The Three Reasons People Lose Custody of Their Children in Family Court

  • In Maricopa County there are three reasons people lose custody in family court or have their parenting time reduced or removed:
    1. They don't know what to do or have a poor strategy
    2. They refuse to change or alter their behavior even slightly due to pride
    3. They are unable to make the changes necessary to prevent losing their kids.
Custody battles are a chess game and the rules of engagement are fairly simple, create a child centered universe and couch every argument and every criticism within that universe.

Yes. This is great advice. Im dealing with a Narcissist ex wife after breaking away and it is the worst thing I have ever gone through. She is literally attempting to destroy my life and watch me suffer regardless of what our children think. I am so heartbroken that someone I trusted with MY LIFE would try to wound me and destroy MY LIFE so carelessly. I know and knew what a narcissist is but the complete understanding will only come to you after you fall in love with one of them and then they diminish you and dispose of you and then when they're done with that, they attempt to destroy your relationship with your kids because the narcissistic father that raised them is now "bonding" with them and getting supply from their supply coming from YOU. SICKNESS. I'm lucky my kids take after their father and see through most of the nonsense. But it's not easy watching them experience the truth and turn their head when they hear another lie from their PARENT. At first I fell for the "competition" part of it with her but now it's just heartache all around. She forces her will on all of us in order to ALWAYS get what she wants.

Sad part is this is destroying families and wrecking childrens lives.

  • @FatherX2022
    @FatherX2022 Před rokem +21

Good talk. After a 3+ year custody battle, where I was awarded primary custody, as a dad...I totally agree that, technically, the best strategy is that "the child is the center of the universe" and all of your parenting actions and court testimony revolves around that. But there's another piece to consider, depending on your judge. Our judge completely ignored my petitions for custody and my allegations on Day 1...and rubberstamped the mother for custody...based on 1 best interest factor instead of the totality of the circumstance. And the judge ignored me and my lawyer for 3 years...and kept rubberstamping whatever the mother wanted. So this 2nd piece is recognizing how to get around the court's bias...because it's definitely real. And I laid out direct testimony for 28 hours, detailing the mother's violence, anger management issues, suicidal threats (all of which the judge was actively ignoring until my testimony)...and undermining all of the standard gender-biased stereotypes the judge could have. I laid out undeniable testimony to prove I was the better parent across 12 best interest factors...not just 1-2 key points. And I blocked the judge from being able to just rubberstamping the mother in the Final Custody Order. So this 2nd piece is to quickly recognize if your judge is gender-biased against dads and/or incompetent...and then strategize to neutralize that, so you can have a decision in the best interests of the child....instead of a decision by a judge that just wants to get through their caseload by taking the "safe" way out and rubberstamping the mother.

Funny how you never hear of politicians talk about this during debates....They will never bring it up on their own. They are hoping that we don't ask questions about it. Don't let a lawyer tell you you have a fair chance. You don't unless mom really screws up and it is documented.

It is extremely important that every word you state, every action you take, and every decision you make, should be centered around what is best for your child.... as opposed to what is best for the mother or the father.
Also, many people complain that they lose because they don't have lawyers. But lawyers are not the solution to this. Many people spend $200K on a lawyer and still have a terrible outcome. You are the All Star MVP of your case. I encourage you to take on that role. Do not outsource that role to a lawyer.

I think courts are really taking this "we don't want to take your kids away from you" policy a little too far. I'm sorry, but if you have a substance abuse problem and you are leaving your kids with sex offenders while you smoke meth and your kids have to watch their grandparents call an ambulance for you because you have stopped breathing, the court SHOULD want to take your kids away from you. She is doing a lot of wagging her finger at parents for just pointing out the shortcomings of the other parent and saying "you have to make your kiddo the center of the universe" but why isn't the COURT making the kid the most important thing? If you want to smoke meth and hang out with sex offenders, that's on you and the court should concern itself with protecting your child's right to not have to suffer the consequences of your bad decision making. I think the child's safety and right to not be raped by a child molester while dad is stoned is more important that "respecting his parental rights." I think he gives up those parental rights every time he picks up the pipe. Instead of making the child suffer through watching that parent go through rehab and continue to be left with who-knows-who, I say give the kid to the other parent and if and when the meth-head parent decides they want to be involved with the kid again then they can PROVE they are clean and sober and a responsible adult who will have a positive influence on the kids life FIRST. THEN they can petition to have time with their kid.

