The problem in the documents case is that Trump owns the judge that is presiding over it. Everything she has done and said indicates that she intends to dismiss the case, but not until the jury is selected so that jeopardy will attach and he will not be able to be tried on those charges.

Cannon needs to be removed from this case and investigated. She has been helping Trump every step of the way. She's not his lawyer, she's suppose to be an impartial judge. Why do you think that a yellow legal pad is called a "legal pad"? it is the preferred format for attorneys, and they go through several notepads every week, usually having a separate notepad for each case they are currently working on, and keeping them filed in chronological order in separate banker boxes.

I think encouraging someone to commit perjury should be a crime, even if the perjury never takes place. I don't think it's clear if simply encouraging perjury is a crime itself.

So the crime is called “conspiring to suborn perjury”, not just subornation of perjury. I was correct that for the charge of suborning perjury, the perjury has to have occurred. I realize it’s a technicality, but they are different crimes, even though the penalties appear to be the same. So add conspiring to suborn perjury to the list of Trump indictments and slap another 5 years of jail time to whatever jail time he might receive for his other crimes.

Watching this from Europe, how can a prosecutor or judge break attorney client privilege and compel testimony from a legal representative against a client? This would seem to he a very dangerous precedent.
Duh! When your Client not only LIES to you but deliberately puts YOU in a criminal liability (if you know ANYTHING about the Documents case against Dtrump then you will know what that is) then YOUR notes become YOUR defence.
Crime/fraud exception. If your lawyer participates in or covers up a crime, the prosecution can apply for an exception to compel testimony.
The prosecution and defence attend a hearing to try to prove the lawyer committed crimes for his client.
In this case, they had compelling evidence and the judge permitted the exception.
It’s already a well established precedent and is very rarely used since most lawyers try to not cross that line.
Client-attorney privilege goes out of the window when the client asks the lawyer to break the law.

It's not a precedent. It's been in place for a long time.
To add to what the others wrote, not *everything* the attorney talked to the client about is now available for questioning, just anything involved in ongoing illegal activities. Obviously if you talk to a lawyer about crimes you charged with, that's covered. If you ask your attorney to go threaten witnesses or go rebury the dead body, that conversation is not covered by the privilege. Other discussions would still be protected. In cases where the conversations are very mixed, they will have a third party (another judge, contracted attorneys, etc) go through the evidence and divide it into protected and not-protected evidence, filtering what actually goes to trial.
