    Great information. Look forward to the other part of this conversation. I did an HLR a couple of years ago, even though I had a favarable decision. I quoted the VA manual in a written statement and was granted a new higher rating based on the HLR. There was no way I could have done that orally. Great information thank you!     Have my HLR informal conference next week, binge watching these videos and hoping for a good result, duty to assist is a black hole I want to avoid.

    Had a hlr and they found dta error no c and p exams for sleep apena. Diabetes and hypertension on same letter that put under favorable findings for sleep apena I have a diagnosis a nexus and in-service event isn't that all I need to get service connected for it

    Would I be able to use migraine secondary to hypertension and depression and anxiety. I’m rated for both but just recently find out I have Chronic Kidney Disease as well.

      You can service connect Chronic Kidney Disease secondary to Hypertension. And yes, you can service connect Migraines to Hypertension.

    Initial claim filed Aug 2021. I received my denial letter Nov 2022, filed a supplemental claim in Aug 2023. I got favorable SC result from the supplemental claim awarded in Jan 2024 but SC was only dated back to Aug 2023 when I filed the Supplemental Claim. I was within the 1 year of the denial letter. Is a HLR the next step to get the SC date adjusted back to initial claim date of Aug 2021?

    I've had several HLR's and they claim to have found dta errors even though the DRO said based on what he reviewed I should've been granted service connection. On the other HLR the DRO claimed how strong my case/evidence was and still data error. That's the DRO's goto when they know you should've been granted service connection but want to refer you back to the adjudicator that screwed you in the first place.

      Me too. The VBA game has 4 steps. 1. get connected with C&P exam. 2. get low balled or a 0%. 3. get the CFile and point out errors in a HLR such as ignored checked DBQ boxes. 4. HLR apologizes and appropriately rates us.

    I am on day 393 of waiting for my higher level decision and well over 420 days of when i initated it.... its crazy how long it takes

    My hlr got a duty to assist. They then sent me to another c and p exam jan 5. Its now january 23 with no decision. Is that normal? How long after the new c and p exam does it usually take for abother decision?

    Can you explain "relative equipoise" in regards to evidence and examples when this happens?

      50/50 , meaning the scales ⚖ are balanced in favorable opinion & unfavorable opinion. The " tie" is still a win for the veteran.

    Just talked to a person from VES about an increased I put in for trying to go from 80% to 100% does anyone know of or had to use them for your C&P. BYW good information.

    Cani change my claim type. I claimed migraines secondary to hypertension. Denied by VA. Reason was they do not relate to each other. Can I now change it to migraines secondary to another service connected disability?

    I am a disgruntled disabled vet... every single CZcams "expert" talks about the veterans claim and why it should be well developed.. what about a veteran that submits a well developed claim with excellent medical evidence, Nexus letters and thorough and supportive DBQ's that are well written yet the veteran gets a lowball rating. Why is there an Appeals process? A HLR process, a Supplemental claim process that takes years to resolve? Because the rater failed to comprehend the claim and forced the veteran to appeal it, only to be given a higher rating because the rater failed to give the proper rating initially... am I upset? You're damn right I am. The rater is the weak link in the claim process