I understand completely. I’m in the situation now with my wife. She has lied and coached my 2 oldest daughters. CPS and the sheriffs backed her with literally zero evidence. It backfired on her and our children with Alabama removing the children over the claims. She told me she would tell the truth about lying to get the kids back and we would move past it together. Instead one day before court she made the most outrageous claims ever and said I was going to take the children by force from their school, shoot the place up, blow up the social service office and it end my life with suicide by cop. Just unbelievable stuff. But the sheriffs and CPS ate it all up and even arrested me on a felony solely on her word. I was all over the news, FB, and front page of the paper. Got suspended from my job and was looking at 10 years. The judge was the only one with sense and threw it out at the first hearing. They just recently got out of foster care where they were split up for 6 months. We have 5 kids. My 4 year old is a daddy’s boy through and through. Even CPS has that for the record. The kids were sent to live near my wife with her father while we await the final civil court hearing involving the removal. After only one month their my daddy’s boy is telling me he doesn’t love me or like me and I hurt him. Obviously more coaching and emotional abuse. At the end of the visit when he had to go back with his grandfather he said he didn’t want to go. He wanted to go with daddy and that he loves me and I’m his best friend. He is so confused by what she and the system by proxy has done to him. It is so wrong. I pray to God the judge will see all this for what it is and send them home to me. Back to love, stability and normality.

This is one of the better videos on child custody I've seen.
Focus on the child. Focus on solutions and be clear to the court how your solutions will help the child. Pro Se litigants frequently lose child custody cases simply because they are ignorant, unprepared, and the opposition points out their entire argument is an ad hominem to prove the other parent is a liar.
Know the law. Know the case law. Know court rules. And, most importantly, keep your child's needs paramount to EVERYTHING else.
Don't blame the system when you go to court and expect the judge to read a few texts, become outraged at your ex's behavior, and award you custody by moral superiority. YOU failed to state a logical, coherent case. YOU failed to be the advocate your child needs. Flaws are ubiquitous in all systems including family court. Learn them. Overcome them. And be the adult your child needs.
Thank you for posting the video. It's quite a contrasting source to all the other legal "advice" out there.

When you write up paperwork as ‘In the interest of the child’, the child is considered to belong to the state. It’s in the state laws, also Uniform Rights of the Child (something like that/global). We grew up learning the ‘Public Side’ and the child is your offspring, child, seed (can’t use those words), but the word property in the law books meaning is chattel (people), and other meanings also. When the state owns your child, there is all kinds of money (bonds) running around behind the scene from lawyers, judges and others. They buy property, become beneficiaries of various companies, have their family members as beneficiaries and they somehow put hidden money there. They get rich.
When you get away from all that, your child belongs to you. Then you are living on the ‘Private Side’, instead of the ‘public side’. You go by our Constitution, not every statute that can be taken and used in any way the courts choose to twist the legalese, in order to make the most money. I certainly don’t understand this whole process. There is so much we have been deceived about since our birth and when we were issued social security numbers. Thankfully, this is not my fight because I don’t know enough, only the tip of the iceberg. Hope that helps a tiny bit. It’s still mind boggling to me how greatly we have been deceived and used our whole life, from our labors…our time and energy, to make so few so extremely rich.

