To all the ones who think what the government is doing is right and just - let's just think about that for a moment. Have you questioned what the contractors are being paid that are bulldozing this down? Have you ever questioned any government contractor? Does the scenario change if they are trying to take your 90 year old grandmother's house who is unable and UNWILLING to move? What about if it was your property that you had spelled out how it was to be used and how you were going to live off the income from it for the rest of your life? Does the government now get to make that decision for you? This government is balking about a citizen standing up for what is right and just. Think it doesn't happen to the elderly and vulnerable populations? Think again. They are the ones who can't fight. I am proud of these people who are fighting not only for themselves, but for those who can't. They have shined a spotlight and heard stories of this happening to all sorts of people. The way the system is set up, we just let government contractors and elected officials take what they want from the taxpayer and then complain when one of our own stands up to it? Come on people. You've got it all wrong.

Another point I want to make is the easier we make this for government officials, the more likely they are to keep doing it. It should be a hard decision for them to do this. They have to be made accountable to We the People. They cannot just pay fair market value for anything they set their sights on.

The only thing is, this was purchased as an investment property! It’s not owned by a 90 year old grandpa who lived there his whole life. This situation sucks, but after reading the city’s statement (and watching ALL of these videos), I think the city has offered fair compensation for this property. The last video said they were still responsible for the mortgage, but the city says they have paid it off. So maybe the last video forced the city to pay off the mortgage? I would think that if they countered the city’s offer with a more realistic number, this whole case would be over. Good luck going to court, I doubt they’ll get much more than the city’s offer once the lawyers get their share.

@@jimharris5049 ok, fair statement, they have the means to fight this better than a 90 year old. Ok, so now the question becomes, where is the line drawn? What can be done to one, can be done to another. That's why I say they are fighting against government overreach for everyone. The better able ones in our society must stand for those who can't fight. Have you checked into how much the contractor's are being paid and who they are by chance?

I think what the city is doing is BS and the fact the Mayor’s family is part owner of the future RV park and will benefit financially smells of corruption. When this property became available for sell, the government should have bought it then. As far as contractors go, they could care less as long as they get paid!

The Race Family has been making their case on youtube for months now - yesterday the City finally presented it's defense. They bought the house for 306K about two years ago. The city claimed eminent domain and offered FMV of 490K but they wanted 3 million. The City went up to 539K and the Race's last demand was 1.5 Million. The city took procession of the property and deposited the FMV amount of 490K in escrow. They bought the house with a realtor but there is nothing said about what disclosures were required. The campground route was cancelled rightfully so since it will provide more tax income to the city than the single family house taken down.

Thank you for your input. We strongly believe that no government should have the power to arbitrarily decide the value of private property or determine when they can seize it through eminent domain.
Our property was appraised using residential comps, which do not accurately reflect its true value or potential. The offer of $490K doesn't come close to what the property is worth. The government's approach to this matter has been neither fair nor transparent.
Moreover, the idea that the government can unilaterally decide to take someone's home without proper compensation or a fair appraisal process is fundamentally wrong. Property owners should have a significant voice in these decisions.
Do you believe that the government should have the authority to determine property values and decide when they can take someone's home?

    • @jackbaker8512
      @jackbaker8512 Před měsícem +14

@@PigeonForgeEminentDomain the city did not arbitrarily decide the value of the property. The value that they offered was based on the price that you paid (which set a fair market value on the property). They offered MORE than you paid (as you are well aware), then they offered a substantial increase over that, which you declined.
The route of the road was set prior to your purchase of the property. The seller, the title company, and your real estate agent did you a serious disservice by not telling you about the road. The seller might even be liable for failing to disclose.

