    By 16 Jul 2023, Canada will allocate 10,000 3-yr open work permits (OWP) for US H-1B visa holders. No LMIA (Labor Market Impact Assessment) and job offer required. OWP means that you can work for any Canadian employer. You can bring your family member in US to Canada. After working 1 year, there are pathways to become PR.

    I lost job on H1b and moved out of country. Meanwhile H1 b visa expired but i have b2visa, can i enter US and search job? If i got job from new employer in 2 weeks of time can i stay in US if i new employer do the visa renewal?

    If I lose my job on H1B, and I go back to my home country while on h1b to look for a job in US. For how long can I stay in my home country to look for a job? Is there any limit there?

      My understanding is that you can spend any amount of time in India looking for a job in US. Your H1B clock in the IS also stops. It is a sweet proposition but the catch is that it is tough to get a job in US when you are not physically there.

    If I convert my H1 to B2 and lets assume the worst case that I am not able to find employment even till the end of I94 expiration of B2? Can I go back to home country and come back on same H1 petition? Or does that petition remain invalid?

      H1 doesn't expire. When you leave the US, the H1B clock stops. When you come back to US, some US company should have processed your H1B petition. You need to show that to the authorities. Since this is a important event, suggest you also consult with a lawyer.

    Can I transfer my H1B visa before stamping after Oct 1? Or can my existing employer cancel my H1B?

      Not sure if this is a first time stamping or a renewal. Generally, it is better to get a stamp and then move jobs. H1B renewal can be tricky, so need more information. Also, get proper guidance from an immigration attorney, they are not very expensive.

    If I applied for Change of Status from H1-B to B1/B2 during the 60 day grace period and the case is pending, can I legally stay in the US until a decision is made?
    If not, this is not really an option considering the current average wait times for this COS is 6-8 months.

      That should be possible, but do talk to an attorney asap. They are the best guide.

      you have 2 months to look for a job.If that doesn't work, you can either stay on a spousal visa or change to B1 visa. The last option would be to go back to India.

    I'm i can't find job in 60.days, is there 10 days grace period? And, can i go back to.home country and come back on same h1b if I get a new job ?
    Secondly i already have b1b2 visa can i continue staying in us?

      Yes you can come back on the same H1 after getting a new job. The H1B clock stops when you leave the US. The grace period as of today is 60days, not more. You can also apply for B2 visa, which will give you 6 more months to be in the US.

      @@kanchanv2949 Yes you cant work on B2, so be watchful there. When converting to H1B, there should be a minimum 30 day wait and preferable 90 day wait. Please talk to a lawyer. Check this out: www.am22tech.com/90-day-rule-uscis/

    Hi sir. This video gave me postive hopes. I lost my job 3 months ago and my 60 day grace period got over. Now I am in india right now. If I find any new employer, can I go back to US with the same H1B? And can you please give me your contact number if you don't mind as I have more questions.

      Recently, rules have changed to allow B2 visa folks to enter the US and look for jobs. You can do a Google search to see the change in rules. This is a workable idea. Note that I am not an attorney to give exact advice.
