Depp has to prove, by legal wording, that defamation happened.
Nothing more or less. Winning or losing this trial has no bearing to the public opinion case Depp won either.
So in some ways, he's already won the important bit : his future employers will know public opinion sees him as an innocent man, which gives studios comfort when hiring him.
Ie less likely to cause controversy is the name of the game.
It's stupid, but i just wouldnt bet on the case being won because legalese is about the semantics and not who deserves justice.

    • @jsas2047
      @jsas2047 Před 2 lety +1

Amber heard winning is super unlikely, since it was never proven that his defamation affected her financially. Especially not 100mil, that number is just seemingly random. There is almost no chance she will actually receive 100mil.
It's sadly also not sure if he will win. Defamation is very hard to prove and there has to absolutely be no doubt that her claims were false. I am very, very sure her claims are false, but am i sure without the shadow of a doubt? Not really, and we have even more information and evidence (like the audio of her admitting to hurting his finger).
Him losing does not mean she will win and the ither way around. They can both lose, which is sadly the most likely option. In the public eye however, he already won. And her losing means her claims are not proven, which also means production companies can feel comfortable working with him again.
Johnny already won, even if he doesn't receive the 50mil. Amber has already lost in every way possible.

Truly proud of him and his legal team telling his story and hope this goes to to show all Men not to be afraid to step forward, but all show all victims to stand up for yourself. I am appalled at what Amber has done for future victims of all genders by faking her claims, lying PROFUSELY on the stand and providing false, faked and staged evidence. It’s absolutely true this was a role of her lifetime, a twisted lie of manipulation and abuse that she has lived in her own head for far too long, Her witnesses and “friends” have been abused and manipulated into sticking with this terribly exaggerated story showing she will stop at nothing and sacrifice everyone before her own self. I hope after she serves time in prison for perjury, she gets the help she desperately needs, she has shown true signs of mental illness and I hope they both find peace in the end. I hope the jury reaches the obvious verdict but I already have lost most faith in humanity and it would not surprise me if Johnny doesn’t win which would be absolutely disgusting if he doesn’t.

"It's never been about the money.... It is about Mr. Depp's reputation."
That statement hits extra hard. Here in Greece we have a saying, "It is better to lose your eye than to lose your name". Meaning that, you're better off losing 1 eye and staying with the other eye for the rest of your life, than it is to lose the integrity of your reputation. 1 less eye is fine - the gods were generous enough to gift us with 2. But losing your name (read: reputation)? You can rarely get that back. Once your reputation is tarnished it is nearly impossible to set things right.

You will have to make a choice though: A: Let your frustration and anger out on others, hurt them like you were hurt as a child, which works best on people who are close to you, your loved ones, because you can hurt them the most and you know it from your own experience. Or B: You take your negative feelings and hurt yourself, like in this case: drug abuse and or unintentionally restaging a abusive relationship and be the victim all over again.

The closing arguments said it all. Johnny's lawyers were emotionally pleading the jury to restore Johnny's name and to hold Heard accountable for her lies and the damage she has done to him with convincing evidence of her faking evidence and stories. Their only concerns are the truth, justice and clearing his name and honor. Then came Rottenborn, reducing their entire case from "Amber Heard is a heroic survivor from domestic violence and sexual abuse" to sternly telling the jury "if Johnny only touched or shouted at her ONCE, Amber WINS" whilst only trying to find loopholes in the already clearly fake evidence. In a case about IPV with horrific stories and damages, winning is what's on their mind. Not justice. Not the truth. Not saving one's honor. Winning. Because that's all that matters to Heard. Being validated, and winning.

