@jeremybuchanan318 you're 100% correct though. I absolutely should have learned true history first but I was a middle school student when 9/11 happened and my family watched corporate news religiously... I couldn't see through the propaganda until it slapped me in the face. I went into the military hoping to gain the experience and skills needed to be a war photographer like the guy that documented the Rwandan genocide, so I could help stop evil things like that, then I realized that the system doesn't want to stop events like that. The system needs conflict to return dividends and every group out there is just the for greed and their own purpose, the military to the industrial corporations to the NGOs. It's a jarring wake up. At least I got the real world education I was seeking.

Agreed. Check it out. It's a great first hand account from Gallagher. The entire investigation was a shit show from start to finish. Eddie's situation sheds a dark light on how the military, specifically the NCIS, conducts investigations. From initial investigation, incarceration, trial, and defendant's rights, the entire military justice system appears to need an overhaul. I would like to know if any of the NCIS agents involved in Gallagher's case could be smacked with civil lawsuits? They raided his house knowing full well both Eddie and his wife were not present. They pointed rifles at his two sons (8 and 18 yrs old) and paraded them around in the front yard while in their underwear. What a bunch of cowards. Thats just the tip of the iceberg. From pre-determining Eddie's guilt, using questionable evidence, manipulating evidence, withholding exculpatory evidence, not allowing the preparation of a proper defense....The list goes on. The NCIS ran a sham on Eddie Gallagher.

    1. Accepting a pardon is an acceptance of guilt, legally. So by offering a pardon before trial, the president is making an assumption of guilt before the case can even be heard in a military court.
    2. The offer of a pretrial pardon is akin to asking a defendant to plead guilty in exchange for a commuted sentence.
    3. The president and other politicians actions thus far have been in service to political posturing and NOT in the best interests of the soldier or the military.

    • @nemesis11fp20
      @nemesis11fp20 Před 5 lety +1

@Meh Burdick v. United States, a Supreme Court ruling specifically states that "...a pardon carries an imputation of guilt and that acceptance carries a confession of guilt." Justice Joseph McKenna delivered the opinion of the court which can be read in the link below should you so desire. Now, I am citing SPECIFIC case law, so if you insist on pursuing armchair law review, I would suggest reading precedent first before waxing poetic on matters you do not understand. Have a nice day.

First off I enjoy listening to the majority of your ideas and stories. Having a son in the military and being the son of a decorated WWII veteran, the military life and condition are important to me.
What I find concerning are your remarks about Navy Seal Eddie Gallagher. The truth of the matter is, you, me, Hillary, Donald and your audience don’t actually know what really transpired with this serviceman unless you were there. The idea of a pardon is egregious until all the true facts of what happened are known.
Having retired from law enforcement, a lot of what you talk about is germane to both services. The cannibalism of brother officers is a real thing. The decision making from commands skewed by political or geopolitical reasons in the military’s case are also real and a detriment.
Your argument of civilian and non-military experienced individuals being oblivious to the actually events of living in that situations are correct. Unless you are there or have been in similar events, you don’t know what it is like. The same is true with police work.
Here’s the problem, the majority of LEO’s and military personnel are great people doing a thankless job but there are bad cops and there are bad operators. There is a history in both services of brother officers and servicemen rushing to defend a comrade only to find out after an investigation that the allegations were true. The second problem is, can the investigations be conducted in a fair and uninfluenced manner? Again, if you are not part of that process you don’t truly know.
Gallagher has an exemplary record just like the recent mass shooter in Virginia Beach. That fact alone cannot be the single determinant as to someone’s guilt or innocence. How many times have neighbors and co-workers after the fact said the shooter was a great guy, never had a problem with him and he was always there to help. Until the day he snapped.
The point I’m making is that your criticism of persons making comments about or considering pardons for events they have no personal knowledge of, is valid. So why are you and your guest doing the same thing? Yes, you have been to war, you have had boots on the ground. You can speak with authority on that experience, about the fog of war and the split second decisions that are necessary to survive, I applaud that. However that does not provide you some secret insight as to what happened in this Gallagher event. Who would have contemplated two Navy Seals suspected of killing a fellow American comrade, a Green Beret? I would point out that a stupid comment is one thing and full pardon before a trail-of-fact is something completely different.
Every humans is flawed, some far more than others. Some act out of a loyalty to one’s country, some evade that loyalty and sit out a war. Some act out of a belief in a greater power, some out of a greed for money. Point being “Nothing” is perfect. Wars will be fought for the wrong reasons and innocent people will go to prison. Until we develop a better way, all we can do is attempt to minimize the collateral damage to ourselves, each other and our country.
What I do find disconcerting is how some members of our military both current and former can cheer and applaud an individual that disrespects a veteran. Whatever your likes or dislikes about Senator McCain’s personal or political life, he is a Vietnam Veteran. He served his country when called and in a role that placed him in danger. He was captured, repeatedly tortured and refused to be released out of sequence, those are established facts. For an individual that turned his back when our country called because he didn’t like that war or because of bunions, to be allowed to repeated insult that veteran or any veteran for that matter is reprehensible. For that veteran’s so-called “Brothers in Arms” to continue to allow repeated insults without a murmur is equally offensive. You know, I would expect that from the likes of a Rush Limbaugh who also refused his country’s call but not from the so-called “Leader Of The Free World”. I thank and respect you for your service to our nation.

