  • Today we take a look around BMW Group Plant Hams Hall, Canton Ln, Coleshill, Birmingham B46 1GB.
The pedestrian footpath and beautiful grounds make it so inviting so we have a good walk around.
We see some engine parts being made, have a chat with the gardeners and witness a Remote Control Robot Landscape Cutter Mower (ROBOFLAIL / FLAILBOT) in action and then Security ask us to leave.
We have a good chat on the way out and then the Police Arrive.
    Enjoy!

It's down to them to mark it clearly. This is why most houses have brick walls with a gate at the front of their garden.

There is no requirement to provide signs nor barriers. If we reduce your argument to its base point then we would be all required to make our property look like prisons with ugly signage & fences everywhere. Do not do this & do not do that. Being facetious for a moment do you require a sign to tell you when to get out of bed? We shouldn't require signs to tell us how to behave in all circumstances.
The first employee clearly stated that they didn't want to make the place look like a fortress or somesuch.
However, if there is no clear signage nor barriers then a member of the public does not commit trespass by entering the site. The offence of trespass would only be complete if the person was told to leave by the landlord, or his agent, and they refused to quit.

I have to use a normal strimmer for it because if I used the ride-on mower it would tip over with me sitting up on top of it. It wouldn't have enough traction to climb the bank either. The tracks on that thing, with its low centre of gravity would be fantastic, though way beyond my budget. I felt like Royalty paying €1000 for my second-hand ride on as it is. Pubicly accessible land, public´s choice.
Of course if the land owner would have asked him to leave, it would have helped. But then again these people weren´t the landowners now were they...

@@whitemonkey7932 Ah yes, thanks for showing how superior you are by insulting other people.
And thanks for showing how little your comprehension skills are, because first of all I didn´t say it had to be the landowner, I said it would have helped.
(If you didn´t notice, I was just saying the exact same thing that Mark said, but from a different point of view).
And secondly, just for reference, only the landowner has the right to pursue legal or civil actions against a trespasser. That land belongs to BMW, and even though the security guards and the facility personnel work for BMW, it is not their land. They didn´t possess any legal documents that would suggest they can make decisions for BMW, otherwise they would have shown them.
They can ask people to leave, everyone can do that, correct. However it takes more than just the word of a security guard, or employee for them to revoke access.
Otherwise anyone with a high viz or uniform could just say whatever they like and it would mean everyone else would be forced to obey.

    • @danielzaba9913
      @danielzaba9913 Před 2 lety +3

@@gamewithadam7235 Incorrect, and again, no one takes time to understand what I am writing.
It´s not a question about if you can trespass or not if the owner is or isn´t there, since you shouldn´t be doing it in the first place. It´s not ok and it´s not like normal people would go trespassing on people´s homes anyway.
The real matter is about the fact that you need signs and barriers if you wish to keep your privacy and if you wish to restrict access to your land. That´s just law, and the truth.
As I already said, you can revoke access as the landowner or if you have the legal documents that give you the power to speak for the landowner or manage that property to full extent. But we´re not talking about a couple of lads here that hang out in the same house and when one goes to buy something from the store, the other one can just tell people "hey it´s my friend´s house".
That comparison is just ridiculous and would arguably never occur in real life. It has nothing to do with this video or anything that I was discussing.
But even in such a ridiculous and silly event, if somebody with the legal means to question the ownership of that house really wanted to do that, like let´s say for example members of government acting under a lawfull court order, your friends wouldn´t be able to just tell them "oh it´s our house" and be done with it.
That´s why you have documentation for owned property, and that´s why you make it in the first place and get it signed and authenticated. I´m sorry but that´s just how the world works, if you can´t prove you own something, then it isn´t yours.
So no, the landowner´s "friends", cannot speak for him or pursue actions just because they are friends. They need much more than that. Not to mention the fact that the people in this video weren´t the landowner´s "friends", and this wasn´t your home, it was publicly accessible land.
And even in the silly event that someone tried to trespass your home just because the landowner isn´t there, you would still have the legal means to prove that you are currently administering that property, and therefore can revoke access. Which you wouldn´t need to do anyway, because besides being a ridiculous scenario, you wouldn´t need to prove anything to anyone unless they have lawful means to ask you. And people wouldn´t be able to trespass a locked door. At that point it would be a break-in.
The situation in this video, is completely different. As I mentioned previously, the personnel there have the legal right to ask somebody whatever they want, including, asking them to leave. Anyone can do that. And of course, they have responsabilities given to them by the company.
However, because the property was a publicly accessible plot of land and obviously not a home, and because no barriers or signs were bypassed, then those specific people from this video that had NOT identified, cannot legally pursue any actions against DJ.
Just because you work somewhere, that doesn´t give you the right to administer that property. That makes no sense, your responsibility has nothing to do with publicly accessible areas or with the right to revoke access on such an area. Your responsability as an employee would be fulfilling the job you were given, regardless of the fact that there´s someone filming from a publicly accessible area. And as a security guard, It would be calling the police and the company if somebody enters a restricted, closed, barred area, aswell as maintaining security inside that area.
But it has nothing to do with revoking access to citizens in publicly accessible grounds.
At no point did they say they are revoking access, at no point did they identify themselves, at no point did they state that they are qualified by the landowner to administer that property. And even if they did, their word alone without identification and some way to check their claims, would have no effect. That´s specifically because they were trying to revoke access to a publicly accesible area. And I´m pretty sure they didn´t have any way to revoke access, because they weren´t qualified, otherwise that gentleman at the beginning would have stated otherwise.
Think about it, if we were to judge by your logic, someone could just wear a high-viz vest and start giving directives that might very well affect people or a company in a negative way. In the video itself when the security guard first arrives, he asks "Are you with Mitie". How would anyone know anything if they can just give directives without any proof?
What if the company doesn´t want to revoke access? How do we know? You can´t just trust the word of people when we are talking about open, accesible areas.
This isn´t a closed area where the one that enters must prove he has the right to, this is a scenario with an open area, where the people that want you to leave are the ones that have to identify.
And I said identify, because they don´t need to have a reason in order to revoke access, but they do need to show that they are qualified to make such a decision. Which they haven´t.
And if you still believe you are right after all that, think about what could happen if somebody that used to work there, suddenly decided to go back the day he was fired, and start giving bad/negative directives.
A security guard that redirects trucks, or an employee that just tells people they can park in their car park.
If nobody needs to prove anything to you, they could very well just cause considerable damage just by wearing a high-viz.

