    - distinguish between the nature and consequences of void, voidable, and putative marriages, and
    - discuss the consequences of a voidable civil marriage and a putative marriage.
    Kindly note that in your prescribed textbook page 40 and study guide page 16 Zulu v Zulu is discussed under putative marriages, the Kwazulu-Natal Divison of the High Court held that a putative marriage cannot be in community of property if either of the parties is a spouse in an existing civil marriage in community of property. However, in MS v Executor, Estate Late NS 2021 (6) SA 483 (FB) the Free State Division of the High Court declined to follow Zulu v Zulu.

    With regards to stuprum, is a civil marriage voidable if a man partakes in extramarital sexual intercourse with a 3rd party, and the said 3rd party falls pregnant?