@Eric hoyt Well Eric, I thank you for your service. I too support Veterans of which my father was a decorated WWII veteran and there are a long list of other veterans from the Civil War, the Philippine American War, Vietnam war, Korea War and others in our family. In my years of military eligibility, there were no wars so I chose law enforcement. As I mentioned the similarities are very much the same. I don't pretend to know what transpired with Gallagher, good , bad or otherwise. I would hope that you would see and understand the need for a difference in how American servicemen act and how a Terrorist organization like Isil or the Taliban act. I hope that a military man like yourself would find it alarming for American personnel to end up on CZcams beheading an opposing combatant. I don't know what you have seen or been through and can only speak for the atrocities I have seen in police work of which there are many committed by "Exception Americans". I hope that SOC Eddie Gallagher is innocent and this is a case of errors. However if he committed the crimes he has been accused of, he put himself in a position where justice demands action.
I would be very interested to hear your comments on the Vietnam Mỹ Lai Massacre incident. Do you believe that Women or children as young as 10 or 11 years old should be raped and mutilated by American military personnel? The three soldiers that attempted to stop that incident were maligned and shunned by other american soldiers for their actions.
I was a Reagan / Bush 1 Republican and supported Republican Ideals for longer than you have been around. I guess that is why even if you generalize and despise all Democrats and support american Veterans. I still do not understand how you support and individual that did not answer his nations call and repeatedly demeans and insults a True Republican Patriot who is a former POW and Vietnam veteran? How do you justify standing up for one Navy sailor and yet turn you back on a verified Navy Veteran who has sacrificed for his country and can no longer fight back because he is buried at Arlington?

