How to prepare a rental agreement (tamil), this video is all about points you must carefully include in your agreement to safe guard yourself and benefit the new rental act.
The new Tenant act amendments 2017 is a boon to landlords, protecting rights of the Landlord mainly and tenants too. Early 2017 new rental amendments, the previous Indian rental act 1948 was not preventing landlords from the tenants who file law shoots prevailing for many years, due to which many houses where closed and not rented. In 2017, in Tamilnadu this act was implemented as per the central govt amendments.
This new tenancy act 2017 is a boon for Landlords, where equal rights are balanced, meaning the agreement made between the Landlord and the Tenant serves as bylaw. It is now easier for a landlord to vacate the tenant instead of going behind the police complaints or law shoot, the landlord can raise a complaint to the RDO (Revenue Divisional Officer) at his taluka to evict the tenant, if he has made rental agreement.

RTO இந்த வேலையை பார்ப்பதில்லை.11 மாதம் வாடகை அக்ரிமெண்ட் முடிந்து அடுத்து 11 மாதத்திற்கு renewal செய்து இருந்தேன். வாடகை கார்,வீட்டின் உரிமையாளரை ஆட்டி படைத்து கொண்டு இருக்கிறார்.வாடகை பணத்தை ஆறு மாதமாக தரவில்லை.போலீஸ் ஸ்டேஷனில் inspector ஜ கையில் போட்டுக் கொண்டு,inspector இது சிவில் கேஸ்.போலீஸ் ஸ்டேஷனில் பார்க்க முடியாது.வக்கிலை பாருங்கள் என்று ஸ்டேஷ்னில் சொல்லி விட்டார்கள்.ஆறு மாத காலமாக நாய் மாதிரி அலைந்து எந்த வித பிரயோசனமில்லை.ஆறு மாதம் காலமாகியும் வாடகை வீட்டை எப்ப காலி செய்வேன் என்று வாடகைதார் சொல்லவில்லை.வாடகை ஒப்பந்த பத்திரம் எல்லாம் இருக்கிறது.இது செல்லாது என்கின்றனர்.
உங்கள் நேரம் நன்றாக இருந்தால் எந்த வித பிரச்சனையில்லை.உங்களுக்கு நேரம் சரியில்லை எனில் எல்லாமே பிரச்சனை.

சிவில் கேஸ்.லாயரை பாருங்கள் என்றார்.வாடகை வீட்டில் குடியிருப்பவர் தான் ஒரு news நீருபர் என்பதை மறைத்து விட்டார்.மாறாக marriage events business செய்கிறேன் என்று சொன்னார். கடைசியாக இந்த 11 மாதம் அக்ரிமெண்ட் வரும் Nov 24 வரை இருக்கிறது. வாடகைதாரர் டிசம்பர் 24 வரை வாடகை வீட்டை காலி செய்ய முடியாது என்று சொல்லி வாடகை பணம் மார்ச்சு மாதம் 24முதல் கொடுக்கவில்லை.
வாடகை அட்வான்ஸ் பணம் ஆகஸ்ட் மாதத்துடன் முடிவடைந்து விடுகிறது.இனி தங்கும் மாதத்திற்கு வாடகை பணம் தராமல் ஓசியில் தங்குவார்.ஊர் தலைவரிடம் பஞ்சாய்த்து பண்ண ரூபாய் 10000 கொடுத்தேன்.அவராலும் ஒன்றும் செய்ய முடியவில்லை. இனி ஒரு போதும் வீட்டை வாடகைக்கு விடக் கூடாது என்று முடிவெடுத்து விட்டேன்.
Civil lawyer இரண்டு பேரை பார்த்தேன்.பொறுமையாக இரு என்று சொல்லி விட்டார்.