    • @gamewithadam7235
      @gamewithadam7235 Před 2 lety +1

@@danielzaba9913 Yes we all saw the video.
It does not change the fact that if a private landowner employs people they can take action against you on their behalf.
Otherwise by your logic people should be suing security for removing them from private property.
If it's public land then there's no reason why the owner should get involved, so I don't know why you imply it makes a difference. That would be a harassment claim. Which is very different. Or noise disturbance/public nuisance. You understand I hope that if any of these people go too far it would be public harassment/public nuisance, which is why the man in the video always has to state his activities and that he is leaving soon. You can't just stay there forever starring at them through a window simply because it's a public footpath. It's common sense you need to move on eventually.
Can you talk without referencing the video and use other scenarios/common sense? I already saw the video I understand it I don't need a recap from someone regurgitating it.

I used to work Security at BMW Hams Hall. Only seen the first 40 seconds so far and I don't recognise those guards.
Those bollards the security showed you are purely to stop vehicles mounting the kerb and driving around the road raised bollards. They're not for pedestrians. The first room you looked through the window was the machine shop. There's a second huge building on the other side of the plant which is assembly. That's where you'd see the engines being assembled. The grates that smelled like sewage etc, there are tunnels underneath the machine shop with a service trench as well. I think most of the smell is caused by fluent and swarf from the machining of parts.
The security gatehouse is based at what we called the fire station (on the other side of the plant) hence why the security were driving a fire livery vehicle. We used to have a 6 wheeler landrover defender which had the water tank in the back and compartments for hoses and fire fighting equipment with the ladder on the top. Basically crossed between a fire engine and a landrover defender that grew an extra 2 wheels.
Haven't worked there for at least 10 years now so I guess alot has changed including the security company and guards. The grounds you walked around bring back memories though.

I find it hilarious what Brits deem to be “Immaculate grounds” paper bags in the pond, grass is partially burned out and not edged and asphalt needing to be tarred.

Tell me Kane Dynasty what the hell has a BMW industrial site anything to do with Brits?
It sounds like your xenophobic to me.

You video’s keep getting better, this one has everything, but the female cop, especially a blonde, is the icing on the cake. Good luck for the future

The private fire vehicle with blue lights is interesting and somewhat rare now-a-days as believe it or not anyone can establish a private fire brigade just as anyone can establish a private ambulance - heavy industry plants such as vehicle manufacturers are required to have suitable fire suppression on site including some form of fire brigade.
This used to be far more common and many industries over the years operated their own private fire service, British Rail had their own fire brigade along with British Coal etc. I think Rolls Royce still have them along with most major airports.

True , the Coal Board or NCB had their own Ambulance Service years ago . These security guys also doubled up as fire and medical as they also carry a defibrillator .