    • @rvasquez8057
      @rvasquez8057 Před 5 lety

@Eric hoyt Your starting to sound more like an angry high school ROTC member then someone that has experienced war first-hand. There are atrocities in war that occur due to various causes. They have had them in every conflict. In North Africa during WWII, german prisoners were sometimes given a cigarette and then shot. The reason for that was a lack of infrastructure and provisions to handle, feed, secure and keep them from re-entering the field of combat. Again Eric, I don't know what Mr. Gallagher did. I don't know why his fellow comrades would make the accusations they have made. I do know that he, like every American should be afforded every opportunity to defend himself with a competent defence. I believe his previous record should grant him the benefit of the doubt. However "IF" he did these actions and it can be proven, justice has to act. We are NOT the Taliban, we are NOT Isil, we are not the KGB and we are NOT the Nazi's. There is and has to be a distinct difference for the American Military then form these groups that pillage, rape, murder and inevitably end up in the trash bin of history. This goes for law enforcement too. The police are held to a higher standard then the people they arrest. Whether you are I agree with the situation in our country of guilt by media or internet post, it is here to stay unless American wise up. That is why we have investigations and trials. Is it perfect ? No, nothing is but it's a hell of a lot better than the Soviets, North Korea or China.
Just answer this one question then: Who do you support or believe, the Navy Seals and Marine Raiders that are accused of killing Green Beret Sgt Logan Melgar in what they claim was a hazing prank. Or the military investigators who initially believed his death was related to being sick and drinking to much? Sgt Melgar is dead! That is a proven fact, and someone asphyxiated him another fact. Here is where your ideals become a problem. If you can kill with impunity anyone in a war situation, even if they surrender, are captured, are receiving medical aid from you or are civilians lined up in a ditch, then what's next? Killing a fellow soldier is not a big stretch if you deem him a detriment to your own goal. Again in this case, I don't know all the facts, therefore I will not opine what I believe happened. But because an American soldier was murdered (People don't usually asphyxiate themselves unless they are performing the old Choke & Jerk) it has to be investigated. So Eric, you can circumspect all you want about this case or you can shit in your hand and i'll tell you which one will be of more substance. So unless you were there or were involved you nor anyone else knows what happened. That is why there has to be investigations. Everyone that speaks as an authority on the facts of this case or SOC Gallagher's case is just giving their opinion that is without weight or substance.
You like me have the right to state your opinion as we choose via our constitution, which you claim you took an oath to defend. That said, with your thoughts and opinions expressed and plastered in writing. If you indeed serverved in our armed forces, I am glad you are no longer are in that capacity. What is concerning is that you walk amongst us and I feel sorry for anyone with a darker skin tone that you perceive is middle eastern and a threat.

That is why for us as US Army Infantryman when I was in 2006-08 in Iraq. Every engagement, raid, or any time we received fire from Hadji. We had to write sworn statements after when we got back to the FOB. Immediately after getting back there would be an After Action Review conducted by our Commander and First Sergeant with Battalion Staff and the Battalion Commander and Sergeant Major. Everyone on the Battalion and Company Command would shut the fuck up until the briefing is over by the Leader on the ground and soldiers involved. Then questions would be asked and after we as leaders and soldiers would write our Sworn Statements after. The statements were reviewed and sometimes individual soldiers and leader be personally interviewed by Battalion Staff and present would be the Jack Offs at JAG who don't have a clue about combat. Good thing on my part was getting my own 4x32 ACOG scope. That saved my ass big time! My unit which I have been assigned to was smart enough to issue the ACOG to every rifleman and Grenadier with an M4 and ELCAN MGS on SAW Gunners and M240 Gunners. The most important thing about combat in Iraq was stressed very much is "Positive Identification"!! See who the fuck who was shooting at you while being engaged and tag them with bullets. PID was fucking important! So if we know we had a mission coming up and had time to prepare. We checked zero if time permits on all our weapons. If not, you better be damned sure to who the fuck you were shooting at. Rules of Engagement a.k.a ROE is always stressed. No fucking body ever forgets this! This shit went all the way back when I was a Paratrooper and machinegunner in Panama 1989. Back then we were using basic combat sights on our weapons as opposed to 2006-08 with Aimpoint red dot scopes and magnified ACOGs. With enemy combatants captured they are different. Some of them are real assholes when being captured and feel guilty of being captured so they make your life like hell when handling these cock suckers. Some have broke through zip ties and attacked me. A kick in the nuts or a butt stroke have brought them down and regained custody. As soon as they get to be interned to become detainees. The International Red Cross become the real enemy. The IRC is full of enemy loving European and American Liberals who claim to be rescuers of both enemy and allied combatants. It is not true. The IRC is sympathetic to the enemy no matter what. Yet they expect you as an American to protect them from the enemy they sympathies with to protect them during a rocket attack on your FOB which they are in. It was well known and documented who the IRC was responsible for more civilian deaths than any one group. They would routinely hand over refugees from one group over to a hostile group ie Muslims to Serbs Serbs to Croats Croats & Serbs to Muslims. The problems with the IRC and the global military community has always been an issue. It won't change anytime soon either.

In reference to comments at approx 17:30 … the whole notion of being considered "innocent until proven guilty" is a colossal myth. The REALITY is that you are considered, and treated, as though you are guilty - until you prove yourself to be innocent. All someone has to do is *accuse* a person of something, and then "the system" considers that person to be guilty right from the start. People need to be aware of that.