I have a questions please if i may.
My wife coerced me by fear of divorce and tricked me into leaving the US part way through a visa application 1 week after my daughters birthday. I had signed my daughter as a US citizen born abroad 10 months prior and moved to the US as a family doing my visa from within the country. We lived in the UK for 2 years together.
I'm a UK citizen, wife is US citizen.
She was the only person who ever dealt with the immigration lawyer on my behalf. I never once spoke to them myself until a later date.
I later found out she was supposedly cheating on me over there in PA, to note. To which I was catching onto and questioning it after seeing all the signs; but could not prove that there and I'm pretty sure now, that was the reason for my removal, before her exposure.
Turned out it was her brothers best friend and or family friend.
She had asked me for a divorce 2 weeks prior; and a week prior to me going. However, we talked, and both agreed...a plan to fix things. Aparently.
She informed me that I was able to go and come back into the US and had contacted them to check, and was ok to do so.
We both signed a contract or signed letter saying that if i left on sabatical, time apart for a break, when I came back, things would be ok as she had been terrible, distant and really abusive for months prior and I was willing to do that for a few months, to save our marraige and family.
She broke it off 2 weeks into me being in the UK, 2 hours after putting me into a group chat with her x. Blamed it on my daughter. From the 2nd day I already started to panic as she wasn't really trying.
After that, I contacted the lawyer to come back and was informed that she never even notified him or even asked any questions if did considering it's importantance. It was totally pre meditated.
Lawyer is refusing to provide me with exact communications at this time, however i still have that email saying they wasn't informed. I thought by PA state law they must retain that all for 5 years. Wheh i contacted the lawyer to come back, instead of trying to resolve it, she stopped it dead by telling him we were separated. Visa route then cancelled, even petition route.
I now have a 3 year ban from the US alienated from my child.
She has now moved to florida with her older sister.
I have evidence of messages prior to leaving showing our conversations, I have the so say contract, I have emails from the lawyer stating that she never notified him, that she killed off my visa route ,evidence of said group chat, and I have messages from that date to now; of her being absolutely inhumane thereafter. It has been horrendous all the while I have tried and done all the right things to sort things out and look after my daughter. My mental and physical health has been obliterated and so has my relationship with my daughter by this. I have been in hospital from heart issues from stress, also a mental health practitioner still ongoing.
I have still despite this, made sure i have sent money over every month for my daughter. Much more than I can afford if I'm honest. However I have asked for documentation to prove her said expenses as I cannot trust her after that, but despite asking weekly for months, she thought it acceptable to provide me nothing but wallmart screenshots, a self made list on messenger and a screen shot of half a screen and has been trying to extort me for her exadurated and demanded amount of money totally disregarding anything she has done, my now finacial situations and ny health, or her behaviour in all this at all. She is now sending me divorce papers, custody papers and child support papers along with her audacity some time soon.
I believe her to be mentally unstable to do such a thing. Who does that to the other parent after sacrafices i have made? I now at this time, believe her to be a malignant narcissist as she has been extremely violent and abusive to me in the past and she has done nothing but gaslight me, and has completely disenfranchised me of my child and visa and has shown absolutely no apathy whatsoever with anything. It's really sick and upsetting. She's done that to a baby not just me. I let the abuse go for years because i love her. Still do sadly but i'm now starting to break the trauma bond that was really pinning me down. It has been extremely confusing and heartbreaking that she's done this considering I was a model husband and father there. I honestly was. Everyone else is confused aswell but have done nothing. But recently, i was informed by several opinions; why she's done all this without remorse. Most likley the aforementioned condition, sadly of a very concerning NPD issue. This is not acceptable on my daughter, or myself. I can prove everything I've said with evidence of all but I'm not sure what to do. Im genuinely scared and I really need help with this please.
Do you pr anyone have any advice please. Thank you.

