      Certainly Clarence Thomas decided years ago that he is above the law, the norms, and the ethics of the Supreme Court, possibly due to his ego being bolstered by being appointed to the court in spite of being unfit and unqualified to ever have been nominated to the Supreme Court in the first place, let alone sworn in. Maybe he has a chip on his shoulder because he will never be revered like Thurgood Marshall, and will only be remembered for being bought and for his arrogant refusal to recuse himself when he absolutely should have done so.

      If you commit a misdemeanor in furtherance of a felony some misdemeanors can be elevated to felonies... for example if you make fraudulent business records to cover up election crimes... the business record crime is a misdemeanor but since it's in furtherance of the felony election crime.... it can be elevated... hopefully that makes sense.

    Mississippi v Johnson: "The Congress is the legislative department of the government; the President is the executive department. The impropriety of such interference will be clearly seen upon consideration of its possible consequences." SCOTUS has already recognized presidential immunity from prosecution for actions taken while in office, even if they're on the fringe of the duties of that office.

What is happening now is the question of does the constitution give Trump immunity from prostitution, either partial or full, and for official acts or private ones. It appears the SCOTUS is leaning toward determining which acts/potential crimes Trump committed under each category. And most likely he will be charged for personal ones like illegally trying to overturn the election in a huge widespread Republican conspiracy, after the courts determined was free and fair..... because he wanted to stay in power. He illegally tried to overturn the will of the voters (in a democracy for his own personal gain. In summary he broke the laws of how and what a democracy is, the people decide who the president will be through the election process, and no one else. Otherwise why vote. As a matter of fact research shows that since 2012, 89 illegal immigrants tried to vote. But Trump is trying to desperately call the election stolen stated there were thousands and thousands. He even claimed poll workers were throwing votes away and scratching out trump votes. Well trash cans nor pens, or any items other than a beverage were allowed at those sites, as stated by many, both democratic and Republican. People need to pay attention and not make assumptions or put out disinformation like the crazy Taylor Swift ones.     It's not "Above the Law". There are positions of trust in society that require elements of power.
    The President has a pardon power to be able to intercept injustice. He is the position of the implementation of the Executive Power as specified by the Constitution, and delegates that power to those in his administration, and some of those positions of trust require Advise and Consent of the Senate. To operate he must have Qualified Immunity for the same reason why Police have that, he must be able to make decisions without those decisions to be met with Civil and Criminal charges, and that is the crux of this. The founders made it clear that the Judiciary was the weakest of the branches because it requires the Executive to implement it's decisions. Is there anybody who has any logic left to figure out the ramifications of all of these CONSTITUTIONAL FACTS?
    A position of ultimate power requires a counterbalance to that power, and that counterbalance is the imposition of Impeachment and Conviction by the Senate.
    The balance that the Founders put in place was very specific, and we have balled that balance up by making the Senate political representatives of The People instead of the State Legislatures by the gigantic mistake of the 17th Amendment. That was an imbalance em-placed by those who consider Democracy to be a be-all and End-all. It is actually two wolves and a sheep voting on dinner. That is why as Franklin said "A Republic, if you can keep it." We now have redundant houses of congress where un-diluted politics causes a major imbalance in the implementation of the Republic.
    As usual, there is no complicated issue that cannot be over-simplified by low IQ journalists into propaganda clauses. As is here. It's almost as if the two wolves consider themselves entitled to lamb stew...

Nixon famously said: "Well, when the president does it … that means that it is not illegal.." Beyond that, this isn't an argument about being above the law it is about proper procedure. Proper procedure for a president (and other high officials like SCOTUS, Senators etc) is IMPEACHMENT. Impeachment with conviction removes title, seat and all immunity. If not for that process, we will see what is happening to Trump happen to all political enemies of the establishment. Trials based on anything and everything to harm the person politically and financially. This isn't the American way, this is the way of fascist countries where the state holds the power and not the people.

    No crime was committed. One can ask for an investigation into whether an election was done properly or not. The very fact that they are responding to this in this manner says much to the general knowledge of YES IT WAS INTERFERED WITH. IT WAS TAMPERED WITH. The fact that not one Democrat has raised a question to 2020's validity states much to the unionization of that party.     Presidential immunity is part of law. Now, "official duties", meaning acts in pursuance of government duties, should be immune from criminal prosecutions. First, because anyone with some intelligence must know that Presidents do things that are immoral, if not illegal, should they be done by ordinary citizens. Those are up to Congress to deal with through impeachment. If they don't impeach or impeachment fails. The majority in Congress agrees with the action even if illegal. Outside of "official duties" it's fair game. The decision of "official duties" will fall to the trial judge. And, as mentioned in this podcast, it would end up being appealed up the line.