They say he had a tracheotomy attempted, multiple chest tubes used to drain blood to reinflate collapsed lungs and some new method of drilling into the bone to start some sort of IV. To someone not used to seeing these thing would probably be aghast at the grotesque nature of how these things work. I think with a smart defense lawyer, showing videos of these procedures to the witnesses that are testifying against him and having expert medical testimony, this case should be clearly a not guilty if not thrown out altogether. In my opinion, this should have never even made it this far. There may be some Military officers/lawyers that are trying to make a name for themselves by crucifying Eddie Gallagher. This is all from several seals that were under his command that he reprimanded and he wrote them up for insubordination and dereliction of duty... they filed these charges as revenge to try and get him in trouble.
Also... he is a medic and was trying to perform a tracheotomy on the ISIS fighter that couldn’t breath after being shot up... the guy died while he was cutting his throat open to insert a breathing tube.
The civilian murders in Iraq are just completely false. navy Jag interviewed Iraqi commanders and his commanders in Iraq and there was no reports of him ever doing anything like that... in fact under oath the top Iraqi commander Jag interviewed said Eddie was the best soldier he had ever met and would trust his life to Eddie in a second... in the interview the Iraqi commander flat out said the accusations are completely false.
Jag has now been petitioning to get that testimony thrown out now.

This whole story stinks to high heaven the SEALS ( and I use that term very loosely) that brought up the charges just so happen to be the same SEALS that chief Gallagher called out for cowardice in the face of the enemy. I firmly believe that he was brought up on these charges because he expected his men to perform at his level of excellence and they in turn made these allegations to make their lives easier

What is baffling to me is how almost the entirety of the Chief's team appear to be totally unsuited to SoF. How did it happen that so many highly trained men developed such a terrible attitude, or how did SEAL training not manage to get rid of them before it became a problem

The respect, I have for all my brothers in arms that have served this Grateful Nation, I'll try to some it up. On the way home from work, June 5th along about 45 min. after midnight, I was about to pass the East Veteran's Cemetery, my foot hit the brake, I turn in and pointed my headlights across the the head stones. Got out of my car, Thanked the AlmightOne for All that have give their last measure, rendered a proper hand salute. I supported the prosecution in principle in that I don't think being a SEAL/American soldier entitles one to commit war crimes.
However, in this situation it looks to be a terrible case and Eddie Gallagher is probably innocent (not to mention that he probably tried to save this man's life!). I'm glad he's out of confinement for now and may justice prevail, even if that means going after corrupt prosecutors, investigators, and those who used their rank and command to influence this case.

Happy that President Trump pardoned them and gave his rank back. We’re in the times that the press blowing everything out of proportion. The military wants to set example where he did it or not.
As far as I am concerned it’s all petty bullshit the military is doing. Army, Navy, Marines it doesn’t matter. The media is trying to turn the American people against the military.

How crazy upside down a country do we have when the very ones who fight for our right to have justice and liberty don't have the same? It's frustrating to watch this happen. When we let politics drive our military via the press, we will all lose our liberty.

As a civilian who has not served I want to say thank you to all of you who have allowed my family and friends the freedoms we have in this great country.
Those of you who have made so many sacrifices (this includes your families) standing on that wall to ensure our way of life, again THANK YOU SO very much!!
It really makes me sick to see how our soldiers can be accused of crimes like this in the middle of a war following an ROE which at times were controlled by politicians, and left our soldiers in situations where your handcuffed and unable to your job. And worst of all it put you all in danger, all because of politics (it really pisses me off to have our soldiers in that situation).
Chief Gallagher and his family should have never had to go through this.
Your thoughts and views regarding this subject are right on target.
These double standards have got to stop.
Again thank you for all you have done for our country. Thank you for your service and sacrifices (again that includes your families).

As a Veteran from Africa, I have looked at lots of operational video's of Afghanistan, Iraq, and Syria. This gives you an idea of what you are dealing with. I have seen reactions that are very good, that are terrible, and lots in between. You have two problems with Afghanistan. Because of the nature of the place, you are not going to win this one. And having anything on any kind of social media leaves you wide open to this kind of thing. War is not nice, it is brutal. If the powers who run damage control cannot maintain some semblance of order. Then like the Manning mess, history will repeat itself.