I will admit here that when the allegations initially came out around Pirates 5 I believe that gave me pause. I kinda believed it. "There's so many allegations. Some could be right." Thankfully I never fully bought them. A dear friend of mine set me right and I am happy that I never publicly lambasted the man. But knowing that I believed the lies even a little still makes me feel horrible. The fact that he has countless times visited sick and dying children as Jack Sparrow just to make them laugh and smile should have stuck with me then. He delighted in bringing those kids even just a little light in dark times as a character they loved. Someone who abuses wouldn't do that, I'm sure. Not as often and with as much enthusiasm as he has.
I have been abused in my own ways. I don't have PTSD I think; never been tested but I can't afford to see anyone about my Depression or ADD so who knows what's all there. I live with someone who has bad anger issues. I know the egg shells one lives on to not invoke rage. An abuse victim wouldn't dream of getting their abuser a weapon. They wouldn't chase and instigate. I do not see any sort of victim when I see Amber. I see a damaged and broken person who became a lying and manipulative monster.
I'm sorry for the long message but this closer and just hearing those audios in succession have left me decently emotional. Find her guilty. Please. Maybe she can get help but I think she is beyond that sadly. But, she does deserve consequences. She has gotten away with the most sickening lies for far too long. The common denominator here is her! I can’t explain why I tried to cover for her. Even after the cops said she’d have to go court because they’d seen me (I looked like jim Carey after he kicks his own ass in liar liar) I was worried about her doing what amber has done here. I’ll never forget the public solicitor apologising to me for initially thinking it was the other way around. Tell you what I look back now and laugh, think how dumb was I for sticking around. If I was a juror, I would vote in favor of the plaintiff: John Christopher Depp II - regarding the defendant's "opinion-piece" (op-ed), which was published in the 'Washington Post' on December 18th, 2018.
I would vote against the defendant: Amber Laura Heard.
To explain this, let's take a look at what Defamation really means in the court of law and how (in my view) it was proven:
To prove a statement to be Defamation, the plaintiff (Johnny Depp) must show five points:
    1) The statement must refer to the plaintiff
Proven implicit reference to the plaintiff is already enough to support this requirement. This was proven in the case.
However, defendant Amber Heard herself has also explicitly stated, on multiple occasions, that the written piece was, in fact, referencing Johnny Depp. Specifically, Amber Heard has testified that the statement "I had the rare vantage point of seeing, in real time, how institutions protect men accused of abuse" refers to how Johnny Depp was protected by the Hollywood industry, despite Amber Heard's experiences and accusations of abuse. Once again, Amber Heard explicitly stated this statement to refer to Johnny Depp and Amber Heard's experiences of abuse regarding Johnny Depp.
    2) The statement is false
Defamation by Implication should be in effect in this case. Nonetheless, the following remains true:
Amber Heard has been proven of committing purjury on numerous occasions. Many of these occasions included accusations of abuse. Following the legal principle "Falsus in uno, falsus in omnibus", literally translating to 'false in one thing, false in everything', a juror is permitted to throw out, or ignore, Amber Heard's testimony in its entirety, or decide upon which parts of the testimony, if any, is truthful.
Most of Amber Heard's testimony, including every single case of abuse of which Johnny Depp was the purpetrator, directly contradicts any other testimony involved in the case, including some of those from individuals close to Amber Heard; the scarce number of individuals who have testified in favor of Amber Heard, and have corroborated (part of) her story.
Any and all persons who were impartial (whom did not know have a relationship with either Defendent, nor with Plaintiff, and stood nothing to gain and nothing to lose from either side triumph in the case) testified against Amber Heard's claims of abuse.
In reality, any and all evidence supports the claim that the defendent, Amber Heard, was not a victim of abuse at the hands of the plaintiff, Johnny Depp. Instead, any and all evidence supports the claim that the plaintiff, Johnny Depp, was a victim of abuse at the hands of the defendent, Amber Heard. This evidence includes evidence of physical, verbal and emotional abuse perpetrated by Amber Heard. The only argument for even so much as verbal abuse perpetrated by Johnny Depp towards Amber Heard, was a recording of Johnny Depp reacting to Amber Heard's screaming by yelling back at her, whilst being chased by her.
Whilst Johnny Depp was recorded, by Amber Heard, attempting to move away from any argument to diffuse them, Amber Heard was caught, on her own recordings, chasing Johnny Depp, blowing up any argument in the process. Amber Heard was never afraid of a fight occurring. She instead went looking, and fighting, for them.
    3) Fault amounting to at least negligence (and in the case of a 'public figure' such as Johnny Depp, actual malice)
[The following assumes points 1) and 2) to be true and proven]
Actual malice is, usually and historically, notably difficult to prove in a defamation case. However, defendent Amber Heard's role in her relationship with plaintiff Johnny Depp is abundant in its representation of actual malice. This is simply because actual malice is proven through "clear and convicing evidence" supporting the defendant's knowledge that the defamatory statement was false, or that the defendant had reckless disregard of whether it was false. There is only one way in which defendant Amber Heard could ever argue she did not have the knowledge of her statement being false, which is through an "insanity plea", or the "insanity defense", which, even if raised (which is highly improbable), would likely still not be granted.
    4) The statement caused damages, or some harm, to the plaintiff
The statement irrefutably caused damages to the plaintiff, Johnny Depp, due to his nature as a 'public figure' and actor.
The statement irrefutably caused personal harm to the plaintiff, Johnny Depp.
The fact, however, remains that there was at a minimum 'some' damages and harm caused to the plaintiff, Johnny Depp, thus proving this point.
Furthermore, "defamation per se" should be in effect in this case, as the statement irrefutably supports one of its possible criteria, namely: "prejudice a person in their profession or trade".
The extent to which the statements in the op-ed caused economic harm towards Johnny Depp has been argued in court, but there is no proven, or set, number. The jury would ultimately have to deliberate upon this number.
    5) Publication or communication of the statement to a third person or party
The statement was posted in the 'Washington Post'.

