There are a ton of people who need pardons, at the very least. Like people who have been in jail for a decade over something that is now legal (anything weed related), and if there was no violence and it wasn't huge amounts, the record should be expunged to help them be able to get employment. The "war on drugs" has cost Americans way too much. Monetarily and just in the huge, traumatizing, fracturing damage it has done to families and friends and people's lives.
This video was about the controversial ones, though, not non-controversial ones.

I also love how in conjunction with the war on drugs, especially small possession charges, the response is typically "all these kids who grow up without dads" as if the policies they are aware of aren't the exact reason for that. They always seem to try to make it a "personal responsibility" issue when us white people get away with doing the exact same things.
And those policies go against their own goals of creating more "American families" by locking up individuals so that they can't start a family, and then they whine and cry about how citizens aren't having enough babies.

I've always thought its intended use is for when someone does something that's illegal according to the letter of the law and the judge has to sentence the person, but most people would agree that an exception should be made due to the specific circumstances.
Expungement means something will be removed from your record, whether you were found innocent or you pled guilty but made it through deferred adjudication, etc.

This is not true.
There was a supreme court decision from a hundred years ago that suggested that acceptance of a pardon implies guilt. This was clarified in an appeal by a US soldier who accepted a pardon in 2021

Pardon powers exist to provide innocent people a means to get out of jail. The majority of pardons are to provide such relief.
Michael Flints pardon is dubious because it is a clear misuse of the pardon power. (I haven't finished the video so Flints pardon is the only one I can judge).
I came to chat because I was surprised that Simons take was basically "the president has the pardon power so why are people complaining about it".
This has probably been said, but pardons not only don't mean you're innocent, you actually can't be pardonned unless you've been found guilty. It's basically saying "yes, you're guilty, but you no longer need to serve your sentence".
And as the courts have ruled, accepting a pardon means that you implicitly admit that you were guilty

If you accept a Presidential pardon, you're admitting guilt to the crime committed. You're saying you committed said crime, and accept responsibility for it. It stays that way on your record forever; "guilty of felony X". The pardon was put in place so the Commander in Chief could step in, and ensure that persons acting outside the law to protect the well-being of the Constitution, and continuation of the government of the United States couldn't be prosecuted. That's obviously flown entirely the fuck out of the window. It was a good idea when British troops were still holding defectors accountable. Nowadays it's absolutely useless.

As for the books being stolen, it reminded me of when people were robbing Fed Ex trucks a few years ago. In English law (not sure about Scottish) a pardon is effectively a declaration of innocence. It is only granted when it becomes clear that the court had made a mistake (usually because new and better evidence is discovered). The word ‘pardon’ seems to suggest forgiveness for guilt, but legally it is used to state that the guilt was falsely attributed in the trial.

Like I do not condemn slave riots and the uprising in the warsaw ghetto, or what people do in a revolution against a brutal, occupying superpower that is stripping them of all of their resources and freedoms, and causing so much suffering and death. You cannot pass judgment on those people. Not to mention that a lot of things change over time as far as what is acceptable. Even if you look in religion, which people equate with the absolute boundaries on morality, have fucked up shit in it. I think there are some things that I, maybe surprisingly, don't give a fuck about (like cannibalism a lot of the time), but some things were always fucked, like brutally r*ping kids, even though that was common in a lot of places. But you can look at the base beliefs of cultures, how open they are to social change, and how much they do to fuck with the lives of those who are suffering, in their own society and out. The US has done so much fucked up shit from the founding of the country to current day to cause suffering and death, both inside the US and out. A lot of indigenous cultures are/were beautiful and incredible, but ended up victims of genocide all over the world. So the past was so impressive until the culture was torn apart. Some current societies are incredible, but they still had a fucked past, and they depend on cruel practices outside of their country to keep their lovely country the way it is. So many places are better than the US, but no place is perfect (as an entire country).

It's the charges that get pardoned, basically it's like having all charges dropped against the person. It has nothing to do with admitting guilt or asserting innocence, but everything to do with the charges themselves.

The only exception is a finding of fact by a court that exonerates the one being pardoned. (found innocent) That is rare because in most of those cases, an appellate court would overturn the conviction before it would ever be considered for a pardon.

One said accepting pardon equates to admitting guilt, the same article cited another court’s opinion that it removes the punishment and the offense, and yet another said it makes the pardoned person “a new man” legally, but with the presumption that punishment enforced before the pardon is deemed justified.
