Even crazier is that this technically isn't their first time-a few years back, they hired PIs to monitor prominent hackers in homebrew communities (including their living habits and technically public online communications) before approaching them with job offers. Reject, and they'd take legal action-pretty much blackmailing them into working for Nintendo. All this was eventually leaked to the public in a few documents containing detailed plans and naming people they wished to target. At least this time around, Bowser isn't forced to work for them directly and the purpose of garnishing his income was simply to repay a debt that had been issued officially through a court of law-though I still feel it's far out of proportion compared to the actual scale of his crime.
They are way more evil than EA and Ubisoft but they make good games so some people just keep defending them.

This is such a messed up case. Gary only made about 300k across 7 years doing this, the least amount of everyone else in the group while the leader made literally millions. They're (currently) charging the "poorest" member of the group with the largest fine. But at the same time, his help in the company with sales helped them, as the court puts it, "Steal about $65 million". So they cost the company $65 million, but Gary made peanuts and is taking the brunt of the punishment. Doesn't seem like a fair sentence to be honest, seems like Gary got a bad deal from the other people on the team that took most of the money and left him out to dry.
Yeah, the big boss of this op is literally enjoying his life over in France with his Russian model girlfriend in his nice apartment bragging about how hard he screwed with companies while unrepentant about his poor fall guy getting smacked with a ridiculous penalty in the US by one of said companies in conjunction with the FBI. Max Louarn deserved Gary Bowser's penalty far more than Bowser himself did.
The judge in this case even lowered the penalty to what Bowser eventually got after Nintendo pushed for the max penalty, citing his unfortunate background as an underling who was manipulated into this situation. And Bowser, already living in squalor before his case, is now stuck with a likely permanent debt. While the group he got tangled up with really was unethical and scummy, and there was some justification for going after them, the punishment he himself got was so far out of proportion to what he did, and he was made out as an example to other hackers while Nintendo celebrated his imprisonment while various figures, including Reggie Fils-Aime, basically jumped in poking fun at his name which kinda downplayed the severity of his situation. Really sad how much Bowser has endured and will continue to have to endure because the powers that be were too heavy-handed with him.

When there is a group robbing a bank and only one person gets caught, the one person getting caught is going to pay back the full amount they robbed + a fine, not just the amount he himself robbed. If he wants to get punished less he just has to reveal the names of the other members, since he doesn't he is fucked. It's just logical.

This is exactly why we need right to repair as part of consumer protection rights. If you own something you own it. A company shouldn't be able to retaliate for you doing what you want with what you own.
The furthest this should ever go is if you mod something, the manufacturer should be able to decline a repair job of that part. But if you for example mod the software, there's no reason for them to deny repairing the shell or screen of the device.

The last Nintendo product I purchased was legend of zelda: twilight princess which released in 2006. So I have not purchased any of there products in 17 years and I see no reason to change that for the foreseeable future, Unfortunately one person alone makes zero difference.
@@The_Steele1 I think it'd be interesting to see if they discourage BotW content production to the point where content creators are afraid to cover TotK when it releases. Without as many content creators spreading the good word, especially people like PointCrow who make creative and novel original content, their publicity might just take a hit and they'll feel how badly they need people like PointCrow to work hand in hand with in order to flourish. However, I do have my doubts that it'll ever get to that point and I'm sure TotK will still have plenty of video coverage, so Nintendo may not feel the burn enough to force them to change policies quite so soon, if ever.
Nintendo sees CZcamsrs as free advertising just as we do, but in a shallow corporate sense that drives them to control everything CZcamsrs produce so they can force them to only showcase what Nintendo approves of in a sanitised, bland manner, viewing content creators as being like an ad agency working for them for free. Nintendo doesn't want the public eye on glitches, mods and emulation of their games, so they wield copyright enforcement measures on CZcams like a weapon to bring CZcamsrs in line and cancel anything against their guidelines that gets too big.
Nintendo can dangle new releases in front of us to get people hyped, but I won't forget about their regular horrid corporate decisions while they do. Personally, as a fan, seeing them apologise and take accountability to improve on poor decisions like these would make me far more excited and happy than any new game they could ever release would.

I do this with all of their videos, too. The first step is admitting there's a problem.
One thing people forget: Gary Bowser’s company sold these hacking/jail breaking/hardware modding tools for $$$. That’s how the hacking group he worked for stayed in business and was profitable. Gary was a PR guy for the hacking group, responsible for their public image, not an insignificant role in getting people on the hacking group’s side.
If the hacking group’s products were NOT sold for $$$, if their products were distributed as “Here’s the instructions for your own hobbyist use for your own private hacking stuff on hardware you bought to tinker with for offline use in your own house, we take no responsibility for any console that you brick by accident or any nefarious activity you do with this” Nintendo wouldn’t be so aggressive. Because the group Bowser worked with made money off of those products, Nintendo was far more harsh, because as you could guess anything that can jailbreak or mod a console can be used for piracy and copyright infringement. You have to be careful if you’re in the space of modding/jail breaking Nintendo hardware for this very reason.
Another reason Nintendo are bearing down so hard on Gary is because they are trying to nail the actual hackers that he was the PR guy for. Make a big arrest and punishment to signal to the group that Nintendo knows the shite they are doing and they are coming for their arses. It’s a brutal tactic, but how else will you prevent people from commercially pirating your hardware? You don’t target the hobbyist in their garage; you target the shadow groups making money off of making your hardware and software security a joke and preventing them from making a mint by making those tools mainstream. It’s similar to a shadow group figuring out how to crack Nuclear launch codes and then setting up a business to sell the tools to crack those codes to hundreds of millions of people over the Internet.
Yeah, this is a harsh punishment. Yeah, it’s disproportionate to the punishment. No, Gary Bowser IS NOT INNOCENT.