We have access to A LOT of info that the jury doesn’t. That’s what makes this very tricky.
We can only hope the jury reaches the same conclusion as everyone watching. The only potential plus is the fact that she brought social media into the evidence and testimony- all of which more or less implied the public opinion is not on her side. So there’s that.

Amber's entire team doesn't once, during any of these statements, look like the people at the TRUE victim's side, who can't believe what they're hearing - that this woman isn't a victim of abuse, but instead the abuser. If that were the case, and she was being stifled and shamed regardless, they would be _furious._ ANYONE would! Remember Ben's face during some of the lies, embellishment, and misdirection that came out of Amber's mouth? Jaw dropped, head shaking, looking around like "Are yall hearing this? Am _I_ hearing this??"
They're not a team supporting an actual abuse victim who are being smothered by lies and propaganda. They are a team who fabricated a story of lies and deceit, and it didn't work - and they have nothing else to give. There are no genuine emotional responses to the accusations being made against Amber in support of Johnny, because there was never a foundation for such emotions to begin with - because it wasn't true. Their version of the story didn't happen. Their entire case was disingenuous, and you can see it in each and every one of their faces.

I purposely watched Rottenboy's closing statement before this just so the trial won't leave a bad aftertaste in my mouth. Maybe it's just me but Ben's closing speech sincerely asks the jury and the entire public audience who've been following this trial to believe in them, while Rottenboy's on the other hand sounded like he's guilt-tripping everyone to side with them by convincing people that the physical abuse on Amber did happen (albeit the obvious lack of evidence and sense) in an "If you don't take our side, you're part of the problem" manner.

Thank you Mr Asmongold for your 'presence' on CZcams during this trial. You were between us viewers and this terrible trial. And most of all i hope Mr Depp finally obtain justice.

This was so powerful it honestly made me want to cry for Johnny because idk how he even has been able to keep his head up and have the strength to carry on and say I’m not going to stop until people know I’m innocent. Just like his life was destroyed it can be returned and made better than before with love and support and demonizing lying, malicious, blackmailing abusers who only seek to gain from others suffering. God bless you Johnny and all admiration to you!!! 🙏🏼❤️

I hope they were filming a Staircase level doc about the legal team strategizing and building the case. Id love to see that.

I absolutely, whole heartedly, 100% approve of this message, that Johnny is a documented victim of DV, with no previous accusations of violence against him. If this Jury awards Amber Absurd in this case, I shall never ever trust the Jury system ever again.

Problem is, you trusted the Jury system to begin with. No matter what can obviously be gleamed from these cross examinations and this entire trial for that matter, that Jury could quite easily not be in full agreement, and cause this to go on seemingly indefinitely. It seems to me that Depp is innocent. Many others agree, and some extremists bent on emotion over truth disagree. At the very least, he's much better on the stand than Heard is

The jury system it self is full of holes. After serving on a grand jury I can say how wild and full of inconsistencies the system has. I just hope they have good judgment.
