  • WI V. DAHMER (1992) - The defense for Jeffrey Dahmer delivers their opening statement. Dahmer pleaded guilty but insane to the murders and dismemberments of 15 boys and men. A jury was tasked to decide if Dahmer was sane at the time of the crimes.
A new Netflix documentary "Monster: The Jeffrey Dahmer Story" explores the gruesome story of Jeffrey Dahmer. Court TV cameras were inside the Wisconsin courtroom in 1992, where a jury was tasked to decide whether Dahmer, who pleaded guilty to the murders and dismemberment of 15 boys and men, should be sentenced to life in prison or admitted to a mental institution.

Right. I bet they knew it was a losing battle. The intention was never to free him but to have him placed in a psychiatric institution instead of prison. I don't know how I feel about that though. What's the point? It might have given him some understanding of himself but he was never going anywhere ever again regardless. It sure wouldn't have helped the victim's family's and they're the people who matter here.

      Ultimately...
the defense attorney is there to force the state
and/or prosecuting attorney to prove its case
      against an accused defendant beyond
      all reasonable doubt.
      Specifically regarding Jeffery Dahmer
      and as @lynsey4224 said below...
      It was never so much
      about "freeing" Jeffery...
but rather, but to have him placed in
a psychiatric institution instead of prison.
      Strangely enough...
      although Jeffery was diagnosed with
      borderline personality disorder (BPD),
      schizotypal personality disorder (StPD),
      and a psychotic disorder, Dahmer
was found to be legally sane at his trial
and was sent to a state prison
rather than to a mental hospital.
Think of what psychologist could have
learned from Dahmer had they been
allowed to examine and study him
had Jeffery been put in a mental hospital
(not unlike, say, Karl Childers from "Sling Blade").

Representing and defending the rights of the most vile of our community is the most important part of being an attorney. It would be easy to violate their rights and cast them to the side, but that would set the precedent that would later be used against every other citizen.

The whole story is tragic. Jeff was born to a mother who didn’t like him, showed him no love or affection and took 26 pills a day. A father who worked all the time and the only time he spent time with him was to dissect dead animals. When I think of the love I give my kids, his story makes me sad. ‘I hate what he did. It was evil and I’m not condoning that. But he craved love and friendship.

Trail ? The defense has the luxury of going first because they’re just presenting information . The prosecution has the task of proving their point . The onus is on them

@@julianmitchell5776 Nope, in North America it's the other way around. The party bringing the case always goes first, in both criminal and civil. The defence attorney mentioned that this trial was unusual in that the defence is going first and that caught my attention.

    • @stevemichael652
      @stevemichael652 Před rokem +8

Wrong. The defense has to prove their point when it’s a guilty plea. This trial is determining whether Dahmer was responsible for his crimes which means the defense has to prove he isn’t. Had it been a trial to determine innocence , the prosecution has to prove guilt. But dahmer is saying he did it but he isn’t responsible, so it’s the defense that needs to prove WHY isn’t he responsible.
