      The Supreme Court has ruled cops have no duty to protect, so you are wrong about the cops having a duty to protect anyone, regardless of what Texas law might say.

      @@Watchdog_McCoy_5.7x28 so the cops cant be held liable for failing to keep people from harm in federal court, but they can in state courts if the state says they do have to, and also they can be charged in both courts for choke slaming a victim to the ground, so you are wrong about assuming this is about failure to protect.

      Decades ago, IN TEXAS, officers appeared for calls from neighbors, where my now-ex-wife had been assaulting me, I answered the door where my shirt was drastically torn for the aggression of the woman. Their ONLY concern... was the WOMAN OK??? I had crawled up into a ball while the woman wailed on me, but NO concern of ANY assault from the woman, while she assaulted me insisting that I should fight to show that I am a MAN. The ONLY showed concern whether the WOMAN was OK. Does this make sense to ANYONE????

      They should get double the time. They put themselves into the shoes of a protector and they break that they should be punished x2. For an example I be using assault, if I assaulted someone and the sentence was 5 years, cops should get 10.

      Exactly... not to mention even if they didn't get violent, they show up and don't accept "no nothing happened, I don't want to talk to you" they keep questioning you trying to get a "yes a crime occurred" which leads to unnecessary and false charges... they don't accept "no" then also asking a girlfriend whether her boyfriend (who she's apparently fighting with about something) everyone's mad at the answer "nothing happened" so I can see why some women eventually lie and say okay "something criminal happened" then afterwards the gal recants her statement and tries to fix it, but the police and courts won't take "nothing criminal happened" as an answer... they will literally go forward with charges without your support and while you're telling them "no crime occurred" all in a bad attempt at "keeping domestic violence victims safe" all while police commit domestic violence themselves at an alarming rate... they also often times end up arresting the boyfriend and start dating the victim.

    He was actually doing quality detective work. He performed the actions of the abuser in order to understand his mindset. Then, he was able to immediately locate the abuser by looking in the mirror.

    What should have happened? The first responding officer would actively listen, while showing understanding and empathy. Tell her that she is sorry to hear about bad reputation and expresss the willingness to do anything to make her feeling to be overturned. Give her a card with a telephone number to call anytime if she needs help, and finally assure her that the police is on her side. Everything would have been very different.

    So let me get this straight, the boyfriend allegedly chokes the victim. The police show up and are unable to locate the boyfriend. So the police decide to further victimize the victim by one upping the boyfriend by choke slamming her, putting her in cuffs, and telling her it is essential her fault they had to assault her. Then the police department and court system take 2 years to arrest the officer who assaulted her.

    I love watching these videos. Always great to learn more about the law and my rights. However, the scariest thing about the videos you post is that almost every situation you audit, even YEARS after the fact, are not resolved. Whether it be charges or lawsuits. Charges still pending, lawsuits being put off. There needs to be major reform for our judicial system.

    I’m trying to figure out how any of the exigent circumstances can exist from a phone call made by uninvolved “witnesses” to the occurrence. How can you have suspicion that the abuser is in the home when the “victim” didn’t call for help, the “victim” says she’s safe in the home with the person she called to be there, and the “victim” saying she doesn’t want to press charges or have any medical attention? This whole thing stems from a third party calling the police

      Edit: since ppl love to assume, are emotionally charged, put words in mouths and apply motives where there were none, I am, and have ALWAYS been in agreement with everything else that was initially said, and her silence after the fact was ridiculous and makes her part of the problem no policing in the institution.       @chahan The plead bargain is a system when you plea to a lesser charge. That is the bargaining part of the plea bargain. So, he made a deal and got the lesser charge. That is how our court works. It is a wheel and deal system. There is plenty of evidence for the full charges, but that would require a lengthy trial process, so a deal was made.

