Kindly note that in your prescribed textbook page 40 and study guide page 16 Zulu v Zulu is discussed under putative marriages, the Kwazulu-Natal Divison of the High Court held that a putative marriage cannot be in community of property if either of the parties is a spouse in an existing civil marriage in community of property. However, in MS v Executor, Estate Late NS 2021 (6) SA 483 (FB) the Free State Division of the High Court declined to follow Zulu v Zulu.
