- The plaintiff says he rented an apartment from the defendant, but the weasel is withholding his security deposit. He refuses to let it go, so he’s suing to get it back. The defendant says the plaintiff left with no notice and damaged the home badly during his tenancy, so he’s getting nothing back.

The defendant claimed that the plaintiff kept a couple of birds in a "plastic box" AND he was a very heavy smoker? Those poor birds must have suffered terribly. That's animal abuse!

Smoking is toxic to anything living especially birds. They have small delicate nostrils so smoking could really hurt them even kill them. Looking at the walls, he was a big smoker.

While the defendant doesn't say what size plastic box the plaintiff is keeping his birds in, the fact that he doesn't say cage is a little concerning. Some people just don't know how to properly keep birds as pets and believe that as long as they are fed and watered regularly, they are good to go. But without a picture, I can't say this with certainty.

If his walls ended up looking like that, imagine what the lungs of anything that breathes would look like being forced to live in that hot box. It's been proven that secondhand smoke can be just as deadly. But you do you. Just don't take others down with you.

I'm confused. I thought Judge Milian said that he can't expect a tenant to be responsible for tiles falling off unless they were broken. And the tenant has to pay for carpet from 1989?
The security deposit was mostly used for the last months rent and wall cleaning. The carpet and tile were not the tenant's responsibility

It will take thousands to take care of the walls alone. Even then, it gets into every inch of the place, so I wouldn't be surprised if faint wisp of smoke is still smelled years later.
He has to pay 1 month rent because he didn't give a 30 day notice and for the damage he did to the walls. These alone will cost the landlord more than the double money of the deposit this tenant was asking back. I hope this landlord sued him later for the remaing money he had to pay out of his pocket.

I believe everything the plaintiff said (the defendants smirk didn't sit right with me), but even if given approval to smoke, it created too much damage. It gets into even little crevice, including inside the walls. It takes thousands to truly get rid of it.

Even if a landord is a nice guy and allows you to smoke even if the contact say you can't, there is a reason he is not removing it from the contract. For not having to pay out of his pocket for the nasty habits of others. Anyway I can't believe this tenant thought he had a case lol. The house is awful because of his nasty habits and hasn't given a 30 day notice.

True, and as a retired licensed contractor, I always quoted X 2 if I knew it was a smokers house, because you to wash twice with tsp, then rincé with clean water, before I could even begin to paint. And no, any primer isn’t good enough. The nicotine stains WILL show through

Smoking is bad, but the vast majority of smokers have smoked every since they were teenagers. Smoking is the hardest habit to quit, out of ALL of the addictions. Especially if you've smoked all of your life. Just pray for them .😢
I agree... but landlords are not responsible to pay the damages for their tenants' addictions. And smokers can't step outside to smoke. I smoked for seven years, quitting 30 years ago... I never smoked inside.

If what he withheld exceeded the actual damages, then he has wrongfully withheld $0, and therefore he does not have to pay any penalty.
Her rulings are based upon the laws of the state where the case is filed. This is why her rulings may seem inconsistent.

Harvey, should be asking legal questions to education the people. Not opinionated questions. Not all renters destroy a place, not all landlords are scum lords, not all lawyers are blood suckers, etc. It is up to each individual to decide how they act.

He didn’t have to pay for the carpet. Or the bathroom tiles. The deposit was taken care of in last month’s rent and damage to the walls from smoke. I feel sure it will cost way more to fix those walls than the few hundred left after rent was subtracted. I’m so sad about those birds, too.😢

I hate when the judge says watch this and looks at the defendant so they can say the opposite, if she just let the plaintiff talk and then the defendant talk,they normally screw up and tell the truth like they did when judge Warner and mayor Koch and judge Judy's husband was the judge on the show,they didn't act animated like this judge they were professional and caught the people in a lie and called them out at the end of the case.
It's because they've already submitted statements saying the opposite. The point is that it doesn't matter what you say in court; it matters what you have evidence for.
I don't know if this one was completely fair. 1989😅 carpet and falling tiles. This apartment was due for updates to begin with. Nor did he follow the law with regard to sending a list of damages. Also, even though I detest smoking and the damage was deplorable... I believe the plaintiff was telling the truth. But you must have evidence. JM was trippin' with this one. Hmmph!

My parents smoked. Growing up I thought the walls were painted yellow. When they passed I realized just how wrong I was.
30 year old carpet was stained? Really? Imagine what was embedded in that carpet! 😱 I wouldn’t keep carpet in my own home for that long, let alone a rental. The carpet should have been a wash. Nicotine stains on the walls? After 5 years of living there? Just bring an estimate of cleaning and painting the walls. I have never had problems with a landlord and I have always been given my entire deposit back.
In this case I believe the tenant. If he knows he an avid smoker he wouldn't agree to not smoking. I believe it's in the lease but I also believe the owner was dishonest about it and let him do it. I also believe that the guy wouldn't not have left either. This is why you have to have proof and something written.
I’m kinda confused about the letter part. Legally they have to send a letter within 30 days or what? Because she said all he had to do was prove the damage…so what is the consequence of NOT sending the letter??

That if he cannot prove all the damages he claims, he has to pay double. Say the landlord withheld a deposit of 4000 dollars, and never sent the letter. Then the tenants sue the landlord, and in court the landlord is only able to prove 1000 dollars of damage. Instead of owing the tenants 3000 dollars (4000-1000 = 3000) he owes them 6000, double, because the landlord did not send the letter as required.

I just know I’ve seen an episode where the landlord didn’t send a letter and had some damages, but the judge said I can’t give you it cause you didn’t send the letter. I’m guessing it’s just different laws for different states. But I think there should be some type of consequence for not sending the letter

@@jennylynx1869 His penalty for that is paying back the double deposit of the money he wrongfully kept. If a court decided that he should give back 300 dollars of the deposit for example, he should give back instead of 300 dollars, 600 dollars. But in this case the plaintiff actually owes even more money even of the double deposit and he hasn't wrongfully kept not even a dollar. A landlord not follwing the rules doesn't mean he will be penalized with stuff he is not in the wrong. With that logic, the tenant didn't follow the rules too by not giving 30 days notice, so he would have to be penalized with stuff he is not in the wrong.
the defendant is at least 65 yes old, and has probably rented many apartments but had never learned that he needed proof of the condition of the apartment before he takes possession? haha
and he doesn’t know that the lease is the only binding contract, anything verbal is null and void when a lease is in place.
maybe he just moved out of his parents house and it was his first apartment. a twenty year old can claim that kind of stupidity but not an old horse like him.

The plaintiff is just plain stupid, he says 'it says no smoking in the lease, but he said I could smoke', but the contract IS the landlord, so why would he put that in the contract if he's just going to say you can smoke anyway?...

In their area, as long as there is actual need to keep the deposit, then there's no penalty. If it turned out he kept part of it for no reasons (or the wrong reasons) then he would have gotten double the amount that was owed. Each city/county/state is different.
He did know that he smoked. That’s why he had sent him a certified letter in the past asking him to stop per his lease. He could have sued the plaintiff for all it’s going to cost to fix those walls.
It’s not a state which requires penalty just for not sending a letter. Just if you wrongfully withhold it. Which he didn’t

I believe that by now the overall facts show that when you rent theres a high probability that things will end up here in court. Owning your own home is the best thing one can do.
are you a realtor? not everyone is wealthy enough to own a home.

Just because someone rents doesn't always mean that they can buy their own home. They might not can afford a down payment, not able to qualify for a loan because of bad or no proper type of credit. So don't just assume that everyone that rents can afford to buy a house