Thank you for your comments. We strongly believe that the government should not have the unilateral power to determine the value of our property or decide when they can take it.
      1. **Property Valuation**: The $490K offer on our property, which was valued by the city using residential comps, does not accurately reflect its true worth. The use of inappropriate comparables undervalues the property and does not consider its full potential.
      2. **Eminent Domain Concerns**: The concept that the government can decide when to take someone's home is fundamentally flawed and unjust. Property owners should have a significant say in such decisions, and the process should be transparent and fair, with appropriate compensation based on accurate appraisals.
This situation highlights a critical issue: the need for reform in how eminent domain is executed. It’s essential that property rights are respected and that owners receive fair treatment and compensation.

I understand that you were/are upset (as anyone would be), but come on ..$3,000,000.00. Eminent domain stinks when it happens. It happened to my parents (who *lived* in their home) for the same reason. They were compensated. My parents didn't except the first offer, but were reasonable with their counter offer.
I'm sorry that this did happen to you, but I do feel that you were being unreasonable by asking for $3,000,000.00 when you paid under $400,00.00. Even $1.5 million is unreasonable.
I get it, you're upset and you should be, because it wasn't disclosed to you at the time of your purchase. You were taken advantage of by the previous owner. They saw someone from out of State and took full advantage of you not knowing there was a plan in place to take the property.

It was a tragedy that they had to sell their home to the government. But, it is what it is. The road that was built through my parent's property is helping the people. My parents took the second offer and they moved.
Again, eminent domain stinks, but it is a law. All home buyers risk eminent domain happening to them. This is nothing new that happened just to you. Luckily for you, this is a second property. How many people are affected by eminent domain and have to truly uproot their lives?
As far as your offer and counter offer. Yes, you're being unreasonable. Your house and land are not valued over a million dollars. Why should taxpayers have to pay more than it's worth?

So there are many things wrong here, with that said most of them deal with morals of the township. A lawsuit will go nowhere, as eminent domain is a legal process approved by the courts. This woman claims that the house was bought as an investment property. She claims that "investment property" is even written on the mortgage paperwork from the bank. She then cries that this was their forever home in the next breath, so which is it? If an investment property you paid $300,000 and were offered over $500,000, I'd say that's a pretty good investment. Pay the original note off and use the proceeds on another property. You can also sue the title company, for not discovering the road project and make even more money. I'd say your investment strategy is a blessing from the man above. So please just stop crying about your investment property its doing just what you wanted, making you money just not in the way you intended.

Thank you for your comments. We firmly believe that the government should not have the authority to arbitrarily decide the value of our property or determine when they can take it.
      1. **Valuation Issues**: The $490K offer we received, based on the city’s appraisal using residential comparables, significantly undervalues our property. This method does not accurately capture its true market value and potential.
      2. **Eminent Domain Concerns**: It is fundamentally unfair for the government to decide when they can seize private property. Property owners should have a substantial say in these matters, ensuring the process is fair, transparent, and includes just compensation based on accurate valuations.
This case underscores the need for reform in how eminent domain is handled. Property rights must be respected, and owners deserve fair treatment and appropriate compensation.
You believe governments should be allowed to infringe on property rights?

“Is there a time when we should intentionally disobey the laws of the land?” The answer to that question may be found in Acts 5:27-29, “Having brought the apostles, they made them appear before the Sanhedrin to be questioned by the high priest. 'We gave you strict orders not to teach in this Name,' he said. 'Yet you have filled Jerusalem with your teaching and are determined to make us guilty of this man’s blood.' Peter and the other apostles replied: ‘We must obey God rather than men!'“ From this, it is clear that as long as the law of the land does not contradict the law of God, we are bound to obey the law of the land. As soon as the law of the land contradicts God’s command, we are to disobey the law of the land and obey God’s law.
Also Shadrach, Meshach and Abed-nego didn't obey the law of the land to fall down and worship the image that Nebuchadnezza made.
The law in many states lets women abort/murder their unborn children. God tells us to not murder one another, so does man's laws supersede God's authority here? Man can be evil and corrupt. You have to go by what the Word of God says if man's laws goes against God.

Faith is the most dishonest position a person can have as faith is not, and can not ever be a reliable path to truth. All people of faith have one thing in common, a delusion outlook on reality.