வாடகை ஒப்பந்தம் முடிந்து பத்து வருடமாகிறது. இந்த பத்து வருடமாக வாய் மொழியாகத் தான் காலி செய்ய சொல்லி வருகிறேன். அவர் வீடு பார்த்துக்கொண்டு இருக்கிறேன். போ
யி விடுகிறேன் என்றே சொல்லி வருகிறார். இப்பொழுது அந்த வீட்டை விற்க போகிறேன். காலி செய்ய rdo ஆஃபீசில் புகார் செய்யலாமா? எப்படி செய்யலாம் என்று அறிவுரை சொல்லவும்.
ஐயா, ஒப்பந்தம் செய்ய வாடகைதாரரை அழைக்க உங்கள் RDO வை நீங்கள் அணுகலாம். அல்லது வாடகை ஒப்பந்தத்திற்கு முன்வருமாறு வாடகை நீதிமன்றத்தை அணுகினால், இந்த பிரார்த்தனைகள் விரைவில் தீர்க்கப்படும்.
ஐயா வணக்கம் நல்ல பதிவு வாழ்த்துக்கள்.நான் வாடகை பணத்தை வருமான துறைக்கு வருமான வரி செலுத்துகின்றேன் . மேலும் அவர் காலிசெய்தபிறகு வாடகை வாராதமாதத்திற்க்கு ஙோஷன் வருமான வரி கட்ட வேண்டும் என்று ஆடிட்டர் கூறுகின்றனர்.இதை எப்படி முறைப்படி காண்பிக்க வேண்டும்.இதற்க்கு தக்க முறையை பதிவு செய்யும் படி கேட்டுக்கொள்கிறேன்.மற்றவர்க்கும் உபயோகமாக இருக்கும் என்று நினைக்கிறேன். 🙏
ஐயா, எனக்கு ஜிஎஸ்டி பற்றி சரியான /முழுமையான விவரங்கள் தெரியாது. , எனவே இதைப் பற்றி நான் கருத்து தெரிவிக்க விரும்பவில்லை.
அருமை. ஒப்பந்தம் தேதி முடிந்த பிறகு முன் பணம் தீர்ந்து பிறகு இரட்டை வாடகை எப்படி வசூல் செய்வது.
உங்கள் அட்வான்ஸ் தொகை எந்த காரணம் கொண்டு வாடகைக்குக் கழிக்க கூடாது. காலி செய்து வீட்டின் சாவியை கையில் கொடுக்கும் போது தான் அட்வான்ஸ் தொகை திரும்ப தர வேண்டும்...
ஒப்பந்த காலம் முடிந்த பிறகு நீங்கள் முறைப்படி உங்கள் டென்டுக்கு காலி செய்யுங்கள் என்று எழுத்துப்பூர்வமாக ஒரு கடிதம் தந்திருக்க வேண்டும் அதில் ஒரு மாசம் கால அவகாசம் கொடுத்திருக்க வேண்டும் பிறகு அவர் காலி செய்யவில்லை என்றால் அப்பொழுது RDO அணுகினால் இரட்டை வாடகை செலுத்த நேரிடும்..
இது சம்பந்தமாக என்னுடைய அடுத்த வீடியோவில் விவரமாக கூற உள்ளேன் தயவு செய்து அதை பார்க்கவும் நன்றி வாழ்க வளமுடன்..

Like no of House Owner suddenly while vacating catch hold of Advance Amount to be refunded during shifting of the house in name of Painting, Cleaning etc...with huge amount which would not be relevant and kind of மோசடி
And most cases those were not even mentioned in Rental Agreement too
Sir, thanks for your comment. Actually, tenant can also approach rent authority if landlord does not repay the advance amount on tenent vacating.. tenant can also mention the delay of payment and demand 8% interest on the same from the landlord..
Signing the agreement between landlord and tenant helps both, like landlord has to give minimum of 1 month time for the tenant to vacate the promise, also landlord to repair the premise, provide acknowledgement of the rent payment and also provide dental agreement to the tenant.. if these are not done by the landlord, then the tenant can approach the RDO... This law is to protect both the parties, earlier, no law was protecting the landlord..👍

Because of non-stipulation ,you can do any amount of damage & quit. Tenants from south occupying flats in Chennai behave differently. Proper north TN or Chennai origin tenants behave decently.

Less than 11 months does not need registration in the sub register office, however it needs to be registered in the tenancy website.. any agreement greater than 1 year needs to be registered in the sub register too then the same needs to be registered in tenancy website too.

Rdo is the rent authority, so write your complaint in two copies, when u go to the RDO office, there is a thappal counter, submit your complaint letter and take a seal acknowledgment in the other copy. The RDO will send the hearing date for you by post and to your opponent.
If there is no written agreement , the oral agreement stands before the test of law!
For new Tenancy Act registration is mandatory as per law and also it needs to be registered online, however if you are in Chennai you can approach the rent Court and case disposal are happening faster..

Sir first of all, u cannot use house for commercial, even as mass storage, if you do so, electricity officials come to know about it then your eb meter charges will be converted to commercials and not residential.. other than that u don't have to inform corporation, just get a commercial meter for the same house separately..

Sir if you have GST in the same address, it means u have already informed govt about your business. If you are using your house as storage, you dont have to put a board, it is not for public access.. If you are particularly using a space or a room in your house which DOES not use electricity like fan or light then you dont have to get a commercial meter too... If you are ok about spending money getting a commercial EB service for the storage room or space, its good or else use a solar panel for electricity then you done have to worry about EB vigilance..

if you go beyond 20L, GST becomes mandatory.. however you have received 10L, it is taxable beyond 5L.. If it was bank transaction, then your bank deducts tds above 5L deposits.
You have not mentioned about registration of this document in RDO office. For different areas you have to go to different RDO . For 10zones give the address of RDO OFFICES. That is more important than the aggrement details which is available in all type / print shops