This is an absolutely crazy sentence. In my home province, an MP that sexually assaulted his colleague, which just came forwards as his victim, was sentenced to 8 months in prison, and was released after 2. Can't believe Gary has to repay $15 million when sexual assaulters get off more lightly. Yes, I know I'm not talking about a situation in the U.S., but the U.S. still has stricter rules in place when you fuck with big multibillion dollar companies than when you assault and traumatize another human being and infringe on their basic rights.
I was worried when he publicized his multiplayer mod so much that Nintendo might do something and unfortunately they did, the same week he released the mod (pretty sure it was the same week). I hope everything works out for him, that must be extremely stressful and scary.

The situation of Gary Bowser is a little more than just that. They weren't scorned only because of paywalling hacks, but because they essentially also bricked peoples Switches for a ransom and in general profiteered from nasty activities that harmed others. And secondly, while it's scummy Nintendo went along with the 20%-30% thing, it was ultimately the decision of the courts that handled the legal case in the U.S so it's also "commentary" about how much the U.S courts fucking suck. He should be paying back to the victims of their hacking scams, not Nintendo.
Yes. But Nintendo themselves were the ones to decide how much they were suing for; yes the court approved this astronomically insane figure, but Nintendo was still the one to push for - and request that level of compensation.
I disagree with this idea that Bowser and the other people at Xecutor are just these modders who jailbreak stuff and that's it. They actively sold products that were geared towards piracy on top of the shitty business practices they took part in. When you are profiteering off of the widespread theft of others, it becomes a lot harder for me to find sympathy when you end up getting caught and punished. They all knew that they would get in trouble if they got caught which is why they were all hiding until they got busted. I don't care how much money nintendo makes, theft is theft. People jump through way too many hoops instead of just saying "yeah I like stealing when it is convenient for me."

The worst part of situations like these is that most likely, nothing will happen to Nintendo. Nothing will get better regarding situations like this one. At most, PointCrow might get his videos back, but at the end of the day these situations will continue to happen for years to come. Nintendo is too big to be stopped, and hurting them in any major way is pretty much impossible because of how many people buy their games.

Point to bring up in regards to pointcrowe is that the video with the "first car" is being claimed due to now nintendo's new patterning with the new BOTW2 game mechanic where you can build vehicles.
Which I find absolutely non-sense since it was a common gameplay mechanic people did in BOTW with the octoballoons and rafts to make vehicle transportation.
I think nintendo patterned it after pointcrowe's video but I don't have the documentation, I just know nintendo is absolutely crazy with their patterning and anything that comes close will get an actioned lawsuit immediately.
The pointcrow situation is messed up but yea it's pretty dumb of a take to say somebody knowingly committing crime and fraudulently hacking IP was punished "too hard" because of how much money they made. If your bank account was hacked and they"only" took 100k but offered to pay it back should they just be null of all crimes? That's not how the real world works.

While the first case with pointcrow is totally bonkers the second case with Bowser makes a lot more sense to me. It's very likely that he contributed in "stealing" way more income than 300k from Nintendo. Obviously they should not have put all the fine on him, I'm just saying I don't think the "pay back what you earned" thought process is fair either. It should be more in line with "pay back what we lost"

What Nintendo is doing right now makes no sense to me, as they're literally bullying creators out of wanting to play TOTK, therefore hurting their own game, since we know that these videos are great advertisements of games. I don't pay very much attention to game ads, but I pay a lot of attention to what my favorite creators are making content on. All of this seems so counterintuitive, Nintendo preying on creators that could never touch them in terms of net value, thank you for making a video on it!

I think they were a bit harsh with Bowser. However, I believe that Nintendo is in their own right to try to stop hacking/modding. I believe if you stream modded games or through emulators, you’re basically against Nintendo’s interests. You are maybe promoting the games, yes, but you might also be promoting modding and emulators, which is not good from Nintendo’s perspective.

Nintendo is malicious beyond fair use and usual implications, actively threatening pointcrow’s livelihood randomly despite him following their own proclaimed content rules. Such laws copyright most certainly need fixing, the precedent big businesses have set likely by legal bribery in the US (lobbying) is abominable.
Imagine if you tuned cars for a living and the car manufacturers came after you and jailed you because the customers should have been buying the faster more expensive models if they wanted more performance... Same thing.
That is simply a false analogy, a car isn't a video game. Also, they didn't just change their own game, they delivered a tool to paying customers that made it possible to steal a product. In your bad analogy, it's like they made a key to the parking lot of the manufacturer, making people able to steal cars from that manufacturers lot.

Even if they did, isn't the key word there "possible" to steal a product. What if it was done to play backups of legally owned games without the need to swap cartridges? Even if that's only what 0.1% of people were doing that's a valid reason. Once you've payed for the hardware you can do whatever you want with it, you own it. The piracy is just an unfortunate side effect.