Yes, meaningful and purposeful. However, 20 years as a public school teacher. Damn good one too. My cancer battle. Now coparent with the government or never see your children again? Sorry. If your ex has had a drug problem in the past (used while in the relationship and during the first year of the child's life) but never sought treatment, but you were able to be clean during that time and relapsed but immediately agreed to testing, intensive outpatient treatment, 12 step meetings and step work, seeing a psychiatrist, etc. Then the ex decides to involve CPS and you fully cooperate with the investigations and they find no evidence of neglectful supervision.... and the ex is basing his wish to flip custody based on an arrest that was the catalyst to treatment and living a clean life... What's the best way to bring up that he had the same problem just never addressed his mental health and addiction professionally so could easily fall back into using or patterns of emotional instability?

There’s a huge challenge when the children are pre-verbal and when you’re coparenting with a stranger. You’re going to see a lot more of this as hookup culture proliferates. How do you suggest dealing with these issues in high conflict child custody?

    • @mymodernlaw
      @mymodernlaw  Před 2 lety +8

If you have two newly single people with children in the mix, it's best that both sides have an understanding that top concern is the safety and happiness of the kids. No matter how volatile the divorce is between the adults, or who else comes into the picture as far as significant others, each parent should be able to trust that the children are in a loving, secure environment when they are with the other parent. A little transparency can go a long way.

I did ask him to do that bc he tried to tell me that I have to go to the court with him to modify the order. I believe that he is manipulating our 10 almost 11 yo into living with him. I do my best to let him get more time out of our order and he’s a great dad. I just feel like he is always attacking me when he does not get his way. I have even gone as far as to get his $5000+ in child support wiped clean bc he couldn’t pay it. I can’t say I am a perfect mother but I do my best being a mom of 2, full time school and working 35 hours per week. As much as I love my daughter and do understand her wants of living with dad, I just feel that it is best that she lives with me. She has a learning disability and has a great relationship with her teachers and she needs the stability and routine. She is easily distracted. @Fake Gyllen - Well I respect that we disagree that it is somehow abusive, many parents also believe monitoring your child’s online activity is also abusive. But I know the very inappropriate stuff I did online back around 2003, now there’s much worse stuff online that is much more accessible. And you may or may not believe that it’s wrong for parents to monitor their child’s online activity, but there’s definitely people out there that believe that it is wrong to monitor it. And I think that’s crazy. But those people would also say children deserve their privacy.

I'm under the impression that custody always comes down to what a court determines what's best for a child's welfare as oppose to what both parent want.
I've seen some pretty nasty divorces and custody disputes (family and friends) and little do people realize that children are ones who gets the rough end of the stick because they must live the consequences. Its things like this which also why I also swear off dating, marriage and children...from what I've witnessed in these kinds of legal fights, I just don't have the emotional fortitude to go through things like this nor do I like to see children in broken relationships/family.

I found this out when his lawyer said I haven't spoken to him in months by phone or email so who is telling him to show up when he hasn't been for a month? While in the relationship with him, I was victim to domestic violence and again my fear is it might happen again but between the father and his new wife. I am most afraid that because I kept my son away from his father I might lose custody. What would your advice be to me. P.S I am not bitter about him and his wife. I've been fighting alone basically for 31 years. Now he's making me the bad parent, In all reality, I'm about to walk away. All my children know who was there and has been there for them. Heck, I need a break anyway😅 it's just so hard to do. But he has my mental state of being a single parent in a marriage. Or past addiction to pain meds. I just took a drug test and passed it without a court order. So let the game begin, for months I've said what needed to be said. And I've accepted whatever is granted I'm fine with. 9 more years on the youngest one, she'll be back if I lose her. And she will give her dad he'll for making me lose her. She's just as feisty as I am.❤😂

In my case I rather have justice for my child. Custody is the easy part for my case but I figured I would be doing a bad service for my child if he does not get justice as a in criminal charges against the other parent. I am in family court right now but I wonder can the judge forward a case to a prosecutor if need be or does it all get handled in family court with the same judge? My child is my world and I do not care to talk bad on the other parent as they already admitted to everything plus legal evidence proving so. I guess what I am trying to say even if the judge granted me sole custody I wouldn't want it to end there.
