  • VA recognizes the Persian Gulf War service as service in the Southwest Asia theater of military operations beginning on August 2, 1990. Many veterans who served in this war developed unexplained illnesses and symptoms collectively referred to as Gulf War Illness or Gulf War Syndrome. VA has since created a Gulf War Presumption for these veterans. Tune in to learn what the presumption includes, how it was affected by the PACT Act, and more.

I've had a claim in for PACT Act related stuff for over 90 days. It went into the step of evidence gathering and decision making within 2 days of submitting it and nothing since. I have called about it but they won't give you any specific information about what is really going on.

I have a C&Pexam and they added on a DBQ for GWS. Would that not be presumptive if they have all my records and can see where I served, my issues, and that I don't have a clear diagnosis?

I applied for disability for Restless leg syndrome in 2017 due to sleep apnea (both were denied). I went to a Burn Pit Registry Examination and the examiner advised me to put in for RLS due to Gulf War Syndrome. Since the claim was denied, am I able to apply for RLS due to Gulf War Syndrome and if the answer is yes, then should it be a new or supplemental claim?

Always appeal everything. They deny everything at first. Appeal everything and make them send you to more exams and make a Doctor explain to you why you were denied. It's not so easy for them to screw you over when you're actually standing right in front of them. Appeal til you get the compensation you deserve. Good luck.

Question, why do presumptive conditions get denied?

      Hello!
For VA disability claims, a presumption can work in two ways: proving exposure to harmful toxins or chemicals during service, or linking a disability to service. A presumption of service connection is when VA presumes a veteran’s disease was caused by their military service, usually due to a certain exposure. The presumption of service connection takes the place of the medical nexus requirement in obtaining service connection. A medical nexus is a link between an event during the veteran’s service and their current disability, usually in the form of a medical opinion. A presumption of service connection acts as that link.

I don't see Kosovo on the list, but it's worth a call to these people just to ask.
