, we're pretty stuck with having to do what we do now.

      1. Overthrow government (very hard but a lot of support)
      2. Protest (which doesn’t work most of the time but if it goes global it might work)
      3.end corruption but this one will never end so oh well.

    This goes with everyday life too. From elementary schools to Graduate/medical school to even every day to day ordinary day jobs- people who cause a disturbance or make a scene that might reflect poorly upon the organization regardless if they are the victim or not will be overlooked/swept under the rug or put on blast & removed for speaking up and pointing out the inequality

      Assange overplayed his hand and lost the bulk of his support. Whistleblowers generally need powerful patrons to survive, but if you get TOO far into your patron's court then you become just a political agent rather than a whistleblower. He lost his neutrality and became a tool, so a lot of people who supported him early on lost interest.

      Which, if you look at the early days, multinational companies and their integration with governments and the press were common subjects for wikileaks. But when you go after them, finding allies is difficult. One of the big downfalls of wikileaks was it upset existing news outlets which really hurt their ability to get general support from any population. They went after real power and lost.

    I still very much like the robust institutions of the US, their commitment to protecting freedom of speech. It might not be flawless but when you compare it to the Indian context (especially the contemporary context), it's almost utopian..

      It truly is. No time in us history has a political party used the heresay of an unknown person to oust out its political opponent because they can't beat him in a fair fight. Not only has the testimonies proven the impeachment inquiries are a scam, it does injustice to real whistleblowers who have real things to report

      Why do you think that?
      Bernie's ideas already changed a lot of things in America. He is the amendment king!
      He fought for freedom. He demonstrated oppression a lot of times. He even changed Vermont and his chair in Vermont from a Republican state to a blue state.
      His ideas begin to form a social movement and he is not even the president yet.