      This is what happens when you completely disregard an individuals desire in a situation that only effects them and substitute for it the “discretion” of an officer who is automatically predisposed to distrust anyone they meet in response to a call. It was an incredibly dangerous precedent to give police unfettered power in a so called “domestic violence” situation. Taking away the rights of citizens to make their own own decisions in matters such as this is almost never beneficial to the citizen and only serves to empower the police state at our expense and to our detriment.

I've always had the belief that you have to either be an extremely good person to want to serve your community, or you're just a power tripping unsuccessful POS if you legitimately want to become a police officer.       Even this video proves I'm right. Just one or two good players would have no damn say about how things should be regardless of their position in the force, and still this is just one of many examples where the bad actors have been reprimanded. Do you have any other false excuses for lying or is that it?

    The officer basically gave her the "you made me do this to you" excuse that abusers use. Hope he goes to jail, and that she wins her lawsuit. No one should have this insult to their injury of having to deal with both an abusive situation with their partner/boy/girl/friend, and a cop who just does the same thing.

      Unfortunately it's *exactly* what the police are here for. We need to disband the police and replace them with an organization that is designed from scratch to put people first, with the proper training and education, instead of paying for a bunch of big guns and big trucks and crap. Only SWAT should even be allowed to have firearms, and any call involving a firearm should be handled by SWAT, not regular officers.

Which is as it should be; if no-one involved wants the laws enforced they shouldn't be enforced. If they cover for them, so be it. That's their choice, what adults do is their business. This notion that the police have a right to investigate and prosecute a crime against a person who says a crime wasn't committed is not only bullshit, but dangerous bullshit. "But it might save lives," you say. "But the people involved don't know what's best for them," you say. This is the exact mindset that let them enforce laws about how big your Thanksgiving could be a little over a year ago. If an adult doesn't want law enforcement help, you don't get to force it down their throat because you believe you know what's best for them better than they do. The neighbors called the cops claiming a young couple was fighting (they were playing video games and talking loudly) the cops came and tried to open the door in the middle of the night. The man being scared grabs his pistol and opens the door. The cops yell “put the gun down” he gets on the ground and put the gun down the cops shoot and kill the poor guy in front of his fiancé he dies in front of her gasping and choking on his blood.

      They performed a strong arm burglary. I have had this happen before to me. A girl called the police on me saying i wouldn't let her into my apartment. I would not let her in, because she did not live there. The police broke my sliding glass door and pulled me out of my apartment, then let her go through my belongings and take what she wanted. When i told them what they were doing was against the law, they asked me if i wanted to go to jail tonight? When their sergeant showed up, he again asked if i wanted to go to jail. I had committed no crimes, they did not have a warrant and nobody was in danger inside my apartment. The police have the guns, numbers, and clout. They can do whatever they want. I realized i was fighting a losing battle and went into, yes sir, no sir, mode. They let her finish robbing me, then let me back into my apartment and left. I was totally floored finally realizing that the cops answer to nobody and do whatever they feel like doing.

      Every one of the officers should be in prison? What the fuck for? The female police officer was very professional. Only Hernandez should’ve been prosecuted, and that’s exactly what ended up finally happening, thank goodness.
      What a shame that it took a new sheriff to clean up the department and take that action though. Shame on the sheriff that was serving when this happened and only put Hernandez on one day suspension without pay.
      The former sheriff should be prosecuted, but not put in prison for what he did. What he did was wrong, but it’s not to the extent that he should be serving prison time for it.
      I will say though that the former sheriff’s history should be looked over with a fine tooth comb though, and if he did something more severe than this, then perhaps prison time would be in order.

      Anyone else would be arrested for the level of association with the suspect during the commission of a violent felony, and be forced to prove their innocence in court.
      She's just as guilty as he is imo.

    Officer Hernandez behaved exactly as a domestic abuser would. He grabbed her by the neck and threw her to the ground, and then told her that it was her own fault. It is hard to believe that he wouldn't act the same way in his personal life.
